SPECIAL PROVISIONS

Notwithstanding any other provision herein to the contrary, the following provisions shall be applicable and govern in the event of conflict:

Safety Test Witnessing Per New Illinois Law

The State of Illinois Fire Marshall's Office, Elevator Safety Division, requires a building owner to have a qualified independent elevator inspector ("QEI") witness all Category I safety tests. This cost can be handled on a time and material basis prior to the annual test being performed. However, for your convenience, Otis proposes to include the work of scheduling and the QEI's fee into this maintenance contract.

Should the QEI inspections fees increase over time, Otis reserves the right, and you agree to pay, reasonable increases of the charge for service. The QEI providing the service is an independent contractor and is not an employee or agent of Otis. Should you request Otis to reschedule a QEl inspection, and the QEI charges Otis a fee for such rescheduling, you agree to make an additional payment for reimbursement of such charge. This service does not address any QEI testing done in conjunction with any material alternation, annual inspection, modernization, or new installation.

Capped Price Adjustment

Price adjustment will be capped at 3%.

RESPONSE-TIME STANDARDS
