Insured-Relator, Saint Torrance comes before this trial (Supreme Court of Ohio)

court, pursuant to Mandatory Judicial Notices and Authorities: Emergency Expedited

Election, Vacate Void Judgment, Subject-Matter Jurisdiction, `Class Action"

"Certification", Declaratory Injunctive Relief and Judgment of a (PCWC), & (PSLCWC).

FACTS

1. On May 4, 2009, Insured-Relator filed a claim with Insurer-Respondent, Allstate

Northbrook Indemnity Company, the Insured-Relator, had called & given the Cincinnati

Police Department a license plate number and after the investigation came out with a

swimming pool company.

2. The Insured-Relator claim was place under the collision part, of the auto policy by the

Insurer-Respondent and explained it was standard procedures, which requires a

deductible from a (PCWC) &(PSi,C(PSLCWC), and the un insured motorist policy is more

sufficient for a ("hit & run") accident explained by the Insured-Relator, and the Insurer-

Respondent, claim adjuster Mr. Phil Cook, explained they have to place it under the

collision part first and have 60 days to make a decision to go with the Collision policy or

the uninsured motorist policy, Insured-Relator remind you that the Insurer-Respondent

policy comes with this underinsured policy and under insured policy when Insured-

Relator, obtain a policy from Allstate, before the under insured motorist policy (See

Exhibit) #1), the Insured-Relator, explained to them it was a "hit & run case, which

automatic falls under the under insured motorist auto policy limits 50,000\100,000 (See

Exhibit #2).

3. The Insurer-Respondent had some hidden illegal business insurance agenda tactics for

the Insured-Relator a (PCWC) & (PSLCWC), because when I applied for coverage for

three vehicles because of the years and make and models, it showed me a double standard

but real with a protected class it rcally showed the insured-relator, that made me fell like

a("third class citizen), blow a regular citizen, and that made me sick, vengeful, miss

treated, like a form of slavery if I ask for something they are trained to say no, but to a

(PCWC) & (PSLCWC) gave me my strength, courage, back bone, a goal to not be denied

no more, which this denial is a form of illegal business insurance practice tactics to delay

payment, fight a customer, but in my situation a (PCWC & (PSLCWC) is

unconstitutional, tormenting, torturing, aggravation of ones condition, and the challenge

is doe Congress and Senate had protected the special class of disabled, handicap, retarded

people sufficiently, if no law then there is a breach of duty own emergency &

Immediately, or you will have a destruction on your legal system like a virus taking a

stroll through your system of computers that will take over eventually, because of abuse

of greed, authority, worldly degrees vs. faithful degrees.

4. The Insured-Relator, was told by the Penny Mabin, that my case was transferred to the

main office in Indianapolis, Indiana to a claim adjuster Phil Cook and I asked Penn

Mabin why and she told insured-relator that she could not answer that question so I called

Phil Cook and that when he explained this sixty (60) days policy before going into this

underinsured motorist policy, I explained what was up with my vehicle being fixed in this

process of delay, and he explaincd to me that he will scnd a check.

5. Insured-Relator, felt something was wrong with this process of car damages delay,

policy related to collision & underinsured motorist policy so I explained to them that I am

a"Protected Class with conditions" and that did not make them move or nothing so I

know something was wrong with this law ofjudicial system, on that point, no fear, from

the insurer-respondent, Phil Cook, Allstate Insurance world. The other point is that

insured-relator, had filed this Complaint on 6-23-2009, which should have not delay

payment to correct car damages and underinsured motorist policy, this is a illegal

business insurance tactics against blacks, Caucasian, and the "third class citizen" the

disabled, handicap, retarded people. Fed Question: does racism still exist in American

and the terrorist act is visible, but no used is neglect of duties who to suppose in force it,

it also showed insured-relator that who is geared to money and not the one that made the

money, my fathers, Oh!, Well here come, his grandson, son.

6. On 7-31-2009 Insured-Relator, place a Mandatory Judicial Notice, discovery to be had

after case conference management and the Insured-Plaintiff-Relator, Opposition for

Deposition to a (PCWC) & force to become a (PSLCWC).

7. On 8-18-2009, during this excellent O.R.C.P, Case Conference Management, which I

was stressed from and by from many Justices & Judges, during my encounter with civil

procedures, even attorneys, the ones I can count on my hand, in many courthouses, was

the only thing I experience first had who was following the O.R.C.P. demonstrated a self-

evident of corruption in a form of a world degree of license that was a great educator but

the actual person made these institution become victim, subject to non-believe in the

educational systems for blacks and Caucasians in America and any other color.

8. On 8-18-2009 Insured-Plaintiff-Relator, had challenged the trial (Judge Entha M.

Cooper) court, with a Mandatory Judicial Notice new added Classification Notice for

Class Action Status, and or Declaratory Injunctive Relief and Judgment of a (PCWC) &

(PSLCWC), this like a guest what choose, if chosen wrong there are constitutional

violations if chosen either way, this one is called ("Stale Mate"). I given the trial

(Supreme Court of Ohio) the test with a (Hint) (Federal Question: Which One pays the

most, and places, a twenty (20) years of tormenting, torture, aggravation of ones

conditions of (PCWC) & (PSLCWC), up to par and equal, and not one Judicial Officer of

any Justice, Judge, Magistrate, Attorneys, Law Clerks, Clerk of Courts, did the duties

they sworn in, under oatb, in office under the US & Ohio Constitutions, which one would

place a (PCWC) & (PSLCWC) up to par and equal or better the "Class Action" or a

"Declaratory Relief and Judgment?).

9. On 8-20-2009 Plaintiff-Insured-Relator filed a Plaintiff Judicial Notice to Vacate Void

Order or Entry & Subject-Matter Jurisdiction pertaining to trial (Judge Entha M. Cooper)

court had caused a mass confusion to the parties to this Complaint, the Insurer-

Respondent attorney J. Patrick Schomaker and other future Respondents, of no escaping a

(PCWC) & (PSLCWC).

10. Trail (Judge Ethna M. Cooper) court, had made another date on 10-15-2009 for Oral

Argument/Pending Motion, but if looking at the record (Docket, Exhibit #3) Plaintiff-

Insured-Relator, placed a Mandatory Judicial Notice and disrespected in a form of

evading fronl a Judicial Officer (trial Judge Ethna M. Cooper) court, is ground for a All

Writs of Mandamus, Prohibition, Peremptory, Alternative and Continuing, and the trial

(Judge Ethna M. Cooper) court, trespassing, treason, upon the US & Ohio Constitutional

violations which is sworn in, under oath, in office is criminal act of Malfeasance,

terrorist act.

11. Defendant-Insurer-Respondent had done a "illegal Business Insurance Practice Act

tactics to a (PCWC & (PSLCWC) of denying Plaintiff-Insured-Relator, a no umbrella

policy to a fixed income (PCWC) & (PSLCWC), Defendant-Insured-Respondent

explained that I had a wreck less operation, ticketed, that I could not receive this umbrella

policy coverage and to think about would not want a wreck less operation person full

insured to protect other Ohioians from a wreck less operation person, where the Plaintiff-

Insured-Relator demonstrated more care for his actions and became concerned to protect

the other Ohioians, Defendant-Insurer-Respondents just contradicted there own intent and

policy holders of Ohioians to make a Plaintiff-Insured-Relator a liability to the Ohioians,

companies, and government being already the property of Ohio. This denial is a form of

bias, prejudice, intentional infliction of emotion distress, tormenting, torturing,

aggravation of one condition, to the Plaintiff-Insured-Relator and the citizen of Ohio

being Ohioians, and the Plaitniff-Insured-Relator, is still being treated as a ("Third Class,

with conditions (Citizens).

PALINTIFF-PLAINTIFF-RELATORNOTICE OF DEIyIAND

12. Plaintiff-Insured-Relator, Emergency Declaratory Injunctive relief from Allstate

uninsured policy of my limits 100,000.00 and any further delays to a (PCWC) &

(PSLCWC), with a Mandatory Judicial Notices and Authorities entitles the Plaintiff-

Insured-Relator his policy, the fraud that has occurred entitles the Complaint to punitive

damages of $300,000 and with Plaintiff-Insured-Relator,

13. Plaintiff-Insured-Relator demands a, "Indefinite Protective Order" for Saint

Torrance, Saint Torrance thee (PCWC) and Saint Torrance thee (PSLCWC). Plaintiff-

Insured-Relator demands All Writs and any other deem Writs of believe of these situation

warrants with a (PCWC) & (PSLCWC), also demands compensatory, and punitive

damages from trial (Judge Ethna M. Cooper) court and Attorney J. Patrick Schomaker

and company or L.L.C. (Smith, Rolfes, Skavdahl) a trial of my peers to decide there faith

or be force to settled as to what Plaintiff-Insured-Relator request for failed US & Ohio

Constitution due process of delay & equal protection clause in the 14`s amendment called

a DOUBLE DUAL AGENT, a spy with in a spy, that works for money not the people

14a' amendments violators double standard for all especially a (PCWC) & (PSLCWC).

14. The claim Adjusters, Allstate be fired by jeopardizing my life on the road, and other

Ohioans, which the only vehicle up and running is my SUV Mits, truck and that is not

safe to drive but I still have to drive which I had explained to the Claim Adjusters and

Allstate about this situation, I am a (PCWC) & (PSLCWC), I try to learn what right but I

been lied to so much I do not believe or trust any one no more I am sorry the system of

greed, not following the law caused Plaintiff-Insured-Relator in the Defense mode and

scared to come out because of being treated as a "Third Class Citizen with conditions

(TCCWC).

I Saint Torrance, comes now being duly affirmed under oath to these "All Writs, with

Expedited Elections, US Constitutional Violations, and all the others Complaint charges

and Compensatory and Punitive Damages and a reserved the rights that a trial by jury of

my peers meaning the disabled, handicap, retarded and the babies, and elders against this

person Honorable Judge Ralph E. Winkler and Honorable Judge Ethna M. Cooper,

Allstates, J. Patrick Schomaker, Charlie Broxterman, Carol J. Schrorer, Phil Cook, Penn

Mabin, Sparkle Mcgeeand All other Respondents on this Complaint, any other "Judicial

Officer" of all and any courts, corporation and persons attempt any retaliation acts will

also be dealt with severely as these two in this Complaint for ignorance and crossing the

law with any illegal business, law tactics done in the Complaint and filed to the Supreme

Court of Ohio against Duke Energy Ohio, Ine, Fifth Third Bank and HSBC Auto

Finance, Inc still pending a oase number, for Relator whom is a (PCWC) and don't fully

understand the Complaint procedures but found to many unconstitutional violations for

equal protection & due process of the US constitutional based on Affidavits, Certificate

of Service should not hold up a (PCWC) for a simple case number, first, and then the

Clerk of Courts, can issue a simple number, and wait to send the Complaint, out when the

Relator a (PCWC) can understand without no help but should have been helped, in the

Rules of Practice and Civil Procedures and books for the (PCWC) too read and

understand is unconstitutional to force a group of sound minds on a unsound minds way,

these Affidavits, requirements, comes now, Relator, is the property of, and a Ohioian, of

the State of Ohio. This personal knowledge, facts, and evidence attached to this

Complaint is sufficient and the Relator, is Affiant to stand competent being a (PCWC) to

testify to all matters and reserved the rights if failed to miss some other law that also seen

sufficient for the Relator, to not know, but the Mandatory Judicial & Administrative

Notice and Authorities will be very efficient to do equal protection & due process rights

under the US Constitutional rights given too all and for a (PCWC) too.

PRAY FOR RELIEF

Relator request all rights and request for All Writs to apply, Expedited Elections, US

Constitutional Violations of the 14s' amendment and al amendments that applies, a

Continuing Mandamus for the twenty (20) years of failed services in Hamilton County

Courthouses delaying a (PCWC), Compensatory and Punitive Damages for this case and

reserve the law with case laws of Saint Torrance vs. whom else in Hamilton county

Courthouses, and in the Supreme Court of Ohio and the Supreme Court of The United

States too. Relator, reserves his rights to a jury trial of my peers consisting of the

disabled, Handicap, Retarded, babies, elders that did not have there US Constitutional

rights on the jury stand as a equal citizen which was always a 3rd class citizen. In this

situation of settlement efforts the amount for the procedural delay and issues

Compensatory in the amount of 700,000.00 and all US Constitutional violations in the

punitive damages in the amount of 12,000,000.00 and if not settled for this amount

reserved the right for jury of my peers and what every given from the jury without

tampering with from and helper, guardian, representative agendas will be necessary for a

amount requested from Relator, or better given from the jury of my peers.

I writing you letter, referencing this claim in question related to this accidentwhere it was a hit and run incident on 5-4-2009. 1 reported this accident to the policedepartment and I do not know if they followed up or not to finding this vehicle andperson related to hit and run accident. I will also be perusing this situation withCincinnati District #3 police department.

I had made appointment with Allstate Insurance to give Allstate their chance tocome out with their estimate with your claim adjuster and I came out with mine damageswith mine. Your claim adjuster Felicia Davis came out with an estimate of only $784.48and my estimate is a total of about $2,223.80 difference. The estimate for damages wasestimated at $3008.28. I ask that Allstate please send this amount of $3,008.28 to myperson in the name of Saint Torrance 3182 Werk Rd #2 Cincinnati, Ohio 45211.

Please will Allstate pursue this person and if so please do keep me infonn of thisd run incident that happen on 5-4-2009 with this person. I

Ms. Mabin,

I looked at my policy and I have uninsured motorist insurance for Bodily Injury and Property damage too. Iunderstand that if the other party doesn not have insurance and his reason that he ran is that in was notinsured so instead of going through my own policy place this claim through my uninsured motorist policyinstead through this other claim. I do not remember Allstate suggesting this other coverage I have or evenoffered to go through when I made my statement on tape with you, but it very simple to place this claim throughmy unisured motorist becasue the other party was without insurance at the time of this accident and my policyis (SS) and its limits are 50,000/100,000 for bodily injury and property damage limits is 50,000/100/000, I amvery reasoanble but if Allstate was not in my favor and not help me accordingly and fair in these dealing, youwill have another situation arise from how you treated me.

P.S. I call you Ms. Mabin and Ms.Mcgkee and i hav not received a return call just delay.

I am with a protected class with conditions I do everything myself as of today I have only received $534.48and my estimate was 2,369.28 and my wheel $639.00 a total of $3,008.28 minus my deductible of $250.00leaving a total of 2,758.28 and minus the check you have already sent to me of $534.48, leaving an amountof $2,223.80, so please do send the amount request so i can start on my vehicle. Please make out thisdifference check to saint Torrance and Mid-City Collision again so I can start on my vehicle. At this time workwill not start until the rest of the money is received, I will not let no one touch my vehicle without alreadyreceiving my policy being honored by Allstate and that include my medical payments, please do forwards acopy of this letter to Sparkle Mcgkee for medical payments being sent too, her numer is 866-575-4363 ext.5189.

P.S. no reponse in three days i will take this matter where you want me to take it and it the court system.Please do send the difference of $2223.80 and make sure diminished value is with this check of $20,000.
