TITLE I 1

DEPARTMENTAL MANAGEMENT AND 2

OFFICE OF THE SECRETARY AND EXECUTIVE 4

MANAGEMENT 5

For necessary expenses of the Office of the Secretary 6

of Homeland Security, as authorized by section 102 of the 7

Homeland Security Act of 2002 (6 U.S.C. 112), and exec-8

utive management of the Department of Homeland Secu-9

rity, as authorized by law, $132,573,000: Provided, That 10

not to exceed $45,000 shall be for official reception and 11

representation expenses: Provided further, That all official 12

costs associated with the use of government aircraft by 13

Department of Homeland Security personnel to support 14

official travel of the Secretary and the Deputy Secretary 15

shall be paid from amounts made available for the Imme-16

diate Office of the Secretary and the Immediate Office of 17

the Deputy Secretary: Provided further, That not later 18

than 30 days after the date of enactment of this Act, the 19

Secretary of Homeland Security shall submit to the Com-20

mittees on Appropriations of the Senate and the House 21

of Representatives, the Committees on the Judiciary of the 22

House of Representatives and the Senate, the Committee 23

on Homeland Security of the House of Representatives, 24

and the Committee on Homeland Security and Govern-25

mental Affairs of the Senate, a comprehensive plan for 1

implementation of the biometric entry and exit data sys-2

tem required under section 7208 of the Intelligence Re-3

form and Terrorism Prevention Act of 2004 (8 U.S.C. 4

1365b), including the estimated costs for implementation. 5

OFFICE OF THE UNDER SECRETARY FOR MANAGEMENT 6

For necessary expenses of the Office of the Under 7

Secretary for Management, as authorized by sections 701 8

through 705 of the Homeland Security Act of 2002 (6 9

U.S.C. 341 through 345), $187,503,000, of which not to 10

exceed $2,250 shall be for official reception and represen-11

tation expenses: Provided, That of the total amount made 12

available under this heading, $4,493,000 shall remain 13

available until September 30, 2016, solely for the alter-14

ation and improvement of facilities, tenant improvements, 15

and relocation costs to consolidate Department head-16

quarters operations at the Nebraska Avenue Complex; and 17

$6,000,000 shall remain available until September 30, 18

2016, for the Human Resources Information Technology 19

program: Provided further, That the Under Secretary for 20

Management shall include in the President’s budget pro-21

posal for fiscal year 2016, submitted pursuant to section 22

1105(a) of title 31, United States Code, a Comprehensive 23

Acquisition Status Report, which shall include the infor-24

mation required under the heading ‘‘Office of the Under 25

For necessary expenses of the Office of the Chief Fi-7

nancial Officer, as authorized by section 103 of the Home-8

land Security Act of 2002 (6 U.S.C. 113), $52,020,000: 9

Provided, That the Secretary of Homeland Security shall 10

submit to the Committees on Appropriations of the Senate 11

and the House of Representatives, at the time the Presi-12

dent’s budget proposal for fiscal year 2016 is submitted 13

pursuant to section 1105(a) of title 31, United States 14

Code, the Future Years Homeland Security Program, as 15

authorized by section 874 of Public Law 107–296 (6 16

U.S.C. 454). 17

OFFICE OF THE CHIEF INFORMATION OFFICER 18

For necessary expenses of the Office of the Chief In-19

formation Officer, as authorized by section 103 of the 20

Homeland Security Act of 2002 (6 U.S.C. 113), and De-21

partment-wide technology investments, $288,122,000; of 22

which $99,028,000 shall be available for salaries and ex-23

penses; and of which $189,094,000, to remain available 24

until September 30, 2016, shall be available for develop-25

ANALYSIS AND OPERATIONS 4

For necessary expenses for intelligence analysis and 5

operations coordination activities, as authorized by title II 6

of the Homeland Security Act of 2002 (6 U.S.C. 121 et 7

seq.), $255,804,000; of which not to exceed $3,825 shall 8

be for official reception and representation expenses; and 9

of which $102,479,000 shall remain available until Sep-10

tember 30, 2016. 11

OFFICE OF INSPECTOR GENERAL 12

For necessary expenses of the Office of Inspector 13

General in carrying out the provisions of the Inspector 14

General Act of 1978 (5 U.S.C. App.), $118,617,000; of 15

which not to exceed $300,000 may be used for certain con-16

fidential operational expenses, including the payment of 17

informants, to be expended at the direction of the Inspec-18

tor General. 19

TITLE II 1

SECURITY, ENFORCEMENT, AND 2

INVESTIGATIONS 3

U.S. CUSTOMS AND BORDER PROTECTION 4

SALARIES AND EXPENSES 5

For necessary expenses for enforcement of laws relat-6

ing to border security, immigration, customs, agricultural 7

inspections and regulatory activities related to plant and 8

animal imports, and transportation of unaccompanied 9

minor aliens; purchase and lease of up to 7,500 (6,500 10

for replacement only) police-type vehicles; and contracting 11

with individuals for personal services abroad; 12

$8,459,657,000; of which $3,274,000 shall be derived 13

from the Harbor Maintenance Trust Fund for administra-14

tive expenses related to the collection of the Harbor Main-15

tenance Fee pursuant to section 9505(c)(3) of the Internal 16

Revenue Code of 1986 (26 U.S.C. 9505(c)(3)) and not-17

withstanding section 1511(e)(1) of the Homeland Security 18

Act of 2002 (6 U.S.C. 551(e)(1)); of which $30,000,000 19

shall be available until September 30, 2016, solely for the 20

purpose of hiring, training, and equipping U.S. Customs 21

and Border Protection officers at ports of entry; of which 22

not to exceed $34,425 shall be for official reception and 23

representation expenses; of which such sums as become 24

available in the Customs User Fee Account, except sums 25

subject to section 13031(f)(3) of the Consolidated Omni-1

bus Budget Reconciliation Act of 1985 (19 U.S.C. 2

58c(f)(3)), shall be derived from that account; of which 3

not to exceed $150,000 shall be available for payment for 4

rental space in connection with preclearance operations; 5

and of which not to exceed $1,000,000 shall be for awards 6

of compensation to informants, to be accounted for solely 7

under the certificate of the Secretary of Homeland Secu-8

rity: Provided, That for fiscal year 2015, the overtime lim-9

itation prescribed in section 5(c)(1) of the Act of February 10

13, 1911 (19 U.S.C. 267(c)(1)) shall be $35,000; and not-11

withstanding any other provision of law, none of the funds 12

appropriated by this Act shall be available to compensate 13

any employee of U.S. Customs and Border Protection for 14

overtime, from whatever source, in an amount that ex-15

ceeds such limitation, except in individual cases deter-16

mined by the Secretary of Homeland Security, or the des-17

ignee of the Secretary, to be necessary for national secu-18

rity purposes, to prevent excessive costs, or in cases of 19

immigration emergencies: Provided further, That the Bor-20

der Patrol shall maintain an active duty presence of not 21

less than 21,370 full-time equivalent agents protecting the 22

borders of the United States in the fiscal year. 23

AUTOMATION MODERNIZATION 1

For necessary expenses for U.S. Customs and Border 2

Protection for operation and improvement of automated 3

systems, including salaries and expenses, $808,169,000; 4

of which $446,075,000 shall remain available until Sep-5

tember 30, 2017; and of which not less than $140,970,000 6

shall be for the development of the Automated Commercial 7

Environment. 8

BORDER SECURITY FENCING, INFRASTRUCTURE, AND 9

TECHNOLOGY 10

For expenses for border security fencing, infrastruc-11

ture, and technology, $382,466,000, to remain available 12

until September 30, 2017. 13

AIR AND MARINE OPERATIONS 14

For necessary expenses for the operations, mainte-15

nance, and procurement of marine vessels, aircraft, un-16

manned aircraft systems, the Air and Marine Operations 17

Center, and other related equipment of the air and marine 18

program, including salaries and expenses, operational 19

training, and mission-related travel, the operations of 20

which include the following: the interdiction of narcotics 21

and other goods; the provision of support to Federal, 22

State, and local agencies in the enforcement or adminis-23

tration of laws enforced by the Department of Homeland 24

Security; and, at the discretion of the Secretary of Home-25

land Security, the provision of assistance to Federal, 1

State, and local agencies in other law enforcement and 2

emergency humanitarian efforts; $750,469,000; of which 3

$299,800,000 shall be available for salaries and expenses; 4

and of which $450,669,000 shall remain available until 5

September 30, 2017: Provided, That no aircraft or other 6

related equipment, with the exception of aircraft that are 7

one of a kind and have been identified as excess to U.S. 8

Customs and Border Protection requirements and aircraft 9

that have been damaged beyond repair, shall be trans-10

ferred to any other Federal agency, department, or office 11

outside of the Department of Homeland Security during 12

fiscal year 2015 without prior notice to the Committees 13

on Appropriations of the Senate and the House of Rep-14

resentatives: Provided further, That funding made avail-15

able under this heading shall be available for customs ex-16

penses when necessary to maintain or to temporarily in-17

crease operations in Puerto Rico: Provided further, That 18

the Secretary of Homeland Security shall report to the 19

Committees on Appropriations of the Senate and the 20

House of Representatives, not later than 90 days after the 21

date of enactment of this Act, on any changes to the 5- 22

year strategic plan for the air and marine program re-23

quired under the heading ‘‘Air and Marine Interdiction, 24

Operations, and Maintenance’’ in Public Law 112–74. 25

CONSTRUCTION AND FACILITIES MANAGEMENT 1

For necessary expenses to plan, acquire, construct, 2

renovate, equip, furnish, operate, manage, and maintain 3

buildings, facilities, and related infrastructure necessary 4

for the administration and enforcement of the laws relat-5

ing to customs, immigration, and border security, 6

$288,821,000, to remain available until September 30, 7

2019. 8

U. S. IMMIGRATION AND CUSTOMS ENFORCEMENT 9

SALARIES AND EXPENSES 10

For necessary expenses for enforcement of immigra-11

tion and customs laws, detention and removals, and inves-12

tigations, including intellectual property rights and over-13

seas vetted units operations; and purchase and lease of 14

up to 3,790 (2,350 for replacement only) police-type vehi-15

cles; $5,932,756,000; of which not to exceed $10,000,000 16

shall be available until expended for conducting special op-17

erations under section 3131 of the Customs Enforcement 18

Act of 1986 (19 U.S.C. 2081); of which not to exceed 19

$11,475 shall be for official reception and representation 20

expenses; of which not to exceed $2,000,000 shall be for 21

awards of compensation to informants, to be accounted 22

for solely under the certificate of the Secretary of Home-23

land Security; of which not less than $305,000 shall be 24

for promotion of public awareness of the child pornog-25

raphy tipline and activities to counter child exploitation; 1

of which not less than $5,400,000 shall be used to facili-2

tate agreements consistent with section 287(g) of the Im-3

migration and Nationality Act (8 U.S.C. 1357(g)); of 4

which not to exceed $40,000,000, to remain available until 5

September 30, 2017, is for maintenance, construction, and 6

lease hold improvements at owned and leased facilities; 7

and of which not to exceed $11,216,000 shall be available 8

to fund or reimburse other Federal agencies for the costs 9

associated with the care, maintenance, and repatriation of 10

smuggled aliens unlawfully present in the United States: 11

Provided, That none of the funds made available under 12

this heading shall be available to compensate any employee 13

for overtime in an annual amount in excess of $35,000, 14

except that the Secretary of Homeland Security, or the 15

designee of the Secretary, may waive that amount as nec-16

essary for national security purposes and in cases of immi-17

gration emergencies: Provided further, That of the total 18

amount provided, $15,770,000 shall be for activities to en-19

force laws against forced child labor, of which not to ex-20

ceed $6,000,000 shall remain available until expended: 21

Provided further, That of the total amount available, not 22

less than $1,600,000,000 shall be available to identify 23

aliens convicted of a crime who may be deportable, and 24

to remove them from the United States once they are 25

judged deportable: Provided further, That the Secretary of 1

Homeland Security shall prioritize the identification and 2

removal of aliens convicted of a crime by the severity of 3

that crime: Provided further, That funding made available 4

under this heading shall maintain a level of not less than 5

34,000 detention beds through September 30, 2015: Pro-6

vided further, That of the total amount provided, not less 7

than $3,431,444,000 is for detention, enforcement, and 8

removal operations, including transportation of unaccom-9

panied minor aliens: Provided further, That of the amount 10

provided for Custody Operations in the previous proviso, 11

$45,000,000 shall remain available until September 30, 12

2019: Provided further, That of the total amount provided 13

for the Visa Security Program and international investiga-14

tions, $43,000,000 shall remain available until September 15

30, 2016: Provided further, That not less than 16

$15,000,000 shall be available for investigation of intellec-17

tual property rights violations, including operation of the 18

National Intellectual Property Rights Coordination Cen-19

ter: Provided further, That none of the funds provided 20

under this heading may be used to continue a delegation 21

of law enforcement authority authorized under section 22

287(g) of the Immigration and Nationality Act (8 U.S.C. 23

1357(g)) if the Department of Homeland Security Inspec-24

tor General determines that the terms of the agreement 25

governing the delegation of authority have been materially 1

violated: Provided further, That none of the funds provided 2

under this heading may be used to continue any contract 3

for the provision of detention services if the two most re-4

cent overall performance evaluations received by the con-5

tracted facility are less than ‘‘adequate’’ or the equivalent 6

median score in any subsequent performance evaluation 7

system: Provided further, That nothing under this heading 8

shall prevent U.S. Immigration and Customs Enforcement 9

from exercising those authorities provided under immigra-10

tion laws (as defined in section 101(a)(17) of the Immi-11

gration and Nationality Act (8 U.S.C. 1101(a)(17))) dur-12

ing priority operations pertaining to aliens convicted of a 13

crime: Provided further, That without regard to the limita-14

tion as to time and condition of section 503(d) of this Act, 15

the Secretary may propose to reprogram and transfer 16

funds within and into this appropriation necessary to en-17

sure the detention of aliens prioritized for removal. 18

AUTOMATION MODERNIZATION 19

For expenses of immigration and customs enforce-20

ment automated systems, $26,000,000, to remain avail-21

For necessary expenses of the Transportation Secu-3

rity Administration related to providing civil aviation secu-4

rity services pursuant to the Aviation and Transportation 5

tration is deploying its existing passenger and bag-13

gage screener workforce in the most cost effective 14

manner; and 15

(3) labor savings from the deployment of im-16

proved technologies for passenger and baggage 17

screening and how those savings are being used to 18

offset security costs or reinvested to address security 19

vulnerabilities: 20

Provided further, That not later than April 15, 2015, the 21

Administrator of the Transportation Security Administra-22

tion shall submit to the Committees on Appropriations of 23

EMERGENCY MANAGEMENT PERFORMANCE GRANTS 19

For emergency management performance grants, as 20

authorized by the National Flood Insurance Act of 1968 21

(42 U.S.C. 4001 et seq.), the Robert T. Stafford Disaster 22

than 5 days after the issuance of the mission assignment 1

or task order, the Administrator shall publish on the 2

Agency’s website the following: the name of the impacted 3

State and the disaster declaration for such State, the as-4

signed agency, the assistance requested, a description of 5

the disaster, the total cost estimate, and the amount obli-6

gated: Provided further, That not later than 10 days after 7

the last day of each month until the mission assignment 8

or task order is completed and closed out, the Adminis-9

trator shall update any changes to the total cost estimate 10

and the amount obligated: Provided further, That of the 11

amount provided under this heading, $6,437,792,622 shall 12

be for major disasters declared pursuant to the Robert T. 13

Provided further, That the amounts collected under section 21

102 of the Flood Disaster Protection Act of 1973 (42 22

ministrative costs shall not exceed 3.5 percent of the total 20

TITLE V 1

GENERAL PROVISIONS 2

(INCLUDING RESCISSIONS OF FUNDS) 3

SEC. 501. No part of any appropriation contained in 4

this Act shall remain available for obligation beyond the 5

current fiscal year unless expressly so provided herein. 6

SEC. 502. Subject to the requirements of section 503 7

of this Act, the unexpended balances of prior appropria-8

tions provided for activities in this Act may be transferred 9

to appropriation accounts for such activities established 10

pursuant to this Act, may be merged with funds in the 11

applicable established accounts, and thereafter may be ac-12

counted for as one fund for the same time period as origi-13

nally enacted. 14

SEC. 503. (a) None of the funds provided by this Act, 15

provided by previous appropriations Acts to the agencies 16

in or transferred to the Department of Homeland Security 17

that remain available for obligation or expenditure in fiscal 18

year 2015, or provided from any accounts in the Treasury 19

of the United States derived by the collection of fees avail-20

able to the agencies funded by this Act, shall be available 21

for obligation or expenditure through a reprogramming of 22

funds that: 23

(1) creates a new program, project, or activity; 24

(2) eliminates a program, project, office, or ac-1

tivity; 2

(3) increases funds for any program, project, or 3

activity for which funds have been denied or re-4

stricted by the Congress; 5

(4) proposes to use funds directed for a specific 6

activity by either of the Committees on Appropria-7

tions of the Senate or the House of Representatives 8

for a different purpose; or 9

(5) contracts out any function or activity for 10

which funding levels were requested for Federal full- 11

time equivalents in the object classification tables 12

contained in the fiscal year 2015 Budget Appendix 13

for the Department of Homeland Security, as modi-14

fied by the report accompanying this Act, unless the 15

Committees on Appropriations of the Senate and the 16

House of Representatives are notified 15 days in ad-17

vance of such reprogramming of funds. 18

(b) None of the funds provided by this Act, provided 19

by previous appropriations Acts to the agencies in or 20

transferred to the Department of Homeland Security that 21

remain available for obligation or expenditure in fiscal 22

year 2015, or provided from any accounts in the Treasury 23

of the United States derived by the collection of fees or 24

proceeds available to the agencies funded by this Act, shall 25

be available for obligation or expenditure for programs, 1

projects, or activities through a reprogramming of funds 2

in excess of $5,000,000 or 10 percent, whichever is less, 3

that: 4

(1) augments existing programs, projects, or ac-5

tivities; 6

(2) reduces by 10 percent funding for any exist-7

ing program, project, or activity; 8

(3) reduces by 10 percent the numbers of per-9

sonnel approved by the Congress; or 10

(4) results from any general savings from a re-11

duction in personnel that would result in a change 12

in existing programs, projects, or activities as ap-13

proved by the Congress, unless the Committees on 14

Appropriations of the Senate and the House of Rep-15

resentatives are notified 15 days in advance of such 16

reprogramming of funds. 17

(c) Not to exceed 5 percent of any appropriation 18

made available for the current fiscal year for the Depart-19

ment of Homeland Security by this Act or provided by 20

previous appropriations Acts may be transferred between 21

such appropriations, but no such appropriation, except as 22

otherwise specifically provided, shall be increased by more 23

than 10 percent by such transfers: Provided, That any 24

transfer under this section shall be treated as a re-25

programming of funds under subsection (b) and shall not 1

be available for obligation unless the Committees on Ap-2

propriations of the Senate and the House of Representa-3

tives are notified 15 days in advance of such transfer. 4

(d) Notwithstanding subsections (a), (b), and (c) of 5

this section, no funds shall be reprogrammed within or 6

transferred between appropriations based upon an initial 7

notification provided after June 30, except in extraor-8

dinary circumstances that imminently threaten the safety 9

of human life or the protection of property. 10

(e) The notification thresholds and procedures set 11

forth in this section shall apply to any use of deobligated 12

balances of funds provided in previous Department of 13

Homeland Security Appropriations Acts. 14

SEC. 504. The Department of Homeland Security 15

Working Capital Fund, established pursuant to section 16

403 of Public Law 103–356 (31 U.S.C. 501 note), shall 17

continue operations as a permanent working capital fund 18

for fiscal year 2015: Provided, That none of the funds ap-19

propriated or otherwise made available to the Department 20

of Homeland Security may be used to make payments to 21

the Working Capital Fund, except for the activities and 22

amounts allowed in the President’s fiscal year 2015 budg-23

et: Provided further, That funds provided to the Working 24

Capital Fund shall be available for obligation until ex-25

pended to carry out the purposes of the Working Capital 1

Fund: Provided further, That all departmental components 2

shall be charged only for direct usage of each Working 3

Capital Fund service: Provided further, That funds pro-4

vided to the Working Capital Fund shall be used only for 5

purposes consistent with the contributing component: Pro-6

vided further, That the Working Capital Fund shall be 7

paid in advance or reimbursed at rates which will return 8

the full cost of each service: Provided further, That the 9

Committees on Appropriations of the Senate and House 10

of Representatives shall be notified of any activity added 11

to or removed from the fund: Provided further, That the 12

Chief Financial Officer of the Department of Homeland 13

Security shall submit a quarterly execution report with ac-14

tivity level detail, not later than 30 days after the end of 15

each quarter. 16

SEC. 505. Except as otherwise specifically provided 17

by law, not to exceed 50 percent of unobligated balances 18

remaining available at the end of fiscal year 2015, as re-19

corded in the financial records at the time of a reprogram-20

ming request, but not later than June 30, 2016, from ap-21

propriations for salaries and expenses for fiscal year 2015 22

in this Act shall remain available through September 30, 23

2016, in the account and for the purposes for which the 24

appropriations were provided: Provided, That prior to the 25

obligation of such funds, a request shall be submitted to 1

the Committees on Appropriations of the Senate and the 2

House of Representatives for approval in accordance with 3

section 503 of this Act. 4

SEC. 506. Funds made available by this Act for intel-5

ligence activities are deemed to be specifically authorized 6

by the Congress for purposes of section 504 of the Na-7

tional Security Act of 1947 (50 U.S.C. 414) during fiscal 8

year 2015 until the enactment of an Act authorizing intel-9

ligence activities for fiscal year 2015. 10

SEC. 507. (a) Except as provided in subsections (b) 11

and (c), none of the funds made available by this Act may 12

be used to— 13

(1) make or award a grant allocation, grant, 14

contract, other transaction agreement, or task or de-15

livery order on a Department of Homeland Security 16

multiple award contract, or to issue a letter of intent 17

totaling in excess of $1,000,000; 18

(2) award a task or delivery order requiring an 19

obligation of funds in an amount greater than 20

$10,000,000 from multi-year Department of Home-21

land Security funds; 22

(3) make a sole-source grant award; or 23

(4) announce publicly the intention to make or 24

award items under paragraph (1), (2), or (3) includ-25

ing a contract covered by the Federal Acquisition 1

Regulation. 2

(b) The Secretary of Homeland Security may waive 3

the prohibition under subsection (a) if the Secretary noti-4

fies the Committees on Appropriations of the Senate and 5

the House of Representatives at least 3 full business days 6

in advance of making an award or issuing a letter as de-7

scribed in that subsection. 8

(c) If the Secretary of Homeland Security determines 9

that compliance with this section would pose a substantial 10

risk to human life, health, or safety, an award may be 11

made without notification, and the Secretary shall notify 12

the Committees on Appropriations of the Senate and the 13

House of Representatives not later than 5 full business 14

days after such an award is made or letter issued. 15

(d) A notification under this section— 16

(1) may not involve funds that are not available 17

for obligation; and 18

(2) shall include the amount of the award; the 19

fiscal year for which the funds for the award were 20

appropriated; the type of contract; and the account 21

from which the funds are being drawn. 22

(e) The Administrator of the Federal Emergency 23

Management Agency shall brief the Committees on Appro-24

priations of the Senate and the House of Representatives 25

5 full business days in advance of announcing publicly the 1

intention of making an award under ‘‘State and Local 2

Programs’’. 3

SEC. 508. Notwithstanding any other provision of 4

law, no agency shall purchase, construct, or lease any ad-5

ditional facilities, except within or contiguous to existing 6

locations, to be used for the purpose of conducting Federal 7

law enforcement training without the advance approval of 8

the Committees on Appropriations of the Senate and the 9

House of Representatives, except that the Federal Law 10

Enforcement Training Center is authorized to obtain the 11

temporary use of additional facilities by lease, contract, 12

or other agreement for training that cannot be accommo-13

dated in existing Center facilities. 14

SEC. 509. None of the funds appropriated or other-15

wise made available by this Act may be used for expenses 16

for any construction, repair, alteration, or acquisition 17

project for which a prospectus otherwise required under 18

chapter 33 of title 40, United States Code, has not been 19

approved, except that necessary funds may be expended 20

for each project for required expenses for the development 21

of a proposed prospectus. 22

SEC. 510. (a) Sections 520, 522, and 530 of the De-23

partment of Homeland Security Appropriations Act, 2008 24

(division E of Public Law 110–161; 121 Stat. 2073 and 25

2074) shall apply with respect to funds made available in 1

this Act in the same manner as such sections applied to 2

funds made available in that Act. 3

(b) The third proviso of section 537 of the Depart-4

ment of Homeland Security Appropriations Act, 2006 (6 5

U.S.C. 114), shall not apply with respect to funds made 6

available in this Act. 7

SEC. 511. None of the funds made available in this 8

Act may be used in contravention of the applicable provi-9

sions of the Buy American Act. For purposes of the pre-10

ceding sentence, the term ‘‘Buy American Act’’ means 11

chapter 83 of title 41, United States Code. 12

SEC. 512. None of the funds made available in this 13

Act may be used to amend the oath of allegiance required 14

by section 337 of the Immigration and Nationality Act 15

(8 U.S.C. 1448). 16

SEC. 513. Not later than 30 days after the last day 17

of each month, the Chief Financial Officer of the Depart-18

ment of Homeland Security shall submit to the Commit-19

tees on Appropriations of the Senate and the House of 20

Representatives a monthly budget and staffing report for 21

that month that includes total obligations of the Depart-22

ment for that month for the fiscal year at the appropria-23

tion and program, project, and activity levels, by the 24

source year of the appropriation. Total obligations for 25

staffing shall also be provided by subcategory of on-board 1

and funded full-time equivalent staffing levels, respec-2

tively, and the report shall specify the number of, and total 3

obligations for, contract employees for each office of the 4

Department. 5

SEC. 514. Except as provided in section 44945 of title 6

49, United States Code, funds appropriated or transferred 7

to Transportation Security Administration ‘‘Aviation Se-8

curity’’, ‘‘Administration’’, and ‘‘Transportation Security 9

Support’’ for fiscal years 2004 and 2005 that are recov-10

ered or deobligated shall be available only for the procure-11

ment or installation of explosives detection systems, air 12

cargo, baggage, and checkpoint screening systems, subject 13

to notification: Provided, That semiannual reports shall be 14

submitted to the Committees on Appropriations of the 15

Senate and the House of Representatives on any funds 16

that are recovered or deobligated. 17

SEC. 515. None of the funds appropriated by this Act 18

may be used to process or approve a competition under 19

Office of Management and Budget Circular A–76 for serv-20

ices provided by employees (including employees serving 21

on a temporary or term basis) of United States Citizen-22

ship and Immigration Services of the Department of 23

Homeland Security who are known as Immigration Infor-24

mation Officers, Contact Representatives, Investigative 1

Assistants, or Immigration Services Officers. 2

SEC. 516. Any funds appropriated to ‘‘Coast Guard, 3

Acquisition, Construction, and Improvements’’ for fiscal 4

years 2002, 2003, 2004, 2005, and 2006 for the 110– 5

123 foot patrol boat conversion that are recovered, col-6

lected, or otherwise received as the result of negotiation, 7

mediation, or litigation, shall be available until expended 8

for the Fast Response Cutter program. 9

SEC. 517. The functions of the Federal Law Enforce-10

ment Training Center instructor staff shall be classified 11

as inherently governmental for the purpose of the Federal 12

Activities Inventory Reform Act of 1998 (31 U.S.C. 501 13

note). 14

SEC. 518. (a) The Secretary of Homeland Security 15

shall submit a report not later than October 15, 2015, 16

to the Office of Inspector General of the Department of 17

Homeland Security listing all grants and contracts award-18

ed by any means other than full and open competition dur-19

ing fiscal year 2015. 20

(b) The Inspector General shall review the report re-21

quired by subsection (a) to assess Departmental compli-22

ance with applicable laws and regulations and report the 23

results of that review to the Committees on Appropriations 24

SEC. 519. None of the funds provided by this or pre-3

vious appropriations Acts shall be used to fund any posi-4

tion designated as a Principal Federal Official (or the suc-5

cessor thereto) for any Robert T. Stafford Disaster Relief 6

and Emergency Assistance Act (42 U.S.C. 5121 et seq.) 7

declared disasters or emergencies unless— 8

(1) the responsibilities of the Principal Federal 9

Official do not include operational functions related 10

to incident management, including coordination of 11

operations, and are consistent with the requirements 12

of section 509(c) and sections 503(c)(3) and 13

503(c)(4)(A) of the Homeland Security Act of 2002 14

(6 U.S.C. 319(c) and 313(c)(3) and 313(c)(4)(A)) 15

and section 302 of the Robert T. Stafford Disaster 16

Relief and Assistance Act (42 U.S.C. 5143); 17

(2) not later than 10 business days after the 18

latter of the date on which the Secretary of Home-19

land Security appoints the Principal Federal Official 20

and the date on which the President issues a dec-21

laration under section 401 or section 501 of the 22

Robert T. Stafford Disaster Relief and Emergency 23

Assistance Act (42 U.S.C. 5170 and 5191, respec-24

tively), the Secretary of Homeland Security shall 25

submit a notification of the appointment of the Prin-1

cipal Federal Official and a description of the re-2

sponsibilities of such Official and how such respon-3

sibilities are consistent with paragraph (1) to the 4

Committees on Appropriations of the Senate and the 5

House of Representatives, the Committee on Trans-6

portation and Infrastructure of the House of Rep-7

resentatives, and the Committee on Homeland Secu-8

rity and Governmental Affairs of the Senate; and 9

(3) not later than 60 days after the date of en-10

actment of this Act, the Secretary shall provide a re-11

port specifying timeframes and milestones regarding 12

the update of operations, planning and policy docu-13

ments, and training and exercise protocols, to ensure 14

consistency with paragraph (1) of this section. 15

SEC. 520. None of the funds provided or otherwise 16

made available in this Act shall be available to carry out 17

section 872 of the Homeland Security Act of 2002 (6 18

U.S.C. 452). 19

SEC. 521. Funds made available in this Act may be 20

used to alter operations within the Civil Engineering Pro-21

gram of the Coast Guard nationwide, including civil engi-22

neering units, facilities design and construction centers, 23

maintenance and logistics commands, and the Coast 24

Guard Academy, except that none of the funds provided 25

in this Act may be used to reduce operations within any 1

Civil Engineering Unit unless specifically authorized by a 2

statute enacted after the date of enactment of this Act. 3

SEC. 522. None of the funds made available in this 4

Act may be used by United States Citizenship and Immi-5

gration Services to grant an immigration benefit unless 6

the results of background checks required by law to be 7

completed prior to the granting of the benefit have been 8

received by United States Citizenship and Immigration 9

Services, and the results do not preclude the granting of 10

the benefit. 11

SEC. 523. Section 831 of the Homeland Security Act 12

of 2002 (6 U.S.C. 391) is amended— 13

(1) in subsection (a), by striking ‘‘Until Sep-14

tember 30, 2014,’’ and inserting ‘‘Until September 15

30, 2015,’’; and 16

(2) in subsection (c)(1), by striking ‘‘September 17

30, 2014,’’ and inserting ‘‘September 30, 2015,’’. 18

SEC. 524. The Secretary of Homeland Security shall 19

require that all contracts of the Department of Homeland 20

Security that provide award fees link such fees to success-21

ful acquisition outcomes (which outcomes shall be speci-22

fied in terms of cost, schedule, and performance). 23

SEC. 525. Notwithstanding any other provision of 24

law, none of the funds provided in this or any other Act 25

shall be used to approve a waiver of the navigation and 1

vessel-inspection laws pursuant to 46 U.S.C. 501(b) for 2

the transportation of crude oil distributed from the Stra-3

tegic Petroleum Reserve until the Secretary of Homeland 4

Security, after consultation with the Secretaries of the De-5

partments of Energy and Transportation and representa-6

tives from the United States flag maritime industry, takes 7

adequate measures to ensure the use of United States flag 8

vessels: Provided, That the Secretary shall notify the Com-9

mittees on Appropriations of the Senate and the House 10

of Representatives, the Committee on Commerce, Science, 11

and Transportation of the Senate, and the Committee on 12

Transportation and Infrastructure of the House of Rep-13

resentatives within 2 business days of any request for 14

waivers of navigation and vessel-inspection laws pursuant 15

to 46 U.S.C. 501(b). 16

SEC. 526. None of the funds made available in this 17

Act for U.S. Customs and Border Protection may be used 18

to prevent an individual not in the business of importing 19

a prescription drug (within the meaning of section 801(g) 20

of the Federal Food, Drug, and Cosmetic Act) from im-21

porting a prescription drug from Canada that complies 22

with the Federal Food, Drug, and Cosmetic Act: Provided, 23

That this section shall apply only to individuals trans-24

porting on their person a personal-use quantity of the pre-25

scription drug, not to exceed a 90-day supply: Provided 1

further, That the prescription drug may not be— 2

(1) a controlled substance, as defined in section 3

102 of the Controlled Substances Act (21 U.S.C. 4

802); or 5

(2) a biological product, as defined in section 6

351 of the Public Health Service Act (42 U.S.C. 7

262). 8

SEC. 527. None of the funds in this Act shall be used 9

to reduce the United States Coast Guard’s Operations 10

Systems Center mission or its government-employed or 11

contract staff levels. 12

SEC. 528. The Secretary of Homeland Security, in 13

consultation with the Secretary of the Treasury, shall no-14

tify the Committees on Appropriations of the Senate and 15

the House of Representatives of any proposed transfers 16

of funds available under section 9703.1(g)(4)(B) of title 17

31, United States Code (as added by Public Law 102– 18

393) from the Department of the Treasury Forfeiture 19

Fund to any agency within the Department of Homeland 20

Security: Provided, That none of the funds identified for 21

such a transfer may be obligated until the Committees on 22

Appropriations of the Senate and the House of Represent-23

atives approve the proposed transfers. 24

SEC. 529. None of the funds made available in this 1

Act may be used for planning, testing, piloting, or devel-2

oping a national identification card. 3

SEC. 530. None of the funds appropriated by this Act 4

may be used to conduct, or to implement the results of, 5

a competition under Office of Management and Budget 6

Circular A–76 for activities performed with respect to the 7

Coast Guard National Vessel Documentation Center. 8

SEC. 531. (a) Notwithstanding any other provision 9

of this Act, except as provided in subsection (b), and 30 10

days after the date on which the President determines 11

whether to declare a major disaster because of an event 12

and any appeal is completed, the Administrator shall pub-13

lish on the Web site of the Federal Emergency Manage-14

ment Agency a report regarding that decision that shall 15

summarize damage assessment information used to deter-16

mine whether to declare a major disaster. 17

(b) The Administrator may redact from a report 18

under subsection (a) any data that the Administrator de-19

termines would compromise national security. 20

(c) In this section— 21

(1) the term ‘‘Administrator’’ means the Ad-22

ministrator of the Federal Emergency Management 23

Agency; and 24

(2) the term ‘‘major disaster’’ has the meaning 1

given that term in section 102 of the Robert T. 2

Stafford Disaster Relief and Emergency Assistance 3

Act (42 U.S.C. 5122). 4

SEC. 532. Any official that is required by this Act 5

to report or to certify to the Committees on Appropria-6

tions of the Senate and the House of Representatives may 7

not delegate such authority to perform that act unless spe-8

cifically authorized herein. 9

SEC. 533. None of the funds appropriated or other-10

wise made available in this or any other Act may be used 11

to transfer, release, or assist in the transfer or release to 12

or within the United States, its territories, or possessions 13

Khalid Sheikh Mohammed or any other detainee who— 14

(1) is not a United States citizen or a member 15

of the Armed Forces of the United States; and 16

(2) is or was held on or after June 24, 2009, 17

at the United States Naval Station, Guantanamo 18

Bay, Cuba, by the Department of Defense. 19

SEC. 534. None of the funds made available in this 20

Act may be used for first-class travel by the employees 21

of agencies funded by this Act in contravention of sections 22

301–10.122 through 301–10.124 of title 41, Code of Fed-23

eral Regulations. 24

SEC. 535. None of the funds made available in this 1

Act may be used to employ workers described in section 2

274A(h)(3) of the Immigration and Nationality Act (8 3

U.S.C. 1324a(h)(3)). 4

SEC. 536. (a) Any company that collects or retains 5

personal information directly from any individual who par-6

ticipates in the Registered Traveler or successor program 7

of the Transportation Security Administration shall here-8

after safeguard and dispose of such information in accord-9

ance with the requirements in— 10

(1) the National Institute for Standards and 11

Technology Special Publication 800–30, entitled 12

‘‘Risk Management Guide for Information Tech-13

nology Systems’’; 14

(2) the National Institute for Standards and 15

Technology Special Publication 800–53, Revision 3, 16

entitled ‘‘Recommended Security Controls for Fed-17

eral Information Systems and Organizations’’; and 18

(3) any supplemental standards established by 19

the Administrator of the Transportation Security 20

Administration (referred to in this section as the 21

‘‘Administrator’’). 22

(b) The airport authority or air carrier operator that 23

sponsors the company under the Registered Traveler pro-24

gram shall hereafter be known as the ‘‘Sponsoring Enti-1

ty’’. 2

(c) The Administrator shall hereafter require any 3

company covered by subsection (a) to provide, not later 4

than 30 days after the date of enactment of this Act, to 5

the Sponsoring Entity written certification that the proce-6

dures used by the company to safeguard and dispose of 7

information are in compliance with the requirements 8

under subsection (a). Such certification shall include a de-9

scription of the procedures used by the company to comply 10

with such requirements. 11

SEC. 537. Notwithstanding any other provision of 12

this Act, none of the funds appropriated or otherwise 13

made available by this Act may be used to pay award or 14

incentive fees for contractor performance that has been 15

judged to be below satisfactory performance or perform-16

ance that does not meet the basic requirements of a con-17

tract. 18

SEC. 538. In developing any process to screen avia-19

tion passengers and crews for transportation or national 20

security purposes, the Secretary of Homeland Security 21

shall ensure that all such processes take into consideration 22

such passengers’ and crews’ privacy and civil liberties con-23

sistent with applicable laws, regulations, and guidance. 24

SEC. 539. (a) Notwithstanding section 1356(n) of 1

title 8, United States Code, of the funds deposited into 2

the Immigration Examinations Fee Account, $10,000,000 3

may be allocated by United States Citizenship and Immi-4

gration Services in fiscal year 2015 for the purpose of pro-5

viding an immigrant integration grants program. 6

(b) None of the funds made available to United 7

States Citizenship and Immigration Services for grants for 8

immigrant integration may be used to provide services to 9

aliens who have not been lawfully admitted for permanent 10

residence. 11

SEC. 540. For an additional amount for the ‘‘Office 12

of the Under Secretary for Management’’, $48,600,000, 13

to remain available until expended, for necessary expenses 14

to plan, acquire, design, construct, renovate, remediate, 15

equip, furnish, improve infrastructure, and occupy build-16

ings and facilities for the department headquarters con-17

solidation project and associated mission support consoli-18

dation: Provided, That the Committees on Appropriations 19

of the Senate and the House of Representatives shall re-20

ceive an expenditure plan not later than 90 days after the 21

date of enactment of the Act detailing the allocation of 22

these funds. 23

SEC. 541. None of the funds appropriated or other-24

wise made available by this Act may be used by the De-25

partment of Homeland Security to enter into any Federal 1

contract unless such contract is entered into in accordance 2

with the requirements of subtitle I of title 41, United 3

States Code, or chapter 137 of title 10, United States 4

Code, and the Federal Acquisition Regulation, unless such 5

contract is otherwise authorized by statute to be entered 6

into without regard to the above referenced statutes. 7

SEC. 542. (a) For an additional amount for financial 8

systems modernization, $34,072,000 to remain available 9

until September 30, 2016. 10

(b) Funds made available in subsection (a) for finan-11

cial systems modernization may be transferred by the Sec-12

retary of Homeland Security between appropriations for 13

the same purpose, notwithstanding section 503 of this Act. 14

(c) No transfer described in subsection (b) shall occur 15

until 15 days after the Committees on Appropriations of 16

the Senate and the House of Representatives are notified 17

of such transfer. 18

SEC. 543. Notwithstanding the 10 percent limitation 19

contained in section 503(c) of this Act, the Secretary of 20

Homeland Security may transfer to the fund established 21

by 8 U.S.C. 1101 note, up to $20,000,000 from appro-22

priations available to the Department of Homeland Secu-23

rity: Provided, That the Secretary shall notify the Com-24

mittees on Appropriations of the Senate and the House 1

of Representatives 5 days in advance of such transfer. 2

SEC. 544. Notwithstanding any other provision of 3

law, if the Secretary of Homeland Security determines 4

that specific U.S. Immigration and Customs Enforcement 5

Service Processing Centers or other U.S. Immigration and 6

Customs Enforcement owned detention facilities no longer 7

meet the mission need, the Secretary is authorized to dis-8

pose of individual Service Processing Centers or other 9

U.S. Immigration and Customs Enforcement owned de-10

tention facilities by directing the Administrator of General 11

Services to sell all real and related personal property which 12

support Service Processing Centers or other U.S. Immi-13

gration and Customs Enforcement owned detention facili-14

ties, subject to such terms and conditions as necessary to 15

protect Government interests and meet program require-16

ments: Provided, That the proceeds, net of the costs of 17

sale incurred by the General Services Administration and 18

U.S. Immigration and Customs Enforcement, shall be de-19

posited as offsetting collections into a separate account 20

that shall be available, subject to appropriation, until ex-21

pended for other real property capital asset needs of exist-22

ing U.S. Immigration and Customs Enforcement assets, 23

excluding daily operations and maintenance costs, as the 24

Secretary deems appropriate: Provided further, That any 25

sale or collocation of federally owned detention facilities 1

shall not result in the maintenance of fewer than 34,000 2

detention beds: Provided further, That the Committees on 3

Appropriations of the Senate and the House of Represent-4

atives shall be notified 15 days prior to the announcement 5

of any proposed sale or collocation. 6

SEC. 545. The Commissioner of U.S. Customs and 7

Border Protection and the Assistant Secretary of Home-8

land Security for U.S. Immigration and Customs Enforce-9

ment shall, with respect to fiscal years 2015, 2016, 2017, 10

and 2018, submit to the Committees on Appropriations 11

of the Senate and the House of Representatives, at the 12

time that the President’s budget proposal for fiscal year 13

2016 is submitted pursuant to the requirements of section 14

1105(a) of title 31, United States Code, the information 15

required in the multi-year investment and management 16

plans required, respectively, under the headings ‘‘U.S. 17

Customs and Border Protection, Salaries and Expenses’’ 18

under title II of division D of the Consolidated Appropria-19

tions Act, 2012 (Public Law 112–74); ‘‘U.S. Customs and 20

Border Protection, Border Security Fencing, Infrastruc-21

ture, and Technology’’ under such title; and section 568 22

of such Act. 23

SEC. 546. The Secretary of Homeland Security shall 24

ensure enforcement of all immigration laws (as defined in 25

section 101(a)(17) of the Immigration and Nationality Act 1

(8 U.S.C. 1101(a)(17))). 2

SEC. 547. (a) Of the amounts made available by this 3

Act for ‘‘National Protection and Programs Directorate, 4

Infrastructure Protection and Information Security’’, 5

$140,525,000 for the Federal Network Security program, 6

project, and activity shall be used to deploy on Federal 7

systems technology to improve the information security of 8

agency information systems covered by section 3543(a) of 9

title 44, United States Code: Provided, That funds made 10

available under this section shall be used to assist and sup-11

port Government-wide and agency-specific efforts to pro-12

vide adequate, risk-based, and cost-effective cybersecurity 13

to address escalating and rapidly evolving threats to infor-14

mation security, including the acquisition and operation 15

of a continuous monitoring and diagnostics program, in 16

collaboration with departments and agencies, that includes 17

equipment, software, and Department of Homeland Secu-18

rity supplied services: Provided further, That continuous 19

monitoring and diagnostics software procured by the 20

funds made available by this section shall not transmit to 21

the Department of Homeland Security any personally 22

identifiable information or content of network communica-23

tions of other agencies’ users: Provided further, That such 24

software shall be installed, maintained, and operated in 25

accordance with all applicable privacy laws and agency- 1

specific policies regarding network content. 2

(b) Funds made available under this section may not 3

be used to supplant funds provided for any such system 4

within an agency budget. 5

(c) Not later than July 1, 2015, the heads of all Fed-6

eral agencies shall submit to the Committees on Appro-7

priations of the Senate and the House of Representatives 8

expenditure plans for necessary cybersecurity improve-9

ments to address known vulnerabilities to information sys-10

tems described in subsection (a). 11

(d) Not later than October 1, 2015, and semiannually 12

thereafter, the head of each Federal agency shall submit 13

to the Director of the Office of Management and Budget 14

a report on the execution of the expenditure plan for that 15

agency required by subsection (c): Provided, That the Di-16

rector of the Office of Management and Budget shall sum-17

marize such execution reports and annually submit such 18

summaries to Congress in conjunction with the annual 19

progress report on implementation of the E-Government 20

Act of 2002 (Public Law 107–347), as required by section 21

3606 of title 44, United States Code. 22

(e) This section shall not apply to the legislative and 23

judicial branches of the Federal Government and shall 24

apply to all Federal agencies within the executive branch 25

except for the Department of Defense, the Central Intel-1

ligence Agency, and the Office of the Director of National 2

Intelligence. 3

SEC. 548. (a) None of the funds made available in 4

this Act may be used to maintain or establish a computer 5

network unless such network blocks the viewing, 6

downloading, and exchanging of pornography. 7

(b) Nothing in subsection (a) shall limit the use of 8

funds necessary for any Federal, State, tribal, or local law 9

enforcement agency or any other entity carrying out crimi-10

SEC. 549. None of the funds made available in this 12

Act may be used by a Federal law enforcement officer to 13

facilitate the transfer of an operable firearm to an indi-14

vidual if the Federal law enforcement officer knows or sus-15

pects that the individual is an agent of a drug cartel unless 16

law enforcement personnel of the United States continu-17

ously monitor or control the firearm at all times. 18

SEC. 550. None of the funds provided in this or any 19

other Act may be obligated to implement the National Pre-20

paredness Grant Program or any other successor grant 21

programs unless explicitly authorized by Congress. 22

SEC. 551. None of the funds made available in this 23

Act may be used to provide funding for the position of 24

SEC. 552. (a) Section 559 of division F of Public Law 3

113–76 is amended as follows: 4

(1) Subsection (f)(2)(B) is amended by adding 5

(c) The Commissioner of U.S. Customs and Border 1

Protection may modify a reimbursable fee agreement in 2

effect as of the date of enactment of this Act to include 3

costs specified in this section. 4

SEC. 553. None of the funds made available in this 5

Act may be used to pay for the travel to or attendance 6

of more than 50 employees of a single component of the 7

Department of Homeland Security, who are stationed in 8

the United States, at a single international conference un-9

less the Secretary of Homeland Security, or a designee, 10

determines that such attendance is in the national interest 11

and notifies the Committees on Appropriations of the Sen-12

ate and the House of Representatives within at least 10 13

days of that determination and the basis for that deter-14

mination: Provided, That for purposes of this section the 15

term ‘‘international conference’’ shall mean a conference 16

occurring outside of the United States attended by rep-17

resentatives of the United States Government and of for-18

eign governments, international organizations, or non-19

governmental organizations. 20

SEC. 554. None of the funds made available in this 21

Act may be used to reimburse any Federal department 22

or agency for its participation in a National Special Secu-23

rity Event. 24

SEC. 555. With the exception of countries with 1

preclearance facilities in service prior to 2013, none of the 2

funds made available in this Act may be used for new U.S. 3

Customs and Border Protection air preclearance agree-4

ments entering into force after February 1, 2014, un-5

less— 6

(1) the Secretary of Homeland Security, in con-7

sultation with the Secretary of State, has certified to 8

Congress that air preclearance operations at the air-9

port provide a homeland or national security benefit 10

to the United States; 11

(2) United States passenger air carriers are not 12

precluded from operating at existing preclearance lo-13

cations; and 14

(3) a United States passenger air carrier is op-15

erating at all airports contemplated for establish-16

ment of new air preclearance operations. 17

SEC. 556. None of the funds made available by this 18

or any other Act may be used by the Administrator of 19

the Transportation Security Administration to implement, 20

administer, or enforce, in abrogation of the responsibility 21

described in section 44903(n)(1) of title 49, United States 22

Code, any requirement that airport operators provide air-23

port-financed staffing to monitor exit points from the ster-24

ile area of any airport at which the Transportation Secu-25

SEC. 557. In making grants under the heading ‘‘Fire-3

fighter Assistance Grants’’, the Secretary may grant waiv-4

ers from the requirements in subsections (a)(1)(A), 5

(a)(1)(B), (a)(1)(E), (c)(1), (c)(2), and (c)(4) of section 6

34 of the Federal Fire Prevention and Control Act of 1974 7

(15 U.S.C. 2229a). 8

SEC. 558. (a) IN GENERAL.—Beginning on the date 9

of the enactment of this Act, the Secretary shall not— 10

(1) establish, collect, or otherwise impose any 11

new border crossing fee on individuals crossing the 12

Southern border or the Northern border at a land 13

port of entry; or 14

(2) conduct any study relating to the imposition 15

of a border crossing fee. 16

(b) BORDER CROSSING FEE DEFINED.—In this sec-17

tion, the term ‘‘border crossing fee’’ means a fee that 18

every pedestrian, cyclist, and driver and passenger of a 19

private motor vehicle is required to pay for the privilege 20

of crossing the Southern border or the Northern border 21

at a land port of entry. 22

SEC. 559. The administrative law judge annuitants 23

participating in the Senior Administrative Law Judge 24

Program managed by the Director of the Office of Per-25

States Code, shall be available on a temporary reemploy-2

ment basis to conduct arbitrations of disputes arising from 3

delivery of assistance under the Federal Emergency Man-4

agement Agency Public Assistance Program. 5

SEC. 560. As authorized by section 601(b) of the 6

United States-Colombia Trade Promotion Agreement Im-7

plementation Act (Public Law 112–42) fees collected from 8

passengers arriving from Canada, Mexico, or an adjacent 9

island pursuant to section 13031(a)(5) of the Consolidated 10

Omnibus Budget Reconciliation Act of 1985 (19 U.S.C. 11

58c(a)(5)) shall be available until expended. 12

SEC. 561. None of the funds appropriated by this or 13

any other Act shall be used to pay the salaries and ex-14

penses of personnel who prepare or submit appropriations 15

language as part of the President’s budget submission to 16

the Congress of the United States for programs under the 17

jurisdiction of the Appropriations Subcommittees on the 18

Department of Homeland Security that assumes revenues 19

or reflects a reduction from the previous year due to user 20

fees proposals that have not been enacted into law prior 21

to the submission of the budget unless such budget sub-22

mission identifies which additional spending reductions 23

should occur in the event the user fees proposals are not 24

enacted prior to the date of the convening of a committee 1

of conference for the fiscal year 2016 appropriations Act. 2

SEC. 562. (a) The Secretary of Homeland Security 3

shall submit to the Congress, not later than 180 days after 4

the date of enactment of this Act and annually thereafter, 5

beginning at the time the President’s budget proposal for 6

fiscal year 2017 is submitted pursuant to section 1105(a) 7

of title 31, United States Code, a comprehensive report 8

on the purchase and usage of weapons, subdivided by 9

weapon type. The report shall include— 10

(1) the quantity of weapons in inventory at the 11

end of the preceding calendar year, and the amount 12

of weapons, subdivided by weapon type, included in 13

the budget request for each relevant component or 14

agency in the Department of Homeland Security; 15

(2) a description of how such quantity and pur-16

chase aligns to each component or agency’s mission 17

requirements for certification, qualification, training, 18

and operations; and 19

(3) details on all contracting practices applied 20

by the Department of Homeland Security, including 21

comparative details regarding other contracting op-22

tions with respect to cost and availability. 23

(b) The reports required by subsection (a) shall be 1

submitted in an appropriate format in order to ensure the 2

safety of law enforcement personnel. 3

SEC. 563. None of the funds made available by this 4

Act shall be used for the environmental remediation of the 5

Coast Guard’s LORAN support in Wildwood/Lower Town-6

ship, New Jersey. 7

SEC. 564. None of the funds made available to the 8

Department of Homeland Security by this or any other 9

Act may be obligated for any structural pay reform that 10

affects more than 100 full-time equivalent employee posi-11

tions or costs more than $5,000,000 in a single year be-12

fore the end of the 30-day period beginning on the date 13

on which the Secretary of Homeland Security submits to 14

Congress a notification that includes— 15

(1) the number of full-time equivalent employee 16

positions affected by such change; 17

(2) funding required for such change for the 18

current year and through the Future Years Home-19

land Security Program; 20

(3) justification for such change; and 21

(4) an analysis of compensation alternatives to 22

such change that were considered by the Depart-23

ment. 24

SEC. 565. (a) Any agency receiving funds made avail-1

able in this Act, shall, subject to subsections (b) and (c), 2

post on the public Web site of that agency any report re-3

quired to be submitted by the Committees on Appropria-4

tions of the Senate and the House of Representatives in 5

this Act, upon the determination by the head of the agency 6

that it shall serve the national interest. 7

(b) Subsection (a) shall not apply to a report if— 8

(1) the public posting of the report com-9

promises homeland or national security; or 10

(2) the report contains proprietary information. 11

(c) The head of the agency posting such report shall 12

do so only after such report has been made available to 13

the requesting Committee or Committees of Congress for 14

no less than 45 days except as otherwise specified in law. 15

SEC. 566. Section 605 of division E of Public Law 16

110–161 (6 U.S.C. 1404) is hereby repealed. 17

SEC. 567. The Administrator of the Federal Emer-18

gency Management Agency may transfer up to 19

$95,000,000 in unobligated balances made available for 20

the appropriations account for ‘‘Federal Emergency Man-21

agement Agency, Disaster Assistance Direct Loan Pro-22

gram’’ under section 2(a) of the Community Disaster 23

Loan Act of 2005 (Public Law 109–88; 119 Stat. 2061) 24

or under chapter 5 of title I of division B of the Consoli-25

SEC. 568. Notwithstanding any other provision of 8

law, Gerardo Ismael Hernandez, a Transportation Secu-9

rity Officer employed by the Transportation Security Ad-10

ministration who died as the direct result of an injury sus-11

tained in the line of duty on November 1, 2013, at the 12

Los Angeles International Airport, shall be deemed to 13

have been a public safety officer for the purposes of the 14

Omnibus Crime Control and Safe Street Act of 1968 (42 15

U.S.C. 3711 et seq.). 16

SEC. 569. The Office of Management and Budget 17

and the Department of Homeland Security shall ensure 18

the congressional budget justifications accompanying the 19

President’s budget proposal for the Department of Home-20

land Security, submitted pursuant to section 1105(a) of 21

title 31, United States Code, include estimates of the num-22

ber of unaccompanied alien children anticipated to be ap-23

prehended in the budget year and the number of agent 24

or officer hours required to process, manage, and care for 25

such children: Provided, That such materials shall also in-1

clude estimates of all other associated costs for each rel-2

evant Departmental component, including but not limited 3

to personnel; equipment; supplies; facilities; managerial, 4

technical, and advisory services; medical treatment; and 5

all costs associated with transporting such children from 6

one Departmental component to another or from a De-7

partmental component to another Federal agency. 8

SEC. 570. Notwithstanding section 404 or 420 of the 9

Robert T. Stafford Disaster Relief and Emergency Assist-10

ance Act (42 U.S.C. 5170c and 5187), until September 11

30, 2015, the President may provide hazard mitigation as-12

sistance in accordance with such section 404 in any area 13

in which assistance was provided under such section 420. 14

SEC. 571. That without regard to the limitation as 15

to time and condition of section 503(d) of this Act, the 16

Secretary may propose to reprogram within and transfer 17

funds into ‘‘U.S. Customs and Border Protection, Salaries 18

and Expenses’’ and ‘‘U.S. Immigration and Customs En-19

forcement, Salaries and Expenses’’ as necessary to ensure 20

the care and transportation of unaccompanied alien chil-21

dren. 22

SEC. 572. Notwithstanding any other provision of 23

law, grants awarded to States along the Southwest Border 24

of the United States under sections 2003 or 2004 of the 25

That no amounts may be rescinded from amounts that 16

were designated by the Congress as an emergency require-17

ment pursuant to a concurrent resolution on the budget 18

or the Balanced Budget and Emergency Deficit Control 19

Act of 1985, as amended: Provided further, That no 20

amounts may be rescinded from the amounts that were 21

designated by the Congress as being for disaster relief pur-22

suant to section 251(b)(2)(D) of the Balanced Budget and 23

Emergency Deficit Control Act of 1985. 24

SEC. 578. The explanatory statement regarding this 1

Act, printed in the House of Representatives section of 2

the Congressional Record, on or about January 13, 2015, 3

by the Chairman of the Committee on Appropriations of 4

the House, shall have the same effect with respect to the 5

allocation of funds and implementation of this Act as if 6

it were a joint explanatory statement of a committee of 7

conference. 8

This Act may be cited as the ‘‘Department of Home-9

land Security Appropriations Act, 2015’’. 10
