I’d like to extend my thanks to the Continuing Education Committee and to our staff at Update for pulling together such an amazing opportunity for professional development. While we had some challenges with the timing of the event, we still had excellent turnout and impressive feedback about the breadth of topics and quality of instructors that we were able to produce from within our own membership. The new format also offered more opportunities to network with other members – getting great minds together to share enthusiasm for the profession can only bring good things. If you missed this year’s event, I hope you’ll make an effort to join us next spring! The days are getting longer and it has been nice to have a long stretch of dry days. I certainly have enjoyed the brief interludes of being able to get back on my bicycle without all the rain gear and I hope you’re enjoying the spring as well.

In keeping with the spring theme of new beginnings, this has been an exciting few months for the Oregon Physical Therapy Association. At the end of March, we debuted a new format for our Annual Conference. I’d like to extend my thanks to the Continuing Education Committee and to our staff at Update for pulling together such an amazing opportunity for professional development. While we had some challenges with the timing of the event, we still had excellent turnout and impressive feedback about the breadth of topics and quality of instructors that we were able to produce from within our own membership. The new format also offered more opportunities to network with other members – getting great minds together to share enthusiasm for the profession can only bring good things. If you missed this year’s event, I hope you’ll make an effort to join us next spring!

Hmura collaborated with PTA Caucus Chair Jen Wood to host a town hall and PTA caucus meeting in Salem. I was lucky enough to be able to attend, and while a freak snowstorm dampened the turnout, the enthusiasm for the event was palpable. Stay tuned Salem there will be an encore soon. The same night in the Gorge, Reimbursement Chair Tom Moline and APTA Delegate Ann Stanley helped coordinate an exciting Doc Talk/Cadaver Lab that sold out quickly and earned rave reviews. The continuing education committee is

investigating opportunities to bring this program to other areas of the state. Meanwhile, in Portland, Vice President Derek Fenwick and others met for an OPTA Pub Night at the Green Dragon. The hope is to host similar events in the Portland area every 6 weeks or so to give members an opportunity to network and discuss the latest issues affecting the profession. The Oregon legislature just completed the first constitutionally mandated even-year legislative session with two major health care bills coming through the process. Senate Bill 1580 was signed into law and authorizes the creation of coordinated care organizations to improve the quality of health care services and reduce the cost through better coordination of care and utilization of proven preventative care. The Oregon Health Authority has posted the first wave of applicants to form a CCO and technical and financial applications will be due as this newsletter goes to press. The first wave of CCOs will be certified on May 28 with the Medicaid contracts becoming effective on August 1, 2012. Obviously, this is a very

quick timeline and much of the detailed work remains. OPTA is working hard to be sure that our members have the most timely and critical information available to them.

The other big bill to emerge from Salem this session is House Bill 4164 which created the Health Insurance Exchange. OPTA will be working closely with the Health Exchange Board to ensure that benefits to see a physical therapist are included in plans offered on the exchange. Early indications are that the model plans will include access to a physical therapist as an essential benefit.

We continue to work closely with the Oregon Health Leadership Council on the acute low back pain direct access pilot

and have had initial meetings with key legislators around amending the practice act to remove limits on direct access. We hope to have a bill in the 2013 session to remove the 60-day limit on direct access.

The Government Affairs Committee has also begun to investigate “fair co-pay” initiatives that would address the increasing shift of the burden of payment for services offered by a physical therapist from the patient’s insurance company/payor to the patient himself through higher co-payments and limited benefits. In other states we have seen instances where the reimbursement from the insurer for the contracted visit with a physical therapist is limited to less than $1 after the patients co-payment is collected. We are gathering examples of policies where patient co-payments constitute an unreasonable amount of the total reimbursement and hope to work in tandem with other health care providers who find their patients dealing with similarly high co-payments.

We are also revisiting our efforts toward protection of the term physical therapy and our “truth in advertising” bill from the 2011 session. This bill failed to get a vote in committee last year because of the 1954 statute that states that chiropractors can provide “physiotherapy.” Of course, the intent of that statute was to allow chiropractors to use modalities in their treatment, not to call the services the provide physical therapy with is clearly misleading to the patient. The need for further clarification on this issue is apparent and we will continue to look for ways

to demonstrate that need to our legislators.

We have established work groups around each of these three legislative concepts to prepare for the coming sessions and continue to meet with legislators, so your donations to the Oregon PT-PAC will be critical over the coming months. As we move forward with these legislative efforts we

will be reaching out to members to contact their legislators to let them know about the bill. If your state legislator sits on one of the key health care committees, we will need your help even earlier in the process to ensure that our bills make it to the full membership for a vote. Alongside 260 fellow physical therapists and physical therapy students, Chris Murphy, Jeremy Hillard, Bethany Lukens and I went to Capitol Hill to learn, advocate and get updated on issues facing the profession.

With political gridlock in Congress and an upcoming election, not a lot has changed over the last year. Key legislative bills that continue to affect how we practice include the arbitrary Medicare Cap, student loan repayment programs and the uncertainty of what the Health Care Reform Act will look like once fully enacted.

Now more than ever, we need support from all members to make sure physical therapists are a part of the reform, as well as, leaders and innovators of cost effective, quality healthcare. Change is coming and I encourage every member to get involved. Be the solution.

Get started by contacting your federal representatives in support of repealing the Medicare Cap (HR 1546/ S 826) and in support of adding physical therapists to the National Health Service Corps Loan Repayment Program (HR 1426/ S 975).

In February, Congress passed an extension to the Therapy Cap exceptions process through the end of the year, but this time there is a slight twist. Patients exceeding $3,700 in combined speech and physical therapy services will be subject to a manual review – stay tuned as final rules around these changes are still pending. The other big twist in the legislation is that beginning on October 1, the Therapy Cap will apply to outpatient hospitals (but not the critical access hospitals) and any services provided in a hospital setting this year prior to October 1 will count towards the cap. Unfortunately, the expenses incurred in a hospital setting will not be uploaded to the Medicare common working file until October, so tracking will be a challenge. APTA is working

with CMS to address these concerns and hope to convince them to update the files prior to the October 1 implementation date. Finally, the legislation also called for a report by MedPAC to

Congress to address a permanent fix to the Sustainable Growth Rate and the Therapy Cap by June of 2013. Stay tuned for more information as it becomes available.

The governance year is well under way for the Oregon Delegation. One of the Delegates brought forward an idea which was then crafted into a motion. Before writing our motion, we gathered ideas from various stakeholders and received great support for the idea. Here is our motion:

That the American Physical Therapy Association (APTA), in concert with appropriate entities, including, but not limited to the Academic Council, conduct a feasibility study to move to an internship model of training as the standard of physical therapist education, with a report to the 2013 House of Delegates. The feasibility study should examine current internship models of training, along with established residencies, mentorships, and fellowships, to determine the readiness to adopt the internship model as the standard of physical therapist education. The feasibility study should also

include a recommendation for inclusion or exclusion of the internship model of training for professional level education as a key concept in the new APTA vision statement.

The support statement (which always follows the motion statement) included the definition of internship model which is:

The internship model is defined as an entry-level, paid, and supervised clinical and didactic experience that begins in the terminal portion of a DPT program. After graduation, interns sit for the national board exam and obtain their licenses. The internship continues after graduation, for a total duration of about one year. Interns would be required to meet specific, standardized learning benchmarks in order to successfully complete the internship.

After speaking with various stakeholders and our reference committee liasion, Nancy Kirsch,

it was decided to withdraw the motion. Although we were sad to do this, we support the goal of keeping “House” business streamlined and for those topics that are not handled in other more appropriate ways. We were assured that a “summit” is planned for fall 2012, to discuss advancing the internship model. (Currently, 2 schools use this model and 20 more plan to start it right away.) Those involved in the summit include APTA, CAPTE, FSBPT and the Academic Council. Depending on what happens at the “summit,” we may bring our motion back in 2013.

Delegates are also contacting the APTA slate of candidates to help gather information before national elections held at the APTA House of Delegates.

No doubt this “House” will again have great information and vigorous debate. Oregon delegates arrive well prepared and eager to take on the business of the House. It is a pleasure to work with such an invested and hardworking Delegates.

The American Board of Physical Therapy Residency and Fellowship Education, informed OPTA that the Oregon Health & Science University and the Child Development & Rehabilitation Center Pediatric Physical Therapy Residency Program in Portland, Oregon has successfully achieved re-credentialing as a pediatric residency program. Our current committee members include: Jeffrey Cox PT, Derek Fenwick PT, Ann Horinouchi PT, Dode Jackson PT, Mike Mulligan PTA, Jenn Wood PTA, Ashleigh Stroud SPT, and Cassie Garcia SPT.

National membership in the APTA continues to make modest gains as compared to 2011. The section with the greatest growth by far is the Research Section, followed by the Oncology and Neurology Sections. Though big numbers are impressive, real growth and retention comes from the one-on-one contact within our local PT community; individuals want to be a part of a community, and we each play a part in welcoming new and returning members.

Future Activities: Several strategies were discussed at the recent annual Board retreat to reach targeted populations to build membership, and retain and engage members. The Membership Committee

Public Relations UpdateBy Mary Hlady, PT, Chair Public Relations Committee

The new website is up and running (check it out! www.opta.org). Now the PR committee will be turning attention to assisting and spotlighting the public relations efforts of our members in the community. If we don’t promote ourselves and the community services we provide, no one else will! We as physical therapists are best able to promote our strength and skills in improving health.

“Surprised, shocked, full of pride.” That’s how Meadow Geddes, a second year student in the Mt. Hood Community

College PTA program, describes what she felt when an administrator from the college called her at home to tell her that she had been nominated to the 2012 All-Oregon Academic Team.

The recognition process started when each of Meadow’s instructors in the PTA program submitted letters of recommendation to the college, each letter outlining Meadow’s academic strengths, her powerful leadership qualities and her

eagerness to work in her chosen field. Each community college in the state then selected two of it’s nominated students for recognition at the state level.

A special luncheon to honor the recipients was held on April 12, 2012. Meadow was introduced to Governor Kitzhaber and luncheon attendees by Dr. Michael Hay, President of Mt. Hood Community College.

Before coming to the PTA program, Meadow already had earned a bachelor’s degree in English. She spent some time working in the retail industry and ran her own business. Meadow realized that she wanted to do work that would help people find health and wellness in their daily lives.

Like many people who choose physical therapy as their

profession, Meadow has had experience as a patient and has helped people close to her, as they managed their way through the rehabilitative process. These personal experiences helped to solidify Meadow’s goal.

Meadow acknowledges the strong reliance on teaching while working with her patients, showing them how to be successful in their own personal wellness. When asked about the strengths of her PTA education, she commented that it was a “marriage of skill and professional communication.”

Having already secured a job, beginning after graduation, Meadow is eager to finish her clinical education and take her licensure exam early this summer.

PTNow is APTA’s clinician web portal. This site is a collaborative effort developed to facilitate the use of best practice guidelines and allow members to interact with other physical therapists sharing similar questions.

The Education Committee will be meeting on May 30 to review responses from our recent Annual Conference hosted at the Portland Airport Sheraton Hotel. The initial input I have received on the changed format style to multiple “breakout sessions” (versus one to two day courses) at this Conference has been very positive!

Our Committee is organizing three more Doc Talks for 2012:

1. May 22nd at OSHU – “Dizziness…Is it Vestibular?

2. September – “Down Syndrome” (most likely at Shriner’s Hospital), and

3. November 14th – “Hip Updates” (location TBD).

We have some exciting national speakers presenting courses. The OPTA is hosting a George Davies Shoulder Workshop in Portland on October 13 and 14. Also we excited to announce that Shirley Sahrmann will be returning to Portland for an Upper Extremity Workshop in 2013!

The Workers’ Compensation Division has filed Oregon medical fee and payment rules effective April 1, 2012 and they have asked OPTA to provide this information so that everyone who is affected to know about the changes.

The proposed rule changes are effective April 1, 2012 and may affect you. The following list highlights some of the rule changes to Division 009, Medical Fee and Payment Rules and to Division 015, Managed Care Organizations. The rules can be found online in both PDF and Word formats. Contact the Workers’ Compensation Division Medical Section with any questions at 503.947.7606 or email [email protected].

Revised OAR 436-009, “Oregon Medical Fee and Payment Rules”:• Updates the physician fee

schedule (Appendix B).• Increases payment for

ambulance and dental services. • Establishes new Oregon

specific (billing) codes for closing examinations (CE001) and for closing reports (CR001). Both codes are payable at 80% of the amount billed.

• Clarifies that there are daily rental rates in addition to monthly rentals, of durable medical equipment, orthotics, prosthetics, and supplies.

• Increases interpreter mileage reimbursement by reducing the minimum round trip mileage eligible for reimbursement from 60 to 15 miles.

• Ambulatory surgery center’s (ASC’s): • Creates Appendix C for

payment amounts of surgical procedures.

• Creates Appendix D for

payment amounts of ancillary services.

• Continues to allow for separate payment for implantable devices.

• Clarifies that an insurer must initiate a dispute when challenging the reasonableness of a provider’s billing.

Revised OAR 436-015, “Managed Care Organizations” (MCOs):• Modifies the MCO certification

and plan development process by incorporating some of the “qualifying” steps into a single application process and eliminating the requirement that an MCO provide a copy of every provider agreement; the MCO may provide a standard provider agreement and identify variations.

• Requires that if the MCO schedules a medical exam for

the worker, the appointment letter must inform the worker if a psychological evaluation is part of the exam and state the reason for the psychological evaluation.
