AN ORDINANCE FOR THE ESTABLISHMENT

OF AN ALTERED SPEED ZONE

0\ - IIT IS HEREBY DECLARED by the Board of Jackson County, Illinois, that the basicstatutory vehicular speed limits established by Section 11-604 of the Illinois Vehicle Codeare more than that considered reasonable and proper on the highway listed below torwhich Grand Tower Township has maintenance responsibility and which is not under thejurisdiction of the Department of Transportation, State of Illinois.

BE IT FURTHER DECLARED that this Board has caused to be made an engineering andtraffic investigation upon highway listed below; and,

BE IT FURTHER DECLARED that, by virtue of Section 11-604 of the above Code, thisBoard determines and declares that reasonable and proper absolute maximum speed limiton Power Plant Road as listed below shall be 45 m.p.h.

A 45 mile per hour speed limit beginning at IL Rte. 3 and extending westerly to Bunge GrainTerminal for a total distance of 1.84 miles.

BE IT FURTHER DECLARED that signs be erected giving notice thereof in conformance withthe standards and specifications contained in the Illinois Manual ofUniform Traffic Control Devicesfor Streets and Highways.

BE IT FURTHER DECLARED that this ordinance shall take effect immediately after the erectionof said signs giving notice of the maximum speed limits.

AN ORDINANCE PROVIDING FOR THE REAPPORTIONMENTOF JACKSON COUNTY, AND THE COMPOSITION AND

SALARY OF THE JACKSON COUNTY BOARD

WHEREAS, the County of Jackson, Illinois is a county having a population ofless than 3,000,000inhabitants and the township fonn ofgovenunent; and

WHEREAS, Division 2-3 ofthe Counties Code (55 ILCS 5/2-3001 et. seq.) provides that the countyboard shall by July 1, 1971 and each ten years thereafter reapportion its county so that each memberof the county board represents the same number of inhabitants; and

WHEREAS, the above cited Division requires that the county board detennine the size ofthe countyboard, the districts from which members are elected, their salary, how a chainnan is elected, thenumber of members elected, the number of members per district and how tenns of office aredetennined.

NOW, THEREFORE BE IT ORDAINED by the Jackson County Board as follows:

1. All prior ordinances, resolutions, and motions adopted by the Jackson County Board pertaining toany matters or subjects herein are hereby repealed as of the effective date of this ordinance.

2. Definitions as used in this ordinance: the following words shall have the meanings indicated:

a. Board means the Jackson County Board.

b. District means a county board district as established by this ordinance.

c. Member or Board Member means a person elected to serve on the county board.

3. The size of the Board shall be fourteen (14) members.

4. The Board Members shall be elected from seven (7) Districts.

5. Two Board Members shall be elected from each of the seven (7) Districts.

6. The Chainnan ofthe Board shall be a member ofthe Board and shall be elected by majority voteof the Board Members with a tenn of office which Shall be two (2) years to commence on the firstMonday of the month following the month in which members of the Board are elected.

7. The salary to be paid to Board Members shall be computed on a per meeting basis and the amountof that compensation shall be $35.00 for each meeting.

8. The Board Members elected in 2002 shall determine by lot which Members shall serve for two(2) year tenns and which for four (4) year terms. Their successors shall be elected to a four (4) yearterm. All terms shall commence on the first Monday of the month following the month ofelection.

9. In making the determination of lot as to which Members shall serve for two (2) and which forfour (4) year terms, the Board shall provide the drawing the lots in such a manner as to insure that ineach District one Member will draw a two (2) year term and one Member will draw' a four (4) yearterm.

10. The seven (7) Districts from which Board Members are to be elected are described andnumbered as follows:

ORDINANCE NO. 01 - '3AN ORDINANCE SETTING REIMBURSEMENT FOR THE COST OF MEDICAL AND

HOSPITAL SERVICES PROVIDED TO PRISONERS IN THE CUSTODY OF THEJACKSON COUNTY SHERIFF AT THE ILLINOIS DEPARTMENT OF PUBLIC AID

RATES FOR MEDICAL ASSISTANCE.

WHEREAS, 730 ILCS 125/17 provides, in part, that the Jackson County Sheriffshall furnishnecessary medical aid for all prisoners under his charge; and

WHEREAS, 730 ILCS 125/17 also provides, in part, that any hospital and/or physicianproviding medical services to a prisoner in the custody ofthe Jackson County Sheriffshall be entitledto obtain reimbursement from the County for the cost of such services; and

WHEREAS, the Jackson County Sheriffmay provide some ofits medical and related servicesto its jail inmates through a written contract with a medical provider; and it is not the intent of thisordinance to disturb or affect these type of arrangements now or in the future; and

WHEREAS, 730 ILCS 125/17 further provides, in part, that the County Board may byordinance limit the reimbursement for hospital and/or physician services furnished to inmates to therates set by the Illinois Department of Public Aid for medical assistance; and

WHEREAS, it is in the best interests ofthe citizens ofJackson County, Illinois for the CountyBoard to limit the reimbursement for the cost ofhospital and/or physician service provided to inmatesin the Jackson County Jail to those rates established by the Illinois Department of Public Aid formedical assistance.

NOW, THEREFORE, BE IT ORDAINED, by the County Board ofJackson County, Illinoisthat:

1. Pursuant to 730 ILCS 125/17, reimbursement by the County of Jackson, Illinois for thecost of hospital and/or physician services provided to inmates in the custody of the Jackson CountySheriff shall be set at the Illinois Department of Public Aid rate for medical assistance.

2. Nothing herein shall be construed to affect any written contract. Nothing herein shall beconstrued to affect any suit or proceeding now pending in any Court or any rights accrued or liabilityincurred or any cause or causes of action accrued or existing under any prior Resolution orOrdinance. Nor shall any written contract, or any right or remedy ofany character be lost, impaired,or affected by this Ordinance.

3. This Ordinance shall be in full force and effect immediately upon its adoption.

4. The Chairman ofthe County Board shall be authorized to sign this Ordinance on behalfofthe entire County Board of Jackson County, Illinois.

AN ORDINANCE TO ADD TERRITORYTO THE JACKSON COUNTY ENTERPRISE ZONE

(JACKSON COUNTY)

WHEREAS. the Jackson County Board establ i shed an Enterpri se Zone throughOrdinance No. 90-2, pursuant to authority granted it by the Illinois Enterprise ZoneAct (The "Act"; P.A. 82-1019). as amended. subject to the approval of the IllinoisDepartment of Commerce and Community Affairs. and subject to provisions of the Act; and

WHEREAS, an Intergovernmental Agreement was entered into between the County ofJackson, Illinois (hereinafter "County") and the Cities of Carbondale and Murphysboro(hereinafter collectively "Cities"). through which the governments designated certainareas, and any areas subsequently certified from time to time. as an Enterprise Zonepursuant to and in accordance with the Act. subject to certification of the State asin the Act provided. and known as the Jackson County Enterprise Zone; and

WHEREAS. the Jackson County Carbondale-Murphysboro Enterprise Zone was approvedby the Illinois Department of Commerce and Community Affairs. effective March 1. 1990;and

WHEREAS. a request has been made to expand the current Enterpri se Zone areathrough the addition of a certain parcel of property. pursuant to authority of the Act.and subject to approval by the Illinois Department of Commerce and Community Affairs,and subject to provisions of the Act; and

WHEREAS. the desi gnati ng uni ts of government through thei r desi gnated zoneadministrator. and pursuant to statute. conducted at least one public hearing withinthe Enterprise Zone area.

NOW, THEREFORE. BE IT ORDAINED BY THE JACKSON COUNTY BOARD OF JACKSON COUNTY,ILLINOIS. AS FOLLOWS:

SECTION 1. That Section III of Ordinance 90-2. the Ordinance Establishing anEnterprise Zone for Jackson County. Illinois. is hereby amended by adding Exhibits A·21and B-21 (which exhibits are attached to this ordinance and made a part thereof) to thelist of Exhibits within said Section III.

SECTION 2. That a11 ordi nances and parts thereof in confl i ct herewi th areexpressly repealed and are of no other force and effect.

SECTION 3. The repeal of any ordinance by this Ordinance shall not affect anyri ghts accrued or 1i abi 1ity incurred under said repeal ed ordi nance to the effecti ve datehereof. The provi si ons of thi s Ordi nance insofar as they are the same or substanti all ythe same as those of any prior ordinance. shall be construed as a continuation of saidprior ordinances.

SECTION 4. That it is the intention of the Jackson County Board that thisOrdinance and every provision thereof shall be considered separable. and the invalidityof any section. clause. or provision of this Ordinance shall not affect the validityof any other portion of this Ordinance.

SECTION 5. That the Jackson County Board finds that the subject matter of thisOrdinance pertains to the government and affairs of the Jackson County and is passedpursuant to authorities granted it by State statute and the Illinois Constitution.

WHEREAS, the Jackson County Board estab1i shed an Enterpri se Zone throughOrdinance No. 90-2, pursuant to authority granted it by the Illinois Enterprise ZoneAct <The "Act"; P.A. 82-1019), as amended, subject to the approval of the IllinoisDepartment of Commerce and Community Affairs, and subject to provisions of the Act; and

WHEREAS. an Intergovernmental Agreement was entered into between the County ofJackson, Illinois (hereinafter "County") and the Cities of Carbondale and Murphysboro(hereinafter collectively "Cities"), through which the governments designated certainareas, and any areas subsequently certified from time to time. as an Enterprise Zonepursuant to and in accordance with the Act, subject to certification of the State asin the Act prOVided. and known as the Jackson County Enterprise Zone: and

WHEREAS. the Jackson County Carbondale-Murphysboro Enterprise Zone was approvedby the Illinois Department of Commerce and Community Affairs, effective March 1. 1990:and

WHEREAS, a request has been made to expand the current Enterprise Zone areathrough the addition of a certain parcel of property, pursuant to authority of the Act.and subject to approval by the Illinois Department of Commerce and Community Affairs,and subject to provisions of the Act; and

WHEREAS. the designating units of government through their designated zoneadministrator. and pursuant to statute, conducted at least one public hearing withinthe Enterprise Zone area.

NOW, THEREFORE, BE IT ORDAINED BY THE JACKSON COUNTY BOARD OF JACKSON COUNTY.ILLINOIS. AS FOLLOWS:

SECTION 1. That Section III of Ordinance 90-2. the Ordinance Establishing anEnterprise Zone for Jackson County. Illinois, is hereby amended by adding Exhibits A-20and B-20 (which exhibits are attached to this ordinance and made a part thereof) to thelist of Exhibits within said Section III.

SECTION 2. That all ordi nances and parts thereof in confl i ct herewith areexpressly repealed and are of no other force and effect.

SECTION 3. The repeal of any ordinance by this Ordinance shall not affect anyrights accrued or liability incurred under said repealed ordinance to the effective datehereof. The provisions of this Ordinance insofar as they are the same or substantiallythe same as those of any prior ordinance. shall be construed as a continuation of saidprior ordinances.

SECTION 4. That it is the intention of the Jackson County Board that thisOrdinance and every provision thereof shall be considered separable. and the inval~d~tyof any section. clause, or provision of this Ordinance shall not affect the valldltyof any other portion of this Ordinance.

WHEREAS, the Jackson County Board adopted a Siting Ordinance for Pollution ControlFacilities (Ordinance # 00-3) on February 9,2000; and

WHEREAS, the aforementioned ordinance established procedures for the County tofollow in making determinations on applications seeking local siting approval; and

WHEREAS, the County wishes to amend said ordinance for point of clarification;

NOW, THEREFORE, BE IT ORDAINED that the Jackson County Board hereby adoptsthe following changes as indicated to the Siting Ordinance for Pollution Control Facilities:

I) "Section 2. Procedures

DAY ONE

2. Applicant for site location approval shall file twenty-five (25) copies ofthe application including five (5) full sized copies of exhibits and twenty(20) reduced copies of all exhibits with the Jackson County Clerk, alongwith the appropriate site review application fee. The applicant isencouraged to use paper containing post-consumer recycled products, Theapplicant is required to provide up to ten (l0) additional copies of theapplication to the County upon request.

Each application for a pollution control facility site which includestransfer, treatment, storage and/or disposal of hazardous material shallinclude a $400,000 application fee and each appiication for a pollutioncontrol facility site which includes transfer, treatment, storage and/ordisposal of non-hazardous material shall include a $250,000 applicationfe~ said fees to cover the reasonable and necessary costs, including butnot limited to: notice costs, court reporter costs, hearing officer costs,transcription costs, consulting and engineering review costs, legal fees,and other expenses incurred by the County of Jackson in conducting thereview of the request for site approval, the subsequent public hearing, andthe approval decision. Each application for a permit modification whichrequires local siting approval or expansion of an existing site shall includea $50,000 application fee for the reasonable and necessary costs as setforth herein above.

Any portion of the application fee that remains unexpended at theconclusion of the hearing process shall be returned to the applicant.Should there be any additional costs incurred by the County in excess ofthe application fee the applicant shall bear any and all additional costs."

2) The Jackson County Board is authorized to insert and incorporate theamendments made by this ordinance into the existing Siting Ordinance forPollution Control Facilities; further

WHEREAS, there exists a Jackson County Private Sewage Disposal System Ordinance,as amended, regulating and permitting the construction, repair and installation of private sewagedisposal systems in Jackson County, Illinois; and

WHEREAS, the present ordinance is intended to amend the existing private sewagedisposal system ordinance; and

WHEREAS, the present amending ordinance is adopted by virtue of the authority of theJackson County Board, Jackson County, Illinois; and

WHEREAS, the Jackson County Private Sewage Disposal System Ordinance hasestablished fees which need to be revised from time to time; and

WHEREAS, the amendment made by this present amending ordinance is for the purposeof revising the fees to cover the increasing costs of the Jackson County private sewage disposalprogram and to further supplement tax and grant monies also used to support this program; and

WHEREAS, the amendment made by this present amending ordinance is for the purposeof revising certain sections to be consistent with current private sewage disposal programrequirements and policies, and

WHEREAS, the present amending ordinance has been duly approved by the JacksonCounty Board of I;:Iealth.

THEREFORE, THE JACKSON COUNTY BOARD ORDAINS AND ADOPTSTHE FOLLOWING:

1. The present amending ordinance shall be incorporated into the existing Jackson CountyPrivate Sewage Disposal System Ordinance, as amended, as if originally part of the PrivateSewage Disposal System Ordinance; further

2. Section 2.7.1 shall be amended as follows (additions are underlined - deletions are struck­out):

2.7.1 There shall be a standard $100.00 $125.00 pennit fee charged for the issuance ofapennit authorizing the construction, alteration, or extension of any private sewage disposalsystem. The fee shall be collected by the Health Department at the time an application for pennitis submitted, and shall be deposited into the Health Department fund. If a pennit is denied, thefee shall be returned to the applicant. In addition, the following fee schedule shall apply for otherspecific services rendered.

FOOD SERVICE SANITATION ORDINANCE

WHEREAS, there exists a Jackson County Food Service Sanitation Ordinance, asamended, regulating and licensing certain food establishments located in Jackson County,Illinois; and

WHEREAS, commensurate with the authority of the Jackson County Board to adoptcertain ordinances regulating and licensing such establishments, from time to time, amendmentsto the existing ordinance are necessary; and '

WHEREAS, the present amending ordinance is intended to amend, and not repeal, theJackson County Food Service Sanitation Ordinance, and all its amendments; and

WHEREAS, the Jackson County Food Service Sanitation Ordinance has establishedlicense fees for food service establishments and retail food stores which need to be revised fromtime to time; and

WHEREAS, the amendments made by this present amending ordinance are for thepurpose of revising fees to cover the increasing costs of the Jackson County food safety programand to further supplement tax and grant monies also used to support this program; and

WHEREAS, the amendments made by this present amending ordinance are for thepurpose of revising the required number of inspections based on current state requirements, andestablishing new categories and fees to more proportionately distribute the cost of the food safetyprogram based on number of required inspections; and

WHEREAS, the amendments made by this present amending ordinance are to revise thesection covering waiver of fees for qualifying charitable organizations to include the license for atemporary food service establishment; and

WHEREAS, the amendments made by this present amending ordinance are to revisecertain sections to update safe temperature requirements as applied to potentially hazardous foodand to revise the section on inspection records to be consistent with current requirements andpolicies; and

WHEREAS, the present amending ordinance has been duly approved by the JacksonCounty Board of Health.

THEREFORE, THE JACKSON COUNTY BOARD ORDAINS AND ADOPTSTHE FOLLOWING:

1. The present amending ordinance shall be incorporated into the existing Jackson County Food

FOOD PROTECTION: All food, while being stored, prepared, displayed, served, orsold at food-service establishments or retail food stores, or during transportation between suchestablishments shall be protected from contamination. All perishable food shall be stored at suchtemperatures as will protect against spoilage. All potentially hazardous food shall be maintainedat safe temperatures (45-2¥ 41°F or below, or 140°F or above) except during necessary periodsof preparation and service. Raw fruits and vegetables shall be washed before use. Stuffmg,poultry, stuffed meats and poultry, and pork and pork products shall be thoroughly cooked beforebeing served. Individual portions of food once served to the customer shall not be served again;provided, that wrapped food which has not been unwrapped and which is wholesome may bereser ved served again.

Only such poisonous and toxic materials as are required to maintain sanitary conditionsand for sanitizing purposes may be used or stored in food-service establishments. Poisonous andtoxic materials shall be identified, and shall be used only in such manner and under suchconditions as will not contaminate food or constitute a hazard to employees or customers.

4. Section G. g. is amended as follows (additions are underlined - deletions are struck-out):

g. FOOD TEMPERATURE: Potentially hazardous food shall be stored and displayedat safe temperatures (WF 41°F or below, or 140°F or above, whichever is applicable).Adequate, properly constructed '01' and located mechanical refrigeration shall be provided for coldfoods and adequate, properly constructed and located heating equipment shall be provided for hotfoods.

g. FEES: The following fees shall be required for food service establishments and retailfood stores.

The annual license fee for a food service establishment shall be determined by "seating capacity"and risk category. Establishments are reviewed annually in accordance with Illinois Department

ofPublic Health guidelines to determine if they are a Category I, II, or III establishment asdefined in Section 750.10 ofthe Food Service Sanitation Code (77 Illinois Administrative Code750). These definitions may be revised time to time in the Food Service Sanitation Code, butgenerally indicate that a Category I establishment presents a high relative risk, Category IIestablishment presents a medium relative risk, and Category III establishment presents a lowrelative risk of causing foodbome illness. Category I and II establishments require additionalinspections since they present a higher relative risk of causing foodbome illness based on thelarge number of food handling operations typically implicated in foodbome outbreaks and otherfactors. The "Special High Risk" category are establishments where 3 or more additionalinspections, or more than 5 recheck inspections, were needed during the previous annual licenseperiod. The annual license fee for a retail food store shall be determined by "square footage" and riskcategory. Establishments are reviewed annually in accordance with Illinois Departmentof Public Health guidelines to determine if they are a Category I, II, or III establishment asdefined in Section 750.10 of the Food Service Sanitation Code (77 Illinois Administrative Code750). These definitions may be revised time to time in the Food Service Sanitation Code, butgenerally indicate that a Category I establishment presents a high relative risk, Category IIestablishment presents a medium relative risk, and Category III establishment presents a lowrelative risk of causing foodborne illness. Category I and II establishments require additionalinspections since they present a higher relative risk of causing foodbome illness based on thelarge number of food handling operations typically implicated in foodbome outbreaks and other

factors. The "Special High Risk" category are establishments where 3 or more additionalinspections, or more than 5 recheck inspections, were needed during the previous annual licenseperiod. The license fee for a temporary food service establishment shall be $25.00.

The annual license fee for schools, religious, voluntary, or non-profit making communityorganizations or institutions - - $25.00. However, charitable organizations may apply to theJackson County Health Department for a waiver of annual or tempormy license fees and planreview application fees. A waiver will only be granted if the organization can demonstrate aneconomic need for the waiver. All fees shall be made payable to the Jackson County HealthDepartment and shall be deposited into the Jackson County Health Department funds.

6. Section H. 2. is amended as follows (additions are underlined - deletions are struck-out):

2. INSPECTION OF FOOD-SERVICE ESTABLISHMENTS AND RETAILSTORES: At least onee every 6 months In accordance with Illinois Department of Public Healthguidelines, the Health Authority shall inspect each food-service establishment and retail foodstore located in the County of Jackson, State of Illinois, and shall make as many additionalinspections and re-inspections as are necessary for the enforcement of this ordinance.

7. Section H. 2.b. is amended as follows (additions are underlined - deletions are struck-out):

2.b. INSPECTION RECORDS: Whenever the Health Authority makes an inspectionhe shall record his findings on an inspection report form provided for this purpose, and shallfurnish the original a copy of such inspection report form to the permit holder or operator. Thecopv of the current inspection report shall be posted in a conspicuous place in the establishmentin view of the consuming public.

8. The present amending ordinance shall be inserted and incorporated into the existing JacksonCounty Food Service Sanitation Ordinance and its amendments; further

9. The present amending ordinance shall be effective on the first day of the month following itsadoption by the Jackson County Board; further

10. The Chairman of the County Board shall be authorized to sign this present ordinance.

Ordinance Number 2001- I a-.AN ORDINANCE TO ESTABLISH THE NAMES OF ALL STREETS, LANES,

ROADS OR HIGHWAYS IN THE UNINCORPORATED AREA OFJACKSON COUNTY, ILLINOIS.

WHEREAS, the Counties Code, 55 ILCS 5/5-1067 (West 2000) provides that county boardsmay name or may change the name of any street, lane, road or highway in the unincorporated areaof the county; and

WHEREAS, the County Board of Jackson County has previously approved and enactedOrdinance number 00-07, which Ordinance incorporated certain maps attached to the Ordinance.The maps named or renamed various streets, lanes, roads or highways situated in the unincorporatedarea of the county; and

WHEREAS, in conjunction with implementing and maintaining the emergency telephonesystem (911) in the county various streets, roads, lanes, and highways situated in the unincorporatedarea of the county have been named or renamed since the enactment of the previously mentionedCounty Ordinance number 00-07; and

WHEREAS, the Jackson County Board deems it to be in the best interest of the residentsof the unincorporated area that these named and renamed streets, roads, lanes, and highways beadopted as provided in this present Ordinance; and

WHEREAS, the Jackson County Board believes such naming and renaming ofthoroughfaresin the unincorporated area of the county is essential to sufficiently provide emergency services andemergency response to the residents of the unincorporated area of the county;

THEREFORE, BE IT ORDAINED BY THE COUNTY BOARD OF JACKSONCOUNTY, ILLINOIS, AS FOLLOWS:

A. Jackson County Ordinance 00-07 is hereby repealed effective upon the passage of thispresent Ordinance.

B. All streets, lanes, roads, highways and public ways in the unincorporated area of JacksonCounty, Illinois are hereby named or renamed, as shown and depicted on the attached JacksonCounty, Illinois map and road name list. Said map and road name list is incorporated herein and madea part of this ordinance as if fully set out.

e. This present Ordinance shall be effective upon the date of its adoption.

ORDINANCE 01-.13.-

AN ORDINANCE AMENDING COUNTY SITINGORDINANCE FOR POLLUTION CONTROL FACILITIES

WHEREAS, the Jackson County Board adopted a Siting Ordinance for Pollution ControlFacilities (Ordinance # 00-3) on February 9, 2000 and amended said Ordinance on August 8, 200 I(Ordinance #01-7); and If •

WHEREAS, the aforementioned ordinance and amendment established procedures to followfor the siting of all pol1ution control facilities in Jackson County, Illinois; and

WHEREAS, the County wishes to amend said ordinance to clarify and simplify procedures.

NOW, THEREFORE, BE IT ORDAINED that the Jackson County Board hereby adopts thefollowing changes as indicated to the Siting Ordinance for Pollution Control Facilities:

1) The following underlined portions shall be added to the ordinance; and the struck outportions shall be deleted:

"Section 2. Procedures

WITHIN 14 DAYS OF RECEIPT OF APPLICAnON

4. County Clerk shall notify in writing for ward the application in a general mailingto-aH affected departments or units of government of the filing of the application.The following, at a minimum, shall be notified:

a. County Highway Departmentb. All municipalities within 1.5 miles of the proposed facilityc. Township Supervisord. Fire Protection Districte:- District State General Assembly Members"

2) The present amendments shall inserted and incorporated into the existing Siting Ordinancefor Pollution Control Facilities as if originally set forth therein.

3) The changes made by this amending ordinance shall be effective upon approval and adoptionof the Jackson County Board.
