ORDINANCE NO. 2017-_____ AN ORDINANCE OF THE BOROUGH OF LANGHORNE AMENDING THE 2000 SUBDIVISION AND LAND DEVELOPMENT ORDINANCE OF LANGHORNE BOROUGH TO EXTEND THE HISTORIC OVERLAY DISTRICT AND TO REQUIRE COMPLIANCE WITH THE STANDARDS AND REGULATIONS OF THE HISTORIC ARCHITECTURAL REVIEW BOARD ORDINANCE TO ALL APPLICABLE PROPERTIES; AMENDING THE 1995 HISTORICAL ARCHITECTURAL REVIEW BOARD ORDINANCE TO REVISE PAGE A-24 TO EXTEND THE HISTORIC OVERLAY DISTRICT AND TO REQUIRE COMPLIANCE WITH THE STANDARDS AND REGULATIONS OF THE HISTORIC ARCHITECTURAL REVIEW BOARD ORDINANCE TO ALL APPLICABLE PROPERTIES; AND, AMENDING ARTICLE III, SECTIONS 302 AND 3O4 H, ARTICLE VIII, SECTION 801 J AND APPENDIX MAP 4 OF THE ZONING ORDINANCE OF 1995 TO EXTEND THE HISTORIC OVERLAY DISTRICT AND TO REQUIRE COMPLIANCE WITH THE STANDARDS AND REGULATIONS OF THE HISTORIC ARCHITECTURAL REVIEW BOARD ORDINANCE TO ALL APPLICABLE PROPERTIES. WHEREAS, Borough Council is empowered to enact, amend and repeal ordinances pursuant to the Pennsylvania Municipalities Planning Code (MPC), as amended; WHEREAS, Borough Council has enacted the Langhorne Borough Zoning Ordinance (ZO), the Langhorne Borough Subdivision and Land Development Ordinance (SALDO), and the Langhorne Borough Historic Architectural Review Board Ordinance (HARB); WHEREAS, Borough Council has determined that a community’s core represents a substantial share of its economy and hopes for a vibrant and prosperous future; WHEREAS, Borough Council has determined that supporting and enhancing the historic nature of the Borough and preserving properties of historic and historical significance is vital to the long-term viability of the Borough; WHEREAS, Borough Council has determined that a vibrant mix of commercial, business and residential uses celebrating the Borough’s place in history will enhance the social, cultural and economic well-being of the Borough; WHEREAS, Borough Council created a historic overlay district affecting the majority of the properties in the Borough and desires to extend the goals of historic preservation to all applicable properties in the Borough; and, WHEREAS, Borough Council desires to enhance the historic and cultural significance of the Borough, to regulate and support residential, commercial, business, professional and cultural uses that complement the development of a vibrant community through historic preservation; and, to promote small-scale buildings, in compact arrangement to emulate the residential character of an historic village.

WHEREAS, Borough Council is empowered to enact, amend and repeal ordinances pursuant to

NOW, THEREFORE, be it ENACTED AND ORDAINED by authority of the Langhorne Borough Council, Bucks County, Pennsylvania, the 1995 Historical Architectural Review Board Ordinance is amended and revised to expand the Historic District as set forth in the revised Historic District Overlay Map attached as an Appendix to said Ordinance.

NOW, THEREFORE, be it ENACTED AND ORDAINED by authority of the Langhorne Borough Council, Bucks County, Pennsylvania, the 2000 Sub-Division and Land Development Ordinance is amended and revised to expand the Historic District, to add the expanded Historic District Overlay to Section 200, to add a new definition for the Historic District Overlay in Section 201, to add Section 730 for compliance with the HARB Ordinance in the Historic Overlay District, to apply the Historic District Overlay requirements in Section 800, and to add the expanded Historic District Overlay Map as Appendix F as follows: ARTICLE II DEFINITIONS Section 200 (b) (17) The words “Historic Overlay District” always refer to the District formed by and

under the requirements of the 1995 Historical Architectural Review Board Ordinance, and all revisions, amendments or changes thereto.

Section 201

Historic Overlay District – Any and all historic and historical structures and properties located within the Borough shall be within the Historic Overlay District and subject to the requirements of the 1995 Historical Architectural Review Board Ordinance, and all revisions, amendments or changes thereto. ARTICLE VII DESIGN STANDARDS Section 730 Historic District Overlay (a) The District, bounded, defined and shown on the map entitled “Langhorne Borough Historic

District Overlay,” attached as Appendix “F” is hereby made part of this Ordinance. All requirements, regulations and restrictions contained in the 1995 Historical Architectural Review Board Ordinance, and all revisions, amendments or changes thereto, are incorporated by reference and apply to all applications for sub-division or land development which involve an historical or historic structure.

(b) Where a subdivision or land development is proposed for the site of any structure identified as

historical or historic, the lot lines of the proposed subdivision or land development shall be drawn so as to preserve the historic context of the building, including its outbuildings, with adequate setbacks. Borough Council may permit the alteration of lot sizes or setbacks on other proposed lots within the same development in order to allow adequate land area and setbacks to preserve the historic character of the resource, without increasing the overall permitted density on the site. Adequate land areas and setbacks represent a site sufficient to protect the real estate values of the historic resource to the extent that investment in the restoration and continued maintenance can be ensured.

ARTICLE VIII REQUIRED IMPROVEMENTS Section 800 Purpose

(c) All terms and conditions required by the 1995 Historic Architectural Review Board Ordinance shall be applicable to all properties located in the Borough. All requirements, regulations and restrictions contained in the 1995 Historical Architectural Review Board Ordinance, and all revisions, amendments or changes thereto, are incorporated by reference and apply to all applications for sub-division or land use development.

NOW, THEREFORE, be it ENACTED AND ORDAINED by authority of the Langhorne Borough Council, Bucks County, Pennsylvania, the 1995 Zoning 2000 Ordinance is amended and revised to expand the Historic District under Article III, Section 302 and 304 H, to revise Article VIII, Section 801 J and, to add the revised Historic District Overlay Map as Appendix Map 4 as follows: Sections 302 and 304 H are amended to reference Appendix Map 4 – The Historic Overlay District Map. Section 801 J is amended to read: The total parking required for non-residential uses may be reduced by twenty-five (25%) by Borough Council as a conditional use for structures in the Historic District that are designated historic or historical. The attached Appendix Map 4 - The Historic Overlay District shall replace the prior approved Map 4.

INTERPRETATION This Ordinance does not repeal, abrogate, annul or in any way impair or interfere with existing provisions of the Langhorne Borough Zoning Ordinance, the Langhorne Borough Sub-Division and Land Development Ordinance, the Langhorne Borough Historic Architectural Review Board Ordinance, the Langhorne Borough Stormwater Ordinance, the Langhorne Borough Natural Resource Protection Ordinance, and other laws or ordinances, except those specifically repealed by this Ordinance, or any private restrictions placed upon property by covenant, deed or other private Agreement. SEVERABILITY The provisions of this Ordinance are severable. If any particular section, sub-section, paragraph, clause, sentence, part or provision of this ordinance shall be held illegal, unconstitutional or invalid by a court of competent jurisdiction, such decision of the court shall not affect or impair any of the remaining sections, sub-sections, paragraphs, clauses, sentences, parts, or provisions of this ordinance. It is the intent of Borough Council that this Ordinance would have been adopted if such illegal, invalid or unconstitutional section, sub-section, paragraph, clause, sentence or part of a provision had not been included. EFFECTIVE DATE This Ordinance shall become effective in accordance with the provision of the Borough Code of the Commonwealth of Pennsylvania and the Pennsylvania Municipalities Planning Code.
