WHEREAS, unemployment and underemployment continue to be the perennial problems of the 22

country and have repercussions on the Province of Tarlac and these problems can be 23

attributed to various factors such as (1) inability of our economy to generate adequate 24

jobs; (2) labor market imperfections; and (3) lack of information about labor market 25

supply and demand; 26

WHEREAS, Section 3 of Article XIII of the 1987 Philippine Constitutions provides “the State shall 28

afford full protection to labor, local and overseas, organized and unorganized, and 29

promote full employment and equality of employment opportunities for all”, The 30

same policy is also contained in Book 1, Title 1, Chapter 2, Section 16 of the Local 31

Government Code of the Philippines and in Chapter 1, Article 3 and Book 1, Article 32

12 of the Labor Code of the Philippines; 33

WHEREAS, Section 2 of Republic Act No. 8759 otherwise known as “Public Employment 35

Service Office Act of 1999” declares that the State shall provide full employment and 36

equality of employment opportunities for all, and for this purpose, to strengthen and 37

expand the existing employment facilitation service machinery of the government 38

particularly at the local levels. 39

unemployment and underemployment in the province of Tarlac, there is a need to 48

create the PROVINCIAL TRAINING & EMPLOYMENT SERVICES OFFICES 49

(PTESO) for the purpose of intensification, continuity (and legacy) of employment 50

generation, and skills training & development program of the Provincial government. 51

Hence, producing highly competitive Tarlaqueño workforce having the “Right Skills 52

for the Right Job” that would fit in the Labor Market both domestic and foreign. 53

Furthermore, such creation of the said office will serve as “One Stop Shop” for 54

Tarlaqueños pertaining accessibility to training and employment opportunities. 55

WHEREAS, by institutionalizing the same, the Provincial government of Tarlac is making a 57

commitment in prioritizing the employment needs of our citizenry. 58

NOW THEREFORE, on joint motion, unanimously carried 60

RESOLVED, that the Sangguinang Panlalawigan of Tarlac, in regular session, assembled, hereby 62

ordains that: 63

ARTICLE I 65

TITLE AND SCOPE 66

Section 1. Title. – This Ordinance shall be known as “The Provincial Training and Employment 68

Office of Tarlac”. 69

Section 2. Scope. – This Ordinance shall be find application only within the territorial jurisdiction 71

of the Province of Tarlac. 72

Section 3. Declaration of Policy. – It is hereby the policy of the Province of Tarlac to be a 74

prosperous, peaceful and environment-conscious province with sustainable and globally 75

competitive agriculture; a major logistics, investment, and tourist destination; with well planned 76

communities that are home to healthy, productive and principled citizenry. 77

Following the roadmap of development its leaders have crafted, the provincial government 79

addresses among others the areas of employment, education, health, infrastructure, trade and 80

industry, environment, peace and order, and preservation of its cultural heritage vis-à-vis effective 81

public governance. 82

The Provincial Government advocates for the attainment of optimized human resources where 84

human dignity is foremost. Hence, this Ordinance is enacted to harness at its best the human 85

resources of the Province of Tarlac to alleviate and/or eradicate poverty in the city, by providing 86

all qualified Tarlaqueños to a decent job/work that is suited to everybody’s capabilities and self-87

worth. 88

Through the Provincial Training and Employment Service Office (PTESO), the Provincial 90

Government shall ensure the prompt, timely and efficient delivery of manpower development and 91

employment services, and provision of information relative to skills training and employment 92

opportunities. 93

ARTICLE II 95

THE PROVINCIAL TRAINING AND EMPLOYMENT SERVICES OFFICE 96

Section 1. Creation of the Provincial Training and Employment Services Office (PTESO). – 98

There is hereby created the Provincial Training and Employment Services Office (PTESO) which 99

shall be placed under the control and supervision of the Office of the Provincial Governor and 100

shall be linked with the DOLE, TESDA, POEA, and OWWA and other government agencies for 101

the purpose of coordination and technical assistance. 102

Section 2. General Objectives of the PTESO. – Specifically, the PTESO shall: 104

105

1) Provide a venue where Tarlaqueños could explore simultaneously various trainings 106

(soft trade, modular trades, and Technical-Vocational courses) and employment options 107

and actually seek assistance they prefer; 108

2) Serve as referral and information center for the various services and programs of DOLE, 109

TESDA, POEA, and OWWA and other government agencies present in the area; 110

3) Provide clients with adequate information on available trainings, employment, and 111

labor market situation in the area; 112

4) Network with other Public Employment Service Offices (PESOs) within the region on 113

employment for job exchange purposes; and 114

5) Bring training and employment services closer to Tarlaqueños by expanding reach of 115

existing programs and services. 116

Section 2. General Objectives of the PTESO. 118

1) The PTESO shall provide Labor Market Information (LMI) services. 120

For this purpose, it shall: 122

123

(a) Market and promote each services, through all forms of media, to all its labor 124

market clients; 125

(b) Regularly obtain a list of job vacancies from employers;- 126

(c) Generate and maintain an updated registry of skills; 127

(d) Gather, collate and process data or information on employment trends, 128

particularly labor supply and demand, and disseminate such data or information 129

to labor market clients; and 130

(e) Provide information on licensed or authorized recruitment agencies or 131

recruiters for local and overseas employment. 132

2) The PTESO shall provide referral and placement services for local and overseas 134

as well as private and civil service employment. In accordance with existing 135

policies, rules and regulations, it shall: 136

(a) Undertake active sourcing of vacancies - the PTESO shall encourage employers 138

to submit to the PTESO on a regular basis a list of job vacancies in their 139

respective establishments in order to facilitate the exchange of labor market 140

information between job seekers and employers by providing employment 141

information services to job seekers, both for local and overseas employment 142

and recruitment assistance to employers; 143

(b) Evaluate the qualifications of jobseekers in relation to wage employment 144

options; 145

(c) Refer jobseekers for appropriate employment assistance and monitor the result 146

of such referrals; 147

(d) Institute measures to ensure that recruitment and placement services, both for 148

local and overseas, are in accordance with existing laws, rules and regulations. 149

3) The PTESO shall provide training and vocational guidance and employment 151

counselling services. It shall: 152

(a) Conduct the following available Community Based Training (CBT) upon 154

request of a local government unit (municipal, city, or barangay): 155

wiring, electrical , air-conditioning/ refrigeration and related trades ); 189

iii. Modular trades (Reflexology, cellphone repair, candle repair, candle 191

making and other related trades), 192

(c) Conduct pre-employment counselling, including values development and 194

enhancement of work ethics, to prospective local and most especially to 195

overseas jobseekers; 196

(d) Administer and evaluate psychological tests or examinations; 197

(e) Undertake employability enhancement trainings or seminars for jobseekers as 198

well as those intending to change careers or enhance their employability; and 199

(f) Conduct orientation and training to prospective local and overseas jobseekers 200

regarding rules and regulations on anti-illegal recruitment. 201

4) The PTESO shall provide self-employment services. It shall: 203

(a) Maintain and provide updated directory of government and non-government 205

institutions with existing skills training and livelihood programs, including the 206

directory of lending institutions; 207

(b) Determine client’s potentials for entrepreneurial undertakings; 208

(c) Refer clients for appropriate self-employment or livelihood assistance and 209

monitor the results of such referrals. 210

5) The PTESO shall provide reintegration assistance services to reintegration 212

assistance services to returning overseas Filipino workers (OFWs). It shall: 213

(a) Provide a mechanism for the reintegration of OFWs; 215

(b) Determine or obtain information on returning OFWs and provide periodic 216

information of job opportunities; 217

(c) Undertake other appropriate programs to promote the welfare of OFWs and 218

assist in gathering or tapping the skills and potentials of the returning OFWs; 219

and 220

(d) Facilitation of referral of OFWs to the Overseas Worker’s Welfare 221

Administration (OWWA). 222

6) The PTESO shall monitor performances of the City/Municipal PESOs, SUC-224

PESOs, and Barangay Training and Employment Coordinators (BTECs) leaders 225

for the purpose to address issues and concerns including updates related to 226

program implementation. Likewise, the PTESO shall provide the necessary 227

assistance in the conduct of the regular meetings of the BTECs which is facilitated by 228

the city/municipal Public Employment Service Offices (PESOs). Further, field 229

visitations and regular coordination with Local Chief Executives form part of the 230

technical supervision and administration of the PTESO. 231

7) The PTESO shall likewise perform other functions analogous to the above 233

including programs or activities which is offered by TESDA pertaining Skills 234

Training and Manpower development, and programs or activities developed by 235

the DOLE to enhance provision of employment assistance to clients, particularly 236

for special groups of disadvantaged workers such as persons with disabilities 237

(PWDs) and displaced workers. 238

8) The PTESO shall perform such other tasks related to its functions and to 240

undertake pertinent assignment and duties as may be assigned and/or requested 241

by the Provincial Governor. 242

9) In addition to the foregoing, the PTESO shall undertake the following programs 244

and activities: 245

246

(a) Job Fair – This is being conducted periodically in the Province to bring together 247

in one venue the job seekers and employers for immediate matching. This 248

employment facilitation strategy is aimed to fast-track the meeting of job seekers 249

and employers in one venue at a specific date to reduce cost, time and effort on the 250

part of the job seekers; 251

(b) Special Credit Assistance for Placed Overseas Workers – this type of assistance 253

will enable poor but qualified applicants to avail of opportunities for overseas 254

employment; 255

(c) Special Program for the Employment of Students and Out-of-School Youth 257

(SPESOS) – This program provides employment to deserving students and out-of-258

school-youth coming from poor families during summer and/or Christmas 259

vacations as provided for under Republic Act No. 7323 and amended under 260

Republic Act No. 9547, to enable them to pursue their education by facilitating the 261

employment of secondary level students, this is being implemented throughout the 262

year especially during summer and/or Christmas vacations and of tertiary, 263

vocational, and technical level students any time of the year. Under the program, 264

60 percent of the salaries and wages of the program beneficiaries will come from 265

the LGU while 40 percent from the DOLE; 266

(d) Work Appreciation Program (WAP) – This program aims to develop the values 268

of work appreciation and ethics by exposing the young to actual work situations; 269

(e) Livelihood and Self-Employment Bazaars – These will give clients information 271

on the wide array of livelihood programs they can choose to avail of by referring 272

them to the Provincial Cooperative and Enterprise Development Office (PCEDO) 273

and in coordination with other government and non-government institutions 274

undertaking livelihood and self-employment programs; 275

(f) Vocational and Career Guidance Program – This is being done through 277

coordination with various high schools in the city and with the Department of 278

Education (DEPED-Tarlac) in the conduct of vocational guidance sessions 279

designed to answer future demands from both local and foreign labor markets; 280

(g) Government Internship Program – This is a program of the Department of the 282

Interior and Local Governance (DILG) where the youth is given the opportunity to 283

be trained and exposed to government administration. A component of the 284

Kabataan 2000 Program, now known as the “Sikap Kabataang Pinoy Program,” as 285

provided for by Executive Order No. 1395. Under this program, the participating 286

government agency shall provide the participants with stipend of not more than 75 287

percent of the prevailing minimum wage; 288

(h) Workers Hiring for Infrastructure Projects (WHIP) – This program is in 290

pursuance of Republic Act No. 6685 which requires construction companies in the 291

province including contractors for government-funded infrastructure projects to 292

hire thirty-percent (30%) of skilled and fifty-percent (50%) unskilled labor 293

requirements from the areas where the project is constructed or located; 294

(i) Tulong Alalay sa Taong May Kapansanan (TULAY) – This program aims to 296

assist in the integration of persons with disabilities in society by providing them 297

access to training and employment opportunities both in the formal and informal 298

sectors; 299

(j) Emergency Employment - This designed to provide temporary employment for 301

out-of-school and out-of-work youth and disadvantage workers affected by 302

calamities. The program beneficiaries will be engaged in short-term community 303

works projects. 304

(k) Discovering the World of Work (D-WOW) – It aims to influence the career 306

decisions of graduating high school students by exposing them to actual work 307

situations through field trips or educational tours especially to establishments that 308

belong to the country’s Key Employment Generators (KEG) as identified by the 309

DOLE for the next ten years; 310

(l) Labor Education for Graduating Students (LEGS) – Graduating students of 312

vocational and baccalaureate course are given orientation on labor and employment 313

matters though the LEGS. The Program will help graduating students become 314

familiar with employment facilitation services of the PESO, workers protection and 315

security coverage for employees; 316

(m) Anti-Illegal Recruitment Program – This program is in support of the national 318

government’s campaign against illegal recruitment at the grassroots level by 319

providing relevant and helpful information to all Filipinos planning to migrate and 320

work abroad; 321

(n) Child-Labor Program – This program is in support of the government effort to 323

eliminate in the city all forms of child labor in compliance with R.A. 9231 ( An Act 324

providing for the elimination of the worst forms of Child Labor and affording 325

stronger protection for the Working Child, amending for this purpose Republic Act 326

No. 7610, as amended, otherwise known as the Special Protection of Children 327

against Child Abuse, Exploitation and Discrimination Act); 328

(o) Pwede Pa kami Program (PPKP) - This is an employment assistance program 330

being extended by the PTESO to its clients with age ranging from fourty (40) years 331

old and above. 332

(p) Mobile Passport Service – This is in coordination with the Department of Foreign 334

Affairs in order to facilitate processing of passport applications and renewal of 335

Tarlaquenos. 336

(q) Mobile PRC Renewal – This is another endeavor geared toward employment 338

which caters to the needs of the professionals. This is in coordination with the 339

Professional Regulation Commission (PRC) in order to facilitate the renewal of 340

professional licenses. 341

(r) Other programs and activities designed to enhance the provision of employment 343

assistance to PTESO’s clients including Persons with Disabilities (PWDs), 344

displaced workers and working from the disadvantage sectors. 345

Section 3. Organizational Structure of PTESO. – In order to effectively perform the 347

abovementioned powers and functions, the PTESO shall be divided into two (3) main sections and 348

shall be headed by the Provincial Training and Employment Services Officer (PTESO 349

Manager); 350

1) Records and Administrative Section 352

(a) Assist the PTESO Manager and Section Heads in the performance of their 354 respective functions; 355

(b) Encode and tabulate Labor Market Information (LMI) Report and Registry 356

of Skills. 357

(c) Sorting and encoding of applicants’ resume to the online job matching 358

facility of DOLE (Phil-Job.Net) 359

(d) Perform clerical functions - Creates purchase request, purchase order, 360 disbursement vouchers, inspection and acceptance report, certifications, 361

reimbursements and follow up and keep track of the process of our 362 documents. 363

(e) Perform other functions assigned by the PTESO Manager relative to the 364

foregoing. 365

2) Manpower Development Section 367

(a) Facilitates and releases applicants' exam 369

(b) Scheduling, Monitoring, Profiling of training activities in different 370

Barangay. 371

(c) Coordination between Barangay Officials, Municipalities and other 372

institutions. 373

(d) Prepare, encode profiles of trainees for community based training and 374

livelihood program. 375

(e) Deliver and transfer of consumable materials and machines 376

(f) Prepares purchase request, disbursement vouchers, reimbursement, gas 377

slip and create, process payrolls honorarium, allowance, voucher 378

reimbursement. 379

3) Labor and Employment Section 382

(a) Local Employment 384

i. In charge of domestic placement, career orientation, livelihood, 385

domestic job fairs, schools and recruitment and placement; 386 ii. Maintains recruitment calendar of activities, meetings, presentations 387

and various events; 388 iii. Coordinates activities with recruiters, other private companies and 389

government agencies on available job openings and vacancies for 390

local employment; 391 iv. Manage communications dealing with queries from applicants, 392

companies and recruitment partners in a professional and timely 393 manner; and 394

v. Perform other ad hoc duties as required or as assigned by the PTESO 395 Manager. 396

(b) Overseas Employment 398

i. In charge of Registration of applicants for overseas employment, 399

including screening for job matching and Pre-orientation of 400

applicants. 401

ii. In charge of migrant workers, migrant worker’s reintegration, 402

organization of OFW families and job fairs for overseas 403

employment; 404

iii. Serve as the focal of the Persons pertaining to the concerns and 405

issues of OFWs; 406

iv. Coordinate with Overseas Workers Welfare Administration 407

(OWWA) and other national agencies on programs intended to 408

benefit the OFWs and their families; 409

v. Keep and maintain record of OFWs from the Province of Tarlac and 410

indicating therein their specific address where they are destined; and 411

vi. Perform other duties assigned by the PTESO Manager relative to 412

their function 413

Section 4. Duties and Functions of the PTESO Manager. – The PTESO Manager shall be vested 415

with the power to recommend to the Provincial Governor for appointment the members of the 416

staff, as the exigencies of the Office so require; provided, however, the recommendees to the 417

positions meet at least the minimum requirements of the positions. 418

The primary essence of work of the PTESO Manager is to manage all technical and administrative 420

activities. 421

1) Staff Management 423

(a) Detail staff responsibilities and guide and coach staff when needed. 424

(b) Identify training needs and arrange staff training as necessary (i.e. in-425

relevant briefing sessions or method appropriate to circumstances and 441

attend supervisory meetings when called. 442

(a) Develop action plans, proposals and other documents needed in the 445

implementation of programs and services. 446

5) Conducting Daily Activities 448

(a) Maintain a systematic process flow to ensure the effective and efficient 449

running of the office and to avoid complaints from the clients. 450

(b) If required to do so in “emergency situations” (i.e. situations where 451

extreme staff shortages arise) undertake duties assigned to staff to cover 452

his/her absences and avoid delay of transaction. 453

6) Monitoring PTESO Activities 455

(a) Ensure, by regular checking, that the quality of the service is consistent to 456

the desired standard. 457

(b) As appropriate conduct a reviews of the daily procedures being 458

implemented in order to update and trim down unnecessary processes and 459

carry out remedial action. 460

7) Improvement and Problem Solution 462

(a) Satisfactorily resolve internal or external matters relating to the operation 463

(i.e. operational or staff) referring more complex issues to the PTESO 464

Manager for advice or guidance (includes operational issues coming from 465

previous or subsequent PESO units). If any matter cannot be resolved at 466

this level it should be passed on to the DOLE Provincial Officer. 467

(b) Ensure implementation of improvement initiatives, maintaining 468

appropriate records and working with staff on continual improvement of 469

processes and reduction of waste. 470

8) Furthermore, the PTESO Manager shall coordinate closely with the Department of 472

Labor and Employment (DOLE), Technical Education and Skills Development 473

Authority (TESDA), Philippine Overseas Employment Administration (POEA), 474

Overseas Workers’ Welfare Administration (OWWA), Department of Trade and 475

Industry (DTI), Commission on Higher Education (CHED), Department of 476

Education (DepEd), State Universities and Colleges (SUCs) and establish linkages 477

with various line offices in the Provincial Government of Tarlac, Non-Government 478

Organizations (NGOs), and other agencies offering manpower development /skills 479

training and labor & employment services, both local, national, and international 480

in the attainment of the PTESO vision, mission, goals and objectives. 481

Section 1. Budget Requirement. – The Local Chief Executive is hereby authorized to prepare the 522

executive budget for the salaries of its personnel, its plans programs and activities for the next 523

supplemental budget, the 2016 annual budget and every annual budget thereafter. 524

FINAL PROVISIONS 527

Section 1. Repealing Clause. – Local Ordinances, Resolutions, Orders, Rules and Regulations 529

and other issuances of the Provincial Government of Tarlac that are inconsistent with this 530

Ordinance are hereby repealed, amended, and modified accordingly. 531

Section 2. Separability Provision. – If for any reasons, any section of this Ordinance, or any 533

portion hereof or the application of such section or provision, or portion hereof to any person, 534

group, or circumstance is declared invalid or unconstitutional, the remainder shall be in full force 535

and effect. 536

Section 3. Effectivity. – This Ordinance shall take effect 15 days after its approval. 538
