Road Works (Specified Road Works) (Jersey) Order 2018.

This Order specifies types of road works which are “specified road works” (Article 1). Article 11 of the

Road Works and Events (Jersey) Law 2016 prohibits specified road works from being undertaken without

a permit. The activities include such things as crane operations and using scaffolding but in each case the

activity must be carried out in a road. Certain activities are “specified road works” only if they require

some form of traffic control as specified in the Order (for example temporary traffic lights, road narrowing

or closure of a footway). Road works carried out by a highway authority or utility undertaker are excluded.

Article 2 provides for the Order to come into force on the day after the day it is made.

The Order was made on 19th March 2018 and came into force on 20th March 2018.

EU Legislation (Sanctions – North Korea) (Amendment No. 2) (Jersey) Order 2018.

This Order amends the EU Legislation (Sanctions – North Korea) (Jersey) Order 2017 to give effect in

Jersey to Council Regulation (EU) 2018/285 of 26 February 2018 (OJ L 55, 27.2.2018, p.1) amending

Council Regulation (EU) 2017/1509 concerning restrictive measures against the Democratic People’s

Republic of Korea.

Article 1 amends the definition of Regulation (EU) 2017/1509 to include all amendments to that Regulation

up to 28th February 2018.

Article 2 amends the list of prohibitions whose contravention carries criminal penalties, to cover the 5 new

prohibitions inserted into Regulation (EU) 2017/1509. These include prohibitions on the import (or

purchase or transfer) of certain agricultural products, machinery, types of earth, wood, ships and other

items, as well as the export (or sale, supply or transfer) of certain machinery, vehicles and metals, as listed

in new Annexes XIg to XIl to that Regulation.

Article 3 names the Order and brings it into force on the day after it is made.

The Order was made on 23rd March 2018 and came into force on 24th March 2018.

EU Legislation (Sanctions – Central African Republic) (Amendment No. 4) (Jersey) Order 2018.

This Order further amends the EU Legislation (Sanctions – Central African Republic) (Jersey) Order 2014,

to give effect to Council Regulation (EU) 2018/387 (OJ L 69/9, 13.3.2018; the “implementing Regulation”)

amending Regulation (EU) No. 224/2014 concerning restrictive measures in view of the situation in the

Central African Republic.

The main effect of the implementing Regulation (in force on 14th March 2018) is to make changes, in line

with United Nations Security Council Resolution 2399 (2018), which amended the exemptions to the arms

embargo and the designation criteria for the asset freeze of certain persons engaging in, or providing

support for, acts that undermine the peace, stability or security of the Central African Republic.

The Order was made on 23rd March 2018 and came into force on 24th March 2018.

Road Traffic (Public Parking Places – Charges) (Amendment No. 2) (Jersey) Order 2018.

This Order further amends the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2017 (the

“principal Order” as defined in Article 1) to lower to 50 grams per kilometre the maximum carbon dioxide

emission level for qualification for half-price parking in public car parks of an electric vehicle or a plug in

hybrid electric vehicle (as defined in Article 1 of the principal Order).

This Order also amends the principal Order to increase the charges for parking in public parking places by

approximately 5%. The charges for parking in public parking places were last increased on

1st February 2017.

The principal Order is further amended to provide that where an electric vehicle or plug in hybrid vehicle

is first registered in Jersey after 31st January 2018 by an individual who is not the holder of a trade licence

issued under Article 8 of the Motor Vehicle Registration (Jersey) Law 1993, no charge is payable for

parking in public parking spaces for the period of 12 months beginning immediately after the date the

vehicle was first registered in Jersey.

The Order was made on 26th March 2018 and came into force on 2nd April 2018.

Motor Traffic (Taxi-Cabs – General) (Amendment No. 2) (Jersey) Order 2018.

This Order further amends the Motor Traffic (Taxi-Cabs – General) (Jersey) Order 2002 (the

“2002 Order”), to impose (by Articles 3 and 4) requirements for every taxi and private-hire cab to be fitted

with a properly operating device for the payment of fares and charges by electronic means, and to carry a

notice indicating that such a payment facility is available. Article 2 adds a new definition “electronic

payment device” to Article 1 of the 2002 Order, and by Article 5 breach of either of the new requirements

is added to the offences in Article 11 of the 2002 Order.

Article 6 gives the title by which this Order may be cited and provides for it to come into force 7 days after

it is made.

The Order was made on 28th March 2018 and came into force on 4th April 2018.

Road Traffic (Public Parking Places) (Amendment No. 13) (Jersey) Order 2018.

This Order amends the Road Traffic (Public Parking Places) (Jersey) Order 2006 (“principal Order”, see

Article 1).

Article 2 changes the name of a car park at the St. Brelade Parish Hall.

Article 3 changes the maximum parking period in the Martello Tower Car Park, at Grève de Lecq in

St. Ouen, from a continuous period of 7 days to a total period of 12 hours in any continuous period of

24 hours.

Article 4 sets out the title of the Order and provides that the Order will come into force 7 days after being

made.

The Order was made on 28th March 2018 and came into force on 4th April 2018.

Road Traffic (Speed Limits) (Amendment No. 10) (Jersey) Order 2018.

This Order amends the Schedules to the Road Traffic (Speed Limits) (Jersey) Order 2003 (“2003 Order”).

Article 1 is an interpretation provision.

By Article 2, Schedule 1 to the 2003 Order is amended to replace the lists of roads in the parishes of

St. Brelade and St. John that are subject to a 30 mph speed limit; to reduce the 30 mph speed limit to

20 mph in part of La Grande Route de St. Laurent in the parish of St. Lawrence; to reduce the 30 mph

speed limit to 15 mph in part of La Rue de La Blinerie in the parish of St. Clement so that it applies to the

whole of that road; and extend the 30 mph limit on La Rue des Sapins in the parish of St. Peter so that is

applies to the whole of that road.

By Article 3, Schedule 2 to the 2003 Order is amended to replace the lists of roads in the parish of

St. Brelade that are subject to a 20 mph speed limit and introduce a speed limit of 20 mph on La Grande

Route de St. Laurent (from La Rue du Vard to Rue de Bas) in the parish of St. Lawrence.

By Article 4, Schedule 3 to the 2003 Order is amended to replace the lists of roads in the parish of

St. Brelade that are subject to a 15 mph speed limit and extend the 15 mph limit on La Rue de la Blinerie

in the parish of St. Clement.

Article 5 gives the title of this Order and provides for it to come into force 7 days after it is made.

The Order was made on 28th March 2018 and came into force on 4th April 2018.

Petty Debts Court Rules 2018.

These Rules replace the Petty Debts Court Rules 2004.

The new Rules coincide with the increase to £30,000 approved by the States in the monetary jurisdiction

of the Petty Debts Court as from 9th April 2018. They set out the procedures and practice before the Court,

including new procedures for bringing small claims (not exceeding £5,000) and new provisions as to orders

for costs in connection with civil proceedings. They also enable various matters to be dealt with by practice

directions issued by the Magistrate with the agreement of the Bailiff.

The new Rules were made by the Superior Number of the Royal Court on 29th March 2018 and came into

force on 9th April 2018.

Royal Court (Amendment No. 22) Rules 2018.

These Rules amend provisions in the Royal Court Rules 2004 (“the 2004 Rules”) for the registration of

acknowledgements of debt so as to create a hypothec (i.e. the Jersey equivalent of a mortgage). The need

for the amendment arises from changes to the Loi (1880) sur la propriété foncière recently adopted by the

States, which have facilitated the use of shared equity schemes.

The amendment of the 2004 Rules enables the form of acknowledgements of debt to be set out in practice

directions instead of being set out in a Schedule to the 2004 Rules.

The amending Rules were made by the Superior Number of the Royal Court on 29th March 2018 and came

into force on 5th April 2018.
