Shri Kuldip Singh Ji,

Chairman,

Delimitation Commission,

Nirvachan Bhawan,

Govt. of India, New Delhi.

In connection with partial modification in election member no. 182 of Rajasthan

Legislative Assembly 23-Bhilwara Parliamentary Constituency.

Sir,

The patwar circles Mansha, Gankali and Jawal of Revenue Inspector Circle

Nandrai; situated in Bhilwada district and are in Jahajpur and Mandalgarh

constituencies of Rajasthan Legislative Assembly are near and close to Jahajpur.

These are included in Mandalgarh assembly constituency in the proposed delimitation

draft, which should remain in Jahajpur itself because of the geographical proximity

contrary of this, if these are included in Mandalgarh assembly constituency; it will not be

suitable for public, public representatives and by looking at the map. Mansha and Haguli

were already in Jahajpur assembly constituency from the point of view, distance, means

of communication and administrative facility and Jawal Assembly constituency was in

Page 18: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

Shahpura. Now that Shahpura Bande, Tehsil has become an assembly constituency

together then it will be appropriate to include Jawal in Jahajpur.

Sawaipur, Banka Khera and Badla Patwar Circle were already in Badliyas

Revenue Inspector Circle because of the geographical location of Kothari River and

administrative facility. These are rather very close to manbalgarh, in sfead of Jahajpur

because of Kothari River, Communication facility with villages and administrative facility.

By looking at the map, it proves its authenticity that these three Patwar Circle should be

included in Mandalpur instead of Jahajpur Assembly constituency, which will be in the

interest of the people and of the state. Because of some discrepancy in the Revenue

Inspector circle District collector and Revenue division sent amendment proposal to the

state government, but due to the restriction of the Delimitation Commission, decisions

were not taken. According to the names, based upon the grouth of population in the

eastern regions by including adjoining areas, and not distancing earlier included aeas

according to the names it will not be appropriate. So in the present proposal, my above

ancluded proposal are objection considered as my and dissent note Manse Patwar

circle, gahuli and Jawal Nandrai Revenue Inspector circle should be reparated from

Jahajpur Assembly Constituency and be included became of geographical compactness

and I present my opinion and recommendation that due to the closeness and transport

inconvenience of Kottari river, the Patwar circles of Revenue Inspector Circle of

Sawaipur, Banka Kheda Badla should be reparated rom Jahajpur Assembly

Constituency and included to Mandalgarh area.

(I have my consent in publishing this objection)

Respected Chief Election Commissioner,

Govt. of India

New Delhi.

Subject:- Regarding redelimitation of Sarlarpura Legislative assembly situated in

Jodhpur district of the State of Rajasthan.

Sir,

On the subject stated above it is requested that three legislative assembly

constituencies come under Jodhpur City in Jodhpur district of the State of Rajasthan.

Naming ‘Jodhopu City,’ ‘Sursagar’ and ‘Sardarpura’. In the Draft working Paper sent

recently by the Delimitation Commission. It is seen that Jodhpur ward No. 60 has been

deloted from Saldarpura Assembly area. Neither Congress nor BJP proposed to delete

the ward and nor it is geographically practical to delete this area from Sardarpura.

As per the population viewpoint if ward No. 60 is included in Sursagar then the

population of Sursagar becomes 313172 and the population of Sardarpura remaining

only 268649 that seems quite impractical. Therefore ward No. 60 should be in

Sardarpura legislative assembly area by deleting from Sursagar legislative area so that

as per the Original proposal of the Commission the population of Sardarpur becomes

285356 and of Sursagar becomes 296465 that seems legitimate and logical.

This objection of have should be published along with the Draft working paper.

Note of Dissent for Lok Sabha Constituencies of 6-Jaipur Rural, 8-Alwar and 11-Dausa

Under Section 9 (2) (a) of Delimitation Act 2002 Sir, Associate Members of INC want to divert your kind attention towards the blunder done by Commission in draft working paper released on 8th July, 2005 regarding three parliamentary constituencies named as 6-Jaipur Rural, 8-Alwar and 11-Dausa. The proposed Delimitation of above Lok Sabha Constituencies is not according the provision section 9 (1) (a) of Delimitation Act and your Guideline. The change of Assembly segments between above three Lok Sabha Constituencies is neither logical nor fair because of the following reasons :-

Lok Sabha Constituency 6-Jaipur Rural 1. Delimitation Commission has deleted AC-64-Thanagaji and AC-63-Bansur from Lok

Sabha constituency 6-Jaipur Rural and included AC-48-Jamwaramgarh (SC) and 58-Chaksu (SC).

AC-58-Chaksu has no connectivity with any assembly segments of 6-Jaipur Rural. This will be an island for other seven segments of Lok Sabha constituency 6-Jaipur Rural.

2. AC-64-Thanagaji and AC-63-Bansur can not be separated because they are constituted and formed with common Tehsils and RICs of Alwar District.

Lok Sabha Constituency 8-Alwar

1. Delimitation Commission has changed the compositions of Lok Sabha Constituency 8- Alwar by deleting AC-59-Rajgarh (ST) and included AC-63-Bansur. It is against the provisions and guideline of Delimitation Act. 2. Rajgarh was been the Capital of the erstwhile Alwar State. The first King of the Alwar

Dynasty Maharao Pratap Singh founded Rajgarh in 1764 AD and built palaces and Dams in this area. This is also native place of Famous Freedom Fighter Pt. Bhawani Sahay Sharma, who was the right hand of Chandra Shekhar Azad. Since 1950. AC-Rajgarh was and is part of Alwar Lok Sabha Constituency. It is adjacent to Alwar District Headquarter and socially, geographically, historically a part of Alwar. Therefore we request you to keep AC-Rajgarh in Lok Sabha Constituency Alwar

3. Thanagaji and Bansur Assembly segments are geographically adjacent and well integrated so they should be kept together.

Page 21: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

Lok Sabha Constituency 11-Dausa

1. Delimitation Commission has changed the compositions of Lok Sabha Constituency 11-Dausa by deliting AC-Chaksu (SC) & AC-Jamwaramgarh (ST). Commission has included AC-Thanagaji & AC-Rajgarh (ST) in this parliament constituencies. It is against the provisions and guideline of Delimitation Act, because geographically and administratively AC-Thanagaji & AC-Rajgarh do not give compactness. The % of ST in previously proposed Lok Sabha constituency Dausa was 26.27%. If Commission wants to increase the % of ST in this Lok Sabha Constituecny than AC-Jamwaramgarh can also be included but AC-Chaksu which is not having any connectivity with Lok Sabha Constituency 6-Jaipur Rural can only be included in LS 11-Dausa.

In effect therefore Chaksu should be a part of Parliamentary Constituency Dausa

and Rajgarh to the remain PC Alwar.

Note of Dissent for Assembly Constituencies of Bikaner District Under Section 9(2)(a) of Delimitation Act 2002

Sir Some inadvestant omissions occurred with regard to few wards in 13-Bikaner West and 14-Bikaner East assembly constituencies of Bikaner District have been

Page 22: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

corrected by Draft Working paper of the commission wide letter no. 282/RJ/2005, dated

8th July, 2005. But still the proposed delimitation of AC Bikaner West, AC Bikaner East,

AC Nokha & AC Kolayat has not been done according to the provisions of section 9 (1)

(a). We the Associates Members of INC & BJP got Consensus on Amendment

proposals of AC 13-Bikaner West & 14-Bikaner East and submitted them in the last

meeting of Commission held on 10th June, 2005 at New Delhi as under :-

1. The Wards of old Bikaner City are complicatedly constituted. So many houses of

Old City are having common wall put they have been split in different Wards. To

remove this error Ward No. 3, 4, 5, 6, 18, 19 & 20 may kindly be included in AC

21-Bikaner East and Ward No. 13, 28, 43, 51, 52, 54 & 55 may kindly be deleted.

In same manner Ward No. 13, 28, 43, 51, 52, 54 & 55 may kindly included in AC

20-Bikaner West & Ward No. 3, 4, 5, 6, 18, 19, & 20 may kindly be deleted

2. The division of above ACs proposed by our amendment proposal is also based

on Railway line situated between them.

The Commission has partly accepted our suggestion by shifting Ward No. 54, 55 in AC-Bikaner West and Ward No. 5, 6 & 20 in AC-Bikaner East. The delimitation commission has Suomotto added Ward No. 35 in AC-Bikaner West and Ward No. 22 in AC-Bikaner East. It was not demanded by INC and BJP.

Therefore we request you kindly include Ward No. 13, 28, 43, 51 & 52

in AC-Bikaner West and delete them from AC-Bikaner East. In same manner kindly also include Ward No. 3, 4, 18 & 19 in AC Bikaner East and delete them from AC-Bikaner West.

Kindly also delete RIC Panchu from AC-Nokha & it should be

included in AC-Kolayat, to remove the error of deviation of % in above Acs.

Subject :- Note of Dissent Under Section 9 (2) (a) of Delimitation Act. Regarding Assembly Constituencies of District Churu, Rajasthan.

Sir,

INC Associate Members submitted their amendment proposals in the meeting

held on 10th June, 2005 as under :-

Tehsil Sardarshahar is having 304373 population. It should not be split

Delimitation of this District should be started from AC-Sardarshahar, which is the north

of District Churu. After completion of this Assembly Constituency AC-Taranagar which

is situated in North-East should be constituted & then AC-Sadulpur, AC-Churu, AC-

Ratangarh & AC-Sujangarh should be formed. AC-Sujangarh is situated in the South of

District Churu. The description of proposed amendments was as under in detail :-

& Chhapar Municipal Board. Total Population – 297761

In the meeting of commission held on 10th June, 2005 it was agreed by Hon’ble Commission that Tehsil Sardarshahar will be kept intact and the process of delimitation in Churu District will be started from Tehsil Sardarshahar which is the top North of this District according to revenue record. But the above agreed facts are not followed in the draft working proposal released on 8th July, 2005. The draft working proposal has also ignored the Law & Rules regarding deviation of % in Churu by keeping +10.31 % of deviation in AC-21-Sardarshahar. A revised working paper released by the Commission in the month of May have been also ignored without any reason.

Therefore we request you kindly accept our above amendment proposal and keep intact Tehsil Sardarshahar which is the top north of Churu District. It also provides better geographical compactness, road connectivity and administrative units in comparison to your draft proposal. Note of Dissent for Assembly Constituencies of Jaipur District Under Section 9(2)(a) of Delimitation Act 2002

Sir Associates Members of INC has submitted following amendments before

Commission on 10th June, 2005 regarding three Rural Assembly Constituencies of

District Jaipur and five Urban Constituencies of Jaipur City.

Small amendment proposal in AC-Phulera, AC-Dudu & AC-Jhotwara 1. Due to Sambhar Lake there is no road connectivity of PC Korsinha, PC

Habaspura, PC Dobari & PC Chapari of RIC Narayana & PC Shama ki Dani of

Page 26: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

RIC sambhar with AC-44 Phulera. Almost 8 months in the year these PCs are

full of mud. To reach in Villages of above PCs you have to come from AC-45

Dudu. The above PCs are very well connected with AC-45 Dudu. Therefore it is

requested to include about PCs in AC-45 Dudu. It will also remove the error of %

of deviation in AC-45-Dudu.

2. PC Bhojpurkalan, PC Murlipura of RIC Jobner & PC Shama ki Dani of RIC

Karansar can be included in AC-44 Phulera & deleted from AC-46 Jhotwara. It

will also equalize the % of deviation.

3. The present Phulera AC is physically like a DUMBELL. The above amendment

proposal will also correct the physical features of AC-Phulera and it will also give

geographical compactness. It will also provide connectivity and means of

communication.

Single Ward exchange in five ACs of Jaipur City 1. Hon’ble Commission has proposed seven assembly segments in Jiapur Nagar

Nigam area. But these seven constituencies are not constituted according to the

guideline & rules of the delimitation commission. The main road of the city are

the base of dividing wards of Nagar Nigam, but the proposed constituencies of

Jaipur City are not formed accordingly. Few constituencies are unnecessarily

constituted very lengthy and they are not geographically compact. Specially AC-

Civil Lines is constituted very defectively and lengthy. It starts from Top South of

jaipur City and it ends at Top North of City, which is the Nargarh Hill. We are

suggesting a small amendment proposal of five assembly constituencies named

as AC-Civil Line, AC-Malviya Nagar, AC-Adarsh Nagar, AC-Kishanpole & AC-

Hawamahal in which inter exchange of a single ward has been suggested. It will

give physical compactness, better physical features, administrative unity & easy

road connectivity. The exchange of Ward are as under :-

AC Civil Line : Include Ward 16, Delite Ward 66

AC Hawamahal : Include Ward 66, Deliete Ward 64

AC Kishanpole : Include Ward 64, Delete Ward 50

AC Adarshnagar : Include Ward 50, Delete Ward 34

AC Malviya Nagar : Include Ward 34, Delete Ward 16

Note of Dissent for Assembly Constituencies of Bharatpur District Under Section 9(2)(a) of Delimitation Act 2002 Sir Associates Members of INC had submitted following amendment proposal before

Commission on 10th June, 2005 regarding four Rural Assembly Constituencies of

District Bharatpur.

1. District Bharatpur is one of the example which is having three different cultural

areas within the region. Kama & Nagar Tehsils are having Mave Culture & Brij

Culture. Whereas Tehsil Weir & Tehsil bayana are also having two different

Page 28: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

cultures. We are suggesting exchange of single RICs in AC-75-Weir V/s AC-76-

Bayana & AC-70-Kaman V/s AC-71-Nagar. This amendment proposal is also

submitted looking to the geographical & physical compactness, connectivity,

administrative units and means of communication.

2. RIC Farso should be deleted from 75-Weir & included in 76-Bayana. RIC

Samodar should be deleted from 76-Bayana and it should be included in 75-

Weir. This small exchange of RIC will give physical & geographical compactness

to both Assembly constituencies.

3. RIC Raf is part of Panchayat Samiti Nagar. This RIC is adjourning with AC-

Nagar. Whereas RIC Pasta is situated very far from AC-Nagar and to reach RIC

Pasta you have to cross another Assembly constituency. It means it don’t have

direct connectivity. Hence we propose that RIC Ranf & RIC Pasda should inter

change between AC-Nagar & AC-Kaman.

The Associate Members of BJP also supported our above amendment proposals

in that meeting and they also agreed by submitting their written proposals. Your good

self also fully convinced with above amendment proposal and you have given

assurance to all the associate members that this will be considered. Even than

commission has not incorporated above amendments in draft proposal released on 8th

July, 2005. The proposals of draft working paper released on 8th July, 2005 regarding

AC-Kaman, AC-Nagar, AC-Weir and AC-Bayana are not according to the guideline and

section 9 (1) (a) of delimitation act. Therefore the above amendment proposals

Associates Members of INC had submitted following amendment proposal before

Commission on 10th June, 2005 regarding two Rural Assembly Constituencies of District

Dholpur as under.

1. The present % of deviation of population in Bari & Baseri is +7.34% and –6.57%

respectively. In order to maintain the deference of % of deviation in AC-77-

Baseri (SC) and AC-78-Bari the PC Ibrahimpur, PC Bhimari, PC Sikarra & PC

Kuhawani of RIC Bari should be included in newly constituted AC-Baseri and

deleted from AC_Bari. All of above PCs are adjoining and adjacent with Tehsil

Baseri and is geographically compact. They are part of same panchayat samiti

and therefore, will be administratively suited to the people of the area.

2. AC-77Baseri (SC) can be connected with National Highway easily by including

four Patwar Circles of one RIC from AC-78-Bari. This small amendment will also

provide road connectivity to both Acs- (AC-Bari & AC-Baseri)

Note of Dissent for Assembly Constituencies of Tonk District Under Section 9(2)(a) of Delimitation Act 2002

Sir

We have received your draft proposal dated 8th July, 2005. We have found that

Commission has deleted RIC Nasirda of Tehsil Devali from AC-Devali on the ground

that many villages of RIC Nasirda are covered under Bisalpur Water Project. We

strongly protest that Commission has arbitrarily shifted RIC Mor of Tehsil Todaraisingh

in Tonk. Associate Members of INC and BJP never suggested for this change.

Geographically and Administratively RIC Mor should remain with AC-94-Malpura, as it

was previously proposed by Commission in their Working Paper. The local citizens of

Malpura have raised their protest regarding inclusion of RIC Nasirda in AC-Malpura.

According to them the road connectivity from AC-Malpura with RIC nasirda is only

possible through entering AC-Kekri which is the segment of neighbour district Ajmer.

2. We also request you kindly change of the name 97-Devali as UNIARA-DEVALI.

Note of dissent for Loksabha Constituency – Sawaimadhopur-Tonk

In the draft working paper as against our suggestion commission has named PC-

Sawaimadhopur as PC Sawaimadhopur-Tonk. Whereas the associate members of INC

and BJP jointly suggested to change the name of this Parliamentary Constituency as

Tonk-Sawaimadhopur.

Tonk was separate princely state before freedom. Whereas Sawaimadhopur

district was a part of erstwhile Jaipur state. District Tonk is much larger in size and

population in comparison to district Sawaimadhopur. Therefore, we once again suggest

that the name of this Parliament Constituency should be corrected as Tonk-

Note of Dissent for Assembly Constituencies of Pali District Under Section 9(2)(a) of Delimitation Act 2002

Sir

Associates Members of INC has submitted enclosed amendments before

commission on 10th June, 2005 regarding the Two Assembly Constituencies of District

Pali named as AC-116-Jaitaran and 117-Sojat (SC). Our proposal was based on the

Page 33: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

Guideline and the provisions of Section 9 (1) (a) of Delimitation Act. We wanted to keep

reserve AC-Sojat for SC. Our proposal was as under :-

1. The revised proposal of Commission is partly accepted. AC-Jaitaran and AC-

Sojat are not constituted according to the guideline.

2. This District is also situated in the chain of Arawali Hills. AC Jaitaran and AC

Sojat are having different physical features due to large number of Arawali

mountains situated between them.

3. The maximum area of existing AC-Raipur which is dissolved in proposed working

paper of the commission should be retained in AC-Jaitaran.

4. Looking to the geographically compactness, Physical features and means of

communications (Road connectivity), we request you kindly exchange two RICs

between AC jaitaran and AC Sojat. Description is as under :- RIC Kotkirana of Tehsil Raipur should be included in AC-Sojat.

RIC Raipur partly-PC Birantiya Kalan, PC Hajiwas, PC Jhoontha, PC Leelamba,

PC Raipur-I & PC Raipur-II should be included in AC-108-Jaitaran.

5. The character of AC-Sojat (SC) and AC-Jaitaran will remain same.

BJP Members also submitted their amendment proposal in above meeting

regarding AC-Jaitaran and AC-Sojat, but they wanted to de reserve AC-Sojat.

Principally it was agreed by both the parties that none of the constituency will be

changed from reservation or de reservation.

Sir, We once again request you that looking to the geographically compactness,

physical features and means of communication (road connectivity) kindly exchange two

RICs as above stated between AC Jaitaran and AC Sojat (SC). We hope that

Commission will incorporate our amendment proposals given above otherwise, you are

requested to kindly publish our note of dissent along with the draft proposals of

Commission.

Thanking you,

Note of Dissent for Assembly Constituencies of Jodhpur District Under Section 9(2)(a) of Delimitation Act 2002 Sir Associates Members of INC had submitted following amendment proposal before

Commission on 10th June, 2005 regarding four Rural Assembly Constituencies of

District Jodhpur.

1. The delimitation of Assembly Constituencies in District Jodhpur has not been

drawn according to the guideline of delimitation commission and provisions of

section 9 (1) (a). The proposed constituencies are not geographically and

Page 35: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

physically compact. All the sub-divisions of Jodhpur District has been split

maximum tehsils and panchayat samitis are unnecessarily broken. Therefore the

delimitation of this district should be reviewed and reformed.

2. We are proposing amendment in AC-Osian and AC-Lohawat as under :- 125-Osian Tehsil Osian (partly) RIC Mathania, RIC Osian, RIC cherai (Partly), RIC

Tinwari (Partly), RIC Aau (Partly) & RIC Bapini (Partly). 123-Lohawat :- RIC

Lohawat, RIC Bapini (Partly), RIC Cherai (Partly), RIC Chamu (Partly), RIC

Balesar (Partly), & RIC Tinwari (Partly)

3. In this proposal the existing boundaries of Assembly segments of this District can

be retained maximum.

4. Tehsil and RICs of Jodhpur District are formed defectively. Tehsils and

Panchayat Samatees are coterminous. They are lengthy and inserted in each

other. Hence to form compact Assembly segment it is necessary to split RICs

and Tehsils.

5. Administratively & from the point of view of compactness and communication this

amendment proposal is more perfect and suitable. This is in the public interest.

Amendment Proposal for AC-130-Luni 1. In the meeting of Commission dated 10th June, 2005 Associate Members of INC

and BJP consensually submitted their amendment proposal but Commission has

turned down them without any reason. In draft proposal the formation is not

according to the guideline and section 9 (1) (a) of the Act. AC Luni is having –

10.27% deviation which is against the rules. Therefore we once again request

you kindly accept a small amendment in AC-Luni. PC Kakelaw & PC Jaleli

Fauzdara of RIC Dangiawas (Tehsil Jodhpur) & PC Roodkali of RIC Bisalpur

(Tehsil Jodhpur) should be included in AC_Luni and deleted from AC-Bilara. If

commission do not agree to split two RICs than we suggest you to included RIC

Dangiawas in AC-Luni which the most adjacent RIC and geographically

compacted with proposed AC-Luni. The character of AC-Bilara and AC-Luni will

remain same.

Page 36: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

Amendment Proposal for AC-124-Shergarh 1. Looking to the geographical compactness, administrative and revenue units,

means of communications, different cultural and population associate members

of INC and BJP jointly suggested amendment proposal of AC-Shergarh in the

meeting of commission dated 10th June, 2005 but commission has ignored it.

Now the proposed AC-Shergarh and AC-Lohawat are defectively formed and

they are not geographically compact. If commission do not want to split RICs

than we suggest a feasible amendment as under which is according to the

guideline and rules of delimitation act.

2. RIC Shetrawa should be deleted from AC-Lohawat & RIC Chamu should be

included in AC-Lohawat. RIC Shetrawa should be included in AC-Shergarh &

RIC Chamu should be deleted. The deviation of % will not exceed average

population of District.

Amendment Proposal for AC. Jodhpur, Sursagar and Sardarpura

Delimitation of above three Urban Assembly Constituencies was perfectly framed

in draft working paper previously released in the month of March, 2005 but now it has

been changed unnecessarily. Ward No. 60 of Nagar Nigam Jodhpur should remain with

AC Sardarpura as commission as previously proposed in working paper. The

population of Jodhpur City is sufficient to form three Urban Assembly segments. There

is no need to include the Rural population in these Acs.

We hope that Commission will incorporate our amendment proposals given

above otherwise, you are requested to kindly publish our note of dissent along with the

draft proposals of Commission.

Thanking you,

Note of Dissent for two Assembly Constituencies of Baran District regarding AC 193-Anta and AC 195-Barna-SC

Under Section 9(2)(a) of Delimitation Act 2002 Sir The proposed delimitation of this district BARAN is against the guideline and

the provision of section 9 (1) (a) of delimitation act, 2002. It seems to have been

prepared to favor the ruling party of the state. There are SECTON OFFICER many

compositions in various Acs which either have no connectivity or they are inter injected

in each other. The assembly constituencies of District Baran as proposed in the draft

proposal are geography defective administratively no-convenient. They are neither

Page 38: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

logical nor fair. Commission have Delimitated AC 195-Baran with intention to keep this

segment reserved for SC resulting AC Anta as de-reserved.

To remove these anomalies and errors, we are proposing the amendment

proposal regarding AC 193-Anta and AC 195-Baran, which comprise all Tehsils & RICs

inducted. It is having better connectivity and better geographical and administrative

compactness. Similarly, our proposed amendments relate to the Assembly segments of

District Baran looking at the geographical, physical, social, cultural and administrative

situations. In our proposal we have kept intact the SDO area, Panchayat Samiti area.

Less number of Tehsils & RICs have been split in our proposals. It is better-compacted

proposal. The proposed amendments are as under :-

The Chairman, Delimitation Commission of India, New Delhi.

Note of Dissent for Assembly Constituencies of Bharatpur District Under Section 9(2)(a) of Delimitation Act 2002 Sir Associates Members of BJP & INC has submitted following amendment proposal

before Commission on 16th June, 2005 regarding four Rural Assembly Constituencies of

District Bharatpur.

Page 40: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

1. District Bharatpur is one of the example who is having three different cultural

areas within the region. Kama & Nagar Tehsils are having Mave Culture & Brij

Culture. Whereas Tehsil Weir & Tehsil Bayana are also having two different

cultures. We are suggesting exchange of single RICs in AC-75-weir V/s AC-76-

Bayana & AC-70-Kaman V/s AC-71-Nagar. This amendment proposal is also

submitted looking to the geographical & physical compactness. Connectivity,

administrative units and means of communication.

Hence we proposed that RIC Ranf & RIC Pasda should be

inter exchange between AC-Nagar & AC-Kaman.

The Associate Members of INC also supported our above amendment proposals

in that meeting and they also agreed by submitting their written proposals. Your good

self also fully convened with above amendment proposal and you have given assurance

to all the associate members that this will be considered. Even than commission has

not incorporated above amendments in draft proposal released on 8th July, 2005. We

are unable to understand why this amendment proposal commonly agreed by both the

parties has been turned down. The proposals of draft working paper released on 8th

July, 2005 regarding AC-Kaman. AC-Nagar, AC-Weir and AC-Bayana are not according

to the guideline and section 9 (1) (a) of delimitation act. Therefore the above

amendment proposals submitted by associate members of INC and supported by BJP

members should be accepted by the commission.

We hope that Commission will incorporate our above amendment proposals in

the interest of Law and Citizens of Bharatpur District. Otherwise, you are requested to

kindly publish our note of dissent along with the draft proposals of Commission.

Kind attention of Shri Shangara Ram

I would like to draw your kind attention regarding of Delimitation Act 2002 of 33

that Delimitation Act 2002 (Part-2) will do delimitation according to the Act of

Parliament, Census of 2004, and by the section 5 of the Act No. 3 of 2004; from 31-10-

2003 according to the figures of Census as ascertained in the Census and keeping in

Page 42: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

view the provisions of the Constitution and Act specified in Section-8 and the following

provisions, Viz.-

(a) All the constituencies will be geographically compact areas and from next page

their natural textures the existing borders of administrative units, communication

facilities and public facilities will have to be kept in mind while doing their delimitation.

(b) The delimitation of every assembly constituency will be done in such a manner

that they will come completely within one Parliamentary Constituency.

On the basis of above norms the proposals regarding Tonk segment of

Parliamentary Constituency, which were earlier proposed by you in which the R.I. circle

more of Todaraysingh was included in the Malpura Assembly Constituency which was

according to the norms of Delimitation Commission and no change was necessary. But

the proposal has been changed for which I am sacking its dismissal. The changed area

of the present Malpura assembly constituency in which R.I. Circle Nasrda has been

added with Malpura, in place of R.I. Circle more, should be cancelled. Because –

(1) This area of Nasirda is not connected to Malpura. This area is about 80 km. Far

away from Malpura, whereas more, the area in the east is only 18 km. Away from

Malpura.

(2) The area of R.I. circle Nasirda comes under Devali Tahsil and its Police Station,

Court and Panchayat Committee also comes under it. The people are also directly

connected to Devali. Therefore connecting this area to Malpura would be against the

natural quality standards of Delimitation Commission, borders prevailing the

administrative units, communication facilities, public facilities and variations the

geographical difference. So, these changed boundaries should be cancelled and the

proposed in its original form made by the Delimitation Commission in the primary level,

Page 43: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

in which more of the Toda Rai Singh was attached to Malpura should be kept precisely

as it was.

Hence in the implementation of the public interest it is requested to the

Delimitation Commission to make amendment to include the same R.I. circle in Malpura

Assembly Constituency and oblige

Subject:- To change the name of “Parliamentary Constituency Sawai Madhopur” as

“Parliamentary Constituency Tonk” and its Headquarter to be Tonk-

regarding.

Sir,

Page 44: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

You are requested to pass the order to change the name of

“Parliamentary Constituency Sawai madhopur” Seat in Rajasthan, created by the

Commission at present; as “Parliamentary Constituency Tonk”. Because :-

1. As far as geographical area is concerned, Tonk district is larger than

Sawai Madhopur district. The area of Tonk district is 7194 sq.km. whereas the area of

Sawai Madhopur district is only 5513 sq.km.

2. According to the census of 2001, the population of Tonk district is also

more than that of Mathopur district. According to the published figures of the population

of 2001, the population of Tonk district is 12, 11, 671 whereas the population of Sawai

Madhopur district is only 11, 17, 057.

3. The extension of voters in Tonk district is in 1089 Villages. Whereas there

are only 794 Villages in Sawai Madhopur, which is very much less in number than that

of Tonk district.

4. The distance of Tonk, from Jaipur city, the capital of Rajasthan is 100 km,

whereas Sawai Madhopur is situated 175 km. Far away from the capital i.e. Jaipur.

5. Tonk City is situated in National Highway no. 12, whereas Sawai

Madhopur City is not connected with any National Highway.

6. There is “Municipal Council” in Tonk City, whereas, there is only

“Municipality” in Sawai Madhopur from administrative point of view.

7. Tonk City has been a historical City and its area is progressive in the

production of chilli, mustard and carpet and is having industries of bidi and leather far

export also. Whereas Sawai Madhopur district is comparatively not well to do from

industrial point of view.

Page 45: ORDER NO. 12 - Election Commission of India – Dudu (SC) 1. Tehsil Dudu 2. Tehsil Phagi (Partly) – (I) ILRC Phagi (II) ILRC Chouru (III) ILRC Mandor (IV) ILRC Nimera 46 – Jhotwara

8. Parliamentary Constituency, Tonk has been reserved for Schedule tribes

till now, but, now it is being changed in general category. From this point of view, the

population of the people of general category in Tonk district is 8, 32, 696, whereas in

Sawai Madhopur district it is 6, 52, 755 which is less than that of Tonk district.

9. According to the present proposals if the Parliamentary Constituency is

named as “Sawai Madhopur Parliamentary Constituency” and its headquarter is fixed at

Sawai Madhopur, then this city will have the distance of 205 km. From assembly

constituency Malpura, 145 km. From assembly constituency Dewali and 110 km. From

Niwai city of assembly constituency Niwai; of Tonk district.

10. The constituencies of Madhopur district were earlier included in the very

“Parliamentary Constituency Tonk” in the first general election held in 1952 and the

general election held after that i.e. in 1957 in the counting.

Therefore keeping in view the above facts, your are requested to give your

acceptance to change the name of “Parliamentary Constituency Sawai Mdhopur” as

“Parliamentary Constituency Tonk”.
