Thereafter on February 16, 2015, the respondent, through counsel, filed a motion for reconsideration of the order attaching her counter-affidavit thereto. In the interest of justice, this office resolves to grant the motion for reconsideration and hereby admits the counter- affidavit for the purpose of the preliminary investigation. However, under the Revised Rules on Administrative Cases in the Civil Service, a clarificatory hearing during preliminary investigation is not mandatory nor a matter of right of the parties. Nonetheless, should this office deem it necessary to conduct a clarificatory hearing, the respondent, through counsel, will be accordingly notified and allowed to participate. WHEREFORE, the motion for reconsideration dated February 16, 2015 filed by the respondent is partially granted. The counter- affidavit is admitted for the purpose of preliminary investigation. Further, the appearance of counsel for the respondent is hereby noted.

ORDER

On February 11, 2015, this office denied the second motion for extension of time to file counter-affidavit filed by the respondent. Thereafter on February 16, 2015, the respondent, through counsel, filed a motion for reconsideration of the order attaching her counter-affidavit thereto.
