Call to Order Beth Ann Ball, Section Chair, called the meeting to order at 9:06 a.m. The Section began the meeting by reading the vision statement. The Occupational Therapy Section is committed to proactively:

Approval of Minutes Action: Mary Beth Lavey all moved that the minutes from the March 9, 2017, meeting be approved as submitted. Anissa Siefert seconded the motion. The motion carried. Executive Director’s Report The Executive Director informed the Section on the upcoming association meeting and conferences. The Executive Director reported that he is putting the laws and rules in an easier format to work on draft changes. The Executive Director provided an update on the elicense system. Discussion of Law and Rule Changes The Executive Director informed the Section that the Senate hearing beg and OPTA testified in support of the sub bill allowing OTPTAT Board to remain as is. Administrative Reports Licensure Report Action: Beth Ann Ball moved that the Occupational Therapy Section ratify, as submitted, the occupational therapist and occupational therapy assistant licenses issued by examination, endorsement, reinstatement, and restoration by the Ohio Occupational Therapy, Physical Therapy, and Athletic Trainers Board from March 9, 2017, through May 11, 2017, taking into account those licenses subject to discipline, surrender, or non-renewal. Mary Beth Lavey seconded the motion. The motion carried.

Assistant Attorney General’s Report Melissa L. Wilburn, AAG, informed the Section that HB290 will go into effect on August 6th which will allow healthcare professionals earn continuing education credit for volunteer work. The board will need to adopt rules for this provision. Ms. Wilburn further reported that there is proposed language in HB49 which would track licensees arrest records between renewals. The proposed language will not change our licensure laws. The Board can only only take disciplinary action on convictions not arrest records. Enforcement Report Jean Halpin reported that the Enforcement Division opened twelve cases and closed eight cases since the March 9, 2017, meeting. There are currently twelve cases open. There is one consent agreement and two adjudication orders being monitored. Jean Halpin reported that Christopher Jones complied with all terms and conditions and was released from his consent agreement. Enforcement Actions: Jean Halpin recommended that the Section issue a notice of opportunity for a hearing for case number OT FY17-032 for falsification of a CPR card required for employment Action: Mary Beth Lavey moved that the Section issue a notice of opportunity for a hearing for case number OT FY17-032 for falsification of a CPR card required for employment. Beth Ann Ball seconded the motion. The motion carried. Jean Halpin recommended that the Section rescind the notice of opportunity for a hearing for case number OT FY17-012 based on additional information reviewed. Old Business Limited Licensed Rules The Executive Director informed the Section that he is waiting on the Legislative Service Commission to provide a copy of the rules. New Business Medicaid School Program The Section review the letter from OOTA regarding enrollment requirements. The Section will work with Legal Counsel to respond to this issue. Action: Mary Beth Lavey moved to go into executive session to receive legal advice from our AAG regarding to discuss pending and imminent court action against the boar d pursuant orc (ORC 121.22 (G)(3)). Open Forum The Executive Director attended the Senate Finance Committee hearing on the budget bill earlier today. There were no changes to the proposed rules. Ohio Occupational Therapy Association (OOTA) Report There was no formal report. Good Morning Beth, I am writing to update you regarding the MSP situation. As you know, a response from Melissa Wilburn, Assistant Attorney General was sent via email to me on May 23, 2017, related to my submitted question (May 4, 2017) and follow‐up discussion at the May 11, 2017 OT Section meeting. I responded to Ms. Wilburn via email and followed‐up with a phone conversation to her, seeking clarification about her statement regarding the Independent Medicaid Enrollment Application “becoming a requirement”. My understanding during that phone call, is that the rule requiring the Medicaid agreement, 5101‐35‐05 (c), first needs to be adopted. After that point, there would be further activity seeking a formal opinion from the Ohio Attorney General. I agreed to assist her in any way necessary. On May 30, 2017 this rule was heard by JCARR and subsequently adopted. I will be contacting Ms. Wilburn today to see what is the next step in this process. Please advise me if you are aware of further details regarding the course of this matter. I wanted to also update you about the experiences OT Practitioners in school settings are now having as the school year is coming to an end. OT Practitioners are reporting to me that:
they are being threatened with insubordination they are being threatened with job termination they are being compelled to complete the application now (before the end of the school
year), despite the fact that the program does not come into effect until July 1, 2017, for services provided during the 2017‐18 school year
they are filling out the application without knowing what they are agreeing to, while being directly instructed by the billing agent who is the electronic data interchange (EDI) trading partner for the school district, and specifically benefits from the MSP claiming generated by the practitioner

they have shared with their employer and/or billing agent that they are awaiting additional guidance from the OT Section and ask for patience
they are questioning sections of the Medicaid application, specifically the ethics of agreeing to the 16 terms and conditions, and how they can be categorized as independent provider/contractor and sole proprietors, while they are working in a school setting
To keep you fully informed, OOTA will be hosting a phone conversation with Senator Lehner’s office tomorrow June 2, 2017, to further discuss HB 89, the MSP rules impacted, and the resulting activities and issues around the Medicaid application. I also wanted to make you aware that there is also a meeting on June 7, of the Ohio School Health Services Association, which is an association representing the interests of billing agents, CPAs and school districts. July 10, 2017 To: The OT Section of the OTPTAT Licensure Board Additional information regarding the MSP enrollment application process and potential impact upon school based practice has recently come to my attention. Occupational therapists are being told by billing agents that if they personally do not want to complete an Independent Medicaid Provider Enrollment Application so that their school district can bill Medicaid, the OT can have a co-worker who has completed the application refer the student to them. This creates many new questions and dilemmas. I have listed all of the potential questions that I will be directing to the 3 state agencies involved but realize those addressed by the OT Section are likely limited to those questions found in “B” below. A. REGARDING IDEA/OPERATING STANDARDS—IS THERE ANY CHANGE TO 1. who is the OT of record 2. who conducts annual and re-evaluations of the student 3. who contributes to the writing of the IEP 4. who writes the progress report 5. who conducts the initial evaluation and completes the individual report (as part of the ETR) 6. is there a limit on the number of students one OT can refer 7. can one OT refer for multiple OTs B. REGARDING OT LICENSURE REQUIREMENTS ---IS THERE ANY CHANGE TO 1. who writes and updates the POT 2. who supervises the OTA 3. does the referring OT have to co-sign the OT's billing notes 4. does the referring OT's name have to be listed on the POT, if she is not the one that is responsible for writing it
C. REGARDING MSP RULE 1. which NPI number is used on the documentation for claiming I sincerely appreciate your attention to this matter and look forward to your clarification of those questions relevant to the Laws and Rules Regulating the Practice of Occupational Therapy.

TO THE OCCUPATIONAL THERAPY SECTION OF THE OTPTAT LICENSURE BOARD
I am in need of clarification about some common documentation practices and issues as they relate to the Occupational Therapy Code of Ethical Conduct.
1. OTs and OTAs in educational settings provide related services to carry out theIEP. To comply with federal mandates, IDEA, and state rule, ODE Operating Standards 3301‐51, the purpose of our school based practice is to provide interventions based on the educational needs of the children. Our services, therefore, must be educationally relevant and resulting documentation must align and comply with the previously mentioned state and federal regulations.
OTs and OTA’s are often pressured to also document and code (CPT) their services as medically necessary, so that the claim for these services can also be billed to Medicaid by the school district via contracted billing agents. Many practitioners feel conflicted by this, but often document as their employer and/or billing agents advise. In discussions with school‐based practitioners about their “medical necessity” concerns, I have encouraged them to document services provided per the IEP requirements and code as “non‐billable” any services for which they have doubts.
OT practitioners have also reported to me that their school district compels them to document services on the IEP, Section 7 in specific manner vs. how ODE/OEC requires;
a.) to keep students on as “direct” services when the OT recommends to move the student to an “indirect” type of service, and/or b.) to document collaborative/”support to school personnel” services under the “related service” category.
In my understanding, both of these practices violate the OT Practice Act as well as ODE Operating Standards 3301‐51‐07.

I am requesting that the OT Section develop a Q&A that would address the ethics of documentation in this situation. Below is a question from the PT Section. I am not suggesting that the OT Section replicate the sample below, but to formulate their own Q&A, that is clearer and more accurate. For example, the therapist documents and codes for services rendered but does not directly bill for services. I have highlighted what I believe to be the most important points to be made. _____________________________________________________________________________ Question 36: I'm a school-based physical therapist. Can I bill all of my services to the Ohio Medicaid Schools Program (OMSP)? The Ohio Medicaid Schools Program (OMSP) reimburses school districts only for services that are medically necessary. This does not prohibit the provision of educationally necessary services, but limits billing Medicaid only for those services that are also medically necessary. Therefore, therapists must be cautious about what services they document for Medicaid billing. If, in the therapist's professional judgment, the services the therapist provides the student are educationally necessary, but not medically necessary, the therapist is not required to bill for these services and doing so may be considered Medicaid fraud. The Physical Therapy Section recommends that licensees contact Mark Smith, OMSP Program Coordinator at the Ohio Department of Education to verify who is responsible for the billing and how is should be done. In addition, licensees might also contact Cathy Csanyi, the OT/PT Specialty Consultant with the Ohio Department of Education, Office for Exceptional Children, to determine if all of the goals and services should be both educationally and medically necessary. Under the code of ethical conduct for physical therapy practitioners, established in rule 4755-27-05 of the Administrative Code, a physical therapist shall maintain the ability to make independent judgments on what physical therapy services are provided to the student. The physical therapy practitioner also has an obligation to ensure that the services provided are not billed inappropriately.

2. I have similar ethical concerns regarding the documentation of services provided at the county level as per the DODD early intervention system which uses the Primary Service Provider (PSP) model, due to some recent changes. As background, the PSP model is based on parent education and coaching, not necessarily any direct service to the child and uses one or two team members to provide the parent‐driven services documented on the IFSP. The service is most often provided by the Developmental Specialist, a non‐licensed therapist. OTs working in the county DD system are instructed that they are not to use a medical model. It is important to note that not all county programs have an OT on the “core” team. In addition, I would suggest from my understanding, that the PSP model predetermines the nature (type, amount and frequency), and scope of services a child and family receives, which I believe is not in alignment with IDEA Part C requirements, as the team makes the determination of who, where, how.
DODD recently proposed a new rule regarding an Early Interventions System of Payment for those babies and toddlers receiving county level services under an IFSP. This rule would allow DODD/county boards the ability to bill public and private insurances for the services on the IFSP, with parent consent. This rule was just adopted June 19, 2017. OOTA and others raised many concerns including assuring informed parent consent, compelling community and hospital practitioners to use the PSP model if they want to provide services as part of the IFSP, and legitimately using public and private insurance benefits that are based on medical necessity for an educational/coaching service.
Given this new funding mechanism and the requirement to function under the PSP model, the PSP OT provider may now be put in a position to document their service differently; in such a way, as to meet the medically necessary criteria public and private insurance payors have established. The current nature of the DODD EI System and the new System of Payment seem incompatible, however, the current concern is the ethical dilemmas this may cause for those OTs involved in providing services to babies and toddlers under the PSP model.
I am requesting that the OT Section develop a Q&A that would address the ethics of documentation in this situation.
I sincerely appreciate the time and consideration of the OT Section to address the professional ethics involved in these two different, yet similar situations regarding service documentation. The compromise to the ethical practice of occupational therapy and potential impact on the consumer is very concerning. Your guidance is essential regarding the ethics of professional documentation, as we strive to provide quality services to Ohio’s children.
