2002I’m pleased to present the New Jersey Department ofEnvironmental Protection’s (NJDEP) Open Public RecordsAct, July 2005 Annual Report. This report details the numberof Open Public Records Act requests received within theDepartment along with the monies spent processing theserequests. As the report shows, the NJDEP receives the bulk ofall Open Public Records Act requests within the State.

It is important to note that out of 29,580, Open Public RecordsAct requests received during the first three years since theOPRA legislation was implemented, there have only been 6appeals and three have already been through the appealsprocess. The decisions were that the Department correctlydenied access to those documents. The Department has lostno cases on appeal.

One of my first goals since becoming Commissioner was toensure that the citizens of New Jersey had quick and easyaccess to Department documents. People have a right to knowabout the air they breath and the water they drink. In carryingout the mission of providing easy access to documents, wemust also be mindful of the legislature’s intent that we do notabridge the fundamental right to privacy and public safety.

We continue to strive to make it as easy as possible for peopleto obtain information. For example, the NJDEP has a newlyimproved Web site that provides easy access to keyenvironmental reports and other public documents seven daysa week at no charge. The improved Web site further enhancesthe demonstrated efficiency, effectiveness and responsivenessof DEP’s OPRA process. Easier, faster real-time access topublic documents online through DEP Data Miner likely willreduce the number of OPRA requests submitted to the NJDEP.DEP Data Miner may be accessed at: http://www.nj.gov/dep/opra/online.html

I have directed staff to continue to be responsive, accountableand open in providing access to documents. The public’s rightsto know and have access to information are an essential partof open goverment. Therefore, we are committed to ensuringthat people have easy and swift access to documents.

The Open Public Records Act (OPRA) took effect on July 7, 2002. The Open Public Records Actestablishes strict timeframes for providing access to state and local documents. The definition of agovernment record is any paper, written or printed book, document, drawing, map, plan, photograph,microfilm, data processed or image processed document, information stored or maintainedelectronically or by sound-recording or in a similar device, or any copy thereof, that has beenmade, maintained or kept on file in the course of official business or has been received in thecourse of official business. Access must be provided within 7 business days and immediate accessfor bills, vouchers and contracts. If a record is in storage or archived, the Department must identifya time by which it will be made available.

In an effort to process requests within the strict timeframes, the Department of EnvironmentalProtection created the Office of the Record Custodian (ORC), which receives all record requests,determines whether a request is complete, inputs paper forms into a central database, assignsrequests to the appropriate Assistant Commissioner Record Custodians (ACRC), makes policy/legal determinations, (i.e. exceptions, confidentiality, etc.) and notifies requesters of the outcomeof requests, copying costs and access arrangements.

The Department has assigned approximately 20 people to be ACRCs. These people monitor thetracking system each day and ensure that file officers in the program areas respond to requestsfrom the Office of the Record Custodian.

The Department assigned approximately 150 people to be file officers. They are responsible formonitoring the computer system to identify new requests, review files and determine if requestedrecords exist, determine whether any requested records are confidential or need to be redacted,notify the ORC of availability of requested records and any reasons for denial or redaction, updatethe database to reflect responses to requests and raise any policy questions to the Office of theRecords Custodian. The Department then notifies the requestor, both in writing and by phone.

The Department has established an Open Public Records Act Web page at: www.nj.gov/dep/oprato explain the law and assist citizens in making records requests. The Web site also contains linksthat provide immediate access to key documents. OPRA requests may be mailed, hand carried orsubmitted online. Most people elect to have their requests submitted to the Department online.

The following report provides information about Open Public Records since the OPRA law tookeffect.

Each request received is assigned to the appropriate ACRC(s) . This chartillustrates the primary program where each of the 12,067 requests wasassigned. A single request may be assigned up to ten times (i.e. to each ofthe Assistant Commissioner Programs). As a result, NJDEP’s programsactually handled 30,249 requests. The table on page 22 is based on 30,249“requests” figure; it shows the percentage handled by each of the pro-grams based on that figure.

In-person reviews are an efficient way to providerequestors access for requests that generate a largenumber of records. Requestors schedule appoint-ments and come to our offices to conduct their ownfile review. The table and chart below show the num-ber of file reviews scheduled at all of NJDEP’s mainoffices between 7/7/04 & 7/6/05. In all, the Depart-ment scheduled 5,102 appointments in our thirdyear, reflecting a 67 percent increase from the previousyear. A total of 9,857 appointments were scheduledfor the three-year period ending 7/6/05.

Most copy jobs are sent to the Treasury Print Shoplocated within the DEP. Treasury has a staff ofthree full time employees making copies.

The Treasury Print Shop collected $334,959 incopying fees for the year ending July 6, 2005. Occa-sionally ORC and the program areas will completecopy jobs internally. The Department has collected$19,049 during the year for these copying charges.

The copy rate is $0.75 for one through ten pages,$0.50 for eleven through twenty pages and $0.25for every page thereafter. Approximately 2,099copy jobs have been processed between 7/07/04& 7/06/05.

Expenditures are shown by program area.The Department spent a total of $1,537,662 not including indirect costs such as equipment, sup-plies, etc. The Department has not received any additional funding from the legislature for theprocessing of OPRA requests.

An appeal of a decision maderegarding an OPRA requestmay be made to the Govern-ment Records Council or di-rectly to Superior Court. Todate, of the 29,580 OPRA re-quests submitted to the NewJersey Department of Environ-mental Protection, there havebeen only three cases that wentthrough the appeals process andthe decisions were that the De-partment correctly denied ac-cess to the documents. Therehave been no decisions againstthe Department. There werefive cases appealed but laterwithdrawn. Presently, there arethree appeals pending. The fol-lowing are brief summaries ofthose requests where a decisionwas made. Appeals That Went to Decision

OPRA Request #8619/James Lockwood.Requestor submitted an OPRArequest seeking the name andaddress of the woman involvedin a bear incident on WingdamTrail in Wawayanda State Parkon Aug. 10, 2003, as well as theincident report and any otheradditional records that may ex-ist regarding the incident. TheDEP, while producing therecords, redacted the portionsthat revealed the woman’s iden-tity and an appeal was filed withthe Government Records Coun-cil (GRC). The GRC ruled onApril 8, 2004 that the Depart-ment acted properly because, asthe person who reported the in-cident to the DEP, the woman

was entitled to confidentialityunder the “identity of a com-plaintant”

OPRA Request #9353/Jordan MarianoRequestor submitted an OPRArequest seeking a list of chlo-rine gas users which was de-nied for domestic security rea-sons and an appeal was filed.The GRC ruled in March 2004that the Department correctlydenied access to these recordsbecause “the information re-quested falls squarely withinthe ambit of Executive OrderNo. 21 and falls under the ex-ceptions set forth in N.J.S.A.47:1A-1.”

OPRA Request #4766/Susan SteinmanThe OPRA request was submit-ted on February 21, 2003 re-questing the following:Princeton Township Commu-nity Based Deer Managementapplication for 2001-2002, in-cluding all attachments (ie; con-sent forms provided by propertyowners to permit net and boltbait sites.) Princeton TownshipBased Deer Management Ap-plication for 2002-2003, withall attachments and consentforms. OPRA Request #22116/NJ Environment WorkCouncilThe OPRA request was submit-ted on December 2,2004 re-questing the following: The lat-est available drafts of the DEPMOA with chemical industrytrade association and specificchemical companies concern-ing site security, latest availabledraft prescriptive orders by DEPand the Domestic Security TaskForce concerning chemical sitesecurity for the chemical sectorand the latest copy of the chemi-cal industry “best practices”document. This request was de-nied for domestic security rea-sons. An appeal was filed withthe New Jersey GovernmentRecords Council.

OPRA Request # 4990/Kim HarisOn March 3, 2003, Kim N.Haris submitted an OPRA re-quest to DEP for the following:“Fish and Wildlife Councilmeeting minutes for the monthsof December, 1998, January,1999 and February, 1999.” OnApril 10,2003, the Office of theRecords Custodian mailed therequestor the documents whichwere requested in the OPRArequest. Kim N. Haris paid$20.00 (check number 3556)

This requestwas denied for a number of rea-sons (ie; proprietary, disruptionto agency operations, trade se-crets, computer security, ongo-ing enforcement). An appealwas made to the GovernmentRecords Council and the casewas referred to the Office of Ad-ministrative Law for a hearing.

Enhancing CommunicationWeb site: With more than 10,000 Web pages andnearly 6,000 PDF documents, the DEP’s Web siteis rapidly becoming its most powerful communi-cation medium. Every day, the site receives morethan 11,000 visitors who view over 40,000 Webpages. To ensure the site meets users’ needs, it iscontinually updated with new items, new datadownloads, reports, rules and event information.Every day, right away: Honoring the public’sright to know by offering better access to informa-tion about environmental protection, the DEP un-veiled its “Data Miner,” a newly improved Website that provides easy, round-the-clock access tokey environmental reports and other public docu-ments seven days a week.

Enforcement alerts: To improve customer ser-vice and communications with its constituencies,the DEP began regularly issuing EnforcementAlerts to regulated communities to keep them in-formed about plans to target certain complianceproblems and ways in which the department willcontinue to provide compliance assistance.
