Warning letter towebsite ownerThis first step is more of a formality and is needed for further escalation. The hosting provider will often ask you to first contact the website owner prior to taking any further steps. Unfortunately, and as you can imagine, the success rate is low. The website owner knows he is selling counterfeit and is making good money.

Cease & Desisthosting providerNotify the hosting provider and ask him to remove the content. If he does not comply with your request, he becomes liable and you can start further legal procedures. The C&D, which you can send by e-mail or regular mail, must include the domain name, IP address, the relevant trademark registrations or copyrights, a takedown request and your personal contact details.

Notify registrarIt all started with the website owner who registered the domain name through the registrar. Not all registrars have the will to respond to a take down request, but many of them do want to stop illegal activities. Setting up relationships and informing registrars of infringements is a good strategy to make an impact on the problem.

Incorrect WHOISAccording to the regulations of ICANN, the WHOIS information of the website owner should be correct. Infringers often use falsified details. By reporting these to the correct organization, the website owner will be asked the update his information. If he doesn’t comply before a specific date, the domain name will be blocked and becomes inaccessible.

Block payment servicesIf all the above has not resulted in shutting down the webshop, then it is time to step up your game. Report the domain to PayPal, Mastercard and Visa and inform them of the illegal activities. When it is not possible to pay with PayPal or credit card, their sales will drop drastically.

Remove fromsearch enginesCripple the webshop and make it invisible. File a copyright complaint with Google, Yahoo, Bing and other search engines and let them remove the site from their search results. The site will still be live and active but no traffic = no sales.
