Ninety-Eighth Annual Council: January 27—29, 2017

RULES OF ORDER

The general rules of parliamentary procedure set forth in the latest edition of Robert's Rules of Order shall govern the conduct of the session of Council except wherein other procedure is provided by the Diocesan Constitution or Canons. Any motion or resolution within the scope of authority of any committee of Council may be presented directly to such committee by the proposer. Any motion may be offered on the floor of Council (unless ruled out of order by the President of the Council) in which event it shall, if seconded, and if at least two-thirds of the delegates present and voting then vote to permit its consideration (see diocesan Canon 29), be referred to the appropriate committee of Council for consideration without discussion or debate. The committee to which such a motion or resolution has been presented or referred shallreport motion either favorably or unfavorably prior to the adjournment of Council.

Announcements Annual Executive Board Reportfrom the Secretary

• Your table number for the Friday business session is printed on your name tag. We will not have assigned seating during meals or during business on Saturday.

• Council Committees are requested to meet near the podium for a brief check-in immediately following the Friday afternoon business session.

• Clergy and Lay Delegates each have a turquoise voting card inserted in their name tag holders. Please do not lose your voting card. This card informs the tellers of your voting status at the balloting area for the election of diocesan leadership positions and at the onsite convocation meetings. This card also allows tellers to count your vote in open legislative sessions of council.

• Lynn Robertson will certify delegates in the check-in area using the Certificates of Election as filed by parishes. Remember that Alternates serve in the order listed on the Certificate of Election.

• Your name tag serves as your meal ticket and must be worn for Friday dinner, Saturday lunch, and/or the Saturday banquet. If you are registered for the Commission on Ministry lunch or the Clergy Spouse lunch, your nametag will have a special designation.

• There are no oral Program Reports during Council this year. During this Council weekend, you will have ample opportunity to visit and view program displays of the Episcopal Diocese of Southwestern Virginia in the Crystal Ballroom.

Line of Credit established for the Diocese of Southwestern Virginia:

In accordance with diocesan Canon 7, Section 8, and as Secretary of the diocese, I inform this Ninety-Seventh Annual Council, as was also reported to nine prior Councils, that in 2004 a $100,000 line of credit was established with Wachovia Bank. This credit line was established for the primary purpose of providing financial resources for the cash flow needs of the Phoebe Needles Center, Inc. There is a letter of agreement in place between the Diocese of Southwestern Virginia and the Board of Directors of the Phoebe Needles Center, Inc. which outlines the process by which Phoebe Needles borrows money from the diocesan line of credit and outlines the process for repayment from Phoebe Needles. The line of credit is now held by Union Bank and Trust. As of December 31, 2015, the outstanding balance on the line of credit was $38,100.

Furthermore, the Executive Board at its meeting of January 7, 2006, authorized the Treasurer and Secretary of the Diocese to increase this line of credit to an amount not to exceed $250,000. It is the policy of the Executive Board that no funding will be obtained from the line of credit without the prior approval of the Executive Board. In 2009 the Executive Board authorized the use of $115,000 from the diocesan line of credit for the purchase of the former Ruth Caperton house next door to Evans House. In 2015, the Executive Board paid off the entire balance from the purchase of this house.

REPORT OF THE CONSTITUTION AND CANONS COMMITTEE

December 2015

As discussed at the Fall Convocation meetings, the Constitution and Canons Committee is proposing an amendment that will begin the process of changing the name of the annual meeting of the Diocese of Southwestern Virginia from “Council” to “Convention.”

The Diocese of Virginia commissioned its Historiographer to research and report on the history of the use of the term “Council” to refer to an annual meeting of a Diocese. Her report, delivered in January 2015, is available here:

As a result of this research, the 220th Annual Council of the Diocese of Virginia approved a proposed amendment to the Diocesan Constitution to change the name of its annual meeting from “Council” to “Convention.” That proposed amendment will be presented again at the 221st Annual Council of the Diocese of Virginia, in January 2016, and if approved for a second time will become effective. At the same time, the Diocese of Virginia will vote on a proposed amendment to its Canons to change the name of its annual meeting from “Council” to “Convention.” These materials are available here:

As was discussed at the Fall Convocation Meetings, there are compelling reasons for this change in order to move the Diocese away from the troublesome history surrounding the term “Council,” and to conform our terminology to the terminology used in the Constitution and Canons of The Episcopal Church. Accordingly, to begin this process in the Diocese of Southwestern Virginia, the Committee proposes adoption of the resolutions set forth herein.

Amendment to Constitution of the Diocese of Southwestern Virginia

After deliberation, the Committee proposes that the Constitution be amended by adoption of following resolution:

RESOLVED, that the Constitution be amended so that the words “council” and/or “Council” wherever they appear therein referring to the annual meeting of the Diocese are deleted and replaced with “Convention.”

Amendments to the Diocesan Constitution must be approved by two successive Councils in order to take effect. Const. Art. 16. If this proposed amendment is approved by

the 97th Annual Council of the Diocese, then the Committee will bring it back to the 98th Annual Council of the Diocese in 2017 for a second vote and, if approved again at that time, the amendment would become effective. At the same time, the Committee will bring a similar proposed amendment to the Diocesan Canons to change the name of the annual meeting of the Diocese from “Council” to “Convention.” That Canonical amendment, if approved, would take effect immediately. Canon 30, Sec. 3.

Additional Implementing Resolutions

Pending the formal amendment of the Constitution and Canons, the Committee also proposes the adoption of the following resolutions, which if adopted will allow the Diocese to use the term “Convention” for its 98th Annual Meeting in 2017, even in advance approval of the formal amendments:

RESOLVED, that the name of the annual meeting of the Diocese of Southwestern Virginia be changed from “Council” to “Convention.”

BE IT FURTHER RESOLVED, that until such time as the Constitution and Canons of the Diocese of Southwestern Virginia have been amended to reflect this name change, the term “Convention” shall be deemed to substitute for the term “Council” and any act of the Convention shall be deemed to satisfy any requirement in the Constitution or Canons of the Diocese of Southwestern Virginia that an act be performed or approved by Council.

four (4) lay elected, i.e., two (2) lay delegates and two (2) lay alternates; and that the balloting for Standing Committee and Ecclesiastical Trial Court proceed among the three (3) remaining candidates and that on the second ballot, the one (1) candidate for each office receiving the fewest votes shall be eliminated.

And be it further resolved by the 97th Council of the Diocese of Southwestern Virginia that if, in any round of balloting for Standing Committee or Ecclesiastical Trial Court as described above there should be a tie among one or more persons for the privilege of remaining on the ballot, then all of such persons receiving the same number of votes shall remain on the ballot and shall proceed to the next round of balloting, and in such next round of balloting the number of persons equal to the number receiving the same number of votes in the prior round of balloting shall be eliminated (i.e., if two persons should receive the same number of votes, then each shall remain on the ballot for the next round of balloting at which time the two candidates receiving the lowest number of votes shall be eliminated).

Resolution Regarding Voting

Submitted by the Chancellor of the Diocese

Whereas the 97th Council of the Diocese of Southwestern Virginia will have the privilege of electing:

A) One lay and one clergy member to the Standing Committee, each to serve for a term of three (3) years;

B) Two lay and two clergy (one of whom has, by tradition, been the Bishop) delegates, and two lay and two clergy alternate delegates to the Provincial Synod;

C) One lay and one clergy member to the Ecclesiastical Trial Court, each for a term of three (3) years;

Whereas each of the five (5) Convocations may submit a nominee for each of the positions; and,

Whereas it has in the past proved unduly cumbersome to elect such persons by majority vote, as the election procedures have only allowed the elimination of that person receiving the lowest number of votes per ballot; and

Whereas in order to expedite the balloting procedures, the Council has expressed its wish to reduce the number of ballots for election to such positions to not more than three (3);

Now therefore be it resolved by the 97th Council of the Diocese of Southwestern Virginia as to elections among multiple nominees for Standing Committee and Ecclesiastical Trial Court; that on the first ballot there be eliminated all but the three (3) candidates for each office receiving the highest number of votes; and in the case of clergy and lay delegates to Provincial Synod, those clergy candidates receiving the most votes on the first ballot will be the three (3) clergy elected, i.e., one (1) clergy delegate and two (2) clergy alternates, and those lay candidates receiving the most votes on the first ballot will be the

Whereas the Millennium Development Goals ended their activity in 2015, and

Whereas the new goals to end poverty, protect the planet, and ensure prosperity for all as part of a new sustainable development agenda will be called the Global Goals for Sustainable Development, and

Whereas they will run through the year 2030; therefore be it

Resolved that the diocese MDG committee change its name to the Global Goals Committee; and be it further

Resolved that the committee continue on its mission to raise awareness of these goals that affect ending poverty, eliminating hunger and preventable illness, promoting education and gender equality in the world.

Additional information: The MDG Committee unanimously voted to change its name at its December Committee meeting and asks that Council confirm this name change.

A Resolution Regarding the “Council Endowment Fund”

Submitted by the Executive Board

WHEREAS, the 95th Annual Council of the Diocese of Southwestern Virginia approved a "Resolution Concerning the Fund for Mission and Outreach" which directed that the funds contained in the "Council Endowment Fund" be made available to the Phoebe Needles Center, Inc. for use in the construction of an Adult and Family Lodge subject to a number of conditions which the Phoebe Needles Center, Inc. was required to satisfy in order to receive the funds; and

WHEREAS, the Phoebe Needles Center, Inc. was not able to satisfy the conditions required for it to receive the funds contained in the "Council Endowment Fund"; and

WHEREAS, all of the deadlines for the Phoebe Needles Center, Inc. to satisfy the conditions required for it to receive the funds in the "Council Endowment Fund" have passed; and

WHEREAS, the "Resolution Concerning the Fund for Mission and Outreach" provided that, in the event the Phoebe Needles Center, Inc. was not able to satisfy the conditions required for it to receive the funds, that the Executive

Board was to make a recommendation to the 2016 Annual Council regarding the future use of the funds contained in the "Council Endowment Fund"; and

WHEREAS, the Executive Board considered this matter at its meeting on November 14, 2015; and

WHEREAS, the Executive Board's recommendation to Annual Council is that the "Council Endowment Fund" remain under the control of the Trustees of the Funds of the Protestant Episcopal Church in the Diocese of Southwestern Virginia, Inc. (the "Trustees of the Funds"), to be invested along with the other funds under the control of the Trustees of the Funds;

Therefore be it resolved that the 97th Annual Council of the Diocese of Southwestern Virginia directs that all of the funds in the "Council Endowment Fund" remain under the control of the Trustees of the Funds, to be invested along with the other funds under the control of the Trustees of the Funds, until such time as a future Annual Council (or Annual Convention) shall pass a resolution directing the expenditure of all, or some portion, of such funds.

A Resolution Regarding Policy for the Use of Alcohol at Church Functions in the Diocese of Southwestern Virginia

Submitted by the Rev. Shelby Ochs Owen 12/1/15, based on General Convention 2015 Resolution A158.

Resolved, that the 97th Annual Council of the Diocese of Southwestern Virginia acknowledge The Episcopal Church’s long-standing tolerance for the use of alcohol, which in some cases has contributed to its misuse and undermined a climate of wholeness and holiness for all; that our Church culture too often avoids hard conversations about alcohol use and the role of

forgiveness and compassion in healing and recovery; and that The Episcopal Church in General Convention has committed itself to increased awareness about alcohol, substance misuse, and addiction, and called others to do the same; and be it further

Resolved, that Council adopt the following Policy for the Use of Alcohol at Church Functions

and call on congregations, conference and retreat centers, and all ministry programs in the diocese to observe its provisions when offering alcohol for consumption; and be it further

Resolved, that Council urges the Executive Board to ratify this policy as the policy of the Diocese to replace “The Use of Alcohol at Church Functions,” guidelines adopted by Executive Board in April of 1979, and to review the policy from time to time to consider whether it should be revised or updated, all as contemplated by General Convention Resolution A158; and be it further

Resolved, that rectors or other clergy members in charge of congregations, directors of conference and retreat centers, leaders of ministry groups, and all others who have responsibility for our organizational and program life as a diocese instruct both their leaders and (where applicable) their members in the provisions of this policy.

Policy for the Use of Alcohol at Church Functions in the Diocese of Southwestern Virginia

1. The Episcopal Church in the Diocese of Southwestern Virginia seeks to provide a safe and welcoming environment for all people, including people in recovery. To that end, we affirm the following practices for the use of alcohol in church settings, which are intended to remove unnecessary stumbling blocks from the paths of our members and friends.

2. Some congregations and ministry groups* may decide not to serve alcohol at events or gatherings. Others may decide to permit a limited use of alcoholic beverages at events they sponsor.  Both can be appropriate if approached mindfully.

3. Groups or organizations sponsoring activities or events at which alcoholic beverages are to be served must have permission from the rector or clergy member in charge (if in a parish setting) or other designated leader (in non-parish settings).  Such groups or organizations must also assume responsibility for those persons who might become intoxicated and must provide alternative transportation for anyone whose capacity to drive may be impaired. Consulting with liability insurance carriers is advised.

4. All applicable federal, state and local laws should be obeyed, including those governing the serving of alcoholic beverages to minors.

5. Serving alcoholic beverages at events where minors are present is strongly discouraged. If minors are present, alcohol must be served at a separate station that is monitored at all times to prevent underage drinking.

6. Alcoholic and non-alcoholic beverages must be clearly labeled as such.  Food prepared with alcohol does not need to be labeled provided the alcohol is completely evaporated by the cooking process; however, it is recommended that even in this case the use of alcohol in cooking be noted on a label.

7. Whenever alcohol is served at a congregational event or other ministry setting, leaders must make it clear that alcohol consumption is not the focus of the event and that drinking alcohol is not required to participate.

8. The serving of alcoholic beverages at church events should not be publicized as an attraction of the event, e.g. “wine and cheese reception,” “cocktail party,” and “beer and wine tasting.”

9. If alcohol is served, appealing non-alcoholic alternatives must always be offered with equal prominence and accessibility..

10. Food must be served when alcohol is present.

11. Whenever alcohol is served, the rector or clergy member in charge (or designated leader of a ministry group) must appoint a trusted adult to oversee its serving. That adult may not drink alcoholic beverages during the time of his or her execution of this responsibility.  

12. When alcohol is served, its use must be monitored and anyone showing signs of intoxication must not be served.

13. Recognizing the effect of alcohol as a mood-altering drug, alcoholic beverages shall not be served when the business of the Church is being conducted, nor shall it be offered immediately beforehand.

14. Clergy shall consecrate an appropriate amount of wine when celebrating the Eucharist and perform ablutions in a way that does not foster or model misuse.

15. Clergy are encouraged to acknowledge the efficacy of receiving the sacrament in one kind and to consider providing non-alcoholic wine where appropriate.

*The term “ministry groups” is intended to refer to a variety of non-parish settings. This would include (but not be limited to) diocesan meetings, retreat and conference centers, campus ministry settings, or any other official gathering of Episcopalians under diocesan sponsorship.

Saturday@Council begins in the Roanoke Ballroom at 9 AM. Martha Bourlakas will speak; the Rt. Rev. Mark A. Bourlakas will give the Bishop’s Address to Council; and keynote speaker, the Rev. Dr. Dwight Zscheile, will present Faithful Innovation in a New Apostolic Age. Today's cultural context seems full of uncertainty and insecurity, both for the church and beyond. This session will offer insights into cultural shifts that are affecting the church, along with lessons from the world's most innovative organizations, for how Episcopalians can translate and share their treasures with new populations and generations. After a short break, Zscheile will follow up with Joining God in the Local. This session will utilize concrete stories and practices from an ordinary Episcopal church that has been on a journey of missional experimentation and renewal by joining God in the local.

Project Resource ~ Financial Consulting and Resources for Parishes: Project Resource was designed to create a team of diocesan coach-consultants who each have the training and digital resources to lead any church in any situation concerning resource development of money, vision, or people—three great resources of a church’s mission.
