Whereas, the COLLEGE and PARTNER seek to establish this Articulation Agreement (“Agreement”) to facilitate students’ transfer from COLLEGE to PARTNER Programs. Both COLLEGE and PARTNER may be referred to individually as a “Party” or collectively as the “Parties”. I. PURPOSE A. This Agreement provides a framework to develop programs designed to enhance the educational experience of students attending both COLLEGE and PARTNER institutions in areas including, but not limited to: i. Transfer of credit, including Transfer and Reverse Transfer; ii. Data sharing; iii. Transfer student benefits. Both Parties enter into this Agreement in the spirit of cooperation and to mutually recognize each other as quality institutions of higher education. Each Party is dedicated to serving students from diverse populations. II. TRANSFER OF CREDIT A. Transfer of credit from COLLEGE to the PARTNER institution for the purpose of completion of a baccalaureate program of study is designed to maximize the amount of course work completed for the associate degree applicable to the baccalaureate degree. a. Credits from COLLEGE that are transferrable to PARTNER degree programs may be specified in any amendment(s) to this Agreement. b. PARTNER will recognize for transfer credit within legal and accreditation limitations, no less than 60 semester credit hours of course work submitted from COLLEGE resulting from transfer credit, dual/concurrent enrollment, advanced placement, CLEP, or other recognized means by which credit is awarded by examination (as appropriate and subject to COLLEGE policies). c. Separate academic records for students will be maintained at each Party’s institution. B. Reverse transfer of credit from the PARTNER institution to COLLEGE allows students to complete requirements for the associate degree in accordance with the Texas Education Code Section 2, Chapter 61, Subchapter S, Section 61.833. This program is specifically designed to

ArticulationAgreementBetween

LoneStarCollegeand

ThisAgreementisenteredintoandiseffectiveasofthedateoffinalsignature(the“EffectiveDate”),byandbetweenLoneStarCollege(the“COLLEGE”),whichisaninstitutionofhighereducationoftheStateofTexasandapublic juniorcollegepursuanttoSection130.004oftheTexasEducationCodethatislocatedinTheWoodlands,Texas,and (“PARTNER”),whichislocatedat .Whereas,theCOLLEGEandPARTNERseektoestablishthisArticulationAgreement(“Agreement”)tofacilitatestudents’transferfromCOLLEGEtoPARTNERPrograms.BothCOLLEGEandPARTNERmaybereferredtoindividuallyasa“Party”orcollectivelyasthe“Parties”.I. PURPOSE

A. This Agreement provides a framework to develop programs designed to enhance theeducational experience of students attending both COLLEGE and PARTNER institutions inareasincluding,butnotlimitedto:

i. Transferofcredit,includingTransferandReverseTransfer;

ii. Datasharing;

iii. Transferstudentbenefits.

BothPartiesenterintothisAgreementinthespiritofcooperationandtomutuallyrecognizeeach other as quality institutions of higher education. Each Party is dedicated to servingstudentsfromdiversepopulations.

II. TRANSFEROFCREDIT

A. TransferofcreditfromCOLLEGEtothePARTNERinstitutionforthepurposeofcompletionofa baccalaureate program of study is designed to maximize the amount of course workcompletedfortheassociatedegreeapplicabletothebaccalaureatedegree.

a. Credits from COLLEGE that are transferrable to PARTNER degree programs may bespecifiedinanyamendment(s)tothisAgreement.

b. PARTNERwillrecognizefortransfercreditwithinlegalandaccreditationlimitations,nolessthan60semestercredithoursofcourseworksubmittedfromCOLLEGEresultingfromtransfer credit, dual/concurrent enrollment, advanced placement, CLEP, or otherrecognizedmeansbywhichcreditisawardedbyexamination(asappropriateandsubjecttoCOLLEGEpolicies).

allowstudentstoreceivetheadvantagespursuanttocompletionoftheassociatedegreewhentheyleaveCOLLEGEandpriortocompletionofthebaccalaureatedegree.

a. PARTNERwillprovideCOLLEGEwithinformationontransferstudentstohelpCOLLEGEofficials determine students who could benefit from reverse transfer of courses andCOLLEGEwillprovidePARTNERwith informationaboutdegreesawardedasa resultofreversetransfer,subjecttoapplicablestateandfederallaws.

b. COLLEGEandPARTNERwillwork together to establish a timeline for record exchange,includingoriginalsubmissionandthescheduleofrepeatedacademicrecordsubmissions.

c. SeparateacademicrecordsforstudentswillbemaintainedateachParty’sinstitution.

C. COLLEGEandPARTNERwillpromotetheopportunityoninstitutionwebsites,insocialmedia,inprintedandelectronicmaterials,andthroughvariouspresentations,mediarelations,andevents.

III. DATASHARING

A. COLLEGEwillprovidethefollowingdataelementstoPARTNERonanannualbasis:

a. Directoryinformation,asdesignatedbyCOLLEGE,forstudentswhohaveexpressedastatedinterestintransferringtoPARTNERinstitution;

b. MajorareaofinterestforstudentswhohaveexpressedastatedinterestintransferringtoPARTNERinstitution,and

c. Studentinformationwithinlegalguidelinesaboutspecificstudentswiththegoalofmakingstudents aware of scholarship, financial aid, and the potential to satisfy degreerequirementsbytransferringcourseworkbetweenbothParties.

B. PARTNERwillprovidethefollowingdataelementstoCOLLEGEonanannualbasis:

a. DirectoryinformationforstudentslivingintheCOLLEGEservicearea;

b. DegreenameandcompletionstatusofCOLLEGEtransferstudents;

c. SemestersattendedbyCOLLEGEtransferstudents;

d. HourscompletedbyCOLLEGEtransferstudents;

e. GradePointAverageofCOLLEGEtransferstudents,and

f. Studentinformationwithinlegalguidelinesaboutspecificstudentswiththegoalofmakingstudents aware of scholarship, financial aid, and the potential to satisfy degreerequirementsbytransferringcourseworkbetweenbothinstitutions.

C. COLLEGEagreesthatdatatransferredfromPARTNERtoCOLLEGEisandshallremainthesole

and exclusive property of the PARTNER. PARTNER agrees that the data transferred fromCOLLEGEtothePARTNERisandshallremainthesoleandexclusivepropertyofCOLLEGE.

D. Datasharingpracticesandstoragewillbeconsistentwith theFamilyEducationRightsand

PrivacyAct(FERPA)aswellasCOLLEGEandPARTNERpoliciesandproceduresformanagingstudentrecordsandotherconfidentialinformation.

C. Recognize the eligibility of COLLEGE students and employees to apply for the followingscholarshipprogram(s): .

c. Renewableforupto termsbasedonmaintainingeligibility.

D. COLLEGEstudentsandemployeesadmittedtoPARTNERinstitutionwillbeallowedaccesstoacademicadvisingservicesatPARTNERinstitution.

E. StudentsjointlyadmittedtoCOLLEGEandPARTNERinstitutionwillreceive:

a. StudentIDatCOLLEGEandPARTNERinstitution;

b. Studentcomputer/internetaccountatCOLLEGEandPARTNERinstitution;

c. StudentaccesstocomputerlabsatCOLLEGEandPARTNERinstitution;

d. StudentaccesstolibrariesatCOLLEGEandPARTNERinstitution;

e. StudentaccesstosportingeventsatPARTNERinstitution,and

f. Freeelectronictransfertranscripttransmission/evaluation.

F. COLLEGEHonorsstudentsadmittedtoPARTNERinstitutionwillreceive:

a. AcceptancetoPARTNERinstitutionHonorsCollegewithaminimumGPAof andsatisfactionofthefollowingHonorsCollegeadmissioncriteria: );

b. PARTNERwillacceptaminimumof12hoursoftransferHonorscredits;

c. Honorstransferstudentswillbeeligibleformeritandneed‐basedaidcommensuratewithqualifications.COLLEGEandPARTNERwillworktogethertoprovideasimpleprocessforscholarshipapplication;

d. HonorstransferstudentswillbeeligibletoliveinPARTNERHonorshousing,and

e. COLLEGEandPARTNERwillworktoprovideadditionalopportunitiestoHonorstransferstudents,suchaspotentialaidforhousing,potentialtravelandstudyabroadbenefits,andjoint admissions benefits. All opportunities will be detailed in Appendices to thisAgreement.

V. TERM

A. ThisAgreementwillcommenceon (date)andremainineffectfortwofullacademicyears,includingsummer,andshallautomaticallyrenewforthreeadditionalone‐yearterms for a maximum five‐year term unless sooner terminated in accordance with this

Agreement. Either Partymay requestmodification of thisAgreement inwriting, subject toreview.

B. Immediate termination will occur if either COLLEGE or PARTNER loses their current

accreditationstatus.Ifterminationduetoalossofaccreditationoccurs,theAgreementwillendretroactivetothedatetheaccreditationstatuschanged.

C. Notwithstandinganyotherprovisionof thisAgreement,eitherPartyshallhavetheright to

terminatethisAgreementuponten(10)days’priorwrittennoticeifthePartytowhomsuchnoticeisgivenhasbreachedanyprovisionofthisAgreement,andsuchbreachshallnothavebeencuredwithintwenty(20)daysfollowingthereceiptofsuchnotice.

D. Notwithstandinganyotherprovisionof thisAgreement,eitherPartyshallhavetheright to

terminatethisAgreementafterthirty(30)calendardays’writtennoticeisgiventotheotherParty.

E. NotwithstandinganyotherprovisionofthisAgreement,intheeventoftermination,PARTNER

agreestoensurestudentscurrentlyenrolledinornewlyacceptedintoaProgramunderthisAgreement,priortotheeffectiveterminationdate,willbegiventheopportunitytocompletetheirDegreeProgramwithPARTNER.

VI. RELATIONSHIPOFTHEPARTIES

A. It is agreed andunderstood that nothing in thisAgreement shall be construed to implyorcreate any partnership, joint venture, association, or like relationship between the Parties.NeitherPartyshallhavethepowertoobligateorbindtheotherinanymannerexcepttotheextenthereinprovided.

VII. GENERALPROVISIONS

A. This Agreement and all attached Exhibits and Appendices (collectively known as the“ArticulationAgreement”or“Agreement”),containstheentireagreementbetweenCOLLEGEandPARTNERandmayonlybemodifiedinwritingbytheindividualsauthorizedtoexecuteonbehalfoftheirrespectivePartybelowortheirdesigneesatleastthirty(30)daysinadvanceofthemodification.

B. PartiesagreethatthisAgreementwillbeconstruedbythelawsoftheStateofTexas(exclusive

of its conflict of laws provision), and venue for purposes of claims, or litigation shall beHouston,HarrisCounty,Texas.

C. AnynoticerequiredorpermittedunderthisAgreementshallbeconsideredeffectiveasofthe

datesentbycertifiedmail,returnreceiptrequestedasfollows:

D. ThisAgreementisenteredintobyandbetweenthePartiesheretoandfortheirbenefit.Unless

explicitlyprovidedinthisAgreement,thereisnointentbyeitherPartytocreateorestablishthirdpartybeneficiarystatusorrightsinanythirdparty,andnosuchthirdpartyshallhaveanyrighttoenforceanyrightorenjoyanybenefitcreatedorestablishedunderthisAgreement.

E. ThisAgreementmaybeexecutedinmultiplecounterparts,eachofwhichwillbedeemedan

original,butallofwhichtakentogethershallconstituteoneandthesameinstrument.

F. Each individual executing this Agreement on behalf of any Party expressly represents andwarrants that he/she has authority to do so, and thereby to bind Party on behalf ofwhich/whomhe/shesigns,tothetermsofthisAgreement.

COLLEGE and PARTNER agree to the following terms and conditions (in addition to thespecificationsoftheArticulationAgreement):

A. Students applying to COLLEGE and simultaneously meeting PARTNER admissionrequirementsmayapplyforandbeacceptedintothejointadmissionprogramfollowingthePARTNERinstitution’sapplicationprocess.

B. IfastudentdoesnotmeetthePARTNERinstitutionentrancerequirementsatthetimetheyenterCOLLEGE,theyarenoteligibleforjointadmission.TheymaybecomeeligibleatafuturedatebymeetingtherequirementsfortransferstudentadmissiontoPARTNERinstitution.

C. After acceptance under joint admission, a student must continually meet all admissionrequirementsforbothinstitutionstoretaintheireligibilitytoparticipateintheprogram.

D. Students accepted under joint admission may transfer, alternate enrollment betweeninstitutions,orco‐enrollattheirdiscretion.

E. Students opting for co‐enrollment must meet all payment deadlines for the respectiveinstitutions.Meansforreducingstudentfinancialobligationswillbeexplored.COLLEGEandPARTNERwill strive tomake financial aid transfer between the respective institutions asconvenientaspossibleforthestudent.

F. StudentswholosetheireligibilitytocontinueinclassesateitherParty’sinstitutionlosetheireligibilitytoparticipateinthejointadmissionsprogram.EachPartyreservestherighttoallowstudentstocontinueatitsrespectivediscretion.

G. Students are expected to abide by conduct, computer/internet usage, and facilities usagepoliciesateachinstitution.Studentswhoco‐enrollwillbeexpectedtobeknowledgeableoftherulesforstudentsatbothinstitutionsandagreetocomplywithsaidrules.Studentsappealingacademicordisciplinaryissueswillbedirectedtotheinstitutionunderwhosejurisdictionthematterfallsandwillfollowestablishedproceduresatthatinstitution.

H. Students may transfer courses covered by articulation agreements freely between bothinstitutions.
