PUBLIC HEALTH & SAFETY COMMITTEE Date and Time: Monday, September 18, 2017, at 5:15 pm, (Council Chambers) Members Present: Rasmussen, Wagner, Kellbach, Peckham, McElhaney Others Present: Alfonso, Rayala, Hardel, Kujawa, Goede, Mielke Minutes of the previous meeting(s) (8/21/17 & 8/28/17) Motion by Kellbach, second by Peckham to approve the minutes of previous meetings. (8/21/17 & 8/28/17). Motion carried 5-0. Consider various license applications Rasmussen stated there were recommendations for denial of Public Transport Divers Licenses for Chase Kasper and Daniel Oheron; and an Operator License for Chia Meng Xiong. It was noted that none of the individuals were present to appeal. Rasmussen noted there is an application for a Class B Beer license for REB Enterprises, LLC dba as the Wausau RiverWolves Hockey Team, operating out of Marathon Park beginning on October 1, 2017. Rasmussen reported the Liquor License Review Subcommittee met prior to this meeting to consider the license application of Daly’s, LLC, for the Class B Beer & Liquor license surrendered by Third Peak Hospitality, LLC (formerly Crostini’s). The subcommittee reviewed the plan of operation and recommended approval for Daly’s who plans to open in October. It was noted that these two applications would need to be taken to the September 26, 2017 Council meeting. There is also a Class B Beer/C Wine application for Mid State, LLC, dba as La Taqueria Restaurant, 520 S 17th Avenue. Luis Melendez, owner, addressed the committee indicating they planned to open around Thanksgiving. It will be casual, fast paced, no live entertainment, an outdoor patio area, with operational hours from 11:00 am – 10:00 pm. Motion by Wagner, second by McElhaney to approve or deny license applications as recommended by staff. Motion carried 5-0. Discussion and possible action regarding pedal pubs or pedal taverns. Rasmussen stated this was discussed a few years ago when they were fairly new and some communities prohibited them; since then, some communities are now allowing them, but with restrictions. She indicated we have recently received interest in having one in the City of Wausau. Dan Dadabo and Ashley Sampson addressed the committee and provided background information on themselves and indicated they would like to provide a pedal pub business. Dadabo proposed a pedal pub business that would be treated like a limo, which is exempted from open container laws. He stated safety would be their top priority; no alcohol would actually be served on the pedal pub, the riders would bring their own; the driver of the bike would be the only person allowed in the center of the bike. (He referred to pictures provided in the packet.) The driver would never be allowed to consume alcohol while operating the bike and all employees would undergo a background check. He stated the top speed of the bike is approximately 8 mph, less than your average jogger. No glassware would be allowed on board. They felt The 400 Block and the riverfront would be a perfect location due to the concentration of businesses in that area, as opposed to residential areas. He stated the hours proposed would be between 10:00 a.m. to 9:00 pm. Dadabo indicated they were open to discussion about having music on the bike. Ashley Sampson stated the alcohol brought on board would have to be a closed container. She explained they could purchase it from businesses that we would be working with and would stop at, where they could purchase closed containers and bring them on to the pedal pub. Alfonso stated the changes to the law were that pedal pubs were a place that alcohol could be consumed as an unlicensed premise, like a park. It could be purchased from anywhere or brought from home as long as it is sealed. The statutes also have a limitation on how much can be brought on of not more than 36 ounces of beer or fermented malt beverages. She noted some communities have reduced that limit, such as Madison, which limits to not more than 24 ounces. Rasmussen stated there would need to be some type of specified route. Alfonso stated Madison, LaCrosse and Green Bay have them and they all require an approved route which cannot be changed without permission. Wagner did not feel they should operate after dark. Sampson stated the typical route is about a mile and they would like to partner with some of the key places of Wausau, such as Bull Falls Brewery, Malarkey’s, Red Eye, etc., to support these businesses.

Hardel questioned if the driver would be a licensed bartender. Dadabo stated they would not because they would not actually be serving the alcohol. Hardel questioned how they would handle minors or the possibility of people jumping off or on. Dadabo stated the driver would have riders sign waivers and would be ensuring the amount of alcohol brought on the bike is what is allowed by law. Sampson stated the drivers will be trained on how to handle riders that have had too much to drink; they make sure there are eight people on the pedal pub. Discussion took place regarding not using streets with a speed limit higher than 25 mph and avoiding busy streets, such as Scott Street. Sampson explained you have to have a minimum of eight people to operate the pedal pub, so groups would sign up and pay a group fare for a tour for approximately three hours with maybe four stops. The consensus was to direct Alfonso to draft an ordinance and bring it back to the next committee meeting for review and discussion. Rasmussen indicated they were looking for an approved route process; a limitation on the quantity of sealed containers; only getting off and on at approved stops; drivers take the Responsible Beverage Service training; include penalties for jumping off or breaking the rules. Clarification, discussion or possible action regarding issuing of miscellaneous licenses and/or permits (Bee Keeping, Chicken Keeping, Pet Fancier) Rasmussen explained there has been an issue with applicants waiting for these licenses that are delayed a month or more by having to go through Public Health & Safety Committee. Since the committee is not doing the inspections for these permits, once they are inspected and approved by staff the clerk should be authorized to issue them. Alfonso clarified that the Bee Keeping and Chicken Keeping permits do not require Public Health & Safety approval, however, the Pet Fancier License does require approval of the committee. It was noted the live animal/poultry sale in a marketplace also requires committee approval. Rasmussen commented it makes sense for the committee to talk with the owners of the marketplace because there are a lot of questions that we would ask, but with regard to Pet Fancier, they should be allowed to be issued administratively. Wagner felt the Marathon County Health Department has to somehow be involved with the approval of the sale of live animal/poultry in the marketplace. He suggested they would need to pass inspections by both the Humane Officer and the Health Department. Alfonso stated the live animal market was not specifically on the agenda, so she would bring it back next month. Motion by McElhaney, second by Peckham to approve amending the ordinance to allow Pet Fancier Licenses to be issued by the clerk following inspection and/or approval of the Humane Officer. Motion carried 5-0. Operations Report from Fire Department for August 2017 Chief Kujawa stated Mark Mirek is no longer going to be our Medical Director as he is moving. She also reported on an application for a $100,000 technological grant to be split by three departments, in which Wausau has made it into the top 5 out of 39 applicants. Report placed on file. Tavern Activities / Compliance Checks / Law Enforcement Activities Hardel presented the Tavern Report for August 3, 2017 through September 4, 2017. Applications as listed have or will have a background check run by staff and reviewed by the Police Chief or his 

designee.   Applications marked pending will have a status update at the meeting.  In accordance with city 

ordinance, all permits approved are held for debts owed to the city until the debt is paid in full. 

 

1. Denial Recommendations by the Police Department:  Two Operator Licenses – New:  1) Dustin 

Georgeson, Lengthy criminal record; and 2) Anthony Zelenka, Lengthy criminal record.  Also, four Public 

Transport Driver Licenses:  1)  Shelbie Klopp, Very lengthy record which includes felonies; 2)  Michael 

Kratwell, Lengthy criminal record; 3)  Bobbie Jo Roth, Convicted sex offender, lengthy record; 4) Dale 

Ware, Multiple felony convictions.   

 

2. The Liquor License Review Subcommittee recommends the available Class B Beer & Liquor License be 

awarded to Mid State LLC, dba La Taqueria, 520 S 17th Avenue.  This would go to Council on November 

14th and they plan to open about November 15th or just before Thanksgiving.   Other applicants 

considered were:  Tyler Vogt, dba The Diner; Downtown Grocery; Jenny’s Family Restaurant, and 

Mountain Lanes, Inc.   

 

3. License list contains various approved Operators and Public Transport Drivers.  There are no special event 

applications this month.

COMMENTS ON CREATING CHAPTER 5.73 COMMERCIAL QUADRICYCLE

The City has been requested to consider the matter of commercial quadricycle operation

(commonly known as “pedal pubs”). The proposed ordinance establishes a licensing arrangement for the operation of these

vehicles on City streets and roads in a manner which seeks to ensure the public, health and safety of those travelling on a commercial quadricycle, as well as pedestrians and other vehicles that also share City streets and roads.

The highlights of the proposed ordinance include: - Licensing of the quadricycle business owner, as well as quadricycle drivers on

an annual basis. License term is proposed as one year. - Requires pre-approved travel routes by the Public Health & Safety

Committee, Common Council and Police Department. The Chief of Police would have the authority to approve requests for temporary routes.

- Limitation on the hours of operation of commercial quadricycles carrying passengers from 10:00 a.m. through 10:30 p.m.

- Requires quadricycle drivers to be responsible for actively and affirmatively managing the behavior of passengers.

- Prohibits music, yelling or conversation that carries to nearby residences audible above the level of conversational speech at a distance of 50 feet for more.

- Requires certain conditions for the safe loading and unloading of passengers. - Permits the carry-on and possession of not more than 36 ounces of fermented

malt beverages. No other alcohol beverages are permitted on a commercial quadricycle.

- Prohibits glass containers. - Requires commercial quadricycles to meet certain equipment and safety

standards such as headlights, brake lights and reflectors. - Requires a commercial general liability insurance policy naming the City, its

employees and agents as additional insureds with minimum limits of $2,000,000.

An open issue remaining for decision is the amount of the commercial quadricycle

business license and the commercial quadricycle driver’s licenses. For purposes of comparison, taxi/limousine transportation company licenses are $200.00 per year and operator’s licenses are $50.00 per year.

The Common Council of the City of Wausau do ordain as follows:

Section 1. That Chapter 5.73 Commercial Quadricycle Licensing is hereby created to read as follows: 5.73.010 Definitions. For purposes of this chapter, the following definitions shall apply: (a) “Commercial Quadricycle” has the meaning given in Wis. Stat. s. 340.01(8m). (b) “Commercial Quadricycle Business” means any person, entity or other enterprise that owns a commercial quadricycle or manages the operation of a commercial quadricycle for profit or not for profit. (c) “Commercial Quadricycle Driver” means any person who operates a commercial quadricycle. 5.73.020 License required. (a) No person may engage in the activity of operating a commercial quadricycle business without first obtaining a license from the city clerk as required under this chapter. (b) No person shall operate a commercial quadricycle without obtaining a commercial quadricycle driver’s license from the city clerk as required under this chapter.

5.73.030 License fee. (a) The annual fee for a commercial quadricycle business license shall be as set forth in section 3.40.010(a). (b) The annual fee for a commercial quadricycle driver’s license shall be as set forth in section 3.40.010(a). (c) The license fee for any license issued under this chapter shall be paid at the time the application is filed with the city clerk. License fees are non-refundable. 5.73.040 License term. Licenses issued under this chapter shall be issued on an annual basis beginning on January 1 and expiring December 31. 5.73.050 License application. (a) Applicants for a commercial quadricycle business license shall submit a sworn application on a form provided by the city clerk which shall give the following minimum information: (1) Name, address, and telephone number of the applicant; indicate whether the applicant is a natural person, partnership, corporation, unincorporated association or limited liability company; and, the names and addresses of all partners, members or officers and directors of the entity or enterprise as the case may be. (2) If the applicant is a natural person, the date of birth and driver’s license number of the applicant. If the applicant is a partnership, corporation, unincorporated association or limited liability company; the names and addresses of all partners, members, or officers and directors of the entity or enterprise as the case may be. (3) A statement of whether the applicant or any partner, member, officer or director has been arrested or convicted of any crime or ordinance violation together with a description of the nature of the offense and the place of conviction. (4) The number of quadricycles to be operated or controlled by the applicant, the serial number of each vehicle, the number of persons the vehicle is designed to carry and a photograph of the quadricyle unit(s) to be operated. (5) A detailed description or map of the proposed route on which the quadricycle is to be operated. (6) The location of proposed depots or terminals where passengers will be picked up or dropped off and written permission from the property owner where such depots or terminals will be located. (7) Such further information as the city may require. (b) Applicants for a commercial quadricycle driver’s license shall submit a sworn application on a form provided by the city clerk which shall give the following minimum information:

(1) Full name, address, phone number, and date of birth of the applicant. (2) Driver’s license number. (3) An acceptable passport sized photograph of the applicant. (4) A statement of whether the applicant has been arrested or convicted of any crime or ordinance violation together with a description of the nature of the offense and the place of conviction. (5) Such further information as the city may require. (c) Every quadricycle driver shall meet and maintain the following requirements in order to hold a commercial quadricycle driver’s license: (1) A valid driver’s license issued by the state in which they reside and be eligible to drive in the State of Wisconsin. (2) Be at least 18 years of age. (3) Shall not have an arrest or conviction record subject to Wis. Stat. §§111.321, 111.322, and 111.335. (4) Have successfully completed within the 2 years prior to the date of application the responsible beverage server training course set forth in Wis. Stat. §125.04(5)(a)5. (5) Any time a quadricycle driver’s automobile driver’s license is suspended, revoked, or canceled, the quadricycle driver’s license shall likewise be immediately suspended, revoked or canceled until such time as his or her automobile driver’s license is reinstated, at which point he person may reapply to the City for a quadricycle driver’s license. 5.73.060 Insurance. A commercial quadricycle business must have in force at all times, adequate liability insurance and must agree to indemnify, defend, and hold the city, its employees and agents harmless against all claims, liability, loss, damage, or expense incurred by the city as a result of any injury to or death of any person or damage to property caused by or resulting from the activities for which a license may be granted. As evidence of liability insurance, the commercial quadricycle business shall furnish a Certificate of Insurance, on a form acceptable to the city, evidencing the existence of commercial general liability insurance naming the City of Wausau, its employees and agents as additional insureds with minimum limits of two million dollars ($2,000,000.00) in the aggregate. The policy of insurance or insurance certificate shall identify each commercial quadricycle covered by the policy. Whenever such policy is cancelled, not renewed, or materially changed, the insurer and the licensee shall notify the city by certified mail. No license shall be issued until the applicant provides proof of insurance in compliance with this section. 5.73.070 Approved assembly sites and routes required. (a) All commercial quadricycle businesses shall operate tours only from approved commercial locations on private property approved by the city. These sites shall be used by the licensed business as the locations for patrons to gather and assemble prior to embarking on a commercial quadricycle tour and to disembark at the conclusion of the tour. Approved sites shall provide patron access to restroom facilities. (b) Commercial quadricycles shall operate only on routes approved by the chief of police or his or her designee, the public health and safety committee and the common council. Any new route

must be applied for and approved by the common council in advance. Temporary routes must be applied for and approved by the chief of police or his or her designee. A temporary route application must be submitted in writing and include a proposed map no later than three (3) business days prior to the applicant’s proposed first date of operation of the temporary route. No quadricycle driver may operate a commercial quadricycle on a street closed off to public traffic regardless of whether the street has been included in an approved route. 5.73.080 Operating Restrictions and Conditions. (a) Commercial quadricycles shall only be operated on routes specified in the approved application. (b) No person may drive a commercial quadricycle occupied by passengers after 10:30 p.m. or before 10:00 a.m. (c) No commercial quadricycle shall use any public street or other public property as a waiting area unless such area is a legal motor vehicle parking area or as otherwise permitted pursuant to this code. (d) No driver shall stop to load or unload passengers or their belongings in the intersections of any street, in a crosswalk or in any manner or other location that would be considered unsafe. No driver shall load or unload in any such manner that will in any way impede or interfere with the orderly flow of traffic on the streets. (e) No commercial quadricycle shall be operated or parked on a public sidewalk. (f) No commercial quadricycle business or driver shall allow any person to drive a commercial quadricycle unless that person holds a valid commercial quadricycle driver’s license and a valid Wisconsin driver’s license or valid driver’s license issued by any other state. No person may drive a commercial quadricycle while such person’s Wisconsin driving privileges are suspended or revoked. (g) The driver of a commercial quadricycle shall operate the quadricycle at all times in compliance with applicable city and state traffic and parking laws. A commercial quadricycle driver shall not permit or cause a commercial quadricyle to be operated in any unsafe manner or operating condition. (h) Each passenger on a commercial quadricycle is permitted to carry on to the commercial quadricycle no more than 36 ounces of fermented malt beverages as defined in Wis. Stat. §125.02(6). No other alcohol beverages as defined in ch. 125, Wis. Stats. may be possessed on, carried upon, or consumed upon a commercial quadricycle. (i) No alcohol beverages, including fermented malt beverages shall be possessed, carried on, or consumed on a commercial quadricycle if any passenger on the commercial quadricycle has not attained the legal drinking age as defined in Wis. Stat. §125.02(8m) unless that person is accompanied by his or her parent, guardian, or spouse who has attained the legal drinking age. (j) No driver or employee riding on a commercial quadricycle may consume alcohol or have a blood alcohol concentration of more than 0.0 while hired to transport passengers.

(k) No glass containers may be carried on a commercial quadricycle. (l) No person may drive a commercial quadricycle on which any alcohol beverages are carried or consumed other than fermented malt beverages under this section. (m) All commercial quadricycles shall be clean and maintained in a good state of repair. All commercial quadricycles shall be well painted, have an appearance free of damage or deterioration and be in a safe operational condition. Passenger compartments shall be free of trash and refuse and free of odor. Seats shall be kept clean and free of stains and tears. Commercial quadricycles shall be inspected daily by the commercial quadricycle business and the driver for daily wear and tear and any adjustments and repairs shall be made before transporting passengers. (n) No commercial quadricycle driver shall permit more passengers to be carried in a commercial quadricycle other than the normal seating capacity and no more than two persons in addition to the driver shall be in the center aisle while quadricycle is in motion. (o) No commercial quadricycle driver shall text or use a cell phone or any other type of electronic device while driving a commercial quadricycle. (p) No driver shall drive or be permitted to drive a commercial quadricycle for more than a period of ten hours in any twenty-four hour day. (q) No music or amplified sound shall be played, nor yelling or conversation conducted in such a manner that the sound carries to nearby residences or properties and is audible above the level of conversational speech at a distance of 50 feet or more from the point of origin of the sound. (r) It is the responsibility of the driver to actively and affirmatively manage the behavior of the passengers so that their behavior remains law abiding during the excursion, both while the vehicle is in motion and at a stop. Behavior which shall be prohibited and prevented includes specifically, but is not limited to, violations of state law and local ordinances regarding indecent exposure, disorderly conduct, public urination and littering. (s) All commercial quadricycles shall be, at all reasonable times, subject to inspection by the city police department. (t) All commercial quadricycles shall have the trade name and telephone number of the commercial quadricycle business conspicuously displayed on the commercial quadricyle. A commercial quadricycle shall conspicuously display the commercial quadricycle business license. (u) It is the responsibility of the commercial quadricycle driver to properly dispose of all trash. (v) Any commercial quadricycle not in compliance with the minimum requirements of this chapter may be cited and placed immediately out of service. Any quadricycle which has been so removed from service shall not be returned to service until such vehicle has been approved by the chief of police for resumption of service.

5.73.090 Vehicle Safety and Equipment Standards. No commercial quadricycle business licensee or driver shall operate or allow the operation of a commercial quadricycle on any street unless the commercial quadricycle meets the following equipment and safety standards: (a) Tires. Tires shall be of a size appropriate for the vehicle with no mismatched tires per the design of the vehicle. There shall be no cuts to the tire, localized worn spots that expose the ply, or visible tread wear indicators. (b) Operational horn. The commercial quadricycle shall be equipped with a fully operational horn or bell. (c) Brakes. The commercial quadricycle shall be equipped with a front and rear braking system capable of being manipulated by the driver from the driver’s normal position of operation and capable of causing a commercial quadricycle with a loaded passenger compartment to come to a complete stop in a linear path of motion when each wheel of the vehicle is in contact with the ground on dry, level, clean pavement. The braking system controlling the rear wheels shall be a hydraulic disc braking system, which are unaffected by rain or wet conditions. An emergency brake shall also be provided in addition to the hydraulic disc braking system. (d) Headlights, taillights, mirrors, turn signals, and other requirements. Every commercial quadricycle shall be equipped with the operational equipment set forth in the subsections below: (1) A headlight capable of projecting a beam of white light for a distance at a minimum of 300 feet which shall be clearly visible during darkness and must be illuminated at all times during darkness. (2) A side-mounted mirror or a wide-angle rearview mirror affixed to the commercial quadricycle to reflect to the operator a view of the street for a distance of at least 200 feet from the rear of the commercial quadricycle. (3) A red light and brake light affixed to the rear of the commercial quadricycle which must be visible for a distance of at least 200 feet from the rear of the commercial quadricycle and must be illuminated at all times during darkness. Turn signals must be affixed to the front and rear of the vehicle. (4) All commercial quadricycles shall have reflectors on the frame and a red reflector mounted on each side of the rear of the vehicle, at least one inch from the outer edge and centered. In addition, the international slow-moving triangle must be displayed on the rear of the commercial quadricycle. 5.73.100 Commercial quadricycle business licensee responsibilities. Every licensed commercial quadricycle business shall: (a) Take affirmative measures to ensure that all of its owners and drivers comply with the terms of this chapter.

(b) Be responsible for ensuring that all commercial quadricycles are operated by a commercial quadricycle driver with a valid commercial quadricycle driver’s license issued under this chapter. (c) Ensure that no commercial quadricycle is operated in an unsafe mechanical condition or continues to operate after it has been ordered out of service. 5.73.110 Revocation or suspension. In addition to all other penalties, any violation of the terms of this chapter shall be grounds for revocation, suspension, or nonrenewal of the license pursuant to the provisions of chapter 5.04. 5.73.120 Commercial quadricycle passengers. No passenger on a commercial quadricycle shall disembark from the commercial quadricycle while it is in motion, while it is located in the intersection of any street, or other location that would be considered unsafe. 5.73.130 Penalties. (a) Any person violating this chapter shall, upon conviction for a first offense, forfeit $100.00, together with the costs of prosecution. Each and every day during which any such violation continues shall constitute a separate violation. (b) Any person violating this chapter shall, upon conviction for a second or subsequent offense, forfeit $200.00, together with the costs of prosecution. Each and every day during which any such violation continues shall constitute a separate violation.

Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 3. This ordinance shall be in full force and effect on the day after its publication.

Currently subsection (d) of W.M.C. §8.08.010, Certain creatures forbidden provides an exception to the general prohibitions against keeping, harboring or maintaining certain creatures in the city such as poisonous snakes, farm animals and wolves and permits the sale of live poultry or farm raised game birds at a marketplace upon compliance with certain conditions.

The ordinance currently provides that the permits shall be issued by the Public Health & Safety Committee.

In order to more efficiently process applications for these permits, it is recommended by the Public Health & Safety Committee that the City Clerk be authorized to issue these permits upon a determination by the City Clerk that all the requirements for such permits have been met by the applicant. Approval by the Public Health & Safety Committee therefore would no longer be required.

of live poultry or farm raised game birds (“Birds”) at a marketplace upon compliance with all of the following conditions:

. . . (3) The sponsor of the marketplace, or the owner of lessee of property on which a

marketplace is located, obtains a permit issued by the city clerk, which shall be valid only for a period of April 1 to November 1. The fee for such permit shall be as provided in section 3.40.010(a). Prior to issuance of a permit, the applicant shall submit to an inspection and demonstrate that the requirements of this subsection (d) are met or shall be met prior to the sale of any Birds. Permits shall be approved by the Public Health and Safety Committee prior to issuance. A permit shall be subject to revocation or suspension upon failure to comply with any provision of this subsection (d). Once a permit is revoked, a permit shall not be reissued to the holder.

(1) Event #170108299, 09/14/17 at 12:25 AM: An anonymous citizen called to complain about the noise coming from the bar. Officers responded and noted that they could barely hear anything while outside the bar. Contact was made with the bartender to advise them of the anonymous complaint. They were hosting karaoke, and agreed to turn it down more. The Officers noted that the bar had already kept the windows and doors closed to keep the noise to a minimum, and considered the complaint unfounded.

(2) Event #170112700, 09/25/17 at 6:30 AM: A named citizen called to report a person loitering on the porch entrance to the bar for the last twenty minutes. Before and Officer could respond, the reporting person called back to say the person was gone. No Officer responded and the call was cleared. The caller called back and requested extra patrol, saying that there a lot of “vagrants and idiots” in the neighborhood, and that the bar people are loud. The caller claimed he could see where people were urinating outside the bar again, and was concerned that someone would steal from him. The extra patrol request was given out to the sector Officers.

Cop Shoppe Pub, 701 Washington Street

(1) Case #17-10420, 09/11/17 at 11:24 PM: (Combined with Event #170106455) Two calls were received regarding a single individual that was being disruptive in the bar and trying to start fights. Officers responded and made contact with the male in question. The male was found to have valid warrants for his arrest, but resisted Officers trying to take him into custody, to include spitting and kicking at them. He was taken to Jail and booked in under the corresponding charges. A third call (Event #170106459) was created after it was discovered that the male that had been arrested had also damaged a bar patron’s bike that had been parked outside the bar. The last call for this property in this time frame (Event #170106476) was the owner of the bike calling again.

Domino Bar, 740 Washington Street (1) Event #170111255, 09/21/17 at 10:55 PM: An Officer responded to the bar for a

report of a found dog. The Officer returned the dog to its owner. (2) Event #170112152, 09/23/17 at 6:38 PM: A Patrol Officer and a K-9 Officer

conducted a K-9 sniff of a vehicle parked in the parking lot of the bar after having previously seen the vehicle at a residence with suspected drug activity. The dog sniff did not produce an alert for the odor of illegal drugs in the car and no enforcement action was taken.

El Jalapeno’s, 300 N. 3rd Street

(1) Case #17-10697, 09/17/17 at 2:23 AM: A complainant that refused provide their identity called to report that there was a male hitting his head against the pavement, and said it was between El Jalapeno’s and Oz bar. Officers responded and made contact with the reporting person, who then identified herself. She said that there was a fight that started outside El Jalapeno’s, and that there was a male that wanted to “fight everybody,” and was being held down by friends. An unidentified female was seen kicking that male in the head. The male that had been in the street was extremely intoxicated, and became combative while being transported to the hospital in the ambulance. The male was later taken to HCC for an alcohol detention and was not cooperative with an investigation. This call was entered in the CAD system under the Oz Bar, however I will not put it under that entry.

Glass Hat Bar, 1203 N. 3rd Street

(1) Case #17-10381, 09/10/17 at 3:07 AM: A bar employee called regarding a group of people that had been involved in a verbal argument that started inside the bar. They told the group to leave the bar, and the argument continued, so the employee called. Officers responded, and located the group near the railroad tracks, off the bar property. The altercation was confirmed to be only verbal in nature. One person was taken to jail for Probation/Parole violation.

(2) Case #17-10696, 09/17/17 at 2:11 AM: Officers were conducting extra patrol in the area of the bar when they observed two males in the parking lot behind the bar, one of whom appeared to be urinating. Contact was made with the male that was urinating, who provided a false name. One of the Officers remembered the male’s correct name from past contact, and arrested him. The male was charged with Obstructing an Officer, and was also held on a Probation Violation.

extra patrol in reference to someone throwing rocks over the fence and into their patio. Some of the patrons on the patio had been hit, but not hurt. An Officer sat outside the bar and did not find anything.

(2) Event #170111032, 09/21/17 at 11:50 AM: A citizen called to report that her car was keyed the previous night. There were no known suspects, and they were going to check bar surveillance before filing an actual complaint. The Officer advised the citizen that he could help her complete a self-report form if needed.

Intermission, 325 N. 4th Street

(1) Event #170113110, 09/26/17 at 1:57 AM: A 9-1-1 call was received reporting that there were two women fighting outside the bar. Officers responded and made contact with one woman, who admitted that she involved in an altercation with another woman, after she told the woman she should not drive home drunk. The other woman’s identity was not known, and the woman Officers had made contact with did not want to pursue the matter.

Malarkey’s, 412 N. 3rd Street

(1) Event #170111849, 09/23/17 at 1:17 AM: A citizen called in a noise complaint against the bar, saying the music was too loud. Officers responded and agreed that the music was loud, and noticed the bar had propped the door open. They were asked to close the doors, which helped lower the noise level. The Officer called the citizen back, but the citizen did not answer. A message was left explaining how the call was handled. **NOTE: Case #17-11002, 09/24/17 at 1:00 AM: A called was received after a male was found with stab wounds at the corner of 3rd Street and Jefferson Street, just outside of Malarkey’s bar. Upon investigation, the stabbing was found to have taken place in the parking lot of the Landmark apartment building, and the victim was able to move to the intersection, where he was located. The incident did not involve the bar directly, and some of the employees were helpful during the incident.

VFW Burns Post 388, 388 River Drive (1) Case #17-11482, 10/03/17 at 8:57 AM: Officer took a walk-in complaint of a fight

that had occurred on 09/30/17, during a wedding reception that was held at the bar. The Officer took the complaint, which involved a confrontation with the complainant’s friends and the bride of the wedding. The fight included pulling of hair, dragging to the ground, and grew from there as more people were involved. More than one person was hit with a bottle in the head. The investigation in continued, as the investigating Officer attempts to make contact with others involved. The Officer did not make contact with any bar employees, but noted in his report that the fight had taken place in the basement, below the restaurant area of the building. Based on the description of the size of the fight, I believe a staff member from the VFW should have been aware of the incident and contacted the Police. Assessed 50 Demerit Points for failing to maintain an orderly premise. I will forego the enhanced assessment of 50 Demerit Points, as the injuries are alleged by the victims to have occurred at the wedding, and Officers did not witness the injuries at the scene.

Wausau On The Water (WOW), 1300 N. River Drive

(1) Event #170114772, 09/29/17 at 5:47 PM: A family called to report their child dropped $20.00 in the parking lot. Someone else behind them pick it up. The child confronted the people that picked up the money, but they claimed it was theirs. They had left before the Officer arrived and their identities were not known. WOW gave the family a $20.00 gift card. No report was filed.

Cheers Bar, 101 E. Thomas Street

(1) Event #170114482, 09/28/17 at 10:48 PM: The owner called to report that a person named “Nick” had broken the front windows of the bar, and had slammed a mug behind the bar. The suspect was identified, since the owner knew him as a regular. However, the owner insisted on not pursuing charges for the damage, and did not want him banned from the bar.

DenMar Tavern, 601 W. Thomas Street

(1) Event #170105203, 09/07/17 at 9:56 PM: An anonymous caller reported a noise complaint of yelling, screaming and swearing outside the bar. Officers responded but did not locate any disturbance. No further Law Enforcement action was taken.

Lumpy’s Bar, 265 Chellis Street

(1) Case #17-10608, 09/14/17 at 11:49 PM: A called that refused to be identified called to report that a woman was getting beat up by her boyfriend. Officers responded and as a result of the investigation, a male was referred for Disorderly Conduct and Criminal Damage to Property (Domestic-related).

Roc’s Place, 810 S. 3rd Avenue ***NOTE: Case #17-11616, 10/06/17 at 1:30 AM: This event will be on next month’s bar report; however, due to the serious nature of the event, I thought it necessary to include the information on this month’s report to keep everyone apprised. Unless otherwise mandated, I will assess Demerit Points as normal at the next bar report. Three separate calls were received reporting gunshots fired outside the bar. Officers were in the process of doing a walk-through when the call came in, and observed some of the aftermath, however, no one was discovered to have been injured, and the suspects involved were not identified. A suspect vehicle was stopped shortly after the incident; however the occupants denied involvement and were arrested on non-related drug charges. Several bullet casings and some actual bullets/projectiles were recovered at the scene. The investigation has been turned over to the Detective Bureau for further follow up. I anticipate assessing 50 Demerit Points for Failure to Maintain an Orderly Premise. (1) Event #170106111, 09/10/17 at 12:26 AM: A bar employee called to report a fight

that was occurring and that the fight involved a gun. Officers responded, and found no fight in progress. Contact was made with the caller and the bar owner. It was determined that all of the people involved in the fight had left prior to Officer arrival. No Law Enforcement action was taken.

(2) Event #170109276, 09/17/17 at 1:58 AM: A Patrol Lieutenant was on foot in the bar parking lot when he noticed a verbal altercation taking place outside the bar on the sidewalk. The Lieutenant made contact with the male, who was belligerent the entire time. The male’s friend assured that he would take the male away from the area. A short time later, the same boisterous male was in another verbal altercation, and began yelling at Officers as they approached him. His friend again tried to get him to leave. The male eventually moved into the street, was yelling and stopping traffic on S. 3rd Avenue. Another Officer the Lieutenant moved in to attempt to arrest the male, however the friend intervened enough and physically removed the friend from the area for good.

(3) Event #170111803, 09/22/17 at 11:33 PM: A bar employee called to report that there was a patron that was refusing to leave the bar. Officers responded and made contact with a male, and eventually gave the male a ride to his residence. It was not noted in the call if it was the same male that had been a problem for the bar.

(4) Case #17-11381, 10/01/17 at 1:00 AM: A bar employee called to report that there was a male out of control at the bar. Officers responded and determined there had been a domestic incident between a male and female at the bar. The male was arrested for Domestic Battery and Disorderly Conduct, and taken to jail. The female was referred to the District Attorney’s Office for similar charges, advised that she could not return to the bar, and released at the scene.

dispute that was occurring outside the bar. Two males were arguing with someone else about the cab that had pulled up. Another cab was called for the other people and they were separated. These people had come from Roc’s Place and were part of the exterior crowd after the bar had closed.

Day’s Bowl-A-Dome, 1715 Stewart Avenue

(1) Event #170108348, 09/15/17 at 14:17 AM: An employee called to report finding the door to the business open, even though the business was closed. Officers responded and cleared the building, determining that nothing was amiss. The employee suspected that the night crew failed to properly lock the door.

Whiskey River Bar & Grill, 5512 Stewart Avenue

(1) Event #170112866, 09/25/17 at 4:06 PM: An employee called to file a complaint against a co-worker for harassment. The caller stated the co-worker was very vulgar. An Officer called the reporting person and was advised that the issue would be taken care of through the employer and no longer need Law Enforcement intervention.

101 Pub, 101 N. 3rd Avenue

(1) Case #17-10901, 09/22/17 at 1:45 AM: A bar employee called to report an altercation taking place at the bar. On arrival of the Officers, the involved patrons were still in the bar and engaged in a verbal argument. Those involved denied a physical altercation, even though one of them had a ripped shirt. The two males were issued citations for Disorderly Conduct and released.

Campus Pub, 1110 W. Campus Drive

(1) Case #17-11454, 10/02/17 at 9:56 PM: A bar employee called to report that there was a fight in the parking lot. Officers responded and made contact with two female victims, who reported that a male that had fled the scene on foot had battered them. One of the women sustained a broken nose and teeth as a result of being struck. Officers later located the male in a different part of the city and took him into custody. He had abrasions to his hands and blood on his shirt, but denied having been at the bar. The bar owner provided video footage that confirmed that it was the same make taken into custody that had attacked the women. Officers later recovered a pistol from the area in which the male had been taken into custody. The investigation continues into whether the male had discarded the weapon prior to being taken into custody.

the front door. On arrival, Officers located a newly hired cleaning person, who was not familiar with how to reset the alarm. A key holder was contacted, and responded to the bar to reset the alarm. An alarm form was completed.

Labor Temple, 318 S, 3rd Avenue

(1) Event #170109226, 09/16/17 at 11:09 PM: A citizen called to report hearing six gunshots in the area. Officers responded and checked the area. No evidence was located, and no injuries were reported. Officers were unable to locate the source of the sounds.

Showtime Gentlemen’s Club, 1709 Merrill Avenue

(1) Event #170112316, 09/24/17 at 1:28 AM: A bar employee called to report that there was a fight between several males in the parking lot behind the bar. The caller reported that everyone had already left, and that there were no injuries. An Officer responded sometime later, for another fight (see below), and the bouncer thought some of those involved might still be behind the bar looking for keys and a cell phone. Officers checked the parking area and did not locate anyone.

(2) Event #170112320, 09/24/17 at 1:51 AM: A bar employee called to report a fight between two males inside the bar, and that the bouncer was trying to break the fight up. By the time Officers arrived, both males involved had left. No charges were pursued against anyone from this incident. Officers remained at the bar while the crowd cleared, since it was the second fight call that had been received from the bar. No other Law Enforcement action taken.

ALCOHOL BEVERAGE DEMERIT POINTS ASSESSED VFW Burn Post 388 was assessed 50 Demerit Points for Failure to Maintain an Orderly

Premise, for a large fight that occurred during a wedding party on 09/30/17, which was not reported by facility staff. I will attempt to follow up with them regarding this incident, if the investigating Officer does not do so during his next work days.

Cop Shoppe Bar dropped 100 Demerit Points, to a total of zero (0) remaining, due to time drop off.

Domino Bar dropped 25 Demerit Points, to a total of 25 remaining, due to time drop off. Whiskey River Bar and Grill dropped 50 Demerit Points, to a total of 25 remaining,
