BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI , TWO-THIRDS OF THE SENATE AND HOUSE OF REPRESENTATIVES CONCURRING THEREIN, WHICH TWOTHIRDS CONSISTS OF NOT LESS THAN A MAJORITY OF THE MEMBERS ELECTED TO EACH HOUSE, That the following amendment to the Mississippi Constitution of 1890 be submitted to the qualified electors of the state for ratification or rejection at an election ln he held on the first Tuesday after the first Monday of November, I978:
Repeal Section 19, Mississippi Constitution of 1890, which reads as follows:
Section 19. Human life shall not be imperiled by the practice of dueling; and any citiizen of this state who shall hereafter fight a duel, or assist in the same as second, or send, accept, or knowingly carry a challenge therefor, whether such an act be done in the state, or out of it, or who shall go out of the state to fight a due l, or to assist in the same as second, or to send, aC(.'Cpt, or carry a challenge, shall be disqualified from holding any office under this Constitution, and shall be disfranchised. No railroad hereafter constructed in this state shaH pass within three {3) miles of any county seat without passing through the same, and establishing and maintaining a depot therein, unle!ois prevented by natural obstacles. Your official ballot should show the names of all candidates under the name of their political parties or as independents, whkhever is app1icable, for the foUowing offices: Uniterl States Senator, Representative in Congress of your Con~essional District, Supreme Court Judge. for the First (Central) District, Supreme Court Judge for the Second (Southern) Distric t, Chancery Court Judge of your Chancery Court District, Circuit Court Judge of your Circuit Court District, County Court Judge and Family Court Judge of your County, and County Board of Education for the Fifth Supervisors District of each County, with certain exeeptions.
Candidates for County Board of Education should be listed without party affiliation.
The proposed Constitutional Amendments should appear on the regular ballot foHowing the listing of the names of the candidates.
Chapter No. 429, Laws of I978. The ballot shaU contain the names of all candidates who have been put in nomination not less than sixty ( 60) days previous to the date of the election, by the primary election of any political party. This Section also provides for the nlacing on the bal1ot the names of candidates by petition, etc.
