APPROVE SINGLE PLAN FOR STUDENT ACHIEVEMENT 2013-2014 Approve the Single Plan for Student Achievement (SPSA) for Addams, Bryant, Burnett, Cleveland, Fremont, Lee, Madison, Signal Hill, Whittier and Willard Elementary Schools; Hudson K-8 School; and Bancroft, Hughes and Rogers Middle Schools. Each of the plans has been reviewed by Equity, Access, and College & Career Readiness staff for compliance. Each plan contains the components of effective planning based on student needs, assessment data, use of staff, parent involvement, and allocation of resources. Each schools’ approved SPSA for the 2013-2014 school year will also serve as an interim plan until the following school year’s SPSA is revised and approved. The funding for all programs and personnel outlined in these SPSAs is reflective of the current fiscal year only. 2. APPROVE MEMORANDUM OF UNDERSTANDING WITH THE CALIFORNIA

DEPARTMENT OF EDUCATION FOR TITLE II, PART A Approve Memorandum of Understanding (MOU) with the California Department of Education as required by Section 2141 (c) of the Elementary & Secondary Education Act/No Child Left Behind. The MOU asserts that the District shall 1) develop and utilize professional development strategies and activities to ensure that 100% of teachers become highly qualified; and 2) prohibit the use of funds under Title I, Part A to fund any paraprofessional who does not satisfy the requirements of Section 1119 (c), which includes two years of postsecondary education, an associate's degree or higher, or, for an applicant with a high school diploma, the demonstration of necessary skills on a formal state or local academic assessment, unless the District can demonstrate significant student enrollment increase or there is an increased need for translators or assistance with parental involvement activities. This MOU is for the 2014-15 school year. 3. APPROVE PARTICIPATION IN CSULB’s SCIENCE EDUCATION EXPERIENCE TO

HELP UNDERSERVED STUDENTS SUCCEED Approve participation in the California State University, Long Beach (CSULB) Summer Science Camp- SEE US Succeed program. In addition to providing homeless and other students experiencing transition in housing with rich, hands-on science experiences, students will also be exposed instruction that addresses career awareness, the importance of education, and college readiness. Participating students will receive lab books, simple school supplies to be used during camp, and a camp shirt. In addition, teams of prospective science teachers from CSULB plan the curriculum, implement lessons, and gather the equipment and supplies needed for inquiry-based science projects. This same program has been successfully offered for the past six summers at Bethune Transitional Center and Cabrillo High School. The proposal includes the use classrooms at Bethune and Cabrillo for the camp. There is no cost to the district.

4. APPROVE APPLICATION FOR AFTER SCHOOL EDUCATION AND SAFETY PROGRAM

Approve the application for the After School Education and Safety Program to increase the capacity at Washington Middle School. The program provides after school academic support, safe, constructive alternatives for Washington students. The proposal requests $44,550. 5. APPROVE ACCEPTANCE OF FUNDS FROM EDUCATION TECHNOLOGY K-12

VOUCHER PROGRAM Approve the acceptance of funds from the Education Technology K-12 Voucher Program. The vouchers made available through a settlement agreement between consumers and the Microsoft Corporation are to be used to assist districts with implementing and supporting educational technology that fosters effective teaching and promotes student achievement in eligible schools. School districts must purchase equipment and software that are on an approved list and apply for reimbursement. The deadline for using these funds is September 25, 2015. 6. APPROVE THE SUBMISSION OF THE APPLICATION FOR HEAD START AND

EARLY HEAD START PROGRAMS Approve the submission of the 2014-15 five (5) year grant application for the Head Start and Early Head Start program in order to serve 2,025 low-income preschool children and 148 infants, toddlers and pregnant women and their families in program options that include center-based and combination options for preschool, and center-based and home-based options for Early Head Start for the period from July 1, 2014 through June 30, 2015. This grant application reflects the new process to allow grantees in compliance with all Federal requirements to submit a grant application for a five year period. Additionally, the enrollment and funding reflect the re-instatement of all funds and resultant services cut from the program beginning July 1, 2014 due to sequestration. Subject: Adoption of Tentative Agreements, California School Employees Association, Long Beach Enclosures: None Chapter #2, Unit A and Unit B __________________________________________________________________________________ Category: New Business Reason for Board Consideration: Action Date: March 18, 2014 BACKGROUND The Long Beach Unified School District (“District”) and the California School Employees Association, Long Beach Chapter #2 (“CSEA”), recently concluded negotiations for successor Collective Bargaining Agreements covering both Unit A and Unit B. CSEA informed the District on March 14, 2014 that their membership had ratified the Tentative Agreements providing for the modification and extension of the Unit A and Unit B contracts through October 31, 2015. Ratification resulted in revisions to the Unit A and Unit B bargaining unit contracts, including a 3% increase in all salary schedules for bargaining unit members, retroactive to July 1, 2013. In addition, language was modified to align both Unit A and Unit B contracts with the school calendars that were approved on March 4, 2014. In compliance with collective bargaining agreement public disclosure requirements of Government Code, Section 3547.5, the “Public Disclosure of Collective Bargaining Agreement” forms for CSEA Unit A and Unit B have been displayed for public review since March 4, 2014. These forms have also been reviewed by the Los Angeles County Office of Education according to compliance with AB1200 (Chapter 1213/1991), Government Code 3547.5 and CCR, Title V, Section 15449. This revised policy also references new legislation, AB 556, which prohibits employers from discriminating against employees and job applicants based on their military or veteran status. PHILOSOPHY, GOALS, OBJECTIVES AND COMPREHENSIVE PLANS BP 0410 Nondiscrimination in District Programs and Activities The Governing Board is committed to equal opportunity for all individuals in education. District programs, activities, and practices shall be free from discrimination based on race, color, ancestry, national origin, ethnic group identification, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity or expression, or genetic information; the perception of one or more of such characteristics; or association with a person or group with one or more of these actual or perceived characteristics. (cf. 4030 – Nondiscrimination in Employment) (cf. 5131.2 – Bullying) (cf. 5145.3) – Nondiscrimination/Harassment) (cf. 5145.7) – Sexual Harassment) Annually the Superintendent or designee shall review district programs and activities to ensure the removal of any barrier that may unlawfully prevent an individual or group in any of the protected categories stated above from accessing district programs and activities, including use of facilities. He/she shall take prompt, reasonable actions to remove any identified barrier. The Superintendent or designee shall report his/her findings and recommendations to the Board after each review. Pursuant to 34 CFR 104.8 and 34 CFR 106.9, the Superintendent or designee shall notify students, parents/guardians, employees, employee organizations, applicants for admission and employment, and sources of referral for applicants about the district’s policy on nondiscrimination, and related complaint procedures. Such notification shall be included in each announcement, bulletin, catalog, handbook, application form, or other recruitment materials distributed to these groups. In addition, when 15 percent or more of a school’s students speak a single primary language other than English, those materials shall be translated into that other language.

BP 0410 Access for Individuals with Disabilities District programs and facilities, viewed in their entirety, shall be in compliance with the Americans with Disabilities Act and any implementing standards and/or regulations. The Superintendent or designee shall ensure that the district provides auxiliary aids and services when necessary to afford individuals with disabilities equal opportunity to participate in or enjoy the benefits of a service, program or activity. These aids and services may include, but are not limited to, qualified interpreters or readers, assistive listening devices, notetakers, written materials, taped text, and Braille or large print materials. The policy also reflects changes in legal references deleting reference to the Pupil Retention Block Grant and the School and Library Improvement Block Grant which are no longer applicable since the funding for these programs is now included in the Local Control Funding Formula pursuant to AB 97. School Plans/Site Councils

The Governing Board believes that comprehensive planning at each district school is necessary in order to focus school improvement efforts on student academic achievement and facilitate the effective use of district resources. The Superintendent or designee shall ensure that school plans provide clear direction and identify cohesive strategies aligned with school and district goals. For any school that participates in specified state and/or federal categorical programs, the school site council or other schoolwide advisory committee shall consolidate plans required for those categorical programs into a single plan for student achievement (SPSA). (Education Code 52055.755, 64001) As appropriate, a school may incorporate any other school plan into the SPSA. (Education Code 64001) The Superintendent or designee shall review each school’s SPSA to ensure that it meets the content requirements for all programs included, is based on an analysis of current practices and student academic performance, and reasonably links improvement strategies to identified needs of the school and students. He/she shall submit to the Board his/her recommendations for plan approval or revision. The Board shall review and approve each school’s SPSA and any subsequence material revisions affecting the academic programs for students participating in the categorical programs addressed in the SPSA. The Board shall certify that, to the extent allowable under federal law, the SPSA is consistent with district local improvement plans required as a condition of receiving federal funding. Any such review and approval shall be at a regularly scheduled Board meeting. (Education Code 64001) Whenever the Board does not approve a school’s SPSA, the Superintendent or designee shall communicate the specific reasons for disapproval of the plan to the school site council or committee. The school site council or committee shall then revise and resubmit the SPSA to the Board for its approval. The Superintendent or designee shall ensure that school administrators and school site council members receive training on the roles and responsibilities of the site council. STUDENTS BP 5145.3 Nondiscrimination/Harassment-Students The Governing Board desires to provide a safe school environment that allows all students equal access and opportunities in the district’s academic and other educational support programs, services, and activities. The Board prohibits, at any district school, or school activity, unlawful discrimination, harassment, intimidation, and bullying of any student based on the student’s actual race, color, ancestry, national origin, ethnic group identification, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity, or gender expression; the perception of one or more of such characteristics; or association with a person or group with one or more of these actual or perceived characteristics. This policy shall apply to all acts related to school activity or to school attendance occurring within a district school (Education Code 234.1) (cf. 0410 – Nondiscrimination in District Programs and Activities) (cf. 5131 – Conduct) (cf. 5131.2 – Bullying) (cf. 5137 – Positive School Climate) (cf. 5145.9 – Hate-Motivated Behavior) (cf. 5146 – Married/Pregnant/Parenting Students) Prohibited discrimination, harassment, intimidation, or bullying includes physical, verbal, nonverbal, or written conduct based on one of the categories listed above that is so severe or pervasive that it affects a student’s ability to participate in or benefit from an educational program or activity; creates an intimidating, threatening, or hostile, or offensive educational environment; has the effect of substantially or unreasonably interfering with a student’s academic performance; or otherwise adversely affects a student’s educational opportunities. The Board also prohibits any form of retaliation against any student who files a complaint or report regarding an incident of discrimination, harassment, intimidation, or bullying. The Superintendent or designee shall facilitate students’ access to the educational program by publicizing the district’s nondiscrimination policy and related complaint procedures to students, parents/guardians, and employees. He/she shall provide training and information on the scope and use of the policy and complaint procedures and take other measures designed to increase the school community’s understanding of the requirements of law related to discrimination. The Superintendent or designee shall regularly review the implementation of the district’s nondiscriminatory policies and practices and, as necessary, shall take action to remove any identified barrier to student access to or participation in the
