WHEREAS, it is the governments policy to encourage agricultural production in order to achieve food self-sufficiency;

WHEREAS, the livestock and poultry industry is one of the major agricultural industries of the Philippines and the City of General Santos and its accelerated development would mean increased production of meat and other animal products necessary to improve health of the people and to bolster the national and city economy;

WHEREAS, there is further need to develop, expand, and improve the production and management of livestock and animal products in the city;

RESOLVED, as it is hereby resolved, to enact this Ordinance:

ORDINANCE NO. 34 SERIES of 2016

AN ORDINANCE CREATING AND ESTABLISHING THE CITY POULTRY, LIVESTOCK, AND VETERINARY ADVISORY BOARD AND FOR OTHER PURPOSES

Be it ordained by the Sanggunian Panlungsod of General Santos City, that:

SECTION 1. Short Title. - This Ordinance shall be known as the "City Poultry, Livestock, and Veterinary Advisory Board (CPLAVAB) Ordinance".

SECTION 2. Creation. - The City Poultry, Livestock, and Veterinary Advisory Board, hereinafter referred to as the Board, is hereby created structurally and functionally in accordance with the provisions of this Ordinance.

SECTION 3. Declaration of Policies. - It is hereby declared the policy of the City to ensure the food security of its people and to be self-sufficient producers of animal meat and its by-products. Towards this end it shall promote, develop, enhance, and modernize its livestock and poultry production. And also towards this end, it shall establish a board that will set, steer, design, and create policies, procedures, processes and regulations that will promote and sustain the effective supply, management, and development of the food animal industry, primarily but not limited to the livestock, poultry, and veterinary sectors consistent with the objective of maintaining a sound ecological balance, and protecting and enhancing the quality of the environment.

SECTION 4. Definition of Terms. - As used in this Ordinance, the following terms and phrases shall mean as follows:

a) ANIMAL — any member of the kingdom Animalia, other than homo sapiens; is defined as one or more of the following, but not limited to: domestic animal, fowl, livestock, poultry, and swine commonly consumed by people of this city;

b) BOARD- refers to the City Poultry, Livestock and Veterinary Advisory Board c) CITY — refers to the City Government of General Santos. d) FOOD ANIMAL — refers to all domesticated animals slaughtered for human

consumption but not limited to cattle, carabaos, horses, deer, ostrich, poultry, and hogs;

e) FOOD ANIMAL ESTABLISHMENT — any facility or business that has custody or control of food animals;

f) LIVESTOCK — domesticated animals including but not limited to cattle, carabaos, sheep, goats , hogs , and horses;

g) LOCAL GOVERNMENT UNIT — refers to the City Government of General Santos unless it is used to mean other specific local government unit;

h) MEAT ESTABLISHMENT — premises such as slaughterhouse, poultry dressing plants, meat processing plants, cold storage, warehouse, and other meat storage outlets that are approved by the National Meat Inspection Service (NMIS) in which food animals or meat products are slaughtered prepared, processed , handled, packed, and stored;

i) OWNER — any person or persons, firm, association, partnership or corporation, owning, keeping or harboring any animal or animals;

• • j) POULTRY — domesticated birds kept by humans for the eggs they produce, their

meat, their feathers, or sometimes as pets; k) VETERINARIAN — a doctor of veterinary medicine who holds a valid license to

practice veterinary medicine in the Philippines.

SECTION 5. Composition. — The Board shall have the following composition:

a) Chairperson — City Mayor; b) Co-Chairperson — President, South Cotabato Swine Producers'

Association, Inc. (SOCOSPA); c) Vice-Chairperson — Chairperson, Sangguniang Panlungsod Committee

on Agriculture; Members:

d) Regional Director, National Meat Inspection Service 12; e) City Director, Department of Trade and Industry — GSC; f) Veterinary Quarantine Service — Department of Agriculture; g) President, Local Cattle Raisers Association; h) President, Local Goat Raisers Association; i) President, Local Poultry Raisers Association; j) Dean, Mindanao State University - College of Agriculture; k) Department Head, City Veterinarian's Office; I) Department Head, City Environment and Natural Resources Office; m) Department Head, City Agriculturist's Office; n) Backyard Poultry and Livestock Raisers Association; o) GSC Meat Vendors Association ;

SECTION 6. Powers and Functions. — The following shall be the powers and functions of the Board:

a) General: 1) To formulate and establish comprehensive policy guidelines that will improve and

develop the food animal industry sector of General Santos City;

b) Specific: 1) Formulate plans and policies for the management, development, utilization, and

conservation of the food animal industry sector within the jurisdiction of the city; 2) Formulate the long and short range programs calculated to achieve major self-

sufficiency, efficiency, and stability in food commodities of animal origin and in other food animal industry enterprises;

3) Strengthen/ revitalize livestock, poultry, veterinary, and other food animal industry organizations;

4) Facilitate the implementation of national and local government agency projects; 5) Provide data in aid of legislation; 6) Facilitate effective implementation of policies, plans, and laws relevant to the

food animal industry; 7) Assist in the enforcement of food animal industry regulations; 8) Assist in the preparation and implementation of a comprehensive City Poultry,

Livestock, and Veterinary Management Plan based on the precautionary principle and the principle of sustainable development, using scientifically-generated information or best available evidence on the status of the food animal industry resources;

9) Assist in the formulation and implementation of, consistent with the national development framework, an food animal industry development program and set policies and standards for the efficient and economic operations of the food animal industry in accordance with the objectives of food security and rational and sustainable development;

• • 10) Recommend to the Sangguniang Panlungsod the enactment of ordinances, rules

and regulations governing the conservation and proper utilization of food animal industry resources of the city;

11) Prescribe and recommend rules and regulations including visitorial powers, procedures and guidelines concerning the classification, establishment, construction, maintenance and operation of ranches, poultry farms, piggeries, veterinary clinics, pet shops, animal farms, lechon houses, and other related and ancillary animal establishment and the operation of business therein;

12) Actively engage in the conservation, protection and rehabilitation of rare, threatened and endangered fauna and/or animal species as it may determine, including their habitats;

13) Assist in the designation of land areas as protected areas for food animal conservation;

14) Promote international and regional economic and technical cooperation in the food animal industry sector;

15) Facilitate provision of infrastructure support such as demonstration farms, food terminals and markets, farm-to-market roads, quality laboratories, marketing facilities, and post-harvest facilities, in cooperation with concerned agencies;

16) Assist in the establishment and implementation of a Food animal industry Marketing Assistance Program (AnIMAP), aimed at ensuring the generation of the highest possible income for animal farmers and producers, and food animal industry related enterprises, matching supply and demand in both domestic and foreign markets;

17) Facilitate the establishment of a food animal industry credit program to finance livelihood projects of animal farmers and other qualified borrowers;

18) Evaluate the activities and accomplishments of agencies of the government charged with the implementation of the different aspects of the food animal industry development programs;

19) Assist, coordinate, and integrate private sector activities with that of the government sector with the purpose of involving the private sector in the food development programs of animal origin and other animal industries;

20) Perform such other functions as maybe necessary to attain the objectives of the food animal industry development programs; and

21) Perform all other functions consistent with this Ordinance and as may be provided by law.

SECTION 7. Secretariat of the Board. — Through a majority vote, the members of the Board shall elect from among its Non- Government Organization (NGO)and People's Organization (PO )members a Secretariat to assist and facilitate its order of meetings and all other official responsibilities and transactions thereof.

SECTION 8. Duties and Responsibilities of the Secretariat. — The following shall be the duties and responsibilities of the secretariat of the Board:

a) Provide minutes of the meeting to all members of the Board; b) Keep all directories, records, and documents of the Board; c) Coordinate plans and activities of the Board; d) Serve as the center of communication and documentation; e) Facilitate the conduct of the meetings of the Board; f) Perform administrative and other functions as directed by the Board;

SECTION 9. Meetings of the Board. — Within thirty (30) days after this Ordinance shall have taken effect, the Board shall meet to fix, by an Internal Resolution, the day, time, and venue of regular meetings. The meetings shall be held at least once every three (3) months. When public interest so demands, special meetings may be called by the Chair or by a majority vote of the members of the Board.

• • SECTION 10. Internal Rules of Procedure. — On its first regular meeting and within

sixty (60) days thereafter, the Board shall adopt its own rules of procedure. Such rules of procedure shall provide for the following:

a) The organization of the Board including the specific distribution of tasks to each member thereof, if any there be, for the efficient and effective fulfillment of the Board's functions;

b) The agenda for each meeting; c) The plan-making, monitoring, and evaluation process; d) The voting procedures including the conduct of members during meetings; e) Quorum; and f) Such other rules as the Board may adopt

SECTION 11. Honoraria. — The Non — Government Organization and People's Oraganization members of the Board shall receive an honorarium in the amount of One Thousand Pesos (Php 1,000.00) and for the secretariat NGO/PO the amount of Three Thousand Pesos (Php 3,000.00) in every actual attendance of its meetings.

SECTION 12. Appropriation. - The Office of the City Veterinarian shall be responsible for the preparation of the annual budget for the operations of the Board for the purpose of inclusion in the annual appropriations act of the City.

SECTION 13. Separability Clause. - If any provision of this Ordinance is declared unconstitutional, inoperative, the other provisions not so declared shall remain in force and effect.

SECTION 14. Repealing Clause. - All ordinances, rules and regulations or parts thereof inconsistent with this Ordinance, or the rules and regulations promulgated pursuant thereto are hereby repealed or amended accordingly.

SECTION. 15. Effectivity Clause. - This Ordinance shall take effect fifteen (15) days after its publication in one (1) local newspaper of general circulation within the city.
