GENERAL CONDITIONS OF CONTRACT 1) Area of operation : - Area of operation is residential colony situated in the Vasai ,
Navhar(E), O&M Division Vasai Rd(E), O&M Circle, Vasai, Navghar (E) & O&M Division
Vasai, Navghar(E)
2) Period of contract :- For one year or the work amounting to Rs.03 Lakhs is to be carried
out which ever is earlier. In no case you should exceed the limit of laid down as per above,
unless specific extension order is given by this office.
3) Work order :- For electrical maintenance of residential coloney at Navghar(E) Navghar (E),
O&M Division Vasai Rd(E), O&M Circle, Vasai, Navghar (E) & O&M Division Vasai,
Navghar(E) will issue you work order indicating the nature of works, location etc.
4) Works :- The works involve replacement of switches, bulb holder is to fix the fabrications to
H.T. poles, D.P.’s such as fixing of V/Y X arm, repairs top fitting, single pole cut points
power / base channel, pin insulator with pins, Disc. Insulator with hardware etc., paving out
and stringing of HT/LT conductor of any size, earthing of H.T. poles ext (complete HT/LT line
works as per schedule enclosed herewith).
5) No tools & plants will be provided by the Company. So also all the man powers will be
provided by you. 6) For the works during night time, you will arrange lighting etc. at your own cost. 7) All safety precaution as per I.E. Rules will be observed by you during the work. You will be
solely responsible for the safety of your employee including payment of compensation in case
of accident to your employee as well as to the general public during the course of work.
8) It will be your responsibility to compensate for the damage to other installation either of the
department or the public / private property during the work.
9) All the rules pertaining to the traffic for safety of public should be taken care of by
contractors which may include fencing and providing caution notice board, red lamps etc.
wherever & whenever required. In case the procedure of the traffic is violated and in case the
authority clamps penalty, such penalty will be recovered from the contractor. Such
imposition of penalty shall mark a performance factor of the contractor during the tenure of
the contract.

10) During the period of contract you should ensure that both electric contractors as well as
labour contractors licenses should be valid & should abide by all standard laws in force from
time to time.
11) In case of any dispute the decision of the undersigned will be final. Any breach of
contract will result in cancellation of contract, which may be please be noted.
12) The electrical material used by you, should of good quality & ISI mark. The material
should be got approved before utilization.
13) Whenever required cement, sand and material should be provided by the contractor. Cement
provided should be of ISI mark and preferably ACC / L&T etc. make & of good quality.
Materials should be got approved before utilization.
14) The works carried out should confirm to the Company’s standard method of constructions
and should be carried out as per the instructions of the Engineer in charge.
15) The work is to be started only after taking required shutdown / permit from the concerned
field officer and earthing is to be provided wherever necessary and the work is to be got
supervised by Company’s representative.
16) The payment of bills will be made only after complying the following document and
submission of bills in triplicate to the concerned SDO.
i) M.B. duly record.
ii) Work against sanctioned estimates.
iii) Line diagram and pole schedule as prescribed duly enclosed.
iv) Material account in prescribed proforma’s with gate pass no etc.
v) Certificate regarding credit note duly signed by SDO for balance returned material
from work site.
vi) The prior written approval of C.A. for the works carried out other than mentioned in
the schedule of rates.
17) The Income Tax and Work Contract Tax shall be recovered as per rules.
18) Income Tax will be deducted from the Contractors bill @ 2.30% (or as applicable) including
surcharge thereon, applicable on the gross value of the bill as per instruction laid down in
Government of India’s circulars, I.T. Act 1967 unless the necessary exemption certificate
from the Income Tax authority for the purpose is produced will in time.
19) The Contractor will have to complete the work as per the requirement of offices & colony
staff.

20) Penalty :- If the contractors fails to carryout the work within the stipulated period of time
mentioned in this order the contractor will be charged penalty @ ½ % per delayed week or
part thereof subject to maximum of 10% of the cost of unexecuted portion of the work.
Further any such unexecuted work will be completed through any other agency & cost such
will be recovered from yours bills.
21) The contractor will have to complete the work as per the availability of materials. The
material will be issued to contractor as and when they are available.
22) The work shall be carried out normally during the day time. However if situation permits, the
works will have to be carried out at night hrs also. In case of Urgency created if any, work
should be carried out continuously till it is completed.
23) As per as possible no work other than the work mentioned in schedule “A” should be carried
out. However if at all it is required it should be carried out with the prior approval of C.A.
24) The contract work shall be done only by authorized labours as per I.E. rule.
25) Supervisor should be personally present at site while executing the works. The bills of the
works, not supervise by your supervisor, shall not be allowed.
26) The contractor shall comply with the provision of payment of wages Act 1936, minimum
wages Act 1948, employees liability Act 1938, workman’s compensation Act 1923, Industrial
dispute Act 1947, Indian factories Act 1948, maternity benefit Act 1961 or any modification
thereof or any other law relating these to and the rules made there under from time to time
and give effect to the provisions of any law for the time being in force and regulating the
rights and privileges of the laborers employed by him directly or indirectly.
Adequate precautions shall be taken to prevent danger from electrical shock, the material
on any of the sites shall be stacked or placed so as to there is no any inconvenience to any
person or the public. The contractor shall provide necessary fencing and lights to protect
public from accidents and shall be bound to bear expenses of defense of every suit, action,
other proceedings at law that may be brought by any person for injury sustained owing to
neglect of the above precautions and to pay any damages and costs which may be awarded
in any such suit, action or proceedings to any such person or which may with the consent
of the contractor be paid to compromise any claim by any such person.
28) To ensure effective reinforcement of the rules & regulations relating to safety precautions,
arrangements made by the contractor shall be open to inspection by the Engineer or his
representative and the Inspecting Officers from concern department.

29) Should any accidents, fatal or otherwise occur, a detailed report about the same should be
made promptly by the contractor to the Engineer in charge? The contractor should at all
time during excavation of work keep the M.S.E.D. Company Limited fully indemnified
against all risks, claims, litigation’s and financial burdens arising out of all incidental
operations on work and accidents.
30) General :- The special conditions of the contract supplement the instructions to tenderers
and the general conditions of the contract as stated in the tender and contract for works as
applicable to works contract and shall be considered as part of the documents.
31) Period of completion of the work :- The time allot for completion of the work shall be as
stated in the tender notice of invitation of tenders. Time being the
essence of the contract, the failure of the contractor to give adequate progress, shall be dealt
with severely under other provisions of the contract by withdrawal of work or any part/ in
part or whole and execution thereof through any agency solely at the risk and cost should be
beared by the contractor by confiscation of Security deposit and other dues as per provisions
of contract especially in the event of the work being delayed in such a way that overall
progress of work is affected.
32) Departmental supply of material:- the materials if available with the company it will be
handed over to the contractor and contractor will have to fix/ use such materials at given
locations without any extra cost.
The contractor will be responsible for the safe custody of all the materials issued to him by
the company to the satisfaction of the engineer in charge and he will be required to render
proper account of the allocation and disposal of these materials showing where they are used
on the work. The contractor shall return in sound conditions all the surplus material
which are not used on the work. In case he is unable to account full quantity of the
materials issued to him, recoveries will be effected from him at the “cost rates” or “market
rates” prevailing at the time of issue whichever is higher plus sales tax plus 15% to cover
companies departmental supervision charges for all materials unaccounted for.
All materials required for the works, other than those that are specifically mentioned above
shall be supplied by the contractor.
32) Electrical energy:- Electrical energy will be supplied if required to the contractor for
lighting power at free of cost. Such energy shall be supplied at one point where contractor
has to fit his own electric meter. Any temporary wiring etc. from the point of supply shall be
arranged by the contractor at his own cost. The company will not be responsible for the
inconvenience caused due to power failure and no compensation for delaying in work can be
claimed by the contractor.

34) Royalties etc:- All charges such as sales tax, royalties, octroy and other duties or materials
obtained for the works and on fabricated materials, if any, shall be bearded by the
contractor. So also all tolls, local and other taxes etc. royalties for minerals (stone clay etc)
removed shall be payable by the contractor. Due to this account (royalties, tax etc.) all
amount shall be paid directly to the authorities concerned by the contractor or if not paid
will be recoverable from the money due to the contract if so required by the authorities. The
contractor ill not be entitled to any refund in this account.
35) Time is the essence of contract:- time being the essence of the contract, the various items
of the work shall be constructed and completed in accordance with the time programme
decided by the engineer in charge. The time shall be reckoned from the date on which letter of
indent is given to the successful tenderer. The contractor shall commence the work
immediately on receipt of such an order and shall proceed with the same with due efficiency
and without any delay except as may expressly be sanctioned or ordered by the engineer in
charge.
36) Maintenance :- The contractor shall, for a period of months, after date of virtual
completion of the works certified by the Engineer In Charge, maintain the works in such a
manner that, at expiry of the period of repair and condition ( fair wear and tear accepted )
as that they were in at the commencement of the period of maintenance. The Contractor
shall at his own expense repair, rectify and make goods to the satisfaction of the Engineer
In Charge and all defects, imperfections, shrinkages or other faults arising out of use of the
materials or workmanship not in accordance with the contract or from neglect or failure on
part of the contractor to comply with the provisions of the contract.
37) Co-peration with the other contractor :- The contractor shall co-operate shall cooperate
with the company and other contractors working at the site in respect of those works, which
would be executed simultaneously under separate contracts or agencies.
38) Suitability of technical and Skilled personnel:- The contractor must also provide for
necessary skilled and unskilled workmen for each class of work & the Engineer-in-charge
shall have the right to demand the removal of any technical personnel, skilled/unskilled
workmen who in his opinion considered to cause poor workmanship in the execution if the
work or cause indiscipline.The contractor shall also provide for necessary staff such as
operators, laborers and also materials, scaffolding, shoring, tools and plants of every kind,
quality, & description of the work. (The rates quoted in the schedule –B for the different
items of work are deemed to include all the aforesaid charges.)
39) Setting out the works :- The contractor shall at his own expense provide for all pegs, nails,
strings, PVC tapes,, clips, saddles etc. and such other materials necessary for setting out and
shall all times provide for skilled & technical assistants who are capable of carrying out the

work. The contractor shall be responsible for setting out the work and get the same
approved before the work is actually commenced.
40) Rejected material :- It shall be absolutely noted that on the part of the contractor to have on
the site of the work, only such of the materials as have been duly passed by the Engineer-in-
charge. Such of the materials which hae been rejected shall in no account be allowed to remain
on site and if the same are not removed even inspite of a written order to remove the rejected
materials out of the site within a specified time as directed by the Engineer-in-charge, the latter
shall have the full rights to remove the rejected materials and even to destroy them at the cost
of the contractor.
41) Return of the materials :- All the unused materials either supplied directly by the company or
obtained by the recommendations of the company, which in the opinion of the Engineer-in-
charge are likely to be useful to the company, shall be returned in good condition at the original
cost paid for, decided by the company.
42) Damage of the Works :- The works whether fully completed or incomplete, all the
materials, machinery, plants, tools, temporary buildings and other things connected therewith
shall remain at the risk and in the sole charge of the contractor until the complete work has
been delivered to the Engineer-in-charge. Untill such delivery of the completed work, the
contractor shall at his own cost take all the precautions reasonably necessary to keep all the
aforesaid works, materials, machinery, plants, tools, temporary buildings and other things
connected therewith free from any loss or damage and in the event of the same or any part
thereof being lost or damaged he shall forthwith reinstate and make good such loss or damage
at his own cost.
43) Approach at the work site :- The contractor shall make his own arrangements at his own
cost or the necessary approach roads for transport of materials to the site of the work. No extra
charges will be paid by the company on this account.
44) Charges in designs :- The company reserves the right to make any changes in the designs & plans
of the works and the contractor shall be bound to carry them out. No claim or compensation would
be allowed on this account.
45) Payments :- Bills shall be submitted by the contractor quarterly on or before the date fixed by the
Engineer-in-charge for all the work executed upto previous month. Payment of bill for work carried
out shall normally be released of such bill as per availability of the funds. Adjustments of advances
granted, if any materials supplied by the company, as also towards Income tax, Security deposit
etc. shall be made from monthly R.A. bills while every possible effort will be made to finalize the
final bill for the work in question within nine months from the date completion of the work in all
respects as certified by the Engineer-in-charge of the work, no condition for payment of interest on

the net amount of final bill. Will be accepted by the company. In the case of final bill is not finalize
within a period of nine months, from the date of the completion, payment of 100% of the amount as
assessed from the date available at that time shall be released to the contractor, against
submission of a bank guarantee for an amount equivalent to 15% of such amount by the
contractor. The Bank Guarantee shall be in the Company’s standard proforma.
Also the payment of bills will be made only after complying the following document and
submission of the bills in triplicate through the Dy.Executive Engineer, Vasai Rd (E) S/Dn.
1. M.B. should be duly recorded.
2. Material account I prescribed proformas.
3. The prior written approval of C.A. for the works carried out other than mentioned in the base
rates of Schedule ‘B’
46) Reductions from contract price :- The amount of any cost, or expenses of other sums which
under the or any other contract is payable by the contractor to the company may be deducted by
the company from any money due or becoming due y the company to the contractor under the
same or any other contract, without prejudice to the Company’s rights to recover the same by the
ordinary progress of law.
47) Replacement of defective works/materials :- During the progress of the work the Engineer-in-
charge shall decide and notify in writing to the contractor has executed any unsound or imperfect
work or or has supplied any plant or materials inferior in quality or quantity to those specified , the
contractor shall on receiving details of such defects deficiencies have to make good, the
defective/unsound or replace imperfect materials as per written instructions of the Engineer-in-
charge at his own expenses within such time as may be reasonably necessary for the making it
good, proceed to alter, reconstruct or remove such work or supply fresh materials up to the
standard or specification. In case the contractor fails to do so, the company may
on giving the contractor seven days notice in writing of its intentions to do so, proceed to remove
the work or the materials complained of the cost of the contractor perform all such work and/or
supply all such materials provided that nothing in this clause shall be deemed to be deprived the
company or affect any rights under the contract which it may otherwise have in respect of such
defects or deficiencies and no payments which may have been made on account of the plant or
materials delivered on he work executed shall be looked upon as acceptance of such plants,
materials or work.
48) Certificate not to affect right to the company’s or contractor’s obligations :- No certificate of
the Engineer-in-charge not any sum may paid on account by the company nor any extension of
time for works shall affect or prejudice the contract‘s obligations for the due performance of the
contract interpreted as approval of the work done or of the materials supplied and no certificate
shall crate liability on the company to pay for alterations, amendments, variations or additional
works, not ordered in writing by the Engineer-in-charge or discharge the liability on the company of
the contractor of the payment of damages whether due, ascertained or certified or not or any sum,
paid on account otherwise affect or prejudice the obligations of the contractors to the company.

49) Laws and regulations :-
The company shall through the continuance of the contract and in respect of all the matters
arising in the matters thereof, service all notices and obtain consents , way, leaves approval, and
permission, required in connection with the regulations and by-laws of the local or other authority
which shall be applicable to the work.
All works shall be executed by the contractor in accordance with the laws in the force in
Indian relating to the work and rules and regulations there under and any statutory modifications
thereof wherever they are applicable, unless otherwise agreed to in the writing by the Engineer-in-
charge.
50) Contractor’s liability for loss, damage, accidents, etc. :- The contractor shall during the progress
of the work properly cover up and protect work from the injury exposure to weather and shall take
every reasonably, proper, timely, and useful precaution against accident or injury to the same from
any cause and shall be and remained answerable and liable for all accidents or injuries thereto,
which until the same be or deemed to taken over, may arise by the occasioned by the acts or
omissions of the contractors or workman, of the sub-contractor, and all losses and damages to the
works arising from such accidents or in aforesaid shall be made good in the most complete
substantial manner by and at the sole cost of the contractor and to the reasonable satisfaction of
the Engineer-in-charge.Until the work shall be or deemed to be take over as aforesaid, the
contractor shall also be liable for and shall indemnify the company in respect of all damage or
injury to any person or to any property of the company.
51) Not withstanding any thing contained in the contract of the contractor shall be liable to pay for any
actual damage to the plant for the reasons unforeseen or beyond the control of the company during
the period of maintenance as stipulated in this contract.
On the occurrence of an accident which results in the death of the any of the workm
employed by the contractor or which is so serious as likely to the result of death of any such
worker, contractor shall inform company within 24 hours of the happening, contractor shall
indemnify the company against all loss or damage sustained by the company resulting directly,
indirectly from his failure to give intimation in the manner aforesaid including the penalties or fines
if any payable by the company as a consequence of company’s failure to give notice under the
workmen’s compensation Act or otherwise to confirm to the provision of the said act in regard to
such accident.
In the event of any claim being made or action brought against the company and arising
out of the matter referred to and in respect of which the contractor is liable under this clause the
contractor shall be immediately notified thereof, and he shall with the assistance if he so require of
the company but at the sole expense of the contractor conduct all negotiations for the settlement of
the same or any litigation that may arise there from. In such case the company shall at the expense
of the contractor afford all available assistance for any such purpose.

52) Power to vary or omit work :- Any minor work not mentioned in the contract will to be carried
out by the contractor without any extra cost as directed by the Engineer-in-charge.
53) The contractor shall abide himself and fulfill all obligations enforceable under Enforcement of
contract labour (Regulation & abolition) Act 1970 and absolve the Company entirely. In case the
contractor has not fulfilled all the obligations the contract at the time of tendering his tender is
not likely to be considered. Even after award of the contract at any stage if it is observed that any
of his obligations under the Act are not fulfilled, in addition to the action being taken in
accordance with the provisions of the act, the contract may be cancelled and deemed as having
been abandoned by the contractor and action taken suitably in accordance with the terms of the
contract.
54) Inspection and Testing :- The Engineer-in-charge and his duly authorized representative, shall
have at all reasonable times access to the contractor’s premises or works and shall have the power
at all reasonable times to inspect and examine the materials and workmanship of the structure
and if the part of the structure is being manufactured in other premises of the works, the
contractor shall obtained for the Engineer and for his duly authorized representative permission
to inspect as if the plant or the materials were manufactured or erection on the contractor’s own
premises of the work.
In all the cases where the contract provide for tests whether at the premises or at the works
of the contractors, the contractor shall provide, free of charge such labour, materials, electricity,
fuel, water, stores, apparatus, and instruments as may reasonably be demanded to carry out
sufficiently such tests of the structure in accordance with the contract and shall give the facilities
to the Engineer-in-charge or to his authorized representative to accomplish such testing.
In all such cases where the contract provides for tests on the site such tests as to plant,
materials or workmanship shall be efficiently carried out by the contractor in accordance with the
contract.The work so far as it is carried out on the company’s premises shall be carried out at such
time as the Engineer-in-charge may approve but the company shall give the contractor all
reasonable facilities for carrying out the work.
55) Penalty Clause :- Following penalty clause will be applicable for this contract :-
If the contractor fails to carry out the work within the stipulated period of time
mentioned in this order, the contractor will be charged penalty @ ½ % per delayed week or part
thereof subject to maximum of 10% of the cost of the unexecuted portion of the work. Further any
such unexecuted work will be completed through any other agency & such cost will be recovered
from your bills. In the event of the failure of the contractor to deliver the goods within the limit, the
company reserves the right to resend the contract and get the work done by another agency of
company’s choice. Such removal of works from the contractor’s hand, shall be applicable either to
the contractor entirely or to a portion of the work as is found necessary for execution by the

M.S.E.D.C.L. on top priority basis. Further above indication should not in manner be constructed
to limit to Company’s right to issue seven day’s notice to the contractor for any portion of the work.
And get it done at his risk and cost through any other agency as stated in the tender specification.
The penalty clause shall be applicable if the delay in the completion and handing over the time
bound, completion programme set by the Engineer-in-charge, hinders or effects programme. The
decision of the Ex. Engineer, O&M Vasai Division in this respect is final and binding upon the
contractor. The contractor shall carefully study the work to be carried out at different locations and
at different elevations and shall take into account all factors such as shuttering, staging,
shoring, dewatering, if any, transport of materials to time etc., and allow for all such
exigencies in the rates quoted by him.
56) Action when Whole of Security Deposit is forfeited :- In any such case in which under any
clause or clauses of the contract the contractor shall have rendered himself liable to pay
compensation (whether paid in one sum or deducted by the installments)
Or in the case of abandonment of the work owing to serious illness or death of the
contractor or any other clause the Ex. Engineer O&M Vasai Division on behalf of the company
shall have the power to adopt the action as he may deem best suited to the interests of the
company owing to serious illness or death of the contractor or any other clause the Ex. Engineer
O&M Vasai Division on behalf of the company shall have the power to adopt the action as he
may deem best suited to the interests of the company. Not with standing the above provision
to 57 the contractor is not exempted from provisions of other Act or Rule in force.
58) The undersigned reserves the right to disqualify/ cancel the tender without assigning any reason
thereof and the correspondence is not binding for us.

National Bank situated in Navghar – Manikpur / Vasai. The EMD can also be paid in cash in
the office of the Executive Engineer, M.S.E.D.C.Limited, Vasai. Tender submitted without
earnest money deposit will be rejected.
4) The tender duly filled in shall be deposited in “Tender Box” in person or by nominated
representative in the office of the “Executive Engineer, O&M Division, M. S. E. Dist.
Company Limited, Vasai”. The tender will be opened if possible on the due date at 16.00 at
the above office in the presence of each tenderer or their nominated representative who
choose to remain present.

5) Tenderers may send his one authorized nominated representative with authority letter for
submission of tender or to be present a the time of opening of tender. Without authority
letter, representative will not be allowed to participate in the tender process.
6) The important tender dates are :-

14.00 to 16.00 Hrs daily till 22.09.2009

8) The payment of bill shall be made as and when the funds are available. There is no time limit
or period specified for making the payment. Complaint for delay in payment for the reason
beyond control of the Company will not be entertained. No advance payment will be given for
any work. No interest will be paid for any delayed payment for the reason whatsoever.
9) Security Deposit :- The successful tender shall be required to pay security deposit
amounting to 10% of the value of the contract wither by DD / Cash / Pay Order etc. within
“7” days after issue of order.
10) Before submitting their offer the tenderer shall examine closely all document which forms
part of the contract to be entered into.
11) The tenderers should be registered with the Government of Maharashtra as an electrical
contractor. Documentary evidence should be submitted along with tender. The license
number has to be clearly indicated in the tender.
12) The tenderer must have carried out works of the magnitude of Rs. 50000/- or more as an
experience in past period.

13) The tenderer should be registered with the Government of Maharashtra under Sec. 12 (2) of
the Contract Labour Act 1970. Xerox copy of the license should be submitted on request
before issue of tender order. In their own interest, they should keep such license ready.
14) The contractor shall be required to pay the laborers engaged by him on the work not less
than a minimum wage ( which expression shall mean whether for whole time or piece work
the respective rates mean whether for whole time or piecework the respective rates of wages
as fixed under the law for the time being in force ).
15) The contractor shall be responsible for rectification of defects for a period of 12 months from
the certified day of completion of work by M.S.E. Distribution Company Limited. This period
of 12 months shall be known as “Defects Liability period”. Any defects or failures during this
period shall be rectified within one week of intimation in writing. If the same is not carried
out in the stipulated time, we shall have the right to get it repaired departmentally or
through any other agency. The cost of the same shall be recovered from the contractor.
16) If the tenderer has any doubt about the meaning of any portion of the tender he should at
once get clarification from Executive Engineer, M.S.E. Dist. Company Limited, O&M
Division, Vasai in writing sufficient in advance and also personally meet him in this respect,
before the due date. No additions or alterations in the tender form / conditions etc. should
be made by the tenderer. For any dispute the decision of the tendering authority will be final.
17) The tenderers must return all the forms / documents of the tender duly filled in as specified
the rates in figures and in words. Each page must be duly signed by the tenderer. Any
page not bearing the signature of the tenderer, the tender is likely to be rejected. Only
one rate should be quoted for all item of work. In case dual rates are quoted for the same,
the offer is likely to be rejected. Tenderers should not offer rates for tem not covered in the
schedules and also should not split any item of the schedule, doing so, may disqualify the
offer. Discount on any account such as quantitative discount, payment discount etc., will
not be considered for comparison of the rates, as such rate should be on firm quotation
basis only.
18) Special attention is invited to the requirement that all corrections must be initialed and
dated by the tenderer and that all the pages should bear the full signature of the tenderer at
the foot of each page and each schedule should bear the seal of the tenderer.
19) Tenders which do not fulfill all or any of the above conditions or incomplete in any respect
are liable to the rejected.
20) The submission of a tender by a tenderer implies that he has read the instructions and the
conditions of contract etc. After acceptance of the offer we shall not pay any extra charges for
the lead or any other reasons in case the Tenderer is found later on to have misjudged
himself.

21) Tenderer shall remain open for acceptance for a period of 90 days from the date of opening of
the tender. During this period no tenderer shall be allowed to withdraw his offer. Any such
withdrawal during the said period will entail forfeiture of the earnest money deposited with
us.
22) The tenderer should furnish details of his organization, technical experience, equipment and
financial capacity to carry out the works set out in the tender within the time stipulated for
completion.
23) Income Tax clearance certificate issued by the competent authority in favour of the tenderer
for the previous year is necessary. Same should be kept ready and to be submitted on
request.
24) General conditions of the Annual Work contract which form a part of the contract.
25) Tenderers are requested to fill all the columns by words and not dash and dots. Any column
on any page left blank may result in rejection of tender.
26) Filling of any false and fake information shall result in rejection of tender and may invite
legal action.
27) Income Tax and works contract tax as per rules will be deducted from yours Bill.
28) Due care has been taken to mention correct rates / wording. However decision regarding
any oversight printing mistakes will be of Executive Engineer, Vasai and shall be final and
binding to all tenderers.
29) All the document i.e. complete booklet should be returned while submitting the tender. No
part / pages of the booklet should be retained by tenderer.
30) Only tenders of really competent contractors who are known to have adequate resources and
specified experience in this field will be considered.
31) The contractors must arrange for all transport of materials and include all such costs in the
rates quoted by him for the finished work
32) The Earnest money will be forfeited to the company in case the successful
tenderer, after his tender has been accepted shall refuse to pay the prescribed
security deposit and to sign and complete the contract documents.
33) The schedule is liable to alterations by omissions, deductions or addictions at
the discretion of the Executive Engineer, Vasai or his representative as put

forth in the conditions of the contract. The successful tenderer will also have to execute an
arrangement with the
company in the company’s standard proforma. cost of stamp paper shall be
born by firm/contractor.
34) Tender which do not fulfill all any conditions or incomplete in any respect are liable to
summary rejection.
35) The tenderer is requested to visit the site of the work and see for himself the site conditions
regarding, approaches, materials, water supply, labour etc. and all other matters affecting
the work before filling in the rates, the tenderer is further requested to study the
specifications and all other documents attached to the tender papers and then fill in the
percentage rates in the format attached with the tender.
36) The rates to be quoted shall be for finished work complete in every respect and shall include
charges involved in the maintenance of the work as certified by the Engineer In charge.
37) Submission of the tender by the tenderer implies that he has read these instructions and
has made himself aware of the scope of the work,
38) specifications the conditions of the contract and the company will not therefore pay any
extra charges an any account in the case of the contractor finds later on to have misjudged
the site conditions or specifications.
40) In the event of the discrepancy between the description of the words and
figures quoted by the tenderer the description in words shall or prevail.
The contract or any part shall not be sublet.
40) Tenders shall remain open for acceptance of the clause 46 on page no.27 foe
a period of the 3 months from the date on which they are due for submission and during
this period no tenderer shall be allowed to withdraw the tender. Any such withdrawal during
the same period will entail forfeiture of the earnest money deposited by the tenderer.
41) Further information required if any can be obtained from the office o the Executive
Engineer, O&M Vasai Division , Vasai. It must be clearly understood that the tender must

44) Contractor shall produce the certificate regarding the registration under contract labour Act
