1. Considered and approved. While discussing various issue, Shri . Duryodhan Bhapkar

and other elected members stated that the road side hawkers should be resolved as per the

government policy at the earliest.

3. PROPOSAL FOR RECONSTRUCTION OF EAST KIRKEE DISPENSARY: PROPOSAL UNDER ‘D1’ HEAD OF BUDGET ESTIMATES. Ref:- Principal Directorate, Defence Estates, Southern Command letter 8078/Dispensary/Kirkee/C/DE/2016, dated 28/09/2016

To consider the office report dated 03/10/2016 received from Cantonment Executive Engineer. As per the report the Board vide CBR No.01, dated 22/01/2016 had considered the proposal for the demolition and reconstruction of East Kirkee Dispensary and resolved to submit the proposal to the GOC-in-C, Southern Command to obtain sanction under rule 17(a) read with 19(b) of Cantonments Account Code, 1924. Accordingly the proposal was submitted to GOC-in-C through PDDE, SC vide letter No.4/1-D/East Kirkee Dispens./P-37, dated 18/06/2016. The Principal Directorate ,Defence Estates, vide letter referred above has suggested that „the matter may please be placed before the Board for carrying out the work under Maintenance Head., as it was found that „proposal does not appear to be under the category of Original Works but actually its replacement of already created asset.‟ The item is placed before the Board for taking decision on the execution of the work under „Maintenance Head D(2)(a)‟ at an estimated cost of Rs.51.45 lacs. The Budget provision have been made incur an expenditure under recently considered budget estimates for the financial year 2016-2017 (Revised) and Rs.20.00 lacs for the year 2017-2018 (Original) Rs. 31.50 lacs under budget head D-1(a).

In this regard file containing all relevant documents alongwith office note and

letter referred above are placed on the table.

3. Considered and approved. It was resolved to make necessary Budget under

Budget Head D2(a) and accordingly invite. Tenders as per procedure.

During discussions, Shri Suresh.L.Kamble, Vice-President stated that large

scale curtailments have been made in the Budget Estimates sanctioned by the

Competent Authority and therefore a letter should be sent to them for restoration as

curtailments will definitely affect development works.

Shri Suresh.L.Kamble also brought out that the drinking water supplied by the

PMC to Civil area of Khadki is highly inadequate and a high level meeting be held with

them which was agreed to.

Shri Kamble also desired to expedite the process of recruitment & appointments

on vacant posts of the Board.

Mrs. Pooja.M.Anand, Elected Member raised the issue of requirement of

additional staff in Sangamwadi Dispensary which was agreed to; Shri Abhay Sawant

elected Member raised the issue of Shri B.S.Naik‟s issue and it was desired to obtain

legal opinion for further action in the matter.

4. PROPOSAL FOR RE-CONSTRUCTION OF (06) QUARTERS FOR GROUP-D EMPLOYEES AT EAST KHADKI.

Ref:- Principal Directorate, Defence Estates, Southern Command letter No.8078/Class-IV(06)Quarters/ Kirkee/ /2016/DE, dated 07/09/2016. To consider the office report dated 03/10/2016 received from Cantonment Executive Engineer. As per the report the Board vide CBR No.29, dated 22/01/2016 had considered the proposal for the demolition and reconstruction of (06) quarters for Group-D category employees at East Kirkee and resolved to submit the proposal to the Principal Director, Defence Estates, Southern Command to obtain sanction under budget head „Creation of Capital Assets. Accordingly, the proposal was submitted to PDDE, SC vide letter No.4/1-D/Const.of Quart./Capital Asset/P-25, dated 18/06/2016. The Principal Directorate, Defence Estates, vide letter referred above had suggested that „the matter may please be placed before the Board for carrying out the work under Maintenance Head, as it was found that „proposal does not appear to be under the category of Original Works but actually its replacement of already created asset.‟ The item is placed before the Board for taking decision on the execution of the work under „Maintenance Head D-2(a)‟ at an estimated cost of Rs. 59.68 lacs. The Budget provision have been made to incur an expenditure under recently considered budget estimates for the financial year 2016-2017(Revised) Rs.48.00 lacs and for the year 2017-18 (Original) Rs.72.00 lacs under budget head D-1(a). In this regard file containing all relevant documents alongwith office note and letter

referred above are placed on the table.

4. Considered and approved. Necessary Budget provision be made under Budget

Head D2 (a). Tenders be invited as per procedure.

5. INSTALLATION OF A COMPRESSED NATURAL GAS STATION

Ref:- CBR No.14, dated 27/05/2016

The Board vide CBR No.14, dated 27/05/2016 had considered the proposal for

installation of a CNG Station at GLR Sy No.42-A classified as Class „B-4‟ land located

on Dr. Babasaheb Ambedkar Marg, opposite Gurudwara Khadki. It was resolved to

accept option no 1 for installation of a CNG station on an open area of 6000 sqft. The

decision taken by the Board was conveyed to Managing Director, Maharashtra Natural

Gas Limited (MD,MNGL) vide this office letter No.4/1-D/MNGL/CNG Station/P-40, dated

04/08/2016. The MD, MNGL was requested to give the willingness for taking land on

lease and on the terms mentioned in this office letter.

The MD, MNGL vide letter No. MNGL/MD/KCB/2016, dated 05/08/2016 had

informed that as per the layout of the CNG station the area required will be 6855 sqft

whereas the area approved by Board is 6000 sqft.

The issue is placed before the Board for reconsidering and amendment of the

area requirement to 6855 sqft for CNG Station instead of 6000 sqft.

In this connection file containing all relevant document, letter received from

MNGL along with office report of CEE are placed on the table.

5. Considered and approved. It was resolved to send a Proposal for the re-classification of the land from Class B-4 to Class-C for the said land required for CNG Station. 6. PROPOSAL FOR RE-CONSTRUCTION OF MATERNITY WARD IN THE PREMISES OF DR BABASAHEB AMBEDKAR GENERAL HOSPITAL, KHADKI. Reference :- Principal Directorate, Defence Estates, Southern Command letter No.8078/Maternity Ward/ Khadki/2016/DE, dated 08/09/2016. To consider the office report dated 03/10/2016 received from Cantonment Executive Engineer. As per the report the Board vide CBR No.28, dated 22/01/2016 had considered the proposal for the demolition and reconstruction of Maternity Ward in the premises of Dr Babasaheb Ambedkar General Hospital, Khadki and resolved to submit the proposal to the Principal Director, Defence Estates, Southern Command to obtain sanction under budget head „Creation of Capital Asset. Accordingly the proposal was

submitted to PDDE, SC vide letter No.4/1-D/Mat Ward/Capital Asset/P-21, dated 18/06/2016. The Principal Director, Defence Estates, Southern Command, vide letter referred above have the suggested that „the matter may please be placed before the Board for taking revised resolution for execution of work under Original Head.‟ The item is placed before the Board for the execution of the work under budget head D(1) (a) & to submit the proposal under rule 17(a) read with 19(b) of Cantonments Account Code, 1924 to incur an expenditure of Rs.1,84,50,000/- (One Crore Eighty Four Lacs Fifty Thousands only ) out of Cantonment Fund. In this regard file containing all relevant documents alongwith office note and letter

referred above are placed on the table.

6. Considered and approved. It was resolved to submit a proposal to the GOC-in-Chief , Southern Command Pune to obtain the sanction under Rule 17(a) read with 19(b) of Cantonment Account Code,1924 . Necessary Budget provision be made under Budget Head D1(a)

7. PROPOSAL FOR INSTALLATION OF SOLAR PANELS IN KHADKI CANTONMENT

Ref:- Director Defence Estates, Southern Command letter No.8078/Solar Panels/ Khadki/C/DE/2016, dated 28/09/2016. To consider the office report dated 03/10/2016 received from CEE. As per the

report the Board vide CBR No.2, dated 22/01/2016 had approved the subject work and

it was further resolved to submit the proposal to Principal Director, Defence Estates for

forwarding the same to Ministry of Defence, Govt. of India for allocation and sanction of

required funds of Rs.1,74,81,100/- under Budget Head „ Creation of Capital Assets‟.

The Directorate Defence Estates, Southern Command vide letter referred above

had intimated that

i) The proposal has been examined in this Dte. it may be pointed out that the

Cantonment Board, Khadki has shown an amount of Rs.14,65,18,491/- as opening

balance and invested funds of Rs.41,50,00,000/- as on 01/04/2016. It means that the

Cantonment Board, Khadki has adequate funds to bear the expenses for the subject

project.

ii) It is, therefore, requested that the Cantonment Board may send a revised Board

Resolution for sanction of competent authority for installation of Solar Panels in Khadki

Cantonment out of its own resources.

Item is placed before the Board for approval of execution of the work under Budget Head D(1) and to submit the proposal to GOC-in-C to incur an expenditure of Rs. 1,74,81,100/- under rule 17(a) read with 19(b) of Cantonments Account Code, 1924 under budget head „Creation of Capital Asset.

For consideration the Board will require to incur an expenditure of Rs.1,74,81,100/- out of Cantonment Funds and this will generate power of 260 KW per hour. MSEDCL will be paying the cost of Rs.3.70/- per unit for buy back .The financial synopsis of the proposal is appended below for perusal.

From the above it can be seen that to achieve that returns of the investment (payback) 4.5 years will be required, excluding cost of maintenance which will be additional.

The Board may take up the work through its own resources, being one of the most important priority areas of the Government. A proposal will be forwarded under „D1‟ Head, of the Budget Estimates, to the GOC-in-C for his approval, as advised even by the PDDE, as an Original work.

7. Considered and approved. It was resolved to submit a proposal to the GOC-in-Chief , Southern Command Pune to obtain the sanction under Rule 17(a) read with 19(b) of Cantonment Account Code,1924 . Necessary Budget provision be made under Budget Head D1(f)

8. SANCTION OF BUILDING PLAN OF HOUSE No.7,NEW BAZAR, KHADKI To consider the office report received from AE/CEE, KCB for the subject as per the report the HOR of House No.7, New Bazar, Kirkee had submitted building plans for making the internal changes like relocation of the staircase and internal ducks without making any changes in plinth area, height of the building and total built up area. The internal changes are in conformity with the prevailing building bye laws and FSI restrictions. Property located inside the notified civil area of Kirkee Cantonment Board and CEO is competent authority sanctioned the plan. As per the provision of clause I(5) of Lease Agreement „No to erect or suffer to be erected on any part of the premises hereby demised any building other than and except the dwelling house/shops already in existence as shown in the plan annexed to the presents without the previous consent in writing of the Board.’ The plans are placed before the Board for consent as required by Clause No. I(5) of lease agreement. In this connection the building plan received from the appellant, office report received from AE/CEE alongwith file containing all relevant documents are placed on the table. 8. The issue considered. The PCB desired that the details be up for scrutiny so as to take decision which was agreed to by members.

9. SANCTION OF BUILDING PLAN OF HOUSE No.20, NB, KHADKI

Ref:- CBR No.21,dated 01/09/2014

To consider the office report received from AE/CEE, KCB for the subject as per the report the building plan of House No.20,NB, Khadki was sanctioned by the CEO after obtaining the consent of the Board as per clause I(5) of Lease Agreement. The plan was valid for a period of 2 years from 03/12/2014. The HOR had obtained the sanction for the demolition and reconstruction excluding the area occupied by the tenant. The HOR again submitted the building plans for the entire area of the property including the area occupied by the tenants.

The brief details of the plans sanctioned by the Board:-

Proposed FSI - 0.99 i. Permissible FSI - 1.00 j. Residential area as per lease - 1000.80 sqft k. Commercial area as per lease - 829.10 sqft As the HOR had carried out deviations a notice was issued under section 248 of Cantonments Act,2006 vide No. NB/20/P-310,dated 05/09/2015. Details of the revised plans:- a. Proposed Commercial area - 896.60 sqft b. Proposed Residential area - 1294.44 sqmtr c. Total Proposed built up area - 2191.04 sqft d. Proposed FSI - 0.996 e. Permissible FSI - 1.00 f. Cost of Unauthorized Construction - 756.62 sqft @ 1000/- per sqft g. Cost of Unauthorized Construction - Rs.7,56,662/- h. Composition fee @ 10% of residential area - Rs.75,667/- If approved the HOR will require to pay the scrutiny charges Rs.1000/- and development charges Rs.30,877/- The HOR had submitted the revised plan for the demolition and reconstruction of the entire area of property including area occupied by the tenant who was not included in the earlier sanctioned building plan dated 21/09/2014. The revised building plan received from the HOR conforming with the building bye laws and FSI restrictions as reported by Assistant Engineer. The consent of the Board is required as per clause I(5) of Lease Agreement „No to erect or suffer to be erected on any part of the premises hereby demised any building other than and except the dwelling house/shops already in existence as shown in the plan annexed to the presents without the previous consent in writing of the Board.’ Item is placed before the Board for consent as per clause I(5) of lease agreement and to compound the deviations made by the appellant during the course of construction after charging a composition fee of Rs.75,667/-.

In this connection the building plan received from the appellant, office report received from AE/CEE alongwith file containing all relevant documents are placed on the table. 9. The issue considered. The PCB desired that the details be up for scrutiny so as to take decision which was agreed to by members.

10. REVIEW OF THE BOUNDARIES OF THE CIVIL AREA IN KHADKI

CANTONMENT.

Ref:-CBR No.23, dated 2/11/2013

As per Section 46(2) of Cantonments Act, 2006 „The Central Government may in

consultation with Board undertake, as and when required and shall undertake after every census

a review of the boundaries of the civil area in each cantonment.‟ Accordingly a proposal for

Review of the Boundary of Civil Area was considered by the Board vide CBR No.23, dated

02/11/2013 and it was resolved to submit the proposal to the higher authorities as per the

provisions of Section 46(2) of Cantonments Act, 2006.

The proposal was submitted to Principal Director, Defence Estates, Southern Command

vide this office letter No.KCB/Extn./Civil Area/2013-14/P-10, dated 24/12/2013. The Principal

Director vide Directorate letter No.1530/Revision of Civil Area Boundary/Gen/DE, dated

19/06/2014 returned the proposal for re-submission as per the guidelines issued by the

PDDE,SC, Pune vide letter No.1530/Revision of Civil Area Boundary/Gen/DE, dated

01/05/2014.

The revised proposal for review of the boundary of civil area was prepared based on the

directives issued by the PDDE, SC, Pune. The detailed power point presentation was given to the

PCB and all the members of the Board on 25/08/2016 by CEE, KCB. It was proposed to include

four pockets of the areas at present located outside the civil area as under:-

It was decided to include following GLR Sy.Nos being classified as „B4‟ land under the

management of DEO, PC and laying vacant and unused for decades. Only exception is to

POCKET No.5:- It was proposed to include following areas:-

The issue of declaration of Sangamwadi Village as Civil area considered and

recommended being occupied by the civil population only. This land is classified as „B2‟ land

placed under the management of State Govt.

If approved 52.1978 acres area of the above GLR Sy Nos. of Pocket No.2,3,5 required

to be declared as Civil Area. Area of the Pocket No.2 is contiguous to notified civil area.

Inclusion of the above areas will give some relief to the residents in terms of permissible FSI.

The Board will also get additional house tax and revenue due to development of land classified

as Class B-4 placed under the management of Defence Estate Officer, Pune Circle (DEO,PC)

and if the said land included in the civil area, the Board can undertake commercial projects on

these open land for creation of permanent source of income and the Board may expect

to get the revenue to the tune of Rs.150 lacs -200 lacs p.m.

Item is placed before the Board for the approval of the revised proposal of Review of

Civil Area Boundary.

In this connection file containing all relevant documents alongwith original and

revised proposal and original and revised plans are placed on the table.

10. The issue discussed once again. The CEO apprised that a detailed presentation is

already made once on the subject to all the members & the PCB. It was decided to

visit some of the areas for taking further decision.

11. FSI RESTRICTION IN SOUTHERN COMMAND

Ref:- Head Quarters, Southern Command letter No.100476/FSI/Q(L), dated 18/07/2016

FSI restrictions were imposed by the GOC-in-C, Southern Command vide order

dated 26/03/1984 for prevention of overcrowding in Khadki Cantonment area under

section 181(A) of Cantonment Act, 1924. The following restrictions were imposed :-

(a) The permissible Floor Space Index shall be 1 in the Civil area notified under

section 43 A of the Cantonment Act and bazar area notified under Rule 2(b) of the

Cantonment Land Administration Rules 1937 and 0.5 in the remaining areas of Kirkee

Cantonment.

(b) Marginal open space along the periphery of land or plot shall be 4.5 meters

minimum for sites in areas other than the civil area and bazar area.

(c) The height of all building public/Government buildings will be restricted to a

maximum of 18 meters.

(d) The maximum number of storeys permissible shall be ground plus two floors in

all areas of the Cantonment.

The GOC-in-C, Southern Command letter referred above has inserted following

provisions in the FSI order published in the year 1984 in pursuance of Govt. of India,

Ministry of Defence letter No.12/1/Build. Bye Laws/2014/D(Q&C), dated 19/05/2016:-

(a) Wherever there is existing structure/building that exceeds coverage and FAR, re-

erection shall be permitted as per the approval granted to the original structure prior to

the FSI restrictions in the Southern Command.

(b) It is further ordered that this provision will be taken into account while sanctioning

building plans as per relevant provisions in the Cantonments Act, 2006 along with

building byelaws of the respective Cantonment Boards, existing FSI restrictions as

contained in the aforesaid orders as also land policy of the Ministry of Defense issued

from time to time in this regards.

(c) Re-construction/re-erection, as per original FSI will only be allowed, if the owner

is able to produce the original sanctioned plan and record of the same exists with the

Cantonment Board.

(d) No composition/relaxation shall be allowed for residents who have carried out

illegal construction over and above the sanctioned plan.

(e) Existing FSI restrictions as contained in (a) above, will continue to be imposed for

all construction/reconstruction/re-erection/repair for structures that have been

constructed or approved after 26.04.1984 the orders came into effect.

12. COMPLETION CERTIFICATE IN R/o HOUSE NO.481, OLD BAZAR, KHADKI

To consider the office report received from AE/CEE for the issue of the completion certificate.

Shri Deepak L Kudale for Neeraj Horticulturists Pvt. Ltd, & Vilus Talkies Khadki, vide letter dated 10/06/2016 requested for issue of a completion certificate of Cinema Hall etc. Earlier Shri Deepak Kudale submitted an application for issue of part completion, as there is no provision under Section 246 read with Section 242 of Cantonments Act, 2006 for issue of a part completion certificate. The matter was referred to PDDE,SC vide letter No.OB/481/P-126, dated 22/08/2016. In reply PDDE, SC vide letter No. 973/DE/SC/L/CB/Kirkee/Ty, dated 29/09/2016 advised to consider to issue of the completion certificate against the composition plan sanctioned by the Board.

Accordingly the AE/CEE has suggested for issue of the completion certificate as per orders. As the composition plan was sanctioned by the Board, the matter is placed before the Board to consider the issue of completion certificate.

In this connection the office report received from AE/CEE alongwith the Dte. Letter dated 29/09/2016 are placed on the table.

12. The issue considered. The PCB desired that the details be up for scrutiny so as to take decision which was agreed to by members.

13. THIRD PARTY INSPECTION & CERTIFICATION SERVICES FOR THE ORIGINAL AND MAINTENANCE WORK CARRIED OUT BY THE BOARD

Board vide CBR No.23, dated 27/05/2016 had considered the report dated 11/05/2016 received from CEE, KCB for the subject work and it was resolved by the Board.

„considered and approved in principle subject to negotiation of charges with ‘Certification Engineers International Ltd’ (CEI) as the charges of Rs.10,800/- appears to be high. Accordingly matter may be taken up with CEI.’

The CEIL was requested to convey their revised proposal vide this office letter No.4/1-D/CEIL/P-51, dated19/09/2016. In reply a mail has been received by CEE,KCB on 07/11/2016 from Shri Ajit Yadav, CEIL. As per the mail they have modified and submitted their revised offer as follows:-

Item is placed before the Board for consideration of revised offer received from CEIL as above.

It is for the information of the Board that the PDDE, SC, Pune vide their letter No.8078/Budget/Cantt/Gen/Vol.III, dated 24/08/2016 addressed to all the Cantonment Boards in the Southern Command have directed to engage a quality checking technical evaluator it may be either Central or State Govt. agency to incurred expenditure. .

The DGDE, New Delhi have also, vide their letter No.56/15/DGDE/CORRD/CONF/VOL-V/FMS No.52436, dated 06/10/2016, directed all the Boards in the country to engagement of a third party technical evaluator to check on execution of the work. In addition checking of work by an Officer of Directorate at the rank of Director.

In this connection mail received from CEIL alongwith the file containing all relevant documents are placed on the table.

13 Considered and approved. It was further resolved that „Certification Engineers International‟ (CEI) (A Govt. of India Undertaking subsidiary of Engineers India Ltd. (EIL) ) be appointed for the Inspection and Certification of the Maintenance of Original works and stores items of Engineering Section at their revised rates, after execution and agreement, initially for a period of one year.

14. REPAIRS TO PARK ROAD, KHADKI. To consider office report regarding non-maintenance of Park Road, i.e. from junction of Aundh Road backside of Khadki Railway Station to Stone Sett Road at the junction of CSD road.

There have been constant complaints from the public as well as the inmates of Paraplegic Home and Queen Mary‟s Technical Institute (QMTI), Khadki which are run by Indian Army for their disabled War Weterens and Army Personnel regarding non-maintenance of Park Road, i.e. from junction of Aundh Road backside of Khadki Railway Station to rear gate of Savitaribai Phule Pune University due to which lot of potholes have developed on the said stretch of the road. In this regard, Shri Suresh L Kamble, Vice-President, Cantonment Board, Khadki vide his letter dated 30 Sept. 2016 has requested for undertaking resurfacing of Park Road on priority basis on humanitarian grounds although the ownership of the road may not be with the Cantonment Board. Also, the Medical Officer, Paraplegic Rehabilitation Centre (Army) vide his letter no. PRC/Hygiene/2016 dated 19 Jan. 2016 has requested for undertaking the repairs of the road as it is in bad condition for the users and military personnel using wheelchair who are 100% disabled, use the road frequently for morning/evening walk. The matter of poor maintenance of this important road has been constantly raised by senior visiting Military officers and other dignitaries visiting QMTI and Paraplegic Home. As per the office records Park Road is under the management of Public Works Department, Government of Maharashtra (PWD). Accordingly, PWD authorities were contacted and it has been informed by the Executive Engineer, P.W. (Building) Division, Pune vide letter no. PB/1/VBP/2420/2016 dated 19 July 2016 that as per available documents & record repairs & maintenance of Park Road is not being done by them; as also, the road is not under their jurisdiction. The General Land Register records maintained by the office of DEO, Pune state that GLR Sy. No. 65 has been classified as Class B-2 land for all the P.W.D Streets admeasuring 9.9299 Acres with Bombay Government under the management of Provincial Government with Holder of Occupancy rights with P.W.D. The matter was taken up for clarification with the GM, AFK; GE (MH & RH) and GE (C) other probable agencies who normally maintain the roads within the Cantonment limits. In reply GE (C) vide his letter no. 2014/237/E2 dated 25 Oct. 2016 has informed that the said Park road does not belong to them. Similarly, GE (MH & RH) vide his letter no. 2015/116/E2 dated 03 Nov. 2016 has informed that the said road is not under MES area of responsibility. The matter along with other relevant documents is placed on the table for further consideration as Cantonment Board, Khadki being the local body where all the general public lodge their complaints and the Cantonment Board is being criticized for non-maintenance of the road. In case the Board decides to repair/maintain the said road (which will cost @ Rs.41,00,000/-) in larger public interest, the land occupied by the road (approx. 8285

sqm) including road berms etc which is around 11410 sqm (from Aundh Road junction to Stone Sett road at the junction of CSD road) needs to be reclassified into class „C‟ for which a separate proposal for sanction will be forwarded to the Competent Authority. 14. Considered and resolved to submit a proposal to Higher Authorities for re-classification of land pertaining to Park Road as Class „C‟ land. considering the poor maintenance of the road and inconvenience being caused to the inmates of Paraplegic Home on their wheel chairs. During discussions on the issues pertaining to Range Hills Estate area. Smt Vaishali.K.Pahilwan, Smt Pooja.M.Anand & Ms .Kartiki.P.Hiwarkar and other elected members requested to explore possibility of undertaking development works as deposite works and take up matter to request the Ammunition Factory Kirkee (AFK) Authorities in this regard which was agreed to Smt Vaishali.K.Pahilwan also submitted a copy of her letter dt.28/12/2016 to AFK on the subject. 15. EXEMPTION IN ROAD RE-INSTATEMENT (RI) CHARGES TOWARDS UNDERGROUND CABLE WORKS UNDER IPDS SCHEME. To consider letter no. CE/IPDS/CMD/33116 dated 29 Oct. 2016 (received on 17 Nov. 2016) from the Chairman & Managing Director, Maharashtra State Electric Distribution Co Ltd. requesting for exemption for payment of Road Re-instatement Charges towards underground cable works under Integrated Power Development Scheme (IPDS). As per the letter of Chairman & Managing Director, MSEDCL almost 50% of the total project cost for various strengthening and improvement of distribution network undertaken by MSEDCL through IPDS for Urban areas is required to be outlaid for road re-instatement charges to different local Municipal Authorities. This outlay of road re-instatement charges reduces the scope of underground cabling work to fit in the sanctioned project cost. Also, Government of India while approving Detailed Project Report (DPR) has disallowed the provision of Road re-instatement charges. In view of the above, it has been requested that necessary exemption be made towards Road Re-instatement charges towards underground cable works under IPDS Scheme. The matter along with the letter and office report and other relevant papers are placed on the table for further consideration. 15. Considered and resolved to permit Maharashtra State Electric Distribution Co.Ltd.(MSEDCL) to carry out the underground cable work Integrated Power Development Scheme (IPDS) on the following terms and conditions:-

1) No reinstatement charges towards underground cable works will be

imposed. The damaged surface of roads and foot path will be reinstated

by the Maharashtra State Electricity Distribution Company Limited

(MSEDCL) within the stipulated time to the entire satisfaction of the Board,

failing which MSEDCL will be liable to pay the reinstatement charges to

the Board.

2) MSEDCL will submit plans showing details of underground cable works

road wise and obtained a formal approval from CEO, Khadki.

3) The site will be clear in all respect immediately after completion of the

work. The same is not done by MSEDCL in previous work carried out.

4) After removal of HT/LT overhead lines, idle poles should be removed

immediately to enable the Board to carry out the road widening, if

possible.

5) For the installation of transformers and DPs the MSEDCL will fix the

transformers and DPs to the locations shown by the Khadki Cantonment

Board representative as In the previous works the location of

transformers and DPs are creating obstruction in road widening and

obstacles in smooth flow of traffic.

6) MSEDCL will relocate underground cables, transformers and DPs at their

own cost, if asked by the Board in future in public interest.

7) Any other condition which may be put by Govt of India. 16. BUILDING PLANS IN RESPECT OF HOUSE NO.70, CTS NO. 3567, 3568 & 3569, YERWADA, SANGAMWADI, KHADKI. To consider office note regarding application dated 05 Nov. 2016 received from Shri Rajendra M Naidu and Smt. Vaishali R Naidu, owners of House No. 70, CTS No. 3567, 3568 & 3569, Yerwada, Sangamwadi, Khadki requesting for sanction of the building plan on the said CTS Nos. Shri Rajendra M Naidu and Smt. Vaishali R Naidu, have submitted a building plan proposing to construct parking and one floor above it on House No. 70, CTS No. 3567, 3568 & 3569, Yerwada, Sangamwadi, Khadki. Sangamwadi village is situated outside the notified Civil area of Khadki Cantonment and the land is under the management of the Collector, Pune Sangamwadi village is included within the Cantonment limits only for Municipal purposes. As per the property cards dated 29 March 2016 issued by State Government Land department the CTS No. 3567 admeasuring 11.10 sqm (119.44 sqft); CTS No.

The applicants have also submitted a demarcation certificate dated 25 Feb. 2016 of CTS Nos. 3567, 3568 & 3569. The building plan submitted proposes the construction of parking plus one storey on the said CTS Nos. 3567, 3568 & 3569. The details of the proposed construction is as under:- i) Plot area of CTS No. 3567, 3568 & 3569 583.19 sqft. ii) Proposed built up area 286.75 sqft iii) Proposed FSI 0.492 v) Permissible FSI 0.500 The building plan submitted for the proposed construction are conforming the prevailing building bye-laws and FSI restrictions except for the side margins as stipulated in the instructions of GOC-in-C, SC. Further, the matter regarding the transfer of the property in the name of Shri Rajendra M Naidu and Smt. Vaishali R Naidu is in progress and held up due to the fact that no structure exists on site. As land in Sangamwadi village is mostly under the management of the Collector, Pune and hence the Cantonment Board only transfers the right of the structure that too only for municipal purposes. Meanwhile, Shri Rajendra M Naidu and Smt. Vaishali R Naidu started the work of construction on site, which was stopped by the Board by confiscating the material from the site on 01 Oct. 2016. The work of column footings were in progress when the work was stopped. But again the applicants had started the unauthorized constructions, accordingly the building plans submitted earlier on 03 Oct. 2016 were returned back vide letter no. H.No. 70/SW/P-86 dated 29 Oct. 2016 and further to show cause why action be not initiated against them for the said unauthorized construction as per the Cantonments Act, 2006. Also, there have number of complaints from the local residents of the area regarding the unauthorized construction being undertaken on site. Now, Shri Rajendra M Naidu and Smt. Vaishali R Naidu have submitted the building plan proposing construction on House No. 70, CTS No. 3567, 3568 & 3569, Yerwada, Sangamwadi, Khadki and stated that they will not undertake any work. The buildings plans may please be placed before the Board as the proposed construction is situated outside the notified civil area. If approved the applicant will have to deposit an amount of Rs. 1000/- towards the scrutiny charges and Rs. 2868 /- towards the development charges @ Rs.10/- per sqft of the proposed construction. Further, the applicants may please be penalized a fine of Rs.15000/- i.e 10% of Rs. 1,50,000/- (approx. cost of unauthorized construction undertaken) for starting the work without obtaining prior permission from the Board and also, not getting the property transferred from the Board within time period. Applicants will also have to obtain the NOC from the Collector, Pune before the commencement of the construction. In case the same is not

To consider the letter referred above received from Manager, Maharashtra Energy

Development Agency (MEDA) suggesting to conduct energy audit of all electrical installations of

Board to save energy and also to get the funds available under different scheme of Central/state

Government for energy conservation.

During personal discussion between CEE, KCB and Shri Hemant Patil, Manager, Energy

Conservation on 09/12/2016 in MEDA office, it was informed by Shri.Patil that through Energy

Audit measures to save energy will be ascertained thereby reducing the expenditure payable to

the MSEDCL by the Board. He further informed that for the allocation of funds by Central/State

Government for Conservancy of Energy audit reports are required.The Energy Audit will also be

helpful for electrical safety.

He informed that the MEDA will charge 1 to 2 % of Annual Energy bills as consultancy charges.

CEE informed that the charges for energy audit are on higher side on which Shri. Patil informed

that these are the negotiable charges and can be finalized after discussion with higher authority.

He also suggested conducting the Energy audit of all internal and external installations

of Khadki Cantonment Board for Energy Conservation to tentatively 10% to 15% energy saving,

at their negotiable quoted rates 1 to 2% of the annual energy bills of Khadki Cantonment Board.

Conducting the energy audit will save the power losses thereby saving the expenditure of the

Board. As per average of last three years Board had paid Rs.1,50,00,000/- to Maharashtra

State Electricity Distribution Company Limited towards the supply of electricity.

In this connection letter received from MEDA along with report of CEE is placed on the

table.

22. Considered and resolved to appoint Maharashtra Energy Development (MEDA)

to conduct the Energy Audit of Electrical Installations connections of Khadki

Cantonment Board after negotiating their fees to the reasonable level. An Agreement

also to be executed between the Board and Maharashtra Energy Development Agency

(MEDA) subsequently.

23. PROVISION OF FACILITIES SUCH AS TELEVISION SETS, RO WATER PURIFIER AND GARDEN BENCHES TO THE SPINAL CORD INJURY CENTRE : MILITARY HOSPITALl (MH) KIRKEE.

To consider & note the urgent action of approval of the President Cantonment Board for the Auction proceedings held on 13/10/2016 & 21/10/2016 to allocate the Firecrackers Stall at Sy.No. 217, Opp. Bungalow No. 27 (Raja Bungalow), Kirkee in the presence of the Finance Committee Chairman and Board Members.

This year the amount of Earnest Money Deposit was raised from Rs. 8,000/- to Rs. 15,000/- (in cash) and the size of the stalls were also increased form 10’ x 10’ to 12’ x 15’.

Overall 21 bidders participated in the Auction. The Highest bids were received for only 17 nos. of stalls on 13/10/2016 and the remaining stall nos. 11, 12 and 13 were put to re-auction on 21/10/2016.

Last year the total bid amount received for the 20 stalls was Rs. 9,13,000/- whereas an amount of Rs. 13,41,000/- has been collected for the same number of stalls this year. Therefore there is an increase of 47% i.e; Rs. 4,28,000/- from the previous year bid amount. Rs. 4,47,000/- i.e; 1/3rd of the total auction amount needs to be remitted to the Defence Estates Officer, Pune Circle. 29 ORGANIZING A MINI MARATHON OF 5 KM ON OCCASION OF REPUBLIC DAY CELEBRATIONS 2017 ON 15TH JANUARY 2017.

To consider the instructions contained in Ministry of Defence, Government of India, New Delhi I.D No. 1(1)/12/2016/D (Cer) dated 01st Dec. 2016 and the letter no. 8073/Cantt/Circular/Gen/DE dated 09 Dec. 2016 received from the Principal Directorate, Southern Command, Pune to organize a 5 km Mini Marathon, as a part of Republic Day Celebrations 2017, on 15th Jan. 2017 (Sunday). Accordingly, Mini Marathon of various age groups, differently abled persons and senior citizens will be conducted on 15th Jan. 2017. The matter along with the letter and office report, estimation of expenditure and other relevant papers are placed on the table for further consideration. 29. The CEO read out the contents of the instructions of Ministry of Defence, Government of India, New Delhi and the Principal Directorate, Defence Estates, Southern Command, Pune to conduct following activities on the eve of Republic Day Celebrations 2017:- a) Mini Marathon/Run for Nation of 5.0 km on 15 Jan.2017. b) Painting competition for school children on 22 Jan.2017 on a theme relating to Republic Day. Accordingly, the matter was consider in detail and resolved that Mini Marathon (Male & Female) be conducted on 15 Jan.2017 as done last year, as per the instructions. It is further resolved that in addition to 5 km Mini Marathon a 2 km, 3 km & 12 km “President‟s Trophy” (all the races for boys/male & girls/female) and 2km for Senior Citizen (Male & Female) & differently abled wheel chair (manual & mechanical) also be conducted as was done during Republic Day 2016 celebrations. Accordingly, the routes of various events, quantum of prizes, conduct of prizes, distribution and cultural programme, etc were also discussed and confirmed. The Organizing Committee as constituted in consultation with the PCB and all Elected Members be requested to make all the possible efforts for successful & smooth conduct of the event. It was also directed to take necessary assistance from BEG & Centre for conduct of cultural events. Also other Army Units, Ammunition Factory & HE Factory be invited to participate in the event and seek any help if need be. Assistance in this regard be also sought from Pune District Amateur Association/,Pune District Athletic Association, various public organization, NGOs, Resident Welfare Citizens/Representatives,Volunters, Banks, other Sponsors (if any) to make the event successful.

Engineering Branch Report : As per site Inspection carried out by Engineering Section vide dated 04.03.2016, there is no unauthorized construction, no sub-division, no change of purpose but there is an encroachment in the form of Steps 20’ x 4’ on front side of shops and 14’ x 3’ on rear side of property i.e. total 122 sq.ft. As per Direction of PDDE letter No. 9681/DE/SC/L/Kirkee/27/593 dated 08.03.2016 Shri Chandraprakash Devraj Parekh has submitted a notarized Affidavit in the form of undertaking stated that in the event of requirement of land by the Government he will remove the same immediately at his cost and pay the necessary damages as per the rules. In the meantime, this office vide letter No.NBK/02/190 dated 19.07.2016 has published public notice in local newspapers of Indian Express and Loksatta dated 28.07.2016 and Notice Boards of the Cantonment Board, Kirkee for no objections/claims from the public. NO claim/objection received within 30 days.

In this connection, the office report dt.30/08/2016 is placed on the table along-with all relevant documents.

1. Considered and recommended to approve the mutation in respect of House No.02, New

Bazar, Kirkee, GLR SY.No. 27/580 in the name of Shri Chandraprakash .D.Parekh and

necessary entries be made in the GLR/Taxation register subject to the following payment of

necessary transfer fee:-

a) The transferee will not be entitled to have greater right than those of the transferor & as

entered in GLR.

b) All the taxes/dues should be cleared till the end of the current financial year.

Shah requesting theirin for transfer of lease hold rights in respect of H.No. 106 TS, Sy No. 27/414 with Legal Heirship Certificate issued by Jt. Civil Judge, Jr. Division Pune Misc Application No.933/2011 dt. 06.12.2014 and No objection Certificate given by legal heirs dated 25.02.2014. GLR STATUS :- As per GLR the property of House No.106 TS, Kirkee, situated within the Civil Area under Section 46 of the Cantonment ACT 2006 measuring 317 Sqft, Comprising GLR Sy No.27/414 stands on the name of Shri Maniklal Chhaganlal Shah and Smt Kamlabai Maniklal Shah and held on lease in Sch.VI of CLAR 1925.

ENGINEERING BRANCH REPORT: As per the report of the Engineering Branch vide dated 05.04.2016 there is no unauthorized construction, no sub division of site, but change of purpose in form of shop. The site of House No. 106, TS was held on lease meant for dwelling purpose. The lease expired on 20.05.1961. As there was change of purpose, the Board decided to grant lease in Sch.VIII of CLAR 1937 on payment of enhanced rent of Rs.35/- and

premium of Rs.700/- equal to 20 times of the rent. The lessee paid the rent and the case was forwarded to Government for seeking sanction of President of India to regularize the change of purpose. In the meantime, sale transaction has taken place on 05.02.1971 and purchaser Shri Maniklal Chaganlal Shah has requested to transfer the House. A Proposal was submitted vide this office letter No. TS/106/P-161 dated 04.12.1982 seeking sanction of the GOC-in-C Southern Command Pune for regularization of Change of Purpose in respect of above subject property and to grant lease in Sch VIII of CLAR 1937. The date of usage of premises for commercial use is 21.02.1961 and the rent

was recovered from the lessee from 21.05.1961 to 31.03.1963 of Rs. 65.15 @ Rs35/- per annum. Accordingly the Board has recovered the commercial rate of Rs.35/- and premium of Rs.700/- has been fixed and worked out @1/- per Sq.yard as the sites are used for commercial purpose and premium is equal to 20 times of rent. Since the requisite sanction for regularization of change of purpose and grant of lease in Sch.VIII of CLAR 1937, has not yet been received. The matter is still pending for renewal. Since, Shri Chandrakant M Shah has applied for transfer of Occupancy rights by inheritance and produced Death Certificate of the Present HOR. Legal Heirship Certificate and NOC from other legal heirs are enclosed herewith. Legal opinion was obtained from CLA who vide his letter dated13.07.2016 has opined that the property can be transferred in the name of applicant by inheritance based on legal heirship certificate. As per CRS report, Property tax paid upto March, 2016.

In this connection, office report dt 14/07/2016 alongwith the application

is placed on the table along with all relevant documents.

3. Considered and recommended to approve the mutation in respect of House No.106, TS, ,

GLR SY.No.27-414 in the name of Shri Chandrakant .M.Shah and necessary entries be made

in the GLR/Taxation register subject to the following payment of necessary transfer fee:-

In response to above notice an objection was received from Smt.Ratnamala D Naidallu claiming that being the daughter-in-law of the deceased HOR (Shivram M Naidallu) she is the legal nominee. On her request a personal hearing was made on 08/10/2007 by the CEO in the presence of Arya family wherein she was asked to submit the marriage certificate within 15 days. Even after lapse of more than one month Smt.Ratnamala failed to submit the marriage certificate. As she failed to submit the same she was vide letter

No.OB/367/P-126 dated 15.12.2007 advised to seek the order from Court of law, as the Board was not the competent authority to decide title of any property. In response to letter dated 15/12/2007 Smt.Ratnamala submitted a copy of Memorandum of Marriage and requested permission for inspection of house file through her advocate. On this a legal opinion was sought who opinied that there is no prohibitory order from the Court and the matter may be dealt as per his opinion dated 04/07/2007.

The matter was considered and resolved vide CBR NO. 51 dated 29/03/2008 that the decision on the matter be deferred and the same was communicated to the applicants vide this office letter No.OB/367/P-138 dated 21/04/2008.

As per fresh site inspect report there is an encroachment of total ground coverage area 40’ x 42’ = 1680 sqft (GLR area 665 sqft & area of encroachment = 1015 sqft and change of purpose in the form of Kiosk towards Southern Site of property.

The lessees were vide this office letter No. TS/103/P-126 dated 23.05.2013 instructed to remove the encroachment and stop the commercial activities failing which action will be initiated as per provision of law. Final notice was issued to the lessee vide letter No TS/103/P- dated 18.02.2016 for willingness of renewal. No response has so far been received from the lessees.

An advertisement was also published on 21.03.2016 in the daily newspapers i.e. Lokmat, Indian Express and Nav Bharat asking for willingness for renewal of lease. The lessees have not responded so far.

It is therefore imperative that the lease be determined as there is violation

Matter was considered and Board vide Spl CBR No.30 dated 28.04.2008 approved for renewal of lease for further period of 30 years from the date of expiry by delinking unauthorized construction and encroachment on Government land. Case was forwarded to Principal Director, Defence Estates, Southern Command, Pune for sanction of renewal of the property vide letter No.TS/73/P-89 dated 09.06.2008. In reply to the proposal submitted, PDDE,SC, Pune had vide their letter No.9681/L/LC-1/DE dated 17.10.2011 have instructed to submit a copy of indenture in SCh.VI, present status and a copy of letter exercising option for renewal of lease given by HOR. Accordingly site Inspection was carried out and as per the report of Engineering Section dated 09.08.2014 there is a change of purpose in the form of Shop. The

lessees were accordingly informed vide this office letter No. TS/73/P-118 dated 16.10.2014 to remove the violation within 7 days failing which the case will be projected to the higher authorities for determination of lease for breach of conditions. PDDE, SC ,Pune vide letter No. 9681/DE/SC/L/Kirkee/Sy NO. 27/417 dated 20.10.2014 has instructed this office to ask the lessee to remove the breach (change of purpose) & if it is not feasible/practical to remove the breach, required documents be asked for condonation of the breach within the time frame stipulated in the DE,DE letter No.723/A/3/L/DE/2007 dated 19.12.2012. If the lessee fails to remove the breach within the stipulated time, case be sent for determination of lease.

This office had vide letter No. TS/73/P-121 dated 29.10.2014 intimated the

HOR to submit the lease document in Sch VI of CLAR 1925 and all other relevant documents for renewal of lease. In response to the letter, Smt V S Bosadwalla and others had vide application dated 24.09.20105 stated that they are not having any documents for renewal of lease but they are willing to renew the same.

Vide this office letter No.TS/73/P- dated 11.03.2016 notice was again issued to

HORs of the said property, but no reply received till date.

Public Notice issued on 21.03.2016 in the following newspapers.

1) Lokmat 2) Indian Express 3) Nav Bharat.

Final notice issued to Lessee vide letter No. TS/73/P- dt 11.03.2016. No

response received from the lessee and accordingly advertisement was published on 21.03.2016 in daily newspapers i.e. Lokmat, Indian Express and Nav Bharat informing the lessee about expiry of lease and to renew the same. Since the HORs have not submitted requisite documents and moreover there is change of purpose, it is therefore imperative that the lease be determined as instructed vide DGDE, MOD, letter No. 723/A/L/DE/2007 dated 19.12.2012 and proposal be sent for determination of lease. Notice under Section 187 of the Cantonment Act 1924 was also issued to lessees and they were again vide letter No. OB/337/P-193 dt 08/10/2014

intimated to remove the encroachment. However HOR did not respond nor encroachment removed.

Final Notice was issued by this office vide letter No. OB/337 dated 20/02/2016 to the lessees to submit the documents as well as to remove

encroachment for consideration of renewal of the lease.

Based on the letter dated 2.2.2013, HOR namely, Shri R D Agarwal vide

application dated 07.03.2013 intimated that they are ready to pay the

enhanced rent and willing to renew the lease.

Based on the willingness received, the site was got inspected and as per the site inspection report dated 15.03.2013, there is encroachment in the form of G+1 10’ x 6’ admeasuring 60’.00’ sqft (WC & Bathroom) towards Northern

side of the property. Lessee were asked to remove the encroachment vide this office letter NO. NB/79/P-170 dt 30.03.2013. But no response received from

lessees. Final notice was issued to the lessee, vide this office letter No. NB-79/P-

dt.29.02.2016 for renewal of lease failing which case will be proposed for determination.

Public Notice issued on 21.03.2016 in the daily newspapers Lokmat , IndianExpress and Nav Bharat. No documents provided so far for renewal nor

encroachment removed. It is therefore imperative that the lease be determined as per its terms & violations and as instructed vide DGDE letter No. 723/A/L/DE/2007 dated 19.12.2012.proposal for determination of lease is to

be processed. In this connection, the office report is placed on the table along with all

relevant documents.

10. The matter considered in detail. Committee recommended that since the

HOR is not aware of the final Public Notice issued, one last opportunity be

given to the HOR for producing all relevant documents for renewal of lease. If

not complied with, the case be put to the Committee/Board for determination.

lessee for renewal of the lease, matter was referred to Board and the Board vide CACR No. 2 dated 3/12/2013 as confirmed by CBR No.4 dated 24.04.2014, considered and recommended to forward proposal for sanction of the Competent Authority/Principal Director, Defence Estates Officer, Southern Command, Pune for renewal of the lease.

Ex-Facto Sanction was received from PDDE SC vide letter No. 9681/DE/SC/L/Kirkee/Sy No.27/586 dated 10.07.2014 for renewal of lease in Sch IV

of CLAR 1937 for further period of 30 days with effect from 18.01.2001. Applicants were intimated regarding the sanction received for renewal and were instructed to furnish all relevant documents for mutation/renewal vide letter No. NB/33/P- 233 dated 23.07.2014.

Applicants were again informed vide this office letter No.33/NBK/P-234 dated

24.09.2014 to submit all relevant documents for mutation/renewal failing which it was intimated that case will be projected to higher authority for determination of lease. This office has again requested the applicants vide this office letter No. NB/33/P-235 dated 16.01.2015 to attend this office for discussion and for further necessary action on the subject matter.

Applicant namely Shri Vasu Achu Pujari vide letter dated 19.01.2015 requested for transferring the property in the names of 5 legal heirs, but no documents submitted.

Based on the Lands Clerk report dated 20.01.2015, Public Notice Published in

the Newspaper for transfer of property. The Board vide CBR No. 37 dated 06.04.2015 transferred the property in the name of 5 legal heirs namely Vasu Achu Pujari, Jaya Achu Pujari, Chandrashekar Achu Pujari ,Sadashiv Achu Pujari, Ganesh Achu Pujari by inheritance based on Death Certificates and Notarized Affidavit cum Indemnity Bond. However the names have not been entered in the GLR.

The legal heirs had paid the transfer fee Rs.2500/- and also as intimated by this office vide letter No. NB/33/P- 242 dt. 07.05.2015, arrears of annual rent for the period of 18.01.2001 to 31.03.2015 @ Rs. 1520/- has also been paid by the applicant. However they have not executed the lease deed.

Final Notice was issued to the applicant vide this office letter No.NB/33/P-245 intimating the lessee to submit the documents. However no reply received so far.

Public Notice issued on 21.03.2016 in the daily newspapers i.e.Lokmat, Indian Express and Nav Bharat.

The HORs have not produced requisite documents for renewal of lease in spite

of letters and public notice published in the local newspaper. Hence it is therefore imperative that the lease be determined and instructed by DEGD letter No. 723/A/L/DE/2007 dated 19.12.2012 proposal for determination of lease is to be processed. In this connection, the office report is placed on the table along with all relevant documents.

11. Matter discussed in detail. Since the Board in its Meeting dated 06/04/2015 has

approved the Transfer of Property in the name of 5 legal heirs, and Transfer Fees and Arrears has

also been paid, The Committee recommended that the HOR be give 03 Months time to produce

all relevant documents such as Legal Heir-ship Certificate, etc for Mutation & renewal of lease.

If not complied with the prescribed period, the case be taken up for Determination.

As per detailed office report despite repeated attempts, the lessee has not responded to the notices, correspondences and advertisements made by this

office for renewal of lease as under:

(4) Letter No.OB/517/P-218 dated 17.10.2007 It is verified from the file that due to death of HOR Ramdayal K Agarwal,

the property was transferred in the name of Smt Sonabai R Agarwal and 4 others as per CACR No.02. dated 19.06.1986 as confirmed by CBR No. 2 dated 27.06.1986 subject to production of undertaking to the effect that the

prospective HOR is responsible for renewal of lease. It was resolved that necessary entries be made in the GLR/Taxation registers. However, the names

of the new HOR have not been entered in GLR. Vide No. OB/517/P-225 dt 23.07.1986 Smt Sonabai Ramdayal Agarwal

was asked to submit the undertaking jointly on stamp paper stating that she will renew the lease from 20.02.1985 as soon as the mutation is effected and accordingly they have submitted undertaking jointly on stamp paper and

willingness given for renewal of lease.

The Matter for renewal of lease was taken up in the Board Meeting and Board vide CACR NO.4 dated 19.09.1986 as confirmed by CBR No. 26.09.1986 resolved to pend the renewal based on the report of Engineering Section about

unauthorized construction. It was resolved that notice under section 185(1) of the Cantts Act 1924 be issued to the legal claimant of the property to remove

the unauthorized construction of “rooms on terrace measuring 10’-6” x 12’-6”, 10’-6” x 11’-3” with BB Works and RCC Slab” within a period of 30 days.

Vide letter No. OBK/517/P-232 & P-234 Shri Rameshwar R Agarwal and

others were issued a notice under section 185(1) of the Cantt Act 1924 for

unauthorized construction of Rooms on terrace measuring 10’-6” x 12-6”, 10’-6” x 11’-3” with BB Works and RCC Slab.

Shri Rameshwar Ramdayal Agarwal and others vide application dated

11.02.1987 requested to regularize the unauthorized construction and they are ready to pay the composition fees

As per CACR No. 1 dated 24.4.1987 as confirmed by CBR No.1 dated

28.04.1987 Board resolved that unauthorized construction is in violation to the

FSI restrictions and the request for composition fee cannot be agreed to and action for demolition be taken.

On the basis of the application dated 10.08.1986, the Board vide Spl CBR No.19 dated 28.4.2008 considered to renew the lease and also resolved

that the proposal be submitted to the higher authorities on priority basis delinking unauthorized constructions and encroachments on Govt. land. Accordingly proposal was sent to higher authorities vide this office letter No.

OB/517/P-223 dated 09.06.2008. But sanction was not received.

Vide No. OBK/517/P-247 dt 21.10.2014 Smt Sonabai Ramdayal

Agarwal and others were asked to remove the encroachments measuring

357.50 (101.50+256)Sq.ft on Government land in the form of Ottas/Steps and Shahbadi flooring with partly GI Sheet roof and unauthorized construction in the form of Rooms on Terrrace measuring 12’.6” x 10’6” & 11’ 3”x 10’ 6”.

Further the applicant had started shop at the property which amounts to change of purpose and violation.

Vide No.PPE/KCB/P-06 dt 15.12.2014 Notice was issued to Smt Sonabai Agarwal and others under sub section (2) of section 5A of the PPE of

Unauthorized Occupants Act.

Vide this office letter No.OB/517/P- dated 22/02/2016, final notice was

issued to the lessee intimating that if they don’t comply with the procedure for renewal of lease, case will be taken up for determination. No reply received so far.

Public Notice issued on 21.03.2016 in the daily newspapers Lokmat,

Indian Express and Nav Bharat. Since no documents provided for renewal and moreover there is also violation of lease terms (encroachments, Unauthorized construction and Change of purpose), it is therefore imperative that the lease

be determined as per its terms & violations and as instructed vide DGDE letter No. 723/A/L/DE/2007 dated 19.12.2012.proposal for determination of lease is to be processed.

In this connection, the office report is placed on the table along-with all relevant documents.

12. Considered and recommended for determination of lease for House No.517 Old Bazar,

SY.No.27-625 and proposal for the same be sent to the competent authority. Principal Director,

Defence Estates, Southern Command Pune.

It was also recommended that as there is encroachment, the case be referred to the Estate

Officer to take action under PPE Act, and damages be recovered from the period, it was detected.

13. CHARGES FOR ADVERTISEMENT HOARDING ON PRIVATE BUILDING/

PROPERTIES.

To consider report from the Chief Revenue Superintendent to increase in existing rates

for displaying of Advertisement/Hoarding on private Buildings/properties within the jurisdiction

of Kirkee Cantonment on payment of necessary charges. It has been noticed that

Hoarding/Advertisement charges have not been revised/enhanced from the year 2009-10

onwards. Last revision was made vide CBR no. 2 dt. 16-12-2009. Details of charges to be

revised and its comparison with Pune Municipal Corporation is given as below:-

Also, it is proposed that in case of erection of Hoarding/Advertisement on Private

Buildings without prior permission of the CEO, rate will to be charged twice as the rate approved

by the Board.

At present, Smt. Farhat Tahir Kazi has requested to grant the permission for Hoarding,

which is the only hoarding on private property i.e. at Jaishiv Shankar Hsg. Society, Waitagwadi.

The Board receives Rs.94,248/- p.a. as advertisement/Hoarding charges from this Hoarding,

after revision Board‟s expected income would be Rs.2,26,440/- p.a. for year 2016-17 i.e.

increase of Rs.1,32,192/- p.a.

The relevant documents in this regard are placed on the table.

13. Considered and recommended. The charges be revised to strengthen the Revenue as

proposed as the rates have not been revised since 2009.

14. HAND OVER PEACEFUL AND VACANT POSESSION OF PREMISES ON OR BEFORE 23-07-2016

DHL Supply Chain ( Exel India) has given notice to hand over the possession of Hall located at Shopping Complex Sy. No.134 (Old Indian Bank Premises) on or

before 23-07-2016.

The Board had allotted said premises admeasuring 3945 Sq. Ft .consisting of Superstructure at 1st floor of Shopping Complex in GLR Sy No. 134 on Commiserate Road near Shri.Ram Mangal Karyalaya, Kirkee to Exel India Pvt.

Ltd., on licence for a term of 20 (twenty) years, commencing from the 16th January 2006. The name of the firm Excel India Pvt Ltd was later on changes as DHL Supply chain Management.

As per terms & conditions of agreement clause 14, firm can vacate the

possession of the premises by giving 4 months prior notice in advance and can deliver the vacant and peaceful possession after paying outstanding dues up to date. In case if notice is not given then the licensor have the rights to recover

the dues/amount equal to the license fees for the said stipulated period from the Security Deposit and remaining amount can be refunded.

Licensee has paid Rs.9,40,000/- as security deposit vide 4-b receipt no.

767581 dt. 31-01-2006, and in his application has requested to adjust the

remaining monthly license and dues fees from the security deposit and to refund the remaining amount which can be granted. The outstanding amount of Rs.6,22,806/- against the firm can be adjusted from the Security Deposit.

Also, it is suggested that the said premises be allotted to organization

running business or commercial activities like Bank or other institutes or to any company office to receive higher rent amount.

The relevant documents in this regard are placed on the table. 14.. Considered & recommended to take over possession of Hall at the time of Handing

Over//Taking Over the DHL Supply Chain Management due to violation of Agreement Clause

14 with necessary recovery dues . After recovery of dues, the premises be sealed for further

Allotment by Auction as per Rule.

15. POLICY FOR SETTING UP CELL TOWERS ON WHEELS AS AN INTERIM ARRANGEMENT TO EXTEND COMMUNICATION NETWORKS IN MILITARY STATIONS/CANTONMENTS

To consider the office report dated 08.06.2016 received from CEE, KCB for subject

work. As per the report:

The Government of India, Ministry of Defence vide letter No.11026/1/2005/D (Lands),

dated 16/05/2016 have framed the policy for setting up Cell Tower on Wheels (COW) as an

interim arrangement to extend the communication network in military/cantonments. The

Ministry of Defence had promulgated a policy for “Provision of Defence land to Communication

Operators to construct Shared Communication Towers and other Infrastructure to extend

communication network in Military Stations/ Cantonments” vide letter No.11026/1/2005/D

(Lands) dated 12.09.2008.

As per the policy the assessment of the requirement in case of Class „B-4‟ and Class „C‟

land will be carried out by the CEO in consultation with Vice President of the Cantonment Board

and by LMA in case of A1 and analogous A1 land. The DG (signal) or equivalent in case of

Navy/Air force will be consulted if required. The tower on wheels locations as determined by the

CEO should be approved by the Cantonment Board. Care should be taken that location do not

cause problems for traffic movements and parking. No COW on wheels will be permitted on

Class „B3‟ land.

Station Headquarters Kirkee/Aundh had been informed regarding policy framed by

Government of India, Ministry of Defence vide letter No.11026/1/2005/D (Lands), dated

16/05/2016 and was requested to assess their requirements, if any, and suggest suitable locations

for installation of COW on class A-1 defence land vide this office letter No CCE/KCB/2015-

16/Vol. IX/P- 53 dated 13.06.2016.

In pursuance of the said directions a meeting was held on 08/06/2016 at 1500 hrs in the

office of the Kirkee Cantonment Board wherein the following sites are considered for installing

COW on Class B-4/C land in cantonment area.
