The Digital Economy Act
The Act creates two new responsibilities for ISPs:
1. ISPs must notify subscribers of allegations made by copyright owners that their accounts have been used for unlawful filesharing.
2. ISPs must maintain lists, in an anonymised format, of subscribers who have received multiple notifications. Copyright owners can seek a court order to secure details on those subscribers and may pursue targeted legal action.
Ofcom is required to make a code to give effect to these responsibilities, create an independent appeals body and provide reports to the Secretary of State on the impact of a range of measures.
