1. Objectives:-

The drivers engaged in private commercial vehicles, such as Auto, Taxi, Maxi cab, Lorry and Private Bus are constantly exposed to hazards of accident. In the event of an accident, the drivers either meet with death or suffer permanent total or permanent partial disability. In the case of death of the driver, the family which is dependent on the income of the deceased driver is put to untold misery resulting into suffering due to loss of income leading to starvation. In the case of the drivers affected by permanent total disability, the earnings are reduced to nil. As a result, the life of the disabled driver and his family turns wrecked.

In the case of permanent partial disablement, the affected driver’s income is reduced. As a result the family of the driver find it difficult to meet the livelihood needs.

Therefore , there is an urgent need to address this issue by providing relief to the affected drivers and the families of the deceased drivers. This will go a long way in mitigating their hardship.

Hence, accident compensation through insurance coverage is one of the means to provide relief in such cases. A scheme in this regard is proposed as under.

2. Name of the Scheme:-

This Scheme may be called “Karnataka State Commercial Vehicle Drivers’ Accident Benefit Scheme”;

3. Scope and Coverage : -

(i) It shall come into force from the date of publication in the Official Gazette;(ii) It extends to the whole of Karnataka;(iii) This Scheme is applicable to private commercial vehicle drivers, such as, Auto,

Taxi, Maxi cab, Lorry and Private Bus Drivers.(iv) Types of accidents covered are:-

(a) Accident resulting in death of the driver;(b) Accident resulting in permanent total disability ;(c) Accident resulting in permanent partial disability.

4. Accident Cover :-

i. This Scheme is applicable to private commercial vehicle drivers possessing driving licence issued in the State of Karnataka.

ii. These drivers shall also register with the Karnataka State Unorganised Workers’ Social Security Board by paying a one time registration fee of Rs. 25/-;

iii. Age group of the drivers shall be between 20 to 70 years iv. The registered commercial vehicle drivers throughout the State of

Karnataka to be covered under the Scheme (total figures of drivers shall be as provided by the Board);

v. Coverage shall be in respect of both on duty as well as off duty ;

vi. Sum assured is Rs.2,00,000 /-

5. Exceptions :-

The claim is liable to be rejected in the following cases:-

1. If the driver is under the influence of either liquor or drug;2. Accident arising or resulting from the driver’s insanity;3. Accident arising or resulting from the driver committing any breach of law with

criminal intent;4. Accident arising or resulting due to war , invasion, act of foreign enemy, rebellion,

revolution, mutiny, military or usurped power, seizure, capture, arrest and so on;5. Accident arising or resulting from nuclear materials.

7. Procedure for Claim :-

(i) The identification and coverage of the beneficiary shall be as per the records of RTOs in Karnataka.

(ii) The notice of claim shall be submitted to the insurance company within 6 months from the date of accident.

(iii) In case of permanent total disablement or permanent partial disablement claims, claim form shall be accompanied with RTO driving licence extract, badge (in case of passenger vehicles), medical certificates and bills.

(iv) In case of death claim, legal heir of the deceased driver to furnish the death certificate, post-mortem report, RTO driving licence extract, badge (in case of passenger vehicles) survival certificate and so on along with claim form.

8. Settlement of the Claim:

Claims shall be settled by the insurance company selected through competitive bidding throughout the State within the stipulated time by the Board.

PART-IIDESCRIPTION OF WORKS

(i) Registration Requirements The tendered company will issue application forms to commercial

vehicle drivers (i.e., auto, taxi, maxi cab, lorry and private bus

drivers) and collects the same along with other attested mandatory documents, at various collection centres as identified by the Board throughout the State, making use of the company’s manpower, computer systems, peripherals and other infrastructure.

The staff of the tendered company shall then scrutinise the application and other enclosures, and if found correct shall issue a receipt, after collecting a one time registration fee Rs.25/- to the applicant on the spot giving details as to when he should approach the collection centre to get his identity card .

In case the application is found incomplete or if any of the mandatory documents are not enclosed, shall return the same giving reasons for the rejection .

The details of the accepted application are entered into the computer systems making use of the software. Similarly, the documents are scanned and uploaded to the system. After a thorough scrutiny , the application along with the documents are sent online to the notified Registering Officers of the Department of Labour . The Registering Officer undertakes a second scrutiny and if the application is found acceptable , gives a ‘issue signal’ to the collection centre from where the application is generated to issue identity card to the applicant.

The staff of the tendered company at the collection centre shall then issue computer generated identity card to the applicant on the designated date and time. (one side printed identity cards shall be supplied to the tendered company by the Board)

(ii) Software Requirements

The Board intends to computerize the following activities of the scheme:

Computerising all the essential fields necessary for enrollment Generation of acknowledgement Endorsement regarding the defects in case of incomplete

applications/ inappropriate documents. Generation of Receipt of registration fees Issuance of identity card with unique number Tracking of all registered drivers with details of accident cover

extended to them/their family. Generation of MIS reports related to all the above activities.

1) Tenders under two cover system i.e. Technical Bid (Pre-Qualification Requirements) and Financial Bid, duly signed by the companies will be received by the Joint Secretary of the Board.

2) Nature of Service: i ) To develop and operate software for implementing of the scheme.

ii) To enrol beneficiaries under Karnataka State Commercial Vehicle Drivers Accident Benefit Scheme throughout the State.

3) Period of Agreement: Six Months from the

date of signing the agreement.

4) The Tenders shall be submitted to the Joint Secretary, Karnataka State Unorganised Workers’ Social Security Board, Karmika Bhavan, Bannerughatta Road, Bangalore-560029, before the time and date stipulated herein. The tenders shall be submitted in two separate sealed covers as under:

i) One cover meant for Technical Bid (Pre-qualification requirements)as shown in Annexure -1 shall be duly superscribed as “Tender to develop Software and Registration of Beneficiaries under Karnataka State Commercial Vehicle Drivers’ Accident Benefit Scheme - Technical Bid” and addressed to the Joint Secretary Karnataka State Unorganised Workers Social Security Board, Bangalore-560029.

ii) Another cover meant for Financial Bid as shown in Annexure-2 shall be duly superscribed as “Tender to develop Software and Registration of Beneficiaries under Karnataka State Commercial Vehicle Drivers’ Accident Benefit Scheme - Financial Bid” and addressed to the Joint Secretary Karnataka State Unorganised Workers Social Security Board, Bangalore-560029.

iii) And that both the Technical and Financial covers shall be put in an envelope for each work and the envelope shall be addressed to Joint Secretary, Karnataka State Unorganised Workers Social Security Board, Bangalore-560029, and the said envelope shall be duly superscribed as “Tender to develop Software and Registration of Beneficiaries under Karnataka State Commercial Vehicle Drivers’ Accident Benefit Scheme in the State of Karnataka”.

iv) The Tenders shall be signed by the authorized person duly affixing the office seal.

5) Tenders will be opened in the presence of available tenderers or the agents authorised by them in writing on the date and time specified herein.

6) The rates in the tender shall be written in ink or typewritten both in words and figures.

7) The validity of the offer shall remain open for a period of ninety days from the date of opening of tenders. The tenderer cannot withdraw his tender before said period or make/propose nor modify/alter the terms and the conditions of the tender .

8) The Authority shall award the contract to the successful bidder whose Bid has been determined to be substantially responsive and lowest evaluated bid, provided further that the bidder has been determined by the Authority to be qualified to perform the contract satisfactorily.

9) The period of Contract will be for 06 months from the effective date, subject to renewal, at the exclusive discretion of the Authority and which is based on parameters to be fixed by it for renewal.

10) The Notification of Award will be issued by the Tender Accepting Authority. The terms of Agreement will be discussed with the representatives of the successful company and the company is expected to furnish a duly signed Agreement proposed by the Authority in duplicate within 7 days of declaration of ‘award of contract’, failing which the contract may be offered to the next bidder in order of merit.

Note: Terms can be amended by the Authority before entering into the contract.

General Information 1. The “Board” means “Karnataka State Unorganised Workers’ Social

Security Board, Karmika Bhavan, Bannerughatta Road, Bangalore-560029” represented by the Joint Secretary of the Board.

2. Secretary means Secretary to Government, Labour Department and Member Secretary, Karnataka State Unorganised Workers’ Social Security Board.

3. The “Joint Secretary” means the “Joint Secretary of the Board.”

4. The word “Agreement” means “a written agreement on a non-judicial stamp paper of Rs.200/- between the Board and the successful tenderer stipulating the terms and conditions governing the tender.”

Other Terms & Conditions

1. Tenders shall be valid for ninety days from the date of opening of the Financial Bid.

2. Alternative tender/s will not be considered.

3. Tender document is non-transferable.

4. Conditional tenders are liable for rejection.

5. The successful tenderer shall enter into a contract agreement on a non-judicial stamp paper of Rs.200/- only (Rupees Two hundred only) for due performance of the contract.

6. The right to reject any or all tenders without assigning any reason is reserved with the Joint Secretary. No correspondence in this regard shall be entertained.

7. In case any dispute or difference arises between the Board and the Company on any matter within the scope of the agreement, then either party shall forthwith give written notice of such dispute or

difference to the other party and such dispute or difference shall be referred to the Secretary of the Board whose decision shall be final.

8. To prevent disputes and litigations, it shall be accepted as an inseparable part of the agreement that in matters with regard to, interpretation of agreement, mode of procedure and carrying out the work, the decision of the Joint Secretary shall be final and binding on the Agency.

Annexure - 1SECTION A – TECHNICAL PROPOSAL

QUALIFYING CRITERIA:

a) The tenderer should be a registered company under companies Act and should have undertaken Software development related activities and should also have provided manpower and related activites for at least three years. The tenderer shall attach copies of works carried out and undertaken.

b) The tenderer should have a transaction of not less than 3 crores per annum in the last two years. Copies of audited balance sheets to be appended.
