Newsletter 2013-46 November 15, 2013 ODEBRECHT TO EXPLORE APPALACHIAN INDUSTRIAL INVESTMENT Governor Earl Ray Tomblin and Odebrecht Environmental announced that Odebrecht will explore the development of a new petrochemical complex in Wood County. The complex, Appalachian Shale Cracker Enterprise (Ascent), would include an ethane cracker, three polyethylene plants, and associated infrastructure for water treatment and energy co- generation. A purchase option on the anticipated project site in Parkersburg has already been secured. "Although we realize much work remains to be done, this announcement of a potential project is tremendous news for our state and our region. I appreciate the hard work of my team from the Development Office and the Ascent team members who have come together to explore this investment. I look forward to working closely with them to help bring the project to fruition," Governor Tomblin said. Ascent's feasibility will depend on several important variables, including the contracting of long- term ethane supply, as well as financing, regulatory approvals, and appropriate governmental support. Odebrecht will lead Ascent's investment and financing, as well as the operation of water and electric utilities. year, until the end of 2014. "It's a good move in the right direction," said Senator Joe Manchin, who is co-sponsoring Senate legislation to make a similar fix. Senator Manchin and Mark Kirk, R-IL, introduced legislation to delay the implementation of the individual mandate from January 1, 2014 to January 1, 2015.

CAPITOL BUILDING COMMISSION APPROVES RESTORATION TO MEMORIAL

The state Capitol Building Commission approved a $1.6 million restoration of the West Virginia Veterans Memorial, which will include a new lighting system, water drains, handrails and paving stones. Morgantown-based Mills Group recently completed an architectural and engineering review of the memorial located on the state Capitol campus near Greenbrier Street. The state Purchasing Division plans to solicit bids for the repair work early next year. The state hasn't set a timeline for starting and completing the project. Money from the Capitol Improvement Fund will pay for the restoration.

Commission members also approved plans to put a new roofing material on the flat portion of the state Capitol's roof. The cost of the project won't be known until contractors submit bids, state officials said. ZMM Architects & Engineers, Charleston, is designing the replacement roof. The roofing project will include new outdoor walkways and steps that connect the Capitol's East and West wings, which house legislators' offices, to the central building. State lawmakers and lobbyists frequently use the walkways as a shortcut to the House and Senate chambers.

LIFT IT TWICE!!

Most of you have heard the general rules of safe lifting. Remember to “Get a firm grip on the load, keep it close, bend at the knees, use your legs to lift the load, and keep your spine in the natural position (with an arch in your lower back).” These principles always apply and should be incorporated into every lift--if possible!

Given the enormous number of “risky” lifting situations that you are faced with at your place of work, you may not be able to apply these principles every time. This is why you must always remember to LIFT IT TWICE! What?!

The act of lifting is the same as any other movement that you can learn to do better with practice. As you know, the more you practice a skill the better you become at doing it. But preparing to master a skill normally involves mental as well as physical training. Consider bowling, golf, skiing or sharp-shooting. You think carefully about the movements you’re going to make before you do them. This is the only way to get them right--at least until they become second nature. Similarly, lifting TWICE means applying the principal of planning your movements prior to performing the lift:

1. Your first lift is a mental lift. Think about the lift prior to actually doing it: 2. How am I going to lift the item? Can I do it myself or should I get some help? 3. How heavy is the item? Do I need to use mechanical assistance? 4. Where am I taking the item being lifted? Is the area clear where I need to set it down? 5. Is it a difficult path or a distance to go? 6. What hazards may hamper the lift or obstruct the travel path? 7. Eliminate those hazards before you lift the item. In other words, Plan the Lift First! 8. The second lift is the actual physical lift. Here is where you carry out your plan. 9. Use proper body mechanics and techniques while going through the motions. Bend

those knees! 10. Most important: Keep the load as close to your body as possible and don’t twist.

Next time someone tells you to lift twice remember…

WVDOH DEVELOPING NEW 2014 SUPPLEMENTAL The WVDOH announced that a 2014 edition of the Supplemental Specifications to accompany the 2010 Standard Specifications Roads and Bridges will be available from the Contract Administration Division. The 2014 Supplemental is expected in January and shall apply for the January 14, 2014 letting and all lettings thereafter. It is likely that the new Supplemental will be available first in electronic format, followed by printed copies. The Specification Committee will be meeting again in December, so the book is not available for viewing at this time. The new Supplemental will reportedly contain a modest number of changes to the 2010 Standard Specifications. DOT RESCHEDULES LISTENING SESSION ON DBE PROPOSED RULE CHANGES The U.S. Department of Transportation has rescheduled a Listening Session on the proposed changes to DOT’s DBE program rules to December 5 and has extended the deadline for written comments on the proposed changes until December 26. The Listening Session was originally scheduled for October 9, but had to be postponed due to the government shutdown. The Listening Session will be held at U.S. DOT headquarters in Washington, D.C. and is intended to gather information on the potential costs associated with the proposed rules. AGC of America and ARTBA will have a witness participate at the Listening Session. CAWV members participated with AGC and ARTBA in a survey about the potential cost impacts of the proposal and the results will be presented at the session. The CAWV has presented written comments on the proposed changes and will be commenting again. The CAWV, in its comments, opposed the proposed provision that requires contractors to submit with their bids a list of DBEs that will be utilized on the project, including details about the price and scope of the work. The CAWV wrote, “Bid day is always hectic and many quotes are obtained at the last minute. It is often necessary to discuss quotes with subcontractors after the prime's quote has been submitted to clarify scope and price. Denying the prime and subcontractors the time to ensure that DBE subcontractor quotes are correct, especially with the new penalties that are proposed, will lead primes to reject all incomplete or potentially inaccurate quotes. The net result is less DBE utilization.” The association also questioned the requirement that prime contractors that are unable to meet DBE contract goals must submit their ‘good faith efforts’ documentation within 24 hours. The CAWV recommended a longer time limit in order to provide an accurate GFE determination. With regards to states setting their annual DBE goal, the CAWV recommends the states be allowed to set goals based on the actual pool of DBEs that are actually qualified for participating on DOT-funded projects. The association notes, “Setting goals based on the number of firms that are generically identified by the state as certified as DBEs has no correlation to the number of firms that can actually perform the specific work detailed by every contract. If the goals are set at a realistic number based on the market conditions, then program compliance will be much more achievable. While we support the effort to ensure that all certified firms meet the minimum
