Temple City Accountability Act on Nov. 8 ballot On Nov. 8, 2016, ballot Mea- sure AA will give voters the op- portunity to weigh in on the proposed Temple City Govern- ment Accountability Act. A “yes” vote will: • Eliminate gift and campaign contributions from developers and city contractors. • Limit eligibility for City commissions. • Establish definitive term limits for City Council. • Make some technical changes. The Council began work on the project in Febru- ary and took action in July to pass the measure. The Act will incorporate these new provisions into the City Charter, which defines how local government operates, mak- ing them legally enforceable. For details, contact the City Clerk’s office. According to City Manager Bryan Cook, the applicant worked with staff to reduce the project’s size, thereby eliminat- ing significant environmental impacts and improving the project’s neighborhood com- patibility. The revised project proposes 61 residential dwelling units and 7,250 square feet of commercial space in a four- story building.

The Temple City Unified School District recently released resultsfor three major academic assessment exams including the ACT, APand CAASPP.

District exam scores remain strong and steady as participation ratescontinue to climb.

Pending the release of SAT scores, the District shared results of itsACT exam. TCUSD students continue to outperform state averagesamong all categories, according to Duistrict Supt. Kathy Perini.

So it isn’t every day I get toserve an Olympic gold medal-ist; there just aren’t that manyof ‘em passing through TempleCity these days.

Inger Miller was a memberof the U.S. Women’s 4x100-meter Olympic relay team thattook the gold in Atlanta in1996.

And Inger’s dad, Lennox,was my dental school class-mate. And, oh, by the way,Lennox won the Silver in theMen’s Olympic 100-meters inMexico City in 1968 and the

Inger Miller was a member of the U.S. Women’s 4x100-meter Olympic relay team that took the gold in Atlantain 1996.

Bronze in Munich in 1972.Back in the day, my dad

and brother and I were bigtime track and field fans, anda great day for us was goingto any USC dual meet. Lennox

was a legendary sprinter, onscholarship from Jamaica, andUSC was a track and fieldpowerhouse.

So I couldn’t believe itwhen I saw Lennox and I wereUSC dental school classmates.

During the four years ofdental school, I really didn’tget to know Lennox very well,aside from the always wel-coming smile and the friendlysmall talk that helped thisdental student retain somesemblance of his sanity.

After graduating, Dr.Miller stayed close by in Pasa-dena; that’s when I got thechance to know Lennox alittle better. The phone callsalways included a dose oflaughter and, of course, thesort of dialogue you’d expectfrom two USC football ex-perts.

As a super talented special-ist, Lennox gallantly servedour mutual patients, actuallygiving life to seniors, literallystarving from tooth loss.

Against all odds, a feebleelderly lady would typically

shuffle off to Dr. Miller, onlyto return looking yearsyounger, smiling, with aspring in her step and a newensemble to go with it.

And I can’t believe it’s been12 years since a class guy, anelite athlete, and gifted col-league who’d never taken apuff, passed from lung cancer.

First time I met Inger wasat a Pasadena Chamber break-fast; almost tripped over myown feet introducing myself.I shared the message I deliv-ered to Inger’s dad back in1996, “Finally a gold medal inthe family.”

Truth is Doc Miller was agold medal winner for all ofhis way too brief 58 years. Andwhen it comes to being a classact, the apple doesn’t fall any-where but right next to thetree.

“I don’t want the govern-ment to take my money when Idie.”

This is something I hear al-most weekly in my office. Mostclients are surprised to hear thatthe general answer is “the gov-ernment will not take yourmoney.”

Estates will usually pay little-to-no money to the governmentthrough taxes unless there aredebts owed to governmentalagencies such as Medi-Cal.

There are two types of taxesto consider: estate tax and in-come tax.1. Estate Tax

The State of California doesnot impose an estate tax, alsoknown as an inheritance tax.However, the federal govern-ment does impose an estate taxon residents of California. Es-tate tax is a value-based tax,unlike our individual tax re-turns that are based on income.

In 2016, a single individualmay have $5.45 million in grossassets, and a married couplemay have $10.9 million in as-

sets before paying estate tax.This means that the entire

value of your gross estate mustexceed these figures, alsoknown as the estate tax exclu-sion, before your estate will payestate tax at roughly 40%.

If your estate exceeds thesefigures, you will only be taxedon the amount that you exceedthe figure.

Most of my clients are worthless than the estate tax exclusionfigures, so this is not a tax mostclients need to fear. If you areworth close to or above theseexclusion figures, you shouldcontact an attorney or tax pro-fessional to properly plan for

the future.2. Income Tax

Estates and trusts pay in-come tax like you do as an in-dividual or married couple.However, most of my estate andtrust clients do not pay incometax due to the concept of “step-up in basis.”

This concept means that thesurvivor(s) of a decedent’s es-tate or trust may change thecost (or basis) of an appreciatedasset to the current marketvalue.

For instance, if you pur-chased your house for$100,000, but it is now worth$900,000, your survivor(s) get

to step-up (or change) the costfrom $100,000 to $900,000 (thecurrent market value).

If the cost is now $900,000and the sales price is $900,000,then there would be no capitalgains tax due on the sale of thehouse ($900,000 sales price -$900,000 cost basis = $0 taxablegain).

In summary, although most ofmy clients’ estates or trusts do notpay tax, you should consult anattorney or tax advisor to discussyour particular estate or trust.You should also discuss the ad-vantages of having a trust draftedto prevent your estate from pay-ing very expensive probate courtcosts and attorney’s fees.

Does the government have an appetite for your money?

I’d like to address an important IRSrule change for IRA rollovers. Tradition-ally, tax-deferred retirement plan or IRAdistributions could only be rolled overto another qualified plan tax-free if donewithin 60 days.

Otherwise, the distribution is taxed asordinary income on top of a possible10% penalty for people under 59-1/2.

Usually, rollover funds are directlytransferred from one institution to an-other to avoid error. But if a check is cutto an individual, then that person is re-sponsible for getting that money to theright place by the right time.

People make mistakes. Checks getlost; calamity or illness shifts one’s fo-cus. However to undo this blunder, onehad to petition the IRS and pay a $10,000fee to obtain a Private Letter Ruling.Without this, few financial institutionswould accept that delayed deposit andyou’re stuck holding the bag.

Last month the IRS released RevenueProcedure 2016-47, which allows anyone

to self-certify that the missed 60-dayrollover deadline was inadvertent andnot by design. Three conditions must bemet for tax relief:

• The IRS hasn’t denied a previouswaiver request.

• The money must be deposited in anIRA account within 30 days after the rea-son for the delay is no longer a factor.

• The reason must be one of 11 ac-cepted by the IRS (visit http://benefitslink.com/src/irs/rp-16-47.pdf)

This is not a Get Out of Jail Free card.The IRS reserves the right to audit yourreturn to determine whether the waiverwas appropriate. A later refusal couldreopen liability for the distribution’staxation and several other potential pen-alties. Speak to a qualified financial pro-fessional first.

IRS changes IRA rollover rules

keep a copy of their tax returns and supportingdocuments for a minimum of three years.

Going forward, keeping copies of tax returnsis even more important as the IRS makes changesto protect taxpayers and authenticate their iden-tity.

The IRS recommends extension filers using asoftware product for the first time plan ahead.

They should locate a copy of their 2014 taxreturn or alternatively, order a tax transcript, aprocess that may take five to 10 calendar days.The adjusted gross income (AGI) is clearly labeledon both the tax return and the transcript

Taxpayers who prepare their own electronic taxreturns are required to electronically sign theirreturn by using a five-digit, self-selected personalidentification number (PIN).

In order to authenticate their identities, tax-payers will now also need to enter either of twoitems: their prior-year AGI ortheir prior year self-select PINand their date of birth. If marriedfiling jointly, both taxpayers mustauthenticate their identities withthis information.

announces that Temple City AlternativeSchool (TCAS) has received accreditationfrom the Accrediting Commission forSchools, Western Association of Schoolsand Colleges (ACS WASC). After exten-sive review, the school earned recognitionfor its educational achievements andcommitment to learning.

The ACS WASC accreditation certifi-cate serves to further validate the integ-

rity of TCAS’s educational program. “Itwas very gratifying to have an outsidecommittee validate the progress that ourprogram has made,” said Principal Chris-topher Sewell. “We are especially gratefulfor the support we receive from students,parents, community members and theDistrict office. Their support allows us tosuccessfully meet student needs andimplement an effective action plan for fu-ture growth.”

The support Mr. Sewell describes wasnot lost on the ACS WASC visiting com-mittee. It had a major role in confirmingthe school’s sustainability. Pet of the Month

Grover is a 2-1/2 year old American Staffordshire terrier

mix with great looks to match his athletic body and personality. He has gorgeous bright brown eyes, a toffee-colored coat with white highlights, and a cute pair of puppy-sized bouncy ears.

Grover was surrendered by his previous owners because their living arrangements changed.

Despite this loss, he remains a loving happy-go-lucky boy. He enjoys walks, jogs, tennis balls, squeaky toys, and lots of kisses.

Grover would thrive with an active family who can let him show off his athletic skills and even teach him many more skills, sports, or commands.

He has learned his “sit” and “catch” commands quickly. His adoption fee is $145 and includes neuter surgery, vaccinations, microchip and a free wellness exam at a participating veterinarian.
