Subject: Notice of intent to move Emergency Legislation

This memorandum serves as a request to add the following emergency legislation and

accompanying declaration resolution to the agenda of the October 18, 2011 additional legislative

meeting. The nature of this emergency was just brought to the attention of the Subcommittee onRedistricting; as such we are circulating notice at the earliest time possible.

The purpose of this bill is to amend the Redistricting Procedure Act of 1981 to redefinethe ward boundaries within the District of Columbia on an emergency basis, while the permanent

bill undergoes Congressional review.

To declare the existence of an emergency, due to Congressional review, with respect to need to21

amend, on an emergency basis, the Redistricting Procedure Act of 1981 to redefine the22

ward boundaries within the District of Columbia.2324

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this26

resolution may be cited as the AWard Redistricting Congressional Review Emergency27

Declaration Resolution of 2011.”28

Sec. 2. (a) The Ward Redistricting Amendment Act of 2011, Act 19-0097, is not29

projected to become law until December 8, 2011.30

(b) The Board of Elections and Ethics (BOEE) has informed the Council that emergency31

enactment of the new ward boundaries is needed in order to clarify what the boundaries are for32

purposes of nominating petitions for the upcoming primary election.33

(c) The BOEE plans to initiate the nominating petition process on November 14, 201134

and requests that the effective date for the new ward boundaries be November 11, 2011.35



(d) The overriding concern is to ensure that the new ward boundaries are in effect before1

the petition process begins so that resident are able to sign petitions for candidates in wards they2

may properly vote in.3

Sec. 3. The Council of the District of Columbia determines that the circumstances4

enumerated in section 2 constitute emergency circumstances making it necessary that the “Ward5

Redistricting Congressional Review Emergency Amendment Act of 2011" be adopted after a6

single reading.7

Sec. 4. This resolution shall take effect immediately.8

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this20

act may be cited as the "Ward Redistricting Congressional Review Emergency Amendment Act of 21

2011".22

Sec. 2. Section 4 of the Redistricting Procedure Act of 1981, effective March 16, 198223

(D.C. Law 4-87; D.C. Official Code ' 1-1041.03), is amended to read as follows:24

"Sec. 4. Adoption of election ward boundaries effective November 11, 2011.25

A(a) The Council adopts the following election ward boundaries to be effective January 1,26

2012, and to be used in all elections held after February 1, 2012, in the District of Columbia:27

Sec. 3. Section 2411.3 of Title 18 of the District of Columbia Municipal Regulations (184

DCMR ' 2411.3) is amended to read as follows:5

A2411.3 Each Ward of the District shall constitute a separate residential permit parking6

zone; provided, that parking zone in census tract 79.03, (starting at the corner of Nineteenth Street,7

N.E., and Benning Road, N.E., east along said Benning Road, N.E., to Oklahoma Avenue, N.E.;8

Sec. 4. Fiscal impact statement.12

The Council adopts the fiscal impact statement in the committee report for the Ward13

Redistricting Amendment Act of 2011, signed by the Mayor on July 11, 2011 (D.C. Act 19-0097;14

58 DCR 28), as the fiscal impact statement required by section 602(c)(3) of the District of 15

Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code §16

1-206.02(c)(3)).17

Sec. 5. Effective date.18

This act shall take effect following approval by the Mayor (or in the event of veto by the19

Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 9020

days, as provided for emergency acts of the Council of the District of Columbia in section 412(a)21

of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C.22

Official Code § 1-204.12(a)).23
