Project Description

The applicant is requesting to abandon three (3) existing roadway segments, all located adjacent to Calvary Assembly of God and within the North Orange neighborhood. The street segments to be abandoned are as follows:

A. Ohio St. (between Minnesota and Michigan Aves.); B. A portion of Michigan Ave. (between Ohio St. and Clay St.); and C. That part of Harmon Ave. (between the Calvary Assembly of God property and a separately owned lot, west of Clay St.). Previous Actions 1922: Southerly half of Harmon Ave., between Clay St. and Formosa Ave., platted as Fairbanks Ave. as part of The Pines Subdi- vision 1923: Ohio St., Michigan Ave. and the northerly half of Harmon Ave. platted as part of Lawndale Subdivision. 1952: Street name of southerly half of Fairbanks Ave. changed to Harmon Ave. 1953: Calvary Assembly of God established in two (2) former residential structures (demolished when I-4 constructed). 1984: Portion of Lawndale and The Pines Subdivisions, including subject portions of Ohio St., Michigan and Harmon Aves., va- cated by Orange County Commission. 2002: Calvary Assembly of God properties annexed into City of Orlando (ANX2002-00019, City Doc. #020805910); Public- Recreation-Institutional future land use assigned (GMP2002-00073). 2012: Initial zoning of PD/T (Planned Development, Traditional City Overlay) assigned to property (ZON2009-00025, Doc. #1201091203). Adjacent uses, zoning and future land use designations are shown in Table 1 below.

Context & Analysis The affected street segments are provided in Table 2 at right. Michigan Ave. continues east of Clay St., and Harmon Ave. continues east to provide access to a vacant non-Church owned property. Post abandonment, the Ohio St. and Michigan Ave. R-O-Ws will likely be retained as access drives for the Church and a rear access to Calvary Towers (@ 1876 Minne-sota Ave.).

Adjacent & Proposed Development

The subject R-O-Ws abut other Calvary Assembly of God properties that are already developed with church-related uses and surface parking lots. Adjacent uses will not be impacted by the proposed abandonments. No known utility lines are located in the subject R-O-W seg-ments but if any exist, it will be the responsibility of the applicant to work with the utility provider to ensure either relocation or recording of utility easements.

Abandonment Process

The abandonment process (Section 65.506 of the Land Development Code) requires the consent of all adjacent and abutting prop-erty owners. Calvary Assembly of God owns all of the properties adjacent to and abutting the proposed abandonments.

Section 65.505 of the Land Development Code notes that two (2) factors must be considered in the review and approval of aban-donment requests:

A. Adequate Public Facilities: The abandonment cannot result in a higher demand on public facilities and services. In this case, three (3) street segments are being abandoned (see Table 2 above). The abandonment request in and of itself

B. Cost for Improvements: The cost for the abandonment of any right-of-way shall be paid by the applicant or developer of the proposed project, including cost of improvements to adjacent rights-of-way or relocation of utilities within existing ease- ments. The applicant is covering all costs involved with the abandonment request, including costs to relocate existing utili- ties prior to future roadway removal.

F I N D I N G S Subject to the conditions contained herein, the Abandonment proposal is consistent with the requirements for approval of Aban-donment applications contained in Section 65 Part 4E of the Land Development Code (LDC): 1. The proposed Abandonments are consistent with the purpose and intent of the City’s Growth Management Plan.

2. The proposed Abandonments are consistent with the requirements of the Land Development Code.

3. The Abandonments will not result in incompatible land uses.

4. All future development will be in accordance with Chapter 59 of the LDC, the Concurrency Management Ordinance, which ensures that adequate public facilities are available to serve said development.

Based on the information provided in the staff report and the findings noted above, staff recommends approval of the Ohio St., Michigan Ave. (west of Clay St.) and partial Harmon Ave. R-O-W Abandonments, subject to the conditions in this staff report.

C O N D I T I O N S O F A P P R O VA L - R E Q U I R E D Land Development

1. The abandonments as proposed in this report and subsequent ordinance shall take effect prior to the property being replat- ted and recorded. 2. Except as provided herein, the proposed Abandonment request is subject to all codes and ordinances of the State of Florida, City of Orlando, and all other applicable State and federal regulatory agencies. 3. Continued development/redevelopment of the site shall be consistent with the Calvary PD (ZON2009-00025, City Doc.

#1201091203).

Transportation Planning & Engineering

1. Easement Dedication - An ingress/egress easement within a portion of Michigan Ave. abutting the Calvary Towers parcel shall be fully executed and recorded within one (1) calendar year of City Council approval of the abandonment case.

2. Road Maintenance - All responsibility for maintenance of the roadway and sidewalks shall be assumed by the applicant/owner. This requirement may be terminated if the property is redeveloped as something other than its current public benefit or residential use.

3. R-O-W Dedication - To ensure future access and higher functioning roadways, the applicant/owner shall provide an equiva-lent amount of R-O-W on both Minnesota Ave. and Clay St. adjacent to the Church properties, in exchange and in considera-tion for the R-O-Ws being requested for abandonment. This will ensure that sufficient R-O-W exists when the City deems it necessary to expand and/or improve both vehicle and pedestrian movements on Minnesota Ave. and Clay St.

4. Emergency Access to all buildings shall be maintained. At the time of permitting for new structures or as part of a potential redevelopment of the property, both the City's Solid Waste and Orlando Fire Departments must approve of all access areas for maneuverability.

5. Signage, et al - Additional measures shall be provided to alert drivers and pedestrians of the proposed abandonments.

1. Following the MPB meeting, the MPB minutes will be reviewed and approved by the City Council on July 27, 2015.

2. Following the MPB meeting, staff will provide the abandonment request information to the City Attorney’s Office for prepara-tion of an ordinance. The project planner will schedule said ordinance and exhibits for two (2) readings before the City Council. The 2nd reading will be a public hearing.
