Real estate is about relationships, and you need to understand what Virginia law says about your business connections. This course will discuss when and how agency relationships are created, and when licensees must disclose agency relationships. It also includes an overview of an agent’s responsibilities to both customers and clients.

Buyer Beware: Foreclosed and Neglected Properties[4 Hrs. ce credit]

Distressed properties provide as many opportunities for headaches as for bargains. Buyers often have to cope with the economic fallout from the lives of previous owners, including neglected maintenance, vandalism, mortgage liens, unpaid taxes and utility bills. During foreclosure proceedings, homes may be vacant or occupied by tenants or squatters engaged in criminal activity. Homes may have their appliances and wiring removed, creating electrical hazards. Missing or burst pipes can cause severe water damage to interior finishes and result in the onset of mold. Homes are usually sold “as is” by the banks and are not subject to the property condition disclosures required in a regular sale. Buyers may be saddled with construction defects and environmental hazards and can seldom extract price concessions from banks to correct them. This course will help you and your clients prepare for a worst-case scenario.

Construction Essentials [4 Hrs. ce credit]

This course provides a basic understanding of residential construction, including the role of building codes and permits and performance standards required of builders. Phases of new construction (foundation, framing and pre-occupancy) and the typical construction flaws at each phase will be explained. For resale homes, numerous examples of major and minor deficiencies are provided. This course will enable Realtors® to recognize visible defects and communicate them to potential homebuyers.

This course will offer the real estate licensee an in-depth understanding of the elements and problems associated with contract formation, and the ability to understand how problems can be identified and solved. Also covered are the key provisions in the NVAR regional sales agreement and its key addendums, the damages that may arise and liability issues associated with agency. The course includes an important discussion about some common claims of misrepresentation that an agent may encounter.

This course will help you identify potential environmental hazards and advise clients on how to handle them. The course also discusses evaluating a property, performing “due diligence” regarding environmental issues and avoiding legal liability. Students will gain an in-depth understanding of property condition disclosure laws, and the requirements associated with lead-based paint, radon, arsenic, asbestos, underground storage tanks, combustion pollutants and mold.

This course will examine a holistic approach to building design, construction and operation that minimizes the negative environmental impacts while improving building performance and occupant health. New Rules of Real estate Finance[4 Hrs. ce credit]

The objective of this course is to review and explain various residential mortgage financing techniques, loan programs, qualification standards and documentation requirements. The course also covers the features, benefits and potential problems associated with various loans, as well as the new rules of real estate finance after the credit meltdown. There will be a discussion of current market conditions and an overview of the local D.C. metropolitan area, including strengths and weaknesses, properties currently for sale and the month’s supply of housing stock. Accredited Buyer Representative (ABR) [16 Hrs. ce credit]

Becoming skilled at buyer representation will help you change the way you do business and cater to clients at every stage in the home buying process. An Accredited Buyer’s Representative (ABR®) will gain a unique understanding of home buyers’ needs and how best to serve them. ABR Designation RequirementsTo obtain and use the ABR® designation, you must complete all four requirements:

1. Successful completion of the two-day ABR® Designation Course, including an 80 percent passing grade on the exam. After you complete this course you will have three years in which to complete the other ABR® designation requirements.

2. Successful completion of one of the ABR® elective courses, including an 80 percent passing grade on the exam. This course may be taken prior to completing the ABR® Designation Course.

3. Documentation verifying five completed transactions in which you acted solely as a buyer representative (no dual agency). Any transactions closed prior to taking the ABR® Designation Course or closed within three years after completing the ABR® Designation Course are eligible for credit. Documentation necessary for each of your five completed transactions:

Copy of the signed buyer agency agreement OR purchase/sale agreement OR disclosure statement. The contract must verify the agent’s name and/or include the agent’s signature as the buyer’s agent. Providing only the name and/or signature of the buyer’s agent’s broker is not sufficient. And Copy of the closing/settlement statement or letter from your broker verifying that each transaction closed.

4. Maintain active and good membership status in the Real Estate Buyer’s Agent Council (REBAC) and the National Association of Realtors®. Exception: International members of REBAC do not have to be members of NAR. REBAC membership is free the first year, and $110 thereafter.

Important Notes: All requirements must be completed within three years of passing the ABR® Designation Course. Only Realtors® who meet all these requirements and have been officially awarded the ABR® designation are permitted to call themselves an ABR® and use the ABR® logo.

Licensed as a Virginia Real Estate Salesperson in 1976, Larry currently serves as the director of education for Fairfax Realty in Annandale, Virginia. In 1982, he obtained his broker’s license and began his career

in real estate management and agent training. Larry has been active in NVAR for more than 30 years, serving on the Board of Directors and on many committees, including chair of the Commercial Forum. He has also served on committees at VAR. A real estate educator for over 25 years, Larry teaches more than 15 courses for NVAR and VAR. He has received many association awards, but two he truly values are the NVAR Code of Ethics Award and the VAR George Rink Educator of the Year Award. In 2008, he received a BS from Old Dominion University in Interdisciplinary Studies, with a concentration in Work and Professional Studies and a minor in Marketing.

In the real estate business for over 30 years, Doris has brought a wealth of real-life experience into her writing and teaching on the subjects of finance, agency, fair housing, ethics, legislative and legal issues and homeownership counseling. FRIedLANdeR, IIA partner in the law firm of Friedlander, Friedlander & Earman PC, Jerome’s law practice of more than 44 years focuses on wills, trusts, estate planning, real estate law, entity formation and disputes, as well as the litigation arising from those areas. He is a member of the VA and D.C. bars and a past president of the McLean Bar

Association and the Northern Virginia Chapter of the Federal Bar Association. Jerome has been a substitute judge in the General District Courts since 1985. He is the author of law books in landlord tenant law, real estate law (Broker’s Guide to Virginia’s Real Estate Law), and limited liability companies and has also written articles and conducted seminars. In her spare time, Sarah performs Pro Bono work for the National Center for Refugee and Immigrant Children, where she was the recipient of the Mutual of America Community Partnership Award in 2006. A native of France, Sarah is fluent in English and French, and is proud of her U.S. citizenship.

dIANe QuIGLeY, CeRTIFIed ReSIdeNTIAL APPRAISeR

Diane is the owner of Quigley Appraisal Service, and has been appraising residential properties in Virginia and Maryland for more than 25 years. She has taught real estate principles and real estate appraisal for NVAR since 1995. Diane also holds a broker’s license in Florida,

and is the broker/owner of Quigley Realty Services, LLC. She is currently the chairperson for the Virginia Appraisal Board, and has been involved in many professional appraisal organizations over the past 25 years.

WIN SINGLeToN CRB, SRS, SFR, e-PRo

Licensed in 1975, Win earned his real estate broker’s license the following year. In addition to listing and selling properties, he also has served as a sales manager or assistant sales manager for several real estate firms. Win served as vice president of NVAR in 1995 and 1998, treasurer in 1996 and 1997, and as a member of the Board

of Directors from 1990 to 1994, and again in 1999 and 2000. He also has chaired numerous committees including Grievance, Standard Forms, Bylaws, Regional Sales Contract Task Force and the Program and Entertainment Committee. A recipient of the NVAR Code of Ethics Award and an inductee into the NVAR Hall Of Fame, Win also has been a member of NVAR’s Multi-Million Dollar Sales Club and Top Producer Club. As a Virginia Continuing education instructor, he teaches classes in Agency Law, Contracts, Fair Housing, Legal Updates and Code of Ethics. He has developed and teaches a course entitled, “Serving the Consumer through the Internet,” which was named the 1999 VAR Course of the Year.

INCLeMeNt WeAtHeR POLICYInformation regarding course closings or delays may be obtained by calling the NVAR Education Department at 703.207.3244. We will post cancellation or delay announcements on nvar.com by 7 a.m. on the morning of the scheduled class. NVAR will gladly refund the registration fee for students who are unable to attend a scheduled class due to extreme weather conditions.

AtteNDANCe POLICYIn order to comply with the Virginia and D.C. real estate commission/board regulations, students are expected to arrive on time. Once the class has started, there is a 10-minute grace period. Once that grace period is over, no Virginia or D.C. credit will be awarded for the course. No exceptions!

Cell phones, smartphones, pagers, newspapers, iPads, tablets, and laptops may not be used while class is in session, except for the explicit purpose of viewing class handouts or taking class notes.

NON-SMOKING CAMPUS POLICYIt is the policy of NVAR to provide a smoke-free environment for all employees and visitors. This policy covers the smoking of tobacco products and the use of oral tobacco products, or “spit” tobacco. The use of tobacco products is prohibited inside the facility at all times, and within 50 feet of any building entrance.

NOtIFICAtION OF CHANGeSNVAR reserves the right to change these policies without notice, and continued use of the NVAR facilities will signify acceptance of any adjustment to these terms. If there are any changes to our policies, we will announce these changes on our website.
