Background Information about the NWB

An institution of public government established under Article 13 of the Nunavut Land Claims Agreement (NLCA)

The objects of the NWB are to provide for the conservation and utilization of waters in Nunavut, except in a national park, in a manner that will provide the optimum benefit from those waters for Nunavut’s resident in particular and Canadians in general

NWB has the responsibilities and powers over the regulation, use and management of freshwater in the Nunavut Settlement Area

Community Session

Application before the BoardBIMC’s Type “A” Water Licence Application

Twenty-Five (25) year licence (2013-2038) for the use of water and the deposit of waste in support of the Mary River Project

Water use, including water crossings, and waste disposal activities are planned for three project sites: Milne Port Site, the Mine Site and Steensby Inlet Site

Estimated water use is 1585 cubic metres/day the during the peak construction period

Estimated water use is 625 cubic metres/day during the peak operation period

BIMC’s Type “A” Water Licence Application Cont.

Existing or proposed water sources are as follows: Milne Port – Phillips Creek, 32 km Lake Mine site – Camp Lake Steensby Inlet – 3km and 10 km Lakes Railway Camps – Cockburn Lake, Nivek Lake, and

Raven Camp Lake Construction activities (bridges, etc.) – mostly

unnamed sources

Types of waste disposal activities anticipated include but are not limited to waste rock, sewage and sewage sludge, fuel/oil contaminated water, solid waste, contaminated soil and/or water, hazardous waste storage, and bulky items/scrap metal disposal

March 2, 2012 – NWB acknowledged receipt of BIMC’s Type “A” water licence application

March 9, 2012 – BIMC provided an errata document in support of its Type A water licence application

April 13. 2012 – NWB issued its completeness review for BIMC’s Type “A” water licence application and requested that interested parties begin their completeness check and technical review of the application

April 25, 2012 – BIMC provided its response to the relevant Final Environmental Impact Statement IRs, some of which pertained to the Type A water licence application

October 12, 2012 – BIMC Provided its response to technical review comments submitted by interveners in June 2012 for the Type “A” water licence application

October 18, 2012 – NWB held a Pre-Technical Meeting for the BIMC’s Type “A” water Licence Application

October 31, 2012 – BIMC provided its response to relevant issues raised during the Pre-Technical Meeting held in October 2012

December 14, 2012 – NWB distributed correspondence, which included a draft agenda, informing interested parties of the location/dates for the Technical Meeting and Pre-Hearing Conference planned for the Mary River Project

January 7, 2013 – NWB issued updated information pertaining to the Technical Meeting and Pre-Hearing Conference scheduled for the Mary River Project

January 11, 2013 – NWB distributed the agenda and list of confirmed representatives for the Mary River Project Technical Meeting & Pre-Hearing Conference

Next Steps in the Water Licensing Process for the Application

Technical Meeting (TM) was held earlier today and the Pre-Hearing Conference (PHC) will be held tomorrow

One of the main objectives of the Technical Meeting and Pre-hearing Conference is to help the Board determine whether all substantive issues have been or are being addressed prior to any Board decision to a schedule a Public Hearing

Following the TM-PHC, the NWB will issue a PHC report, which will include a decision on if and when a Public Hearing for the Application will be scheduled

Following the Public Hearing, should a licence be issued, a licence and decision will be submitted to the Minister of AANDC for approval

Objectives of Tonight’s Meeting

Promote community awareness of and participation in the type “A” water licensing process for the Mary River Project

Provide the opportunity for community members to meet face-to-face with other stakeholders as well as provide feedback on the application that is before the Board

Listen and note the concerns and views that community members may have with respect to BIMCs Application and the water licensing process for the application and to answer relevant questions that community members may have

To provide consultation opportunity and information, as well as invite participation in the formal Public Hearing process when scheduled

Objectives of Tomorrow’s Pre-Hearing Conference

Formal meeting with the Applicant and intervening parties, including, AANDC, EC, DFO, QIA and interested community members, to discuss various matters in preparation for a potential future Public Hearing for the Application including:

Who will participate in the hearing Issues to be addressed during the hearing Schedules and timelines for participation Exchange of information prior to a hearing
