I refer to the Resolution of the ~e~is'lative Council under Standing order 52 made on 1 December 201 0 concerning the rest area at Varroville.

I am now delivering to you the documents referred to in that Resolution.

The documents have been obtained from the Office of the Minister for Transport, the Roads and Traffic Authority, Transport NSW, the Office of the Minister for Roads and the Office of the Minister for Planning.

Enclosed at Annexure A are certification letters from the Office of the Minister for Transport, the Roads and Traffic Authority, Transport NSW, the Office of the Minister for Roads and the Office of the Minister for Planning indicating that, to the best of their knowledge, all documents held and covered by the terms of the Resolution have been provided.

Enclosed at Annexure B are indexes of all non-privileged documents that have been provided in response to the Resolution.

In accordance with Item 5(a) of Standing Order 52, those documents for which a claim for privilege has been made have been separately indexed and the case for privilege has been noted. I refer to the Order of the Legislative Council made on 1 December 2010:

That, under standing order 52, there be laid upon the table of the House within 21 days of the date ofpassing of this resolution the following documents relating to the Roads and Traffid Authority's proposed F5 Freeway truck rest area at Varroville, in the possession, custody or control of the Minister for Transport, the Roads and Traffic Authority (RTA), Transport NSW, the Minister for Roads or the Minister for Planning:

(a) any document arising from the RTA investigation undertaken in 2009 and referred to on page 2 (section 2.2) of the RTA paper "Truck Rest Area Strategy F5 Northbound':

(b) any correspondence with trucking or transport companies or recognised trucking or transport industry bodies in relation to closure of the informal truck stop at the crossroads when the M7 opened and/or its replacement with another truck rest area.

(c) any correspondence between the RTA and the Cornish Group or their representatives,

(d) any documents relating to RTA consultation with truck drivers or truck driver representative bodies,

(e) any documents concerning the selection of the Varroville site for a truck rest area,

( any documents relating to the purchase of adjoining Department of Planning land Lot 4 DP 239557,

(g) any correspondence between Campbelltown City Council and the RTA or the Minister for Roads, and

(h) any document which records or refers to the production of documents as a result of this order of the House.

Enclosed with this letter are the documents which the RTA produces in response to the Order.

The RTA has reviewed its relevant files for the purpose of determining whether it: holds documents that:

1. fall within the terms of the Order; and

2. are the subject of a claim for privilege.

Following the review, the RTA prepared, in accordance with Standing Order 52, an index of the documents produced. As part of the indexing procedure, and for the convenience of the Legislative Council, the RTA has collated and labelled the documents so as to facilitate identification of the documents.

The RTA makes a claim on the basis of public interest immunity in relation to a small number of documenfs, on the grounds that they contain personal information. Only the information that identifies the individuals concerned has been redacted from the documents, to protect their privacy. These documents are listed in a separate index and the claim for privilege is attached to it.

This document sets out details in support of the claim for privilege made by Transport NSW as follows:

Public Interest Immunity - Privileqed Documents e)l and e)2 Documents e l ) and e2) contain information relating to road and infrastructure projects, which have not yet gone to tender,

Transport NSW submits that the redacted information contained in the above mentioned documents should not be made public as it would disclose the estimated costs of various infrastructure projects. In particular, the release of this information may result in the following adverse consequences, including:

Placing the NSW Government in an adverse bargaining position with potential tenderers or other project participants; Reducing the NSW Government's ability to deliver maximum public benefit; Limiting the NSW Government's ability to obtain fair value for taxpayers' money; Prejudicing current or future contractual relationships between the NSW Government and the private sector; Causing the loss of competitiveness.within the private sector.

In addition to the above points, Transport NSW makes its claim of privilege on both common law doctrines and the statutory regime. In particular, the information is subject to a claim of public interest immunity because the public interest in disclosure is outweighed by a competing public interest in the suppression of the information (public interest immunity), as it would:

Disclose communications made in the course of developing and promulgating Government policy and business practices; Inhibit frankness and candour in future pre-decision communications, briefings and similar documents; Disclose information, which do not fairly outline the reasons for a subsequent decision Prejudice the integrity of the decision-making process and the ability of the decision-maker to make commercially sound decisions in relation to infrastructure - and other related - projects.

In light of the above points, the release of the redacted information would generally prejudice the NSW Government's ability to engage in contractual relationships with commercial parties and the private sector.

BASIS FOR CLAIMS OF PNVILEGE Roads and Traffic Authority

A. PUBLIC INTEREST IMMUNITY

Privilege has been claimed on the basis o f public interest immunity in respect o f documents the disclosure o f which would be contrary t o the public interest.

The claim for privilege is made in relation t o a small number o f documents that contain personal information about individuals. The information identifies the individuals by disclosing their names and their email addresses.

The RTA has redacted the names o f the individuals and those parts o f their email addresses that disclose their names. In the case of a prominent individual, mobile telephone information has also been redacted.

Public interest immunity is a principle that applies where the production o f documents o r information would be injurious t o the public interest (Sankey v Whitlam ( 1 978) 142 CLR I at 38 per Gibbs ACJ).

The RTA considers that the public interest requiring the personal information o f the individuals concerned not t o be disclosed outweighs the public interest in support o f disclosure.

The RTA has relied on guidance from section 14 of the Government Information (Public Access) Act 2009 (NSW), which provides, in the context o f applications for information under that Act, that there is a public interest consideration against disclosure o f information i f disclosure o f the information could reasonably be expected t o reveal an individual's personal information.

The documents containing the redacted personal information are documents concerning stakeholder consultation. The RTA considers that it is important for the personal information o f individuals to be protected, especially in circumstances where other information, such as the name ofthe organisation t o which the individuals belong, and the ofice contact details ofthbse okanisations, has not been redacted.

O n balance, having regard t o the above considerations, the RTA considers that there is a strong public interest argument t o support the redaction of the personal information in the documents, t o protect the privacy of the individuals concerned.

B. BASIS O F PRODUCnON

The RTA produces these documents t o the Legislative Council under compulsion of law and is not waiving privilege in respect o f any o f the privileged documents by producing them.
