TECHNICAL ADVISORY PANEL

This guide provides an overview of the Panel of experienced local government

technical advisors who may be called upon by local councils, at their own cost, to

assist them in developing a Fit for the Future proposal.

The Panel is divided into four categories: Financial Sustainability advice; Asset and

Infrastructure Management and Planning advice; Service Delivery and Review

advice, and Community Engagement advice.

The Panel has been appointed by the Office of Local Government (OLG), following a

competitive shortlisting process. Panel members are prequalified under the NSW

Office of Finance and Service’s Performance and Management Services

Prequalification Scheme, and have demonstrated experience providing advice in one

or more of the advice categories.

The Technical Advisory Panel will be active until 30 June 2015, to enable councils to

access services as they prepare their Fit for the Future proposals.

The Technical Advisory Panel is one of a number of services coordinated through

the OLG One Stop Shop, to assist councils to develop their Fit for the Future

proposal.

WHY USE THE TECHNICAL ADVISORY PANEL?

The NSW Government is asking all councils to prepare a proposal to become Fit for

the Future, taking into account their community’s needs and future outlook.

Two templates have been produced for councils to use in making their proposals:

Template 1: Council Merger Proposal - for councils that have agreed to

undertake a voluntary merger.

Template 2: Council Improvement Proposal - for councils that have sufficient

scale and capacity, showing how they will become Fit for the Future within

their existing structure.

Template 3: Rural Councils Proposal - will be made available late 2014.

Panel members can provide councils with assistance to:

assess their current and forecast performance against the Fit for the Future

benchmarks;

develop strategies and actions to improve their performance against the

criteria of Sustainability, Infrastructure and Services, and Efficiency; and

engage their communities on Fit for the Future options.

The Technical Advisory Panel is primarily aimed

at councils completing Template 2.

Councils completing Template 1 may also wish to use the services of the

Panel members, particularly in relation to engaging their community on

Fit for the Future options.

These councils should also consider using the other support available through the

OLG One Stop Shop.


PROCURING AND MANAGING PANEL MEMBERS

The services of Technical Advisory Panel members must be procured by councils at

their own cost. There is no obligation for councils to use Panel members.

Any procurement of Panel members should be undertaken inline with local policies

and procedures. However, councils have two choices in relation to the manner in

which they procure the services of Panel members:

Option 1: Procuring from the NSW Office of Finance and Service’s

Performance and Management Services Prequalification Scheme

Technical Advisory Panel members are prequalified under the Performance and

Management Services (P&MS) Prequalification Scheme. This means that councils

may undertake procurement from the Panel inline with the requirements of the

P&MS Scheme, if they choose to. However, there is no requirement to do so.

Councils choosing to procure from the P&MS Scheme are strongly encouraged to

read the P&MS Scheme Guidelines which sets out the Scheme rules. Key aspects of

the rules are highlighted below:

a. Levels of prequalification

There are two levels of prequalification under the Scheme:

Fully prequalified suppliers – who are prequalified to provide services with no

limit on the value of the engagement.

Easy Access Registration List (EARL) suppliers – who may only provide

services valued up to $50,000 incl. GST.

Councils that choose to procure under the Scheme are strongly encouraged to

verify the prequalification level of individual suppliers before engaging them.

b. Minimum levels of competition

Under the Scheme, the following minimum levels of competition apply:

For projects valued at less than or equal to $150,000 (incl. GST), a council

needs to invite one (1) written quotation (Note: only fully prequalified

suppliers may undertake work valued at over $50,000 incl. GST).

For projects valued at more than $150,000 (incl. GST), a council needs to

invite a minimum of three (3) quotations. Open invitations to tender are not

required.

c. Awarding of “flow-on” work to appointed contractors

A service provider’s engagement may result in the need for related ‘flow-on’ work.

The P&MS Scheme Guidelines (pp7 – 9) contain important information about the

awarding of flow-on work, including detailed descriptions of scenarios which may

arise.

An overarching principle is that the potential need for flow on work should be

considered by councils prior to seeking initial quotations, as this may inform the

number of quotations that a council choses to seek.

Option 2: Not using the P&MS Scheme

Councils procuring the services of Panel members outside of the P&MS Scheme

must adhere to the procurement requirements of the Local Government Act 1993

and Local Government (General) Regulation 2005.

The Tendering Guidelines for NSW Local Government (2009) provide important

information for councils to consider when tendering above the $150,000 threshold

prescribed by the Regulation. However, councils may also find the Guideline useful

when undertaking procurement involving amounts below this threshold.

Management of procured Panel members

The OLG takes no responsibility for the services provided to councils by Panel

members. It is a matter for each council to manage the performance of a procured

Panel member, inline with its own contract management procedures.
