REPORT TO THE BUSINESS ADMINISTRATION COMMITTEE

RECOMMENDATION TO CONFIRM NINE MEMBERSOF THE EMPLOYEE RELATIONS COUNCIL

November 2012

Action Requested: That the Business Administration Committee recommendBoard confirmation of eight incumbents öf the Emplöyee Relations Council (ERC)and one nominee for a two-year term expiring January 31,2015.

Background: As required by the Airports Authority's lease with the Federal-Governent, the Board of Directors adopted a Labor Code in November 1988 thatbecame effective on February 1, 1989. This Labor Code established the EmployeeRelations Council consisting of nine members who are named for 2-year terms bythe mutual agreement of the President and Chief Executive Officer and the labororganizations representing Airports Authority employees, and confirmed by theBoard of Directors. The Labor Code also provides that members of the ERC areeligible for reappointment, with no limit on the number of terms a member mayserve.

TheERC is composed of three panels: the Impasse Disputes Panel, theRepresentation Matters Panel, and the Unfair Labor Practices and NegotiabilityDisputes PaneL. Each panel is composed of three members and three alternates. The Impasse Disputes.Panel (a) invokes mediation when the Airports Authorityand the exclusive representative have failed to reach a

collective bargainingagreement despite good faith efforts to do so; and (b) provides certain disputeresolution services. The Representation Matters Panel (a) investigates petitionsfiled for exclusive representatìon in an appropriate unit or for decertification of aunit and provides for an appropriate hearing upon due notice; (b) determines anappropriate unit; and (c) certifies the results of the elections conducted inaccordance with procedural rules and regulations. The Unfair Labor Practices andNegotiabilty Disputes Panel (a) resolves negotiability

disputes; and (b) accepts, investigates, states its findings of fact, and issues orders regarding allegations thata person has engaged in.an unfair labor practice. A summary ofERC activities forthe 2011-2012 term is included in Attachment A.

In deciding who will serve on the ERC panels, the Labor and Employee RelationsDepartment makes an effort to rotate assignments to ensure that the Airports

Page 15: November 2012 · November 2012 2 t.. t. g '0_ liQ ... Gloria Johnson Joseph M. Sharoff Alternates ... NLRB, 1964-67 Supervisory Attorney, NLRB, 1974-76

Authority takes full advantage of the ERC members' expertise in all areas of laborrelations.

Discussion: Representatives for the Airports Authority's labor organizations werenotified of the pending expiration of the current term for ERC members. Theywere also provided with the biographical information for Gloria Johnson, the newnominee to fill the vacancy left by Gail Smith, who resigned from the ERC duringthe 20 1 1-2012 term due to medical issues. All eight incumbents were contactedand expressed an interest in being reappointed for another two-year term.

The.President and the labor organization representatives have agreed on thereappointment of eight incumbents and one new nominee, who are listed inAttachment B. Biographies for all the recommended Council members areincluded in Attachment C.

Recommendation: That the Business Administration Committee recommendBoard confirmation of eight incumbents of the Employee Relations Council (ERC)and one nominee for a two-year term expiring January 31,2015.
