I. Short title andcommencement:_

2 Definitions. :.•In these rules, unless the context otherwise requires,~

•"Appointing Authority" in respect of the Service or a post means such.authorityto whom power of appointment to that service or post has been or may hereafterhe delegated by the Government;

"Other Backward Classes" means Other Backward Classes of citizens asspecified by the Stale Government vide Notification No. F.8-5-XXV-4-64, daled26th December, 1984.as amended frpm time to time;

"Service" means the Chhattisgarh Information eommisswn Service;

"State" means the State of Chhattisgarh;

"State Information Commission" means constituted under section-t5, the Rightto Information Act, 2005 (No. 22 of 2005) as the St.te Informalion Commission.

(m) "State Information Commissioner" means appointed under sub~sechon (3) ofSection -15. the Right to information Act. 2005 (No. 22 of 2005) as the StateInformation Commission.

.-3. Scope and application. ~-Withoutprejud[ce tethe generality of the provisions contained

in the Chhattisgarh CivU ServiCes (General -Conditions of Service) Rules, 1961, theserules shall apply to every member of the service.

4, Constitution of the Service, - The service shall consist of the following persons.namely:-

(I) persons, who at the commencement of these rules are holding substantively theposts specified in Schedule-I;

(ii) persons, recruited to the Service before the commencement of these niles; and

(iii) persons, recruited to the Sep/ice in accordance with the provisions of theserules.

5. Classification, Scale of Pay etc. ~ The classification of the Service, the scale of payattached thereto and the nu,mber of posts included in the service Shall b8 in accordancewith the provisions contained in Schedufe-! ,:

Provided that the Government may, from time totirne, add to .or reduce thenumber of posts included in the Service, either on a permanent or a temporary basis.

/), Method of Recruitment. -

(1) Recruitment to the Service, after commencement of these rules, shall be madeby-the following methods, namely:-

(a) By direct recruitment through Competitive Examination/Selesdon:

lb) By promotion of persons who hold ina substantive cap~city in such~ervices as may be specified in Schedule~IV;

(e) By transfer/deputation of persons who hold in a substantive capacitysuch posts in'servic-eas specified In this behalf.

The number of persons reguited under clause (b) and clause (c) of sub-rule (1)shall not at any time exceed the percentage shown jnschedule~1I of the numberof posts specified in Schedule I.

(3 ) Subject to the provisions of these rules, the method or methods of recruitment tobe adopted for the purpose of filling any particular vacancy or vacancies in theservice as may be required to be filled during any particular period ofrecruitment, and the number of persons to be recruited by each method. shall bedetermined Or) each occasion by the appointing authority in consultation with theChief Information Commissioner.

(4) Notwithstanding anything cont~fned in sub-rule (1), if In the opinion of theGovernment the exigencies of the service so require, the commission may withpnor concurrence of the ·Genral Administration Department adopt such methodof recruitment to the service other than those spec..ifiedin the said sub-rule as itmay be order issued in this behalf, prescribe. .

(5) For the selection 1ndirect recruitment post by merit basis Government shall bemade a criteria. Provided that appointing authority shall have to. consdtuted aselection committee, these said critera or appropriate procedure may be adoptedby Committee with the permission of the Government.

(6) At the time of recruitment, the provision of Chhattisgarh Public Service(Scheduled Castes, Scheduled Tribes and Other Backward ClassesReservation) Act, 1994 (No.21 of 1994) and the directions Issued by theGeneral Administration Department of Governmef1t from time to time, shall beapplicable:

7. Appointment to the Service. - All appo.intments to the Service after the commencementof these Rules shall be made by the Government and no such appointment shall bemade except after selection by one of the m(3thodsof recruitment specified in rufe 6.

&. Conditions of Eligibility for direct Recruitment.- In order to be eligible forSelection/Competitive Examination, candidate must satisfy the following conditions,namely'-

0) Age (a) He must have attained the age of (as in column (3) of Schedule- 111,butriot attained the age specified in column (4) of the said schedule, onthe first day of January, next foUowing the date of publication of theAdvertisment ;

(b) The upper age limit shall be relaxable up to a maximum of (5) five yearsif a candidate belongs to a Scheduled Caste/Scheduled.Tribe or OtherBackward Classes;

(e) The upper age limit shall be relaxable up to a maximum of (ten) 10years to women candidates in accordance with provisions of Rule-4 ofthe Chhattisgarh Civil Service (Special Provisions for appointment ofwomen) Rules,1997.

Note :- The max'imum relaxable for uppElrage limit shall not be morethan 45 (Fourty Five) years after giving relaxation from one ormore than one reasons in Government Service.

(d) The upper age limitshafl also be relaxable in respect of candidates whoare or have been employees of the Chtlattlsgarh Government to theextent and subject to the conditions specified below:~

(i) A candidate who is a permanent/officiating/temporary I contin-gencies payee Government servant;of Chhattisgarh should notbe more than 38 years of age;

(iii) A candidate, who is a retrenched Government servant shall beallowed to deduct from his age the' period of all temporaryservices previously rendered by him upto a maximum ilmit of 7(seven) years even if it represents more than one spell providedthat the resultant age does not exceed the upper age limit bymore than three years.

Explanation:- The term "retrenched Government Servantdenotes a persons who was in temporary GovernmentService of this State or ¢f any of the constituent units, tora continuous period oj not less than SIX months arid whowas discharged because of reduction in establishment notmore than three years prior to the date of his registrationat the employment exchange or of application madeotherwise for employment in Government service.

(c) A candidate who is an ex·serviceman (Military) shall be atiowed todeduct from his age the period of all defense service previously·rendered by him. provided that the resultant age does not exceed theupper age limit by more than three year.

Explanation :- The term ex·serviceman (Military) denotes a personwho belongs to any of the following categories and who wasemployed under the Government of India for a continuous periodof not less than 6 (six) months and who was retrenched ordeclared surplus as a result of the recommendation of theEconomy Unit or due to normal reduction in establishment notmore than three years before the date of his registration at anyemployment exchalge or of application made otherwis>3 foremployment in GovMmment service:·

(l) Ex~servicerJan .(Military) released under mustering outconcessions;

Ex-serviceman (Military) enrolled for the second timeand retired, •

(a) On completion of short term employment,

(b) After fulfilling and condition of recruitment,

(3) Ex~personal.of Ma9fas Civil Units;

(4) Officers (Military and Civil) discharged on completion oftheir contract including short service RegularCommissioned Officers;

(h) The upper. age limit shall be relaxable up to five years in respect of the"Shahid Rajiv Pandy Award, Gundadhur Award, MaharajaPrav;rchandra Bhanjdeo Award and National Award" holder candidates,.' ,

(i) The upper age .limit shall be relaxable up toa maximum of 38 years ofage in respect of candidates who are employees of'Chhattisgarh StateCorporations/Boards;

0) The upper age limit shall be relaxed in the 'case of voluntary HomeGuards and Non-Commissioned _Officers of Home Guards for theperiod of service renederd so by them subject to the limit of 8 (Eight)years but in no case their age should exceed 38 years:

(k) The upper age limit shall be relaxabJe in the case of disabledcandidates as per the instructions issued from time to time by the StateGovernment.

Note (l):~ Candidates who are found eligible for selection under theage conceSSions mentioned in sub clause (i) and (il) ofclause (d) above will not be eligible for appointment. If aftersubmittir.g the application they resign from service eitherbefore or after th~ selection.·They wilt, however continue tobe eligible if they are retrenched from the service or postafter submitting the applications.

Note (2):-tn no .ather case will these age limits be relaxed,Departmental candidates must obtain previous permissionof their Appointing Authorit~. to appear for the selection.

Ol In addition to above instructions given by the General AdministrativeDepartment from time to time will be compiled.

(ii) Educational Qualifications. - The candidate" must possess the educationalqualifications prescribed for the service as shown in Schedule-II! .

(iill Fees. - The candidate must pay the fees prescribed by the ApPointing Authority

9. Disqualification. - 'Any attempt on the part of a candidate to obtain support for hiscandidature by any means may be held by. the Appointing Authority to disqualify him forexamination/selection.

10. Appointing Authority's deciSion about the eligibility of candidates.- The decision ofthe Appointing Authority as to the eligibility or otherwise of a candidate for admission toexamination/selection shall be final and no candidate to whom a certificate of admissIonhas not been issued by the Appointing Authority shall be admitted to theexarninationtinterview.

J 1. Direct Recruitment by Competitive Examination/Selection. -

(1 ) Direct Recruifment by Competitive Examination- A Appointing Authority shallconstitute a-selection Committee consisting of three members, -

(a) Competitive examination for recruitment to the service shall be heJd at suchintervals as the Appoi •..•ting Authority may, in consultation with theGovernment from time to time determine.

(b) The exammationshall be held by the Selection Committee in accordance wIthorders issued by the Appointing Authority from time to time,

(2) Direct Recruitment by Selection.-

(i) Selection for recruitment to the service shall be made at such mtervals. asthe ApPointing Authonty may from time to time determine

(it) The Selection of candidates to the Service shaH be made by the SelectionCommittee by interviewing them,

(3 ) There shall be reserved posts for. the persons belonging to the Scheduled Castes,Scheduled Tribes and Other Backward Classes at the stage of the directrecrUitment in accordance with the provisions 'contained in the Chhattisgarh PublicService (Scheduled Castes, Scheduled Tribes and Other Backward Classes-Reservation) Act, 1994 (No. 21 of 1994) and according to the orders of the StaieGovernment issued from time to time.

(4) In filling the vacancies so reserved, candidates who are .members of theScheduled Castes, ~Scheduled Tribes and Other Backward Classes shall beconsidered for appointment in the order in which their names appear in the listreferred to In rule~12, irrespective of their relative rank as compared With othercandidates.

(5r Candidates belonging to the Scheduled Castes, Scheduled Tribes and OtherBackward Classes Selected by the Appointing Authority to be suitable forappointment to the service with due regard to the maintenance of efficiency ofadministration may be appointed to the vacancies reserved for the candidates ofthe Scheduled Castes, Scheduled Tribes and Other Backward Classes, as thecases may be.

(6) Thirty percent posts shall be reserved for women candidates, in accordance withthe provisions of Chhattisgarh Civil Services (Special Provision for appointment ofWomen) Rules,1997.

Where certain period of experience ha~ been prescribed as an essential conditIonfor filling the posts by direct recruitment and in the opinion of Appointmg Authonty Itis found that the sufficient number of Scheduled Caste, Scheduled Tnbe and OtherBackward Classes candidates having requislteexoerience IS not likely to beavailable for recruitment on the reserved posts, ,then the ApPOfnting Authonty mayrelax the condihon of expenence in respect of Scheduled Caste, Scheduled Tribeand Other Backvvard Classes candidates.

(8) There shall be reserved posts for disabled candidatesdirection of the Genera! Administratfon Department.

12. List of Candidates Recommended by the Selection Committee. -

(1) The Appointing Authority shall prepare a list arranged jn order of merit of thecandidates who have qualified by such standard as the Appointing Authority maydetermine and the list of candidates belonging to the Schedule Castes, ScheduleTribes and Other Backward Classes who though not qualified by that standard butor declared by the selection committe"e to be suitable for the appointment to theservice with due regard to the tFlaintenance of efficiency of administration. The listshall also be published for general information.'

(2) Subject to the provisions. of these rules and the Chhattisgarh Civil Services(General Conditions of Service) Rules, 1961 candidates will be considered forappointment to the available vacancies in the order in which their names appear inthe list

(3) The inclusion of a candidate's name in the list ·confers no right to appointmentunless the Appointing Authority is satisfied after such enquiry as may beconsidered nece.ssary, that the candidates is suitable in all respects forappointment to the Service.

The list shall be valid for a period of one year from the da'te qf issue by theAppointing Authority.

13. Appointment by Promotion.-

(1) There shall be constituted a committee consisting of the members mentioned toColumn (6) of the Schedule-IV for making a preliminary selectron for promotion of . Ieligible candidates.

Provided that, for the purpose of constitution of the committee· underthese sub-rule, that provision of section of the Chhattisgarh Public Service(Scheduled Castes, Scheduled Tribes and Other Backward Classes Reservation)Act, 1994 (No. 21 of 1994), shall also be adhered tet

(3) Reservation in promotion shall be made in accordance with the provisions ofChhattisgarh Public Service (Promotion) Rule, 2003.

(4) Procedure for making promotion in the reserved vacancies shall be madeaccordance with the instruction 'issued by the Government in the GenralAdministration Department. from time to time.

14. Conditions of Eligibility of PromotionlTransfer.-

( 1) The committee shall consider the ,case$ of all persons who on the first day ofJanuary of that year, have completed such years of Service, (whether officiatingor substantive) in the years of the posts from which promotion is to be made or onany other post or posts declared equivalent there by the Government as specifiedin column (5) of Schedule~IV and within the zone of consideration as mentioned inthe column (4) of schedu!e-IV.

Explanation- Method of Computation for Eligibility for Promotion- The calculationof-the period of qualifYing Service all the 1st January of the year in whichDepartmental Promotion Committee/Scrutiny Committee is called formeeting. is done from the year when the Governn)ent servent has attainedthe pay-scale of the respective feeder Cadre/post of service/post and notfrom the date he has attained the pay·scale.

(2) The promotion shall be valid in accoradance with the Chhattisgarh PublicService (Promotion) Rule, 2003.

15. Preparationof list of Suitableofficers.-

(2)

The Committee shall prepare a list of such persons who satisfy the conditions InRu!e-14, above and as are held by the committee to be suitable for promotion tothe service. The list shall be sufficient to cover the anticipated vacancies onaccount of retirement and promotion during the course of one year from thedate of preparation of the selection list A reserve list shall also be prepared tomeet the unforeseen vacancies occurring during the course of above saidperiod.

The criteria for preparation of select list shall be based on seniority subject tofitness as p~r provision of the Chhattisgarh Public Service (Promotion) Rule2003

(3) The name of persons included 'in the select list arranged in order of seniority Inthe service are post as specified in Column (3) of the Schedule-IV at the time ofpreparation of the each select list.

Explanation :- The person, whose name is included in select list but who is notpromoted during validity of list, shall have no claim of seniOrity overthose persons c.onsideredin a subsequent selection merely by the factof his earily serection.

16. Select List. -

(2)

The list as finally approved by the Appointing Authority shall from the select listfor promotion of the members of service from the posts mentioned in column (3)of Schedule-IV to the posts mentioned in-column (4) of said Schedule.

The select list shall ordinarily be in force for a period of one year from the dateof its preparation.

(3) ProvIded that in the event of a grave lapse in the conduct or performance ofduties on the part of any person included in the select list, a special review ofthe select list may be'made at the instance· of the ApPOinting Authority and If thecommittee may, if it deems fit, remove the name of such person from the selectlist.

17. AppOintment to the Service from.the Select list.~

(1) Appointment of the Officers included in the select list to the post borne on thecadre of the service shall follow the order accordance WIth the ChhattisgarhPublic Service (Promotion) Rules, 2003,

(2) It shall not ordinarily be necessary to consl,Jlt the Commission beforeapPOintment of a person whose name is included in the select list to the serviceunless during the period intervening between the inclusion of his name in theseled list and the date of the proposed appointment

~1. Saving;- AU issues pertainin"g .to these rules will not affected by any clause onreservation for the S~hedu!e Castes, Schedule Tribes and Other Backward Classes bythe orders issued by the State Government from time to time here after.

")4 Repeal and Saving :- All rules corresponding to these rules and in force immediatelybefore their commencements are hereby repealed in respect of matters covered bythese rules. '

Provided that any order made or action taken under these rules so repealedshall be deemed to have been made or taken under thE; corresponding proVisions ofthese rules.
