NOTICE OF MOTION AND MOTION FOR PRELIMINARY APPROVAL OF CLASS SETTLEMENT

TO THE COURT, ALL PARTIES AND THEIR RESPECTIVE ATTORNEYS OF

RECORD:

YOU ARE HEREBY NOTIFIED THAT at 9:00 a.m. on April 29, 2011, or as soon

thereafter as the matter can be heard, in Department 1 of the above entitled Court, Plaintiffs Nikki

Meierdiercks, Karin Flavetta and Frank Torres (Plaintiffs) will apply for an order

(1) preliminarily approving the proposed settlement of this class action with Defendant;

(2) approving the form and method for providing class-wide notice; (3) directing that notice of the

proposed settlement be given to members of the Settlement Class; and (4) scheduling a final

approval hearing date to consider Plaintiffs request for final approval of the proposed settlement,

entry of the Final Judgment, and Plaintiffs application for attorneys' fees and reimbursement of

expenses. Said Motion will be based on this notice, the attached points and authorities, the

declaration of Kyle Nordrehaug, the Settlement Agreement between the parties, and the complete

files and records in this action.

Because all parties have agreed to the proposed class settlement, this motion is not opposed

by Defendant 8x8, Inc.
