Recommendation 1

That the Metropolitan Local Government Group approves recommended changes to the Group’s Terms of Reference as attached to this report.

Recommendation 2

That the Metropolitan Local Government Group:

1. elects the following:

a. Chairperson of the Metropolitan Local Government Group (MLGG);

b. A CEO to represent metropolitan CEOs; and

c. Four Mayors who are members of the MLGG

to comprise the MLGG Executive Committee in accordance with the Committee’s Terms of Reference and any agreed alterations made; and

2. confirms the appointment of the LGA President to the MLGG Executive Committee in accordance with the Terms of Reference.

Recommendation 3

That the Metropolitan Local Government Group provides direction to the LGA Secretariat in relation to the MLGG’s budget for 2017/18.

Discussion

MLGG Executive Committee Comments

The MLGG Executive Committee asked the LGA Secretariat to reconsider the wording of recommendation 1 in the draft` report. This request has been actioned, with recommendation 1 being amended.

The Committee agreed that the current format of the MLGG and the MLGG Executive Committee should continue until after the transitional changes to the governance review are implemented, subject to the outcomes of the April 2018 LGA Ordinary General Meeting. The Committee also suggested that further consideration of the terms of reference for the Metropolitan Local Government Group and MLGG Executive Committee should take place following the April 2018 LGA Ordinary General Meeting.

Election of MLGG Chairperson

The Metropolitan Local Government Group (MLGG) is established by Part 21 of the LGA Constitution (attached). Clause 116.3 of the LGA Constitution states that The Group must elect a chair for a period up to 12 months from its members…The Chair must be the principal member of an Ordinary member in the Group.

Mayor Karen Redman (Town of Gawler) has been chair of the Metropolitan Local Government Group during 2017. Mayor Redman is eligible for re-election.

The current Terms of Reference of the MLGG Executive Committee (attached) states that the Chairperson of the MLGG should be a member of the LGA Board at the time of their appointment. With that in mind, the MLGG are asked to consider appointing a chairperson, subject to their agreement, from the following list of metropolitan LGA Board Members who are principal members of a council:

Mayor Karen Redman (Town of Gawler) – 2017 MLGG Chairperson;

Mayor David Parkin (City of Burnside);

Mayor Robert Bria (City of Norwood Payneham & St Peters);

Mayor Gillian Aldridge (City of Salisbury);

Mayor Lorraine Rosenberg (City of Onkaparinga)

Mayor David O’Loughlin (City of Prospect);

Mayor Kevin Knight (City of Tea Tree Gully); and

Mayor Glenn Spear (City of Mitcham).

Review of Terms of Reference for Metropolitan Local Government Group and MLGG Executive Committee

The Terms of Reference (ToR) for the MLGG Executive Committee require that they are reviewed annually, following the LGA’s AGM. The ToRs for both the MLGG and the MLGG Executive are therefore provided to enable a review to be undertaken. The LGA Secretariat recommends some minor changes be made to the Terms of Reference of the MLGG in order to remove reference to the Metro CEOs Committee which was disbanded at the start of 2017.

Matters that could also be considered for the review include the following: 

Governance Review

At its meeting on 5 October 2017 the LGA Board resolved:

“that the proposed LGA governance structure be included on the Agenda for the November 2017 Annual General Meeting together with drafting notes for a new LGA Constitution (bringing the structure into effect) noting that the structure and draft Constitution will be the subject of further consultation with the sector and the Minister for Local Government”.

At the AGM on 16 November 2017, it was resolved that the draft structure and constitution would be subject to sector wide consultation prior to endorsement at the next General Meeting of the LGA in April 2018. It is anticipated that the changes will not be implemented until after the 2018 local government elections and AGM.

MLGG Executive

Under the current Terms of Reference, the MLGG is required to nominate an Executive Committee. The membership of the MLGG Executive Committee is to be appointed on an annual basis at the first meeting of MLGG following the LGA’s Annual General Meeting. When appointing the Executive Committee in accordance with the Terms of Reference, consideration will be given to include at least one woman and one man, and at least one representative from both ‘inner’ and ‘outer’ metropolitan Councils

Membership of the MLGG Executive Committee will comprise the following:

1. Chairperson of the Metropolitan Local Government Group (MLGG);

2. A CEO representative;

3. The LGA President; and

4. Four Mayors who are members of the MLGG.

Financial Implications

The MLGG currently has funds of approximately $193,795 (30 November 2017), while the work plan provided (item 6.2), identifies potential expenditure of $105,000, there are unallocated funds of approximately $70,000 which will increase by an additional $76,000 at the commencement of next financial year.

The MLGG may wish to consider seeking ideas from member councils on possible projects the funds could be used for which would provide benefit to MLGG members.

Extract from LGA Constitution Part 21 - Metropolitan Local Government Group

114. Status of the Group

The Metropolitan Local Government Group (Group) constitutes a Region for certain Ordinary Members.

115. Support to the Group

The LGA may continue to provide administrative support to the Group for such charge (if any) as may be agreed.

116. Group meetings

The Ordinary Members in the Group agree the following in relation to their meetings:

116.1 The Group must meet at least at least six times per year at such time and place as determined by the Chief Executive Officer.

116.2 At least 7 clear days before the date fixed for the holding of meeting of the Group, the Chief Executive Officer must send to Ordinary Members in the Group a notice of the date, time and place of the meeting and of the business to be transacted at the meeting, so far as known to the Chief Executive Officer.

116.3 The Group must elect a chair for a period up to 12 months from its members. When the chair is absent from any meeting, an acting chair for the purposes of that meeting must be elected from members present at the meeting. The chair must be the principal member of an Ordinary Member in the Group.

116.4 The Group may consider and discuss any matter affecting an Ordinary Member in the Group, and if necessary refer any matter to the Board.

116.5 The principal member and the chief executive officer of an Ordinary Member in the Group, or their respective proxies duly appointed under this clause, are entitled to attend and participate in all meetings of the Group.

116.6 An Ordinary Member in the Group has 1 vote at meetings of the Group. To avoid doubt, the Chief Executive Officer does not have a vote.

116.7 The principal member of an Ordinary Member in the Group is a voting member of the Group. That principal member may appoint a proxy authorised to vote, speak or participate on their behalf at a meeting. A proxy appointed by the principal member must be an Elected Representative or employee of the relevant Ordinary Member.

116.8 The chief executive officer of an Ordinary Member in the Group is a non-voting member of the Group. That chief executive officer may appoint a proxy authorised to speak and participate on their behalf at a meeting. A proxy appointed by the chief executive officer must be an employee of the relevant Ordinary Member.

116.9 Elected members and officers of Ordinary Members of the Group that do not fall within clause 116.5 are entitled to attend (but not vote) at meetings of the Group.

117. Group committees

The Group may establish sub-committees to assist it in the performance of its function. Such sub-committees will be of an advisory nature only and may comprise persons who are

METROPOLITAN LOCAL GOVERNMENT GROUP TERMS OF REFERENCE

The Metropolitan Local Government Group is established under the Constitution of the Local Government Association (LGA). Under the LGA constitution the MLGG may consider and discuss any matter affecting a Council which is a member of the Group and if necessary refer any matter to the LGA State Executive CommitteeBoard.

Responsibilities of the MLGG 1. To provide advice to the LGA State Executive CommitteeBoard on matters affecting

Local Government from a metropolitan Adelaide perspective;

2. to provide a forum for discussion of issues which are of common interest to its member Councils;

3. to achieve mutually held objectives and to address Local Government issues and opportunities relevant to metropolitan Adelaide;

4. to provide a strong representative basis for working with State and Federal governments;

5. to provide a vehicle for governments to consult, engage and negotiate on policy decisions that affect metropolitan Adelaide and its communities.

Membership The Mayor and Chief Executive Officer of a Council which is a member of the Metropolitan Local Government Group, or their respective proxies shall be entitled to attend and participate in all meetings of the Metropolitan Local Government Group.

MLGG member Councils:

City of Adelaide Adelaide Hills Council City of Burnside City of Campbelltown City of Charles Sturt Town of Gawler City of Holdfast Bay City of Marion City of Mitcham City of Norwood, Payneham & St Peters City of Onkaparinga City of Playford City of Port Adelaide Enfield City of Prospect City of Salisbury City of Tea Tree Gully City of Unley Town of Walkerville City of West Torrens

Representatives of Mount Barker may also attend as observers, in recognition of that Council’s close functional relationship with Metropolitan Adelaide.

Chair The Metropolitan Local Government Group must elect a Chair for a period up to twelve months from its elected members. The Chair of the MLGG will be elected at the first meeting of the MLGG following the LGA’s Annual General Meeting.

Meeting Frequency The Metropolitan Local Government Group shall endeavour to meet at least once every two monthssix times a year. Meeting are generally held in January, March, May, July, September and November of each year.

Meeting Procedures The Mayor of a Council which is a member of the Metropolitan Local Government Group shall be a voting member of the Metropolitan Local Government Group. The mayor may appoint a proxy authorised to vote, speak or participate on their behalf at a meeting. A proxy appointed by the mayor must be an elected member or an officer of the relevant Council.

The chief executive officer of a Council which is a member of the Metropolitan Local Government Group shall be a non-voting member of the Metropolitan Local Government Group (unless acting as proxy for the Mayor). The chief executive officer may appoint a proxy authorised to speak or participate on their behalf at a meeting. A proxy appointed by the chief executive officer must be an officer of the relevant Council.

The LGA Secretariat must send to Councils which are members of the Metropolitan Local Government Group, a notice of the date, time and place of the meeting and of the business to be transacted at the meeting. This must be done in accordance with the requirements set out in the LGA Constitution.

When the Chair is absent from any meeting, an acting Chair for the purposes of that meeting must be elected from members present at the meeting.

Conduct of meetings The MLGG will generally operate using the LGA Standing Orders for Meetings of the State ExecutiveLGA Board and other LGA Committees as a guide to the conduct of its meetings (Appendix 1). The MLGG Chair may dispense with or vary any provision of the standing orders they consider necessary or appropriate, having regard to the following.

The procedures should: 1. be fair and contribute to open, transparent and informed decision-making; 2. encourage appropriate participation by the elected and appointed representatives

of member Councils; 3. reflect levels of formality appropriate to the nature and scope of responsibilities

exercised at the meeting; and 4. be sufficiently certain to give member Councils and other key stakeholders

confidence in the deliberations undertaken at the meeting. Quorum

1. A quorum shall consist of ten or more Members of the Committee. In this context ‘Members’ includes Voting Members, and any Proxy Member who is eligible to vote by virtue of the absence of a Member.

2. Meetings will commence as soon after the time specified in the notice of the meeting as a quorum is present.

3. If the number of apologies received in advance of a meeting indicates that a quorum will not be present, the meeting may be adjourned to a specified day and time.

4. If a quorum is not present at the expiration of 30 minutes from the time specified in the notice of meeting as the time of commencement, the Presiding Member or, in his/her absence, the LGA Chief Executive Officer (or delegate), will adjourn the meeting to a specified day and time.

5. If a meeting is adjourned to another day, the LGA Chief Executive Officer (or delegate) must give notice of the adjourned meeting to each Member, setting out the date, time and place of the meeting.

Confidential Matters

1. From time to time it may be necessary or appropriate for a meeting to consider a matter in confidence. Examples include (but are not limited to) matters which may:

result in the unreasonable disclosure of information concerning the personal affairs of any person (living or dead);

confer a commercial advantage on a person, prejudice the commercial position of the LGA, or disclose a trade secret (including considering tenders for the supply of goods and services);

be contrary to the public interest; affect the security of the LGA including Members of the Committee and

the LGA’s officers, employees, property or assets; prejudice the maintenance of the law, including the prevention, detection

or investigation of a criminal offence, the right to a fair trial, or any other legal obligation or duty conferred by the courts or by legislation;

involve information relating to actual or anticipated litigation; or involve information given to the LGA on a confidential basis.

2. The Chief Executive Officer of the LGA (or delegate) may determine as an interim measure, that a report to the Committee deals with a matter which should be considered in confidence, and may mark that report accordingly.

3. Upon receipt of a report marked ‘confidential’, Members will not disclose its contents to any person, prior to the meeting at which it is to be discussed.

4. Prior to consideration of a matter which is proposed to be treated in confidence (including any report, verbal report, or motion), the Committee shall first vote on a separate motion to declare the matter as confidential. The separate motion shall give details of why the matter is to be considered in confidence.

5. All debate, discussion, reports and minutes relating to matters which are determined by the Committee to be confidential will remain so indefinitely until the Committee passes a resolution to the contrary.

6. Following a decision by the Committee to treat a matter as confidential, the Chair may immediately ask any person or persons (not including Members of the Committee) to leave the room while the matter is considered.

7. Notwithstanding a decision by the Committee to treat a matter as confidential, nothing shall prevent the staff of the LGA Secretariat from conveying the Committee’s decision on the matter to those persons who have a direct interest in it.

Addresses by Members

1. A Member must not speak for longer than five minutes at any one time without leave of the meeting.

2. A Member may, with leave of the meeting, raise a matter of urgency. 3. A Member may, with leave of the meeting, make a personal explanation. 4. The subject matter of a personal explanation may not be debated.

Voting 1. The Chair, or any other Member, may ask the Chief Executive Officer of the LGA

(or delegate) to read out a motion before a vote is taken. 2. The Presiding Member will, in taking a vote, ask for the votes of those Members

in favour of the motion and then for the votes of those Members against the motion (and may do so as often as is necessary to enable him or her to determine the result of the voting), and will then declare the outcome.

3. A person who is not in his or her seat is not permitted to vote. 4. All motions will be determined on the basis of a majority vote of Members present

and entitled to vote. 5. The Chair shall have a deliberative vote, and if there are equal numbers of votes

on any motion, a second or casting vote. Sub-Committees From time to time the MLGG will form sub-committees to further work on specific issues. Sub-committees of the MLGG will be formed on the basis of group resolution. How sub-committee members are appointed will be determined on a case by case basis. Membership of MLGG sub-committees can include Council staff with related expertise as nominated by participating Council’s CEO. Sub-Committees will report findings and progress to the wider MLGG at predetermined intervals.

MLGG Executive Committee The MLGG will nominate an Executive Committee. The membership of the MLGG Executive Committee will be appointed on an annual basis at the first meeting of MLGG following the LGA’s Annual General Meeting. When appointing the Executive Committee consideration will be given to include at least one woman and one man, and at least one representative from both ‘inner’ and ‘outer’ metropolitan Councils. Membership of the MLGG Executive Committee will comprise the following:

1. Chairperson of the Metropolitan Local Government Group (MLGG); 2. Convenor of the MLGG Chief Executive Officer CommitteeA CEO representative; 3. The LGA President; and 4. Four Mayors who are members of the MLGG.

For MLGG Executive Committee Terms of Reference see Appendix 1. Setting the MLGG Agenda The MLGG Executive Committee is given the role to approve the LGA Secretariat’s suggested agendas for the MLGG and suggest additional agenda items when appropriate.

Member Councils wishing to progress issues through the MLGG may do so with resolution from their elected body. Member Councils can forward any report put to their elected body together with a suitable resolution to the MLGG Executive Officer for inclusion in the MLGG agenda following consideration by the MLGG Executive Committee.

A template is available to assist member Councils in advising the MLGG Executive Committee of proposed agenda item/issues (Appendix 2).

The MLGG Executive Committee will evaluate the relevance of any item forwarded for agenda inclusion against established guidelines. These are outlined and appended to

METROPOLITAN LOCAL GOVERNMENT GROUP EXECUTIVE COMMITTEE TERMS OF REFERENCE

(Approved by MLGG on 18 January 2017)

Name of Committee Metropolitan Local Government Group Executive Committee Role

1. To provide advice to the LGA Secretariat concerning matters under consideration by the Metropolitan Local Government Group.

2. To approve the LGA Secretariat’s suggested agendas for the Metropolitan Local Government Group, and suggest additional agenda items when appropriate.

3. To undertake other duties and functions as may be directed by the Metropolitan Local Government Group from time to time.

Membership Membership of the Executive Committee will comprise the following:

1. Chairperson of the Metropolitan Local Government Group (MLGG); 2. A Chief Executive Officer of a MLGG member council; 3. The LGA President; and 4. Four Mayors who are members of the MLGG.

The membership of the MLGG Executive Committee will be appointed on an annual basis at the first meeting of the MLGG following the LGA’s Annual General Meeting. When appointing the Executive Committee consideration will be given to include at least one woman and one man, and at least one representative from both ‘inner’ and ‘outer’ metropolitan Councils. The Chairperson of the Metropolitan Local Government Group should be a member of the LGA Board at the time of their appointment. Meeting Frequency The Executive Committee will meet approximately three weeks prior to each meeting of the Metropolitan Local Government Group, if required (at the discretion of the MLGG Chairperson). In lieu of a formal meeting, or to advance matters between meetings, the MLGG Chairperson or the LGA Secretariat may decide to communicate with Committee members via email, telephone or some other suitable method. Meeting Procedures

1. The Committee will operate on an informal basis, and will not be subject to formal meeting procedures.

2. Agendas will be prepared for each meeting, and circulated to members in advance. 3. Detailed minutes will not be taken, but a list of agreed actions will be prepared and

circulated to members after each meeting, if required and will form the report from the MLGG Chairperson to the following MLGG meeting.

Executive Support and Implementation The Local Government Association will provide executive support to the Committee. Review The Committee’s Terms of Reference shall be reviewed annually, following the LGA’s Annual General Meeting each year.

METROPOLITAN LOCAL GOVERNMENT GROUP EXECUTIVE COMMITTEE

GUIDELINES FOR AGENDA ITEMS INTRODUCTION These guidelines have been developed to assist the MLGG Executive Committee to determine items to place on the MLGG agenda in line with the agreed role and responsibilities of the broader MLGG group. The MLGG has determined that its role is to:

1. To provide advice to the LGA Board on matters affecting Local Government from a metropolitan Adelaide perspective;

2. to provide a forum for discussion of issues which are of common interest to its member Councils;

3. to achieve mutually held objectives and to address Local Government issues and opportunities relevant to metropolitan Adelaide;

4. to provide a strong representative basis for working with State and Federal governments;

5. to provide a vehicle for governments to consult, engage and negotiate on policy decisions that affect metropolitan Adelaide and its communities.

GUIDELINES FOR APPROVING MLGG AGENDA ITEMS The MLGG Executive Committee will evaluate the relevance of any item forwarded for agenda inclusion against the following guidelines:

The relevance of the issue to the achievement of the MLGG’s responsibilities, objectives and/or schedule of priorities outlined in the MLGG Annual Priorities;

The likely support for the consideration of the issue by metropolitan Councils; The degree to which the issue has relevance to metropolitan Councils as opposed to

being an issue for rural and regional Councils; The degree to which the metropolitan response to sector wide issues will differ to the

likely response from rural and regional Councils; and Whether the issue is “strategic” in nature as opposed to “operational”. The MLGG will

strive to include strategic issues as far as is practical. The relevance of the issue to the achievement of the LGA’s Strategic Plan and

Annual Priorities.

Note: Matters referred by Member Councils for inclusion in the MLGG Agenda would have the possible outcome of :

1. a report to MLGG with recommendation that the issue be brought to the attention of the LGA Executive Committee (metro-wide) (see attached information re: Referring MLGG Matters to the LGA Board

2. a report to MLGG with recommendation that the MLGG nominate a sub-committee to progress the issue (sub-regional)

3. advice to the initiating Council that the issue is not a matter suitable for MLGG attention (local issue)

METROPOLITAN LOCAL GOVERNMENT GROUP THE LGA BOARD

Referring matters to the LGA Board - Reports Reports to the LGA Board are formatted to link with the LGA’s Strategic Plan through reference to Key Result Areas and Strategies within the LGA Strategic Plan. This enables the LGA Board to continually review its Strategic Plan and to ensure its relevance to issues arising for debate and decision. To support this requirement, the MLGG’s Annual Priorities should establish links to the LGA’s Strategic Plan, Key Result Areas and Annual Priorities. LGA Organisational Decision Making Structure The LGA Board conducts the business between Annual and General Meetings. Councils have the opportunity to raise issues directly with the Secretariat, through regional associations, SAROC, the Metropolitan Local Government Group and during the Annual General Meeting or General Meeting of the Association. The LGA Secretariat, headed by the Chief Executive Officer, provides advice to and implements the decisions of the LGA Board. The LGA Secretariat does not implement the decisions of MLGG or SAROC unless these are supported by a decision of the LGA Board.

5 MLGG Annual Priorities

5.1 Metropolitan Smart Cities (Technology) Snapshot

The Lord Mayor offered to host a smart cities summit prior to the end of the financial year to share the outcomes of the work on Metropolitan Smart Cities.

The MLGG asked that the LGA seeks to obtain from the Electoral Commission of South Australia, information relating to the number of supplementary elections held during the current term and the reasons these supplementary elections occurred.

The Snapshot will be presented at the 17 January 2018 MLGG meeting.

The LGA SA Secretariat is negotiating with the City of Adelaide to host a Smart Cities Summit that will explore the findings of the snapshot.

Resolutions from the meeting of the Metropolitan Local Government Group – 12 July 2017

5.1 Smart Cities

undertakes an audit and prepares a report for councils on the “Smart Technologies” currently being used or investigated by councils, and their benefits to councils and their communities;

uses the information gathered from councils to prepare a report identifying opportunities for councils to work together within a collaborative smart cities framework to build the capacity of the sector to achieve efficiencies and deliver community benefits;

identifies how local councils and smart cities are creating employment and economic development opportunities in the community; and

allocates $10,000 from the MLGG budget to undertake the Smart Technologies audit and reporting.

On Track

The University of Adelaide Smart Cities Consortium is supplying an MLGG RDA Adelaide Smart Cities (Technology) Snapshot but not an audit. A full audit would require a separate piece of work that would be informed by the snapshot and would be in far greater detail and include full analysis of the collected data, recommendations for the local government sector and indicative costs.

The MLGG has not made a decision about an audit.

5.3 Small Business Charter

That the Metropolitan Local Government Group recommends to the LGA Board that the LGA Secretariat continue to work with the Office for the Small Business Commissioner and other business organisations or associations to develop a Small Business Friendly Council Charter Program.

Update from 8 November 2017 Previous Resolutions:

The LGA Secretariat continues to work with the Office for the Small Business Commissioner to roll out the Small Business Friendly Council Charter Program.

The Office of the Small Business Commissioner launched the Charter on Wednesday 30 August 2017 in Whyalla as the Whyalla City Council was the first council to adopt the Charter. The Small Business Commissioner, Mr John Chapman, has written to each council seeking their interest in the program. He will offer to meet with them to explain it in further detail.

Nine councils have signed up to the Charter: City of Whyalla, District Council of Franklin Harbour, The Flinders Ranges Council, Holdfast Bay City Council, Municipal Council of Roxby Downs, District Council of Orroroo/Carrieton, District Council of Tumby Bay, Wudinna District Council, and Rural City of Murray Bridge.

5.1 Report from the LGA President – January 2018

Recommendation:

That the MLGG notes the report.

Rate capping

In December the LGA launched the third and final phase of its campaign to oppose the introduction of rate capping in South Australia with ads on Adelaide radio. This campaign will continue until the state election in March 2018, or until all political parties drop the policy. The second phase of our campaign (focussed on activating our sector) is running concurrently with the third phase, a nd the first phase (raising awareness of the extent and value of council services) will continue until the 2018 council elections. The response to our campaign from some political parties has been disappointing – rather than defend this policy they have attacked councils, and attempted to discredit the sector. The LGA will continue to stand up for communities against the cuts to local services that would result from rate capping, and I urge all South Australian councils to actively oppose this policy.

Code of conduct

The Premier recently announced he is putting his plans to repeal the code of conduct for council members on hold. While this is positive news for our sector, we will continue to advocate for the existing code to be improved and strengthened. The behaviour of council members is generally very good, but a stronger code of conduct with increased penalties for breaches will provide councils with better tools to address serious – albeit isolated – behavioural issues as they arise.

Emergency Management

The LGA has partnered with the State Government to secure $2 million from the Natural Disaster Resilience Program for a major project that will provide councils with access to resources to support the development of a whole-of-state Emergency Management Program. This project will run over three years, with a total budget of $3 million. $1 million proponent funding will be provided by the LGA Mutual Liability Scheme, and I would like to thank and acknowledge the LGA MLS board for this contribution. Our sector plays a key role supporting the State’s emergency services agencies, and this funding will increase our capacity to assist during emergency events.

Local government reform

The LGA is currently consulting with member councils on options for local government reform, in order to provide all political parties with a proposed road map for sector reform ahead of the March 2018 state election. A report incorporating the outcomes of this consultation and outlining

the way forward will be presented at the January Board Meeting. I believe we are already the most efficient sphere of government, and we will be asking all political parties to support our sector to achieve greater efficiencies through driving its own reform agenda.

HACC funding for 2018/19

We are continuing to advocate on the key issues for councils outlined in our 2018 state election platform South Australia. Uncapped potential. One recent win we’ve achieved has been a $27 million commitment from the current State Government to continue Home and Community Care (HACC) funding in 2018/19. Councils have raised concerns with the LGA that some community care programs currently offered may not continue if HACC funding were removed in the transition to the NDIS, so it is fantastic to see this commitment of continued support.

SA Planner of the Year

Congratulations to the LGA’s Director Policy Stephen Smith who was awarded the prestigious honour of SA’s Planner of the Year at the Planning Institute of Australia (SA Branch) 2017 Awards for Planning Excellence. Stephen is doing a fantastic job working with both councils and the State Government on the phased transition to our state’s new planning system, and this award is well deserved recognition of his contributions to our sector and the State’s planning profession.

3. Minutes of the previous MLGG Executive Committee meeting held 16 October 2017

The minutes of the MLGG Executive Committee meeting held on 16 October 2017 were confirmed by unanimous consent as a true and accurate record.

4. Guest Speaker

The MLGG Executive Committee approved the attendance of Associate Professor Nick Faulkner from the Adelaide University Smart Cities Consortium, to present the results of the Smart Technologies Snapshot.

5. Draft agenda for the 17 January 2018 Metropolitan Local Government Group meeting

2018 MLGG Governance

The MLGG Executive Committee asked the LGA Secretariat to reconsider the wording of recommendation 1 in the draft` report.

The Committee agreed that the current format of the MLGG and the MLGG Executive Committee should continue until after the transitional changes to the governance review are implemented, subject to the outcomes of the April 2018 LGA Ordinary General Meeting. The Committee also suggested that further consideration of the terms of reference for the Metropolitan Local Government Group and MLGG Executive Committee should take place following the April 2018 LGA Ordinary General Meeting.

Action:

LGA Secretariat to review and amend the report and recommendations in line with discussion at the MLGG Executive Committee.

Proposed 2018 MLGG Workplan

The MLGG Executive Committee discussed at length, the proposed ‘think tank’ events and themes outlined in the 2018 MLGG Workplan report.

The Committee recommended the following actions:

- Consider combining with SAROC to hold a business summit and provide an advocacy strategy to the South Australian Tourism Commission (SATC).

- Rebrand the Think Tank concept. Develop strategies to attract greater attendance.

- Combine three ‘Think Tank’ events into a full day event, possibly as an add-on to the LGA Showcase in April.

Smart Cities (Technologies) Snapshot Update

The report is to be noted and a decision regarding whether to go ahead with the full audit is to be deferred until after the results of the snapshot are known.

The Chairperson advised that she received correspondence from Jane Bartlett from the SA Cricket Association (SACA) regarding a social cricket competition (Super Cricket) across South Australia, and seeking support from metropolitan councils for this project with regards to access to venues. The correspondence will be tabled in the January MLGG agenda.

Action:

- LGA Secretariat to include the correspondence in the January MLGG agenda with a brief covering report.

- The covering report is to seek MLGG’s approval for the Chairperson to write to metropolitan councils encouraging them to support this initiative.

6.1 Smart Cities (Technology) Snapshot Update

That the Metropolitan Local Government Group:

1. notes the report;

2. notes that RDA Adelaide has provided an additional $5,000 towards the Smart Cities (Technology) Snapshot; and

3. provides ‘in-principle’ support for a Smart Cities (Technology) Audit to enable and a more detailed project plan and scope to be developed and considered by the MLGG.

Discussion

At its meeting on 8 November 2017, the Metropolitan Local Government Group resolved to accept the proposal from the University of Adelaide Smart Cities Consortium for the completion of a Metropolitan Councils Smart Cities (Technology) Snapshot.

The MLGG also authorised the LGA Secretariat to negotiate with RDA Adelaide to partner with the MLGG on this project and for the provision of an additional $5,000 to complete this project; and accepted the offer of the City of Adelaide to host a smart cities summit prior to the end of the financial year to share the outcomes of this work.

The LGA Secretariat has produced a 2018 MLGG Work Plan for the MLGG for consideration that includes the presentation of the MLGG Smart Cities (Technology) Snapshot by the University of Adelaide Smart Cities Consortium, provision for a Smart Cities Audit and a Smart Cities In Summit.

At its 12 July 2017 meeting, the MLGG resolved to fund an audit and prepare a report for councils on the ‘Smart Technologies’ currently being used or invested in by councils, and their benefits to councils and their communities. The University of Adelaide Smart Cities Consortium advised the MLGG at its 8 November meeting that for $15,000 a snapshot could be completed but a complete audit with the identification of opportunities for councils to work together within a collaborative smart cities framework to build the capacity of the sector, achieve efficiencies and delivery community benefits would not be possible given the time frames and funds. An audit however could provide these requirements and the identification of how local councils and smart cities can create employment and economic development. An audit such as this would be more expensive.

Associate Professor Nick Faulkner is attending the January MLGG meeting to present the findings of the Snapshot. Members are asked to consider ‘in-principle’ whether an audit should be pursued to enable and a more detailed project plan and scope to be developed.

The MLGG resolved to commit $10,000 to the project and the LGA Secretariat has been successful in securing $5,000 from the RDA Adelaide to partner in this project. The snapshot will be presented to the MLGG meeting on 17 January 2017, after which a decision will be made as to whether an audit will be commissioned or not.

An LGA Consultancy Agreement with the University of Adelaide Smart Cities Consortium was signed in November 2017.

The Consortium is seeking to establish itself as the central point for Smart Cities in the state and will contribute considerable knowledge, skills, experience, networks and students to assist in the realisation of the project.

Principally, the outcome of a three month snapshot will be a gathering and collating of 19 disparate sets of data, and pulling them together into a visible, cohesive whole. The success of the snapshot will depend on how engaged each council is in the provision of the required data.

To facilitate the collection of the data, all metropolitan councils were asked via email on 16 November 2017 to supply the LGA Secretariat with a “Council Coordinator for the Smart Cities (Technology) Snapshot”. This person would act as the contact for the Smart Cities Consortium to coordinate the collection of the data from each council.

Financial Implications

Discussion

MLGG Executive Committee Comments

The MLGG Executive Committee discussed at length, the proposed ‘think tank’ events and themes outlined in the 2018 MLGG Workplan report.

The Committee recommended the following actions:

Actions:

- Consider combining with SAROC to hold a business summit and provide an advocacy strategy to the South Australian Tourism Commission (SATC).

- Rebrand the Think Tank concept. Develop strategies to attract greater attendance.

- Combine three ‘Think Tank’ events into a full day event, possibly as an add-on to the LGA Showcase in April.

Future Towns Future Cities 2018

The LGA’s Economic Development theme for 2017 was ‘Future Towns, Future Cities’ and is recommended to be continued into 2018. This is an umbrella term for events the LGA will hold with and for councils.

These events are aligned with the 11 Economic Development Priorities of the LGA, and are designed to be interactive and informative. The aim is to bring councils, businesses, government agencies and organisations together to discuss ideas, initiatives, funds, projects, programs and tools to help councils plan and deliver for the future.

The Future Towns, Future Cities approach has the objective of aligning the LGA priorities and the priorities of the MLGG to achieve community wellbeing via economic development initiatives.

The suggested MLGG work plan for 2018 to meet the above objectives is outlined below:

1. Metropolitan Smart Cities (Technology) Snapshot final report (refer to item 6.1)

What: Metropolitan Smart Cities (Technology) Snapshot final report.

The MLGG Meeting held on Wednesday 8 November 2017 heard from Associate Professor Nick Faulkner from the University of Adelaide Smart Cities Consortium regarding the Consortium’s proposal to conduct a snapshot review into the smart city technologies used by metropolitan councils. The Group accepted the proposal from the Consortium.

Why: To receive the final report and discuss the Metropolitan Smart Cities (Technology) Snapshot undertaken by the University of Adelaide Smart Cities Consortium and decide next steps which could include the commissioning of a Metropolitan Smart Cities Audit.

Budget: $15,000 (previously approved allocation).

2. Metropolitan Smart Cities (Technology) Audit

What: Metropolitan Smart Cities (Technology) Audit.

The possibility of a Smart Cities Audit was considered at the MLGG Meeting on Wednesday 8 November 2017. Members are asked to consider ‘in-principle’ whether an audit should be pursued and a more detailed project plan and scope be developed.

Why: To expand on the Snapshot to include greater depth of analysis of the Smart things councils do and benchmark against interstate and overseas councils and organisations.

Budget: $60,000 (estimated).

3. Smart Cities Summit

What: Smart Cities Summit. The MLGG also accepted an offer made by the Lord Mayor during the 8 November 2017 meeting, for the City of Adelaide to host a Smart Cities Summit prior to the end of the financial year in order to share the outcomes of the work conducted by the Consortium in relation to the Smart Cities Technology Snapshot. The initiative will also explore entrepreneurialism and innovation in smart cities and councils.

Budget: $7,500.

4. Business Summit

What: Business Summit “The Business of Tourism” (Smart Tourism/Mainstreets as Tourism Drivers (Retail as the case study) / Mainstreet SA Regional Outreach Program).

Note: This event to held in-conjunction with SAROC and SATC

Why: To highlight the importance of tourism. That tourism/the tourist economy or the visitor economy is made up of a large number of small businesses and that state and local government play a vital role in their success. Further to explore the types of digital tools that can be used to stimulate tourism experiences and spend, and the measure of how effective and efficient the investment of state and local government is in tourism and finally how can the local government sector learn from each other to improve the tourism amenity of Mainstreets and placemaking.

5. Procurement and Economic Development

What: MLGG Economic Development Workshop: “Procurement and Economic Development”.

Why: To explore how important procurement philosophy, policy and practice increases effectiveness and efficiencies both inside and outside councils driving economic development.

Who: The 19 Metropolitan council Mayors, Councillors, CEO’s, Senior Staff and Procurement and Economic Development Officers. Business SA, UDIA, LGA Procurement, Office of the Small Business Commissioner, Relevant State Government agency and 19 businesses or one business from each council.

Budget: $7,500.

6. Population and Economic Development

What: MLGG Economic Development Workshop: “Population and Economic Development”.

Why: To explore how important population policy and practice positively effects economic development in communities. Launch of the LGA SA Research & Development Project “Evidence to inform LG Advocacy for a Strategic Population Policy”.

Who: the 19 Metropolitan council Mayors, Councillors, CEO’s, Senior Staff, Economic Development and Tourism Officers Network, and Community Development Officers. Business SA, Committee for Adelaide, Property Council, UDIA, Migration SA, Relevant State Government agency and 19 businesses or one business from each council.

Budget: $7,500.

7. Planning and Economic Development

What: MLGG Economic Development Workshop: “Planning and Economic Development”.

Why: To explore how important planning philosophy, policy and practice positively effects economic development in communities.

Budget: $7,500.

The Economic Development Workshops would replace the Think Tanks. The format will change from two hours to a three hour event and the attendees to be Mayors, CEO’s and relevant council staff and local businesses aligned with each workshop. There is also the option of combining into a one day event. Members are asked to consider which approach they would prefer.

Financial Implications

The Budget for the 2018 MLGG Work Plan is estimated to be $105,000 (not including previously approved activities). These funds are available within the existing MLGG budget.

Recommendation

That the Metropolitan Local Government Group endorses the appointment of Mr Klinton Devenish to the Metropolitan Strategic Roads Committee.

Discussion

The Metropolitan Strategic Roads Committee (MSRC) is established as a sub-committee of the Metropolitan Local Government Group for the purpose of assessing metropolitan applications for strategic road funding priorities for the Special Local Roads Program (SLRP).

Membership of the MSRC consists of:

One Elected Member representative from metropolitan councils north of the River Torrens (currently Cr Mark Groote, City of Prospect);

One officer representative from metropolitan councils north of the River Torrens (currently Mr Robert Tiggeman, City of Port Adelaide Enfield);

One Elected Member representative from metropolitan councils south of the River Torrens (currently Cr George Demetriou, City of West Torrens);

One officer representative from metropolitan councils south of the River Torrens (currently Mr Russell King, City of Mitcham); and

One officer representative from the City of Adelaide.

The position of the officer representative from the City of Adelaide was previously filled by Mr Mike Blythe. Following Mr Blythe’s resignation, the position was filled on an interim basis by Mr David Janson for the purposes of assessing the 2017 metropolitan applications for SLRP. The City of Adelaide has now appointed Mr Klinton Devenish to the position of Associate Director Infrastructure and nominated Mr Devenish to sit on the MSRC as the City of Adelaide’s representative.

The MLGG is asked to endorse the appointment of Mr Devenish to the MSRC.

METROPOLITAN STRATEGIC ROADS COMMITTEE

TERMS OF REFERENCE

Introduction The Metropolitan Local Government Strategic Roads Committee (MSRC) is established to effect a formal regional assessment process for deliberation of strategic metropolitan road funding priorities. All metropolitan Council applications for funding submissions to Special Local Roads are to be submitted through the MSRC assessment format. Metropolitan Council Membership Reference to metropolitan Councils shall include those Councils which collectively constitute the Metropolitan Local Government Group as identified in the LGA Constitution and as amended from time to time. Funding Process Funding for strategic local roads in South Australia is made available under the South Australian Special Local Roads Program. Funding for the Special Local Roads Program is provided from:

15% of Identified Local Road Grants; and 15% of Roads to Recovery 2.

Funding is also available under the Strategic Pool of Roads to Recovery 2. The Local Government Transport Advisory Panel (LGTAP) The Local Government Transport Advisory Panel (LGTAP) has previously been established to consider submissions for strategic road funding under the Special Local Roads Program (SLRP) and the strategic pool of Roads to Recovery 2 (R2R2). The Local Government Transport Advisory Panel (LGTAP) annually calls for submissions from Regional Local Government Associations for projects to be funded under the Special Local Roads Program. Regional strategic projects submitted are assessed under the “fit for purpose” categories of freight, tourism and social. The Metropolitan Local Government Strategic Roads Committee (MSRC) The Metropolitan Local Government Strategic Roads Committee (MSRC) is now established to provide advice to the Local Government Transport Advisory Panel (LGTAP) for the recommendation of strategic metropolitan road funding projects under SA Special Local Roads Program. Process Following written request from the LGTAP to the Metropolitan Local Government Group a call will be made to metropolitan Councils for strategic road funding applications. The MSRC will consider applications from metropolitan Councils or consortiums of metropolitan Councils and propose a program of works across Adelaide for allocation of funding. MSRC in making its recommendations will give due weight to

system provides a numerical score based on inputs including traffic volume and equivalent standard axle figures.

The Strategic Roads Hierarchy for metropolitan Adelaide, developed in 2009/2010 State Government planning documents.

Membership The MSRC members will be appointed by the Metropolitan Local Government Group and/or the Metropolitan Local Government Group Executive Committee. The MSRC will have membership of five persons, consisting of,

one Elected Member representative from metropolitan Councils north of the River Torrens;

one officer representative from metropolitan Councils north of the River Torrens; one Elected Member representative from metropolitan Councils south of the River

Torrens; one officer representative from metropolitan Councils south of the River Torrens; and one officer representative from the Adelaide City Council.

The MSRC may appoint its own Chairperson and determine its own meeting procedures. Executive Support Executive support for the Committee will be provided by the LGA. Executive support shall be non voting. Reporting The outcomes of MSRC deliberations will be provided to the Metropolitan Local Government Group. Review The membership and terms of reference of the MSRC will be reviewed from time to time as determined by the MLGG.

2. endorses the MLGG Chairperson writing to all metropolitan councils providing them with a copy of the correspondence from the South Australian Cricket Association (SACA), and encouraging them to support the initiative.

Discussion

Ms Jane Bartlett from the South Australian Cricket Association (SACA) has written to the MLGG Chairperson seeking support from metropolitan councils for a SACA funding application through the Office for Recreation and Sport in order for SACA to offer social cricket opportunities across the state. Further details about the initiative are attached to this report.

The program will be highly dependent on local government as most local cricket grounds are owned by councils and leased out to clubs or organisations. Therefore, it is recommended that the MLGG Chair write to all metropolitan councils seeking their support for this initiative.

Sean Holden from the LGA suggested I contact you  to inform you of a project that is being proposed by the South Australian Cricket Association (SACA).  

I am assisting SACA with lodging a grant application. Funding is being sought through the Office for Recreation and Sport to support SACA to offer social cricket opportunities (Super Cricket) across the State. This Super cricket would be short game formats for which SACA will provide an umpire, ball and any equipment needed, In addition they will create a fun and welcoming environment with music, banners and shelter if needed. This would be a user pays system with each participant or the team contributing a fee to cover the cost of ball and umpire. 

Games will be able to be booked online with flexibility with days and times the grounds are available. 

This program will provide an opportunity for a wide range of groups in the community to enjoy a fun relaxed activity. Community organisations who are supporting this proposal include disability, multicultural, senior, corporate and at risk youth organisations. 

In the first instance the project is planned to be rolled out in the inner metro area followed by outer metro and then to regional areas over the three years of the project.  

This program will, of course, be highly dependent on local government as most cricket grounds are owned by councils and leased out to clubs or organisations. 

Sean suggested that you would be an appropriate person to contact to seek support for this project. In the first instance a letter indicating that the metropolitan councils support this project in principle and look forward to working with SACA to assist with access of venues. You may wish to discuss this further with Sean as he has a good understanding of the potential benefit and opportunity this project provides.
