Morris, Mayor of the City of San Bernardino: Pursuantto the CaliforniaConstitution, the Charter of the City of SanBernardinoincludingArticle VII, Sec. 122 thereof, andCalifornia election laws,the undersigned registered qualified voterof the Cityof SanBernardino, in theStateof California, doesherebygivenoticethat I ama proponent of a recallpetitionand intendto seekyour recall andremoval from the office ofMayor oftheCity ofSanBernardino, California, andto demande l e c t i on o f a s u c c e s s o r in t h a t o f f i c e .

    Thegroundsfor the recallare as follows: MayorMorriswas elected to office in Februaryof 2006and has since that timehas failedto protect the health, safety, and welfareof the residents of the CityofSan Bernardino and demonstrated dereliction to the duties o fhis elected office by failing to veto fiscallyirresponsible votesand fiscally irresponsible programs leadingto the misuseof the City's GeneralFund.MayorMorris's failuresto act have propelled the Cityof San Bernardinointo financial crisis, and have ledto the filing for protection under Chapter 9 of the federal bankruptcy laws by the City.

    Further, Mayor Morris has violated the public trust by repeatedly failing to facilitate consensuswith the members o f the San Bernardino City Council on basic issues o fCity finances, and ignored adviceo f the City's Executive Stafffor the previous two years regarding financial concerns. His action andinaction have led to massive reductions in City services and police and fire personnel, causing an increasein crime rates, businesses leaving the City, and contributed to overall blight within the City.

    Pursuant to Article VII, Section 122 o fCharter o f the City o fSan Bernardino, a copy o f this noticeand proofof service will be filed with the City Clerk o f the City o fSan Bernardino. Within seven (7) daysafter this Notice is filed the officer sought to be recalled may file with the City Clerk an answer, in notmore than 500 words, to the statement of the proponents. If an answer is filed, a copy o f it must be servedon one o f the proponents, personally or by certified mail, within the same seven (7) day period, and i f it isto be published, at the same time shall file with the City Clerk a statement declaring his/her intent that theanswer be published. The answer shall have printed name, signature, and residence address o f the officert o b e r e c a l l e d .
