Drawings and Specifications are available on line beginning Monday, March 4, 2013 at HISD web site http://www.houstonisd.org/page/68148. Click on Doing Business with HISD. Once on the Material Management page select Procurement Services then Proposal Solicitation Download. Follow the prompts to gain access to Proposal Solicitation. Bid security in the amount of 10% of bid amount must accompany each bid in excess of $100,000. No bid may be withdrawn for a period of 60 days after bid opening. HISD reserves the right to limit the number of contracts awarded to/or performed concurrently to any one Contractor if such appears to be in the best interest of HISD. As a prerequisite to a bidder’s qualifying for award of Contract on this Work, except as otherwise stipulated, the bidder must complete each item of the Contractor’s Qualification Statement. This statement shall be submitted with the Bid Form Base Bid. Bidders who have already submitted a Contractor’s Qualification Statement within the last year will not be required to submit the entire Contractor’s Qualification Statement with the bid. Those bidders should submit only the first page marked with the words “ON FILE”. By completing and submitting a bid, the bidder agrees to comply with the requirements of the following paragraph. A bidder who subsequently does not agree to comply with these requirements may automatically disqualify himself from bidding or receiving award of Contract on the project. The responses to the items of the Contractor’s Qualification Statement will be used in evaluation of the bids on the project.

Bidders may be disqualified and their proposals not considered for any of the following specific reasons.

a. Reason for believing collusion exists among bidders.

b. Reasonable grounds for believing that any bidder is interested in more than one proposal for the work contemplated.

c. The bidder being interested in any litigation against the Board.

d. The bidder being in arrears on any existing contract with HISD or having defaulted on a previous contract with HISD.

e. Lack of competency as revealed by the financial statement, experience and equipment questionnaires, or omission of required proposal submittals.

f. Uncompleted work which, in the judgment of the Board, will prevent or hinder the prompt completion of this Work, if awarded.

g. Other information or circumstance which establish reasonable grounds for belief that the bidder is not a “responsible bidder”.

h. Pre-Bid meetings are mandatory.

By entering into a contract with HISD, the bidder agrees that (1) Work on the project will begin upon receipt of the Notice to Proceed, (2) Contractor will participate as a team member in cooperation with the Project Architect and Owner, (3) The Work will be scheduled and coordinated with the Houston Independent School District and, if applicable, the Principal of the campus of the project in order that the Work of this Contract shall not interfere with normal instructional and learning programs of the school, (4) The Contractor will assign a competent superintendent, full time to each project, and that superintendent shall be maintained on the project for the duration of the project, subject only to his continuous employment, (5) The Contractor will furnish and pay for bonds as follows:

• Projects of $25,000 and under No bonds are required

• Projects over $25,000 and up to and including $100,000 Payment Bond only is required

• Projects over $100,000 Bid, Performance and Payment Bonds are required (6) Contractor will carry and keep in full force for the duration of the project, insurance coverage for builder’s risk, workman’s compensation, comprehensive general liability, and automobile liability as required by the General Conditions, as modified by Owner (7) Contractor will certify that the contractor provides workman’s compensation insurance coverage for each employee of the contractor employed on the project and contractor shall provide a certificate from each subcontractor certifying that the subcontractor provides workman’s compensation insurance coverage for each employee of the subcontractor employed on the project, (8) Contractor agrees to abide by all applicable rules and regulations including all requirements as set out in 28 TAC Rule 110.110 and any amendments thereto. Bidding Procedure Proposals will be received only on the Owner’s Bid Forms for the complete project construction as required by

the Contract Documents. Both blank Bid Forms are to be removed from these documents, filled in, and

The Bid Form-Base Bid must be accompanied by a Bid Bond in the amount of ten percent (10%) of the Base Bid amount plus Alternates if required. All bids must be delivered sealed to the above address at or before the time and date set. Bids will

be received at no other place. If Bid is sent by U.S. Mail, it shall be sent Registered Mail. The Owner reserves the right to reject any or all bids, to accept or reject any or all alternates, and to waive any irregularities in any bid received. The Owner further reserves the right to limit the number of contracts awarded and/or to be performed concurrently to any one Contractor if such appears to be in the best interest of the School District. Award may be made to other than the low dollar bidder. Withdrawal of Bids A bid may be withdrawn only upon request by the bidder or his duly authorized representative, provided such request is received by the Owner at the place designated for receipt of bids and prior to the time fixed for the opening of bids. A withdrawal of a bid shall not be effective unless a written confirmation of the withdrawal is received by the Owner at said place within 48 hours after the time fixed for the opening of bids. The Bid Bond will be returned with the Bids if withdrawn in accordance with the above requirements. The withdrawal of a bid does not prejudice the right of the bidder to file a new bid at the time and place stated. No bid may be withdrawn after the time fixed for the opening of bids for a period of 60 days.

Award of Contract The bidder to whom the award of a Contract is made will be promptly notified following Board action. If a bidder, (a) withdraws his bid within 60 days after the date and time fixed for the opening of bids in the Advertisement for Bids, or, (b) fails or refuses to execute the Agreement, or other required forms within ten (10) days after the same are presented to him for signature, or (c) fails or refuses to furnish properly executed Performance and Payment Bonds, if required, and certification of required insurance upon the execution of the Agreement, the Owner may award the Work to another bidder or bidders or may rebid the project. The Bid Bond, if required, is forfeited if bid is withdrawn after the bid opening, or Contract Documents are not executed in accordance with the above requirements. The bidder will be required to: (1) execute Contract and Performance and Payment Bonds, if required due to Contract Amount, (2) submit certification of required insurances, all using the Owner’s forms for such respective purposes, (3) execute and submit Notification of Hazardous Materials Affidavit, if applicable, and (4) execute Forms, Schedules, and Statements required by the District Affirmative Action Plan, and other forms as required. Permits The drawings have been submitted to all regulatory agencies for prior approval of permits. The Contractor shall hire a Master Electrician for the project, if required. Master Electrician shall be responsible for obtaining electrical permits(s) required for project and for taking care of all inspections. Certificate of Compliance The Owner shall pick up the Certificate of Compliance at the completion of the project. Notice To Proceed The Contractor shall not commence the Work under this Contract until receipt of the Notice to Proceed duly signed by the Owner’s representative.

2. Additional Work

The undersigned Contractor agrees to furnish all labor and materials for any additional work (except Subcontractor work) ordered by the Owner, and for which no pre-agreed price has been fixed, for the direct cost of such extra labor and materials plus 15% for overhead and profit. For additional work to be performed by Subcontractors, and for which no pre-agreed price has been fixed, the Contractor agrees to secure a reasonable price from the appropriate Subcontractor(s) [Subcontractor(s) price not to exceed 15% overhead and profit] and provide the work for the Subcontract price plus 5% for overhead and profit. For additional work exceeding $50,000, the amount of overhead and profit is subject to negotiation between the Owner and Contractor.

3. Schedule A. The undersigned agrees to perform the Work within the following number of calendar days from the date of the Notice to Proceed. Total calendar days to Substantial Completion One Hundred Twenty (120) days B. The Contractor shall take necessary steps to complete the Project within the

agreed number of calendar days. The Contractor shall plan and execute the Work in accordance with the requirements set forth in the Special Conditions of the Contract Addendum Governing Physical Conditions and timing of the Work.

C. The Contractor shall prepare and submit a construction schedule for the Project in accordance with the requirements of the applicable Sections of Division 1 of the Contract Documents.

D. No time extensions will be allowed under this contract due to late deliveries, or changes in the Work that do not affect the critical path schedule of the project.

E. The Contractor agrees that if he is awarded the Contract for the Work and fails to complete the Work on schedule, he shall pay the Owner, as liquidated damages, the sum of $200.00 Per day for each calendar day the Work remains uncompleted. Since the exact amounts of the Owner’s losses due to the Contractor’s delay in completion of the Work are not readily ascertainable, the amounts herein constitute agreed upon damages and are not a penalty. At the Owner’s option, any such accrued liquidated damages may be deducted from sums due the Contractor under the terms of this Contract.
