Rule 3 and Rule 11(2) of Chapter 4 Part F of the Rules and Orders of Punjab and Haryana, Volume V,
are amended as under :
“3. A petition for the issuance of a Writ in the nature of habeas corpus or any petition challenging order
of punishment passed in pursuance to any proceedings before a Court Martial or its equivalent tribunal, matters
pertaining to Protection of Life and Liberty (Protection Matters), Parole, Furlough, Pre-mature release
shall be styled as “Criminal Writ Petition”.
11(2). If the Court, on the other hand, is of the opinion that a prima facie case for granting the petition is
made out, a notice, by electronic mode or any other means, in form Cr.W.P. 1 shall be issued calling upon the
person or persons against whom writ is sought, to appear on a day to be named therein to show cause why such
Writ should not be issued and at the same time to produce in the Court, the body of the persons or person
alleged to be illegally or improperly detained then and there to be dealt with according to law. In that case, a
notice also be issued to the Advocate General of the State concerned in form Cr.W.P. 2”.

Chapter 2 Part C of the Rules and Orders of Punjab and Haryana, Volume V, is substituted as under :
“PREPARATION OF PAPER-BOOKS IN LETTER PATENT APPEALS”
1. The paper-book in such appeals shall ordinarily consist of :-
(a) The memorandum of appeal;
(b) A copy of the judgment/order impugned;
(c) A copy of the judgment/order and documents which were before the Single Judge.
No Appeal under clause 10 of the Letters Patent will be received by the office of Registrar (Judicial)
unless it is accompanied by two sets of following :
(a) Memorandum of Appeal (typed/printed);
(b) Certified copy of judgment/order impugned.
In case of exemption, downloaded copy from the official website of this Court or
printed/typed/photocopy attested by the counsel as true copy.
(c) Photocopy of the complete paper-book which was before the Single Judge including the Writ Petition,
Written Statement, Replication/Rejoinder (if any), with Annexures and Documents in two identical sets
attested by the counsel as true copy.
3. In case appeal is filed by the State or any statutory body, it shall mention, as to whether any other appeal(s)
arising out of the judgment in bunch matter and/or earlier judgment relied upon, has been filed or not. If yes, the
status thereof.”
The aforesaid amendment will be effective from 02.12.2019.

Hon’ble The Chief Justice has been pleased to order that :
Every pleading(s) including application(s), annexure(s) etc. in the High Court shall be in English
Language duly typed in black ink on both side of superior quality legal size paper of 80 GSM and above. The
font shall be Thorndale or Times New Roman in size 14 with double space. Margins on the top and bottom of
the page shall be 1.25 inches and 0.75 inch, respectively. The left side and right side margins shall be 1.25
inches. The numbering shall be at the top middle of each page and will run through both sides of the page, in
accordance with Rule 2(a) Chapter-1, Part A(a) High Court Rules and Orders Volume-V.
The certified copy(ies) on both sides of pages shall be permitted to be filed. However, the certified
copy(ies)/photocopy(ies) dim printed/not legible shall also be filed with legible printed/typed copy of
Annexure(s)/Judgment(s)/Order(s).
Index/Application/Appeal/Revision/Petition should be fairly typed and should not be dim printed or
illegible.
NOTE
In order to avoid immediate inconvenience to the stakeholders the filing shall be accepted as per existing
un-amended rule 2(a) Chapter-1, Part A(a) High Court Rules and Orders Volume-V for a period of two months
from the date of notification of amended rule or for such period thereafter as may be extended by Hon’ble the

Rule 15 in High Courts rules & Orders Volume-V, in Chapter 1 part A(a), the same reads as under :
Rule 16 Supply of Advance copy: Where the petition is against the state Government,
Central Government, any local or other authority of any of their officer, the petitioner
shall serve a copy of the petition together with annexures and the application for interim
relief, if any, in advance to the Advocate General’s office, Advocate authorized to accept
service on behalf of the Central Government of any such local or other authority or any
of its officers, as the case may be. The advocate who has been so served shall
acknowledge receipt of the same by endorsement on the original petition, writing his full
name and enrolment number below the signature. Such acknowledgment together with a
declaration in following format shall be filed with the petition.

Quashing Petitions, Sections of the Acts are usually mentioned wrongly in the petitions like Section 61/85 of
NDPS Act, 61/1/14 Excise Act, 25/27/54/59 Arms Act etc. This create anomaly while passing orders on Bail
Applications.
While mentioning Sections, Counsels also mention the number and year of the Act as Sections of the
Act.”

CORRECTION SLIP No. 172 Rules/II.D4 dated 15.03.2018
Rule 6 of Chapter 6 Part B of the Rules and Orders of Punjab and Haryana High Court, Volume-V is
amended as follows :
“6. An Advocate at the time acceptance of his appointment/engagement shall also record his
residential/office address, telephone/cell number, enrolment number and if available, e-mail as well as fax
number on the Vakalatnama/Memo of Appearance/Written Authorization, which shall be address for service
within the meaning of the Rule 5 of Order 3 of the Civil Procedure, 1908.
Provided that when more than one Advocate accepts the appointment/engagement, it shall be sufficient
for one of them to record his address.
Provided further that every Vakalatnama/Memo of Appearance/Written Authorization shall be affixed
with the requisite Advocate Welfare Fund Stamp. In case of urgency, if the Advocate Welfare Fund Stamp is not
available, the filing will be accepted subject to the undertaking furnished by the counsel that the requisite stamp
will be affixed. The matter shall be listed before the Court only after compliance of the undertaking unless
otherwise ordered by the Court. In the case of respondent also where the counsel files Vakalatnama/Memo of
Appearance/Written Authorization, it shall be affixed with the requisite Advocate Welfare Fund Stamp, and in
case of urgency, if the Advocate Welfare Fund Stamp is not available, the same will be accepted subject to the
undertaking as above.”

It has been decided that Advocates, their staff and High Court Employees shall be allowed entry through
turn-stile and DFMDs gates only if they possess RFID Cards. However, those who have not yet collected their
respective RFID cards or do not possess such cards shall be allowed access on gate passes issued from the
relevant pass-counters near Museum. Such passes shall be valid for a maximum period of two weeks at a time
or till the issuance of RFID Cards whichever is earlier. Litigants shall be allowed entry on the basis of
recommendation of their respective advocates or on production of any of the Government approved photo ID(s).
