This natural phenomenon creates beautiulshades o light. The Northern Lights aresomething else entirely! For thousands oyears people in the northern part o theworld have marvelled at the spectaculardisplays that occasionally light up thenight sky. Sailing with Hurtigruten providesthe best chance o experiencing themagical colour show as it changes romlight green to dark purple fickering acrossthe Arctic sky.

An Applied Physicist by proession, Dr John Mason has been actively

Lecturer at the South Downs Planetarium in Chichester, has been

1. YOUR CONTRACT

Your contract is with Hurtigruten Ltd., a companywholly owned by Hurtigruten ASA, on the basis othese conditions and the inormation contained inthe brochure, and shall be governed by English lawand the jurisdiction o the English Courts. You mayhowever choose the law and jurisdiction o Scotlandor Northern Ireland i you wish to do so. When youbook an air package holiday or sailing with us thecontract between us will exist as soon as you oryour travel agent asks us to conrm your booking.We then become responsible to provide you withthe voyage arrangements or air package holidayyou have booked and you become responsible topay or them, in each case subject to these termsand conditions. You will also become responsibleto pay or any additional arrangements made by uson your behal including International Fli ghts notincluded in any air package, optional excursions,travel insurance or other arrangements requestedby you and booked.

When you make a booking you guarantee you havethe authority to accept and do accept on behal oyour party the terms o these booking conditionsand accept responsibility or making all payments tous or all members o the party. We are unable toaccept provisional or conditional bookings. We willsend all documents and other inormation to youand you will be responsible or ensuring that allother members o the party are kept ully inormed.A conrmation invoice which you should check assoon as you receive it will be sent on receipt oyour deposit. I you wish to change or cancel anyarrangements later you may have to pay a namendment or cancellation charge and additionalcosts (see below) which may be as much as thewhole o the original price o your arrangements.

Only one invoice and one set o documents will beissued. No verbal amendments may be made byeither party to these written booking conditions; anychange must be in writing signed by the ChieExecutive o Hurtigruten ASA.

I your conrmed arrangements include a fight, we(or i you booked via an authorised agent o ours,that agent) will issue you with an ATOL Certicateand a conrmation. Upon receipt, i you believe thatany details on the ATOL Certicate or conrmationor any other or any other document are wrong youmust advise us immediately.

I you book your holiday through a travel agentall communication must be through that agent.Please quote your booking reerence number in allcommunications.

You are responsible or complying with any Visa orother entry requirements or you or any o your partywho are not ull European Union Passport Holders.

2. YOUR FINANCIAL PROTECTION

We hold an Air Travel Organisers Licence grantedby the Civil Aviation Authority under number 3584.When you buy an ATOL protected fight or fightinclusive holiday rom us you will receive an ATOLCerticate. This lists the fight, accommodation,car hire and/or other services that are nanciallyprotected, where you can get inormation on whatthis means or you and who to contact i things gowrong. In the unlikely event o our insolvency theCAA will ensure that you are not stranded abroad iyou have booked a package holiday rom thisbrochure and will arrange to reund any money youhave paid to us or an advance booking. For urtherinormation visit the ATOL website at www.atol.org.uk.

I you book arrangements other than an airpackaged holiday rom this brochure your moniesare protected by our bond held with the PSA(Passenger Shipping Association). We are also amember o the Association o British Travel Agents,tour operator class ABTA V7545.

3. PAYMENT

Once you have asked us to conrm your bookingthe total price o the arrangements you havebooked is due and is payable as ollows:

(i) I you book more than 60 days beore yourscheduled departure date a non-reundable deposito 20%.

The balance is due 60 days beore your scheduleddeparture date. No second invoice will be sent.Travel documents will be issued 7 to 14 days prior todeparture.

(ii) I you book less than 60 days beore yourscheduled departure date the ull price is payablewhen you book. Our preerred method o depositpayment is by bank debit card or credit card.Balance payment may be made by cash, bank debitcard, credit card or cheque (providing there is timeto clear it to meet the payment schedule shownabove you should allow 5 working days orclearance rom the time we receive it).

Online BookingsBookings made online that cost less than 800 ormade within 60 days o departure require ullpayment at the time o booking and no reund ismade i cancelled.

Credit Card ChargesNo charge will be made or deposits or balancespaid by Debit Card/Switch/Delta. In line with mostmajor operators we will make a charge o 2%or deposits and balances paid by credit card.

Your booking may be cancelled i you do notmake payment on time (we will not normally sendreminders) and cancellation charges as set outunder I You Cancel (see below) will be payableby you.

4.A PRICES

All Voyage prices shown in this brochure are inpounds sterling and are per person based on ulloccupancy o the cabin accommodation unlessotherwise stated. Single/Sole occupancy o cabinswith more than one berth is at our discretion assingle/sole use o multiple berth cabins will belimited. The price o your voyage or air packageholiday arrangements was calculated usingexchange rates quoted in the Financial TimesGuide to World Currencies on 08.02.2013,Norwegian Kroner (NOK) 8.7236; Euros 1.1783.We reserve the right to change any o the pricesquoted in this brochure although there will be nochange within 30 days o your departure date.

You will be advised o the current price o the

voyage or air package holiday you wish to bookbeore your contract is conrmed. We reserve theright to increase or decrease prices in li ne with anychange in VAT, local and UK taxes, embarkation/disembarkation ees, uel surcharges, exchangerates, security charges or any ees chargeable orthe services included in the cost o your holiday.

Should it be necessary to make any surcharges we willnotiy you o the relevant adjustments by issuing a newinvoice. In any event we will absorb all such increaseswhere they orm less than 2% o the total cost oyour voyage or air package holiday (excluding anycancellation or amendment charges). Only amounts in

excess o 2% will be invoiced to you, together with anadministration charge o 1.00 per person togetherwith an amount to cover agents commission.

In the event that any surcharge means you paying inexcess o 10% more on the original cost o yourvoyage or air package holiday, you will beentitled to cancel your trip with a ull reund o allmonies paid (except amendment ees). Should youwish to cancel under these circumstances youmust exercise your right to do so within 14 daysrom the date o the invoice we send you showing

the increase.

Should the price o your voyage or air packageholiday go down due to changes above by morethan 2% o your holiday cost then any reund duewill be paid to you. Please note that travelarrangements are not always purchased in localcurrency and some apparent changes have noimpact on the price o your travel due to contractualor other protection in place.

For any excursionor other activity you book beore departure orwith which you are assisted in arranging whilston holiday, your contract will solely be with thesupplier o the excursion or activity and not withHurtigruten. We are not responsible or theprovision o your excursion or activity or oranything that happens during the course o itsprovision by the supplier.

5. IF YOU CHANgE YOUR BOOkINg

I you wish to change your travel arrangements aterthey have been conrmed we will do our utmost tohelp but it may not always be possible. Any requestor changes to be made must be in writing by theperson who made the booking or your travel agent.

You will be asked to pay an administration charge o60 per person and any urther cost we incur inmaking this alteration. NB: most airlines will chargea ee or ticket changes. Costs may increase thecloser to the departure date that changes are made.For example, the transer within 60 days odeparture o arrangements involving a scheduledfight will mean the cancellation and re-booking othis fight and a signicant additional charge.

I you change the number o people in your party,the price o the arrangements will be recalculatedor the new party size e.g. this may mean thataccommodation is under-occupied and eachmember o the party may have to pay an increasedprice.

Any increase in price caused by changes you haverequested is not a cancellation charge even thoughit may arise because a member o your party hascancelled. Any change by you to your conrmedarrangements ater departure is in all cases subjectto availability and any relevant costs.

6. IF YOU CANCEL

You, or any member o your party, may cancel yourtravel arrangements at any time. Written noticationrom the person who made the booking or yourtravel agent must be received at our oces.We recommend Recorded Delivery. Cancellationtakes eect the day we receive your letter or email.Since we incur costs in relation to your arrangementsrom the time we conrm your booking you will haveto pay the applicable cancellation charges as shownin the table below (which also applies i we cancelbecause you have ailed to make payments on time- see Payment section) together with the cost oany air are or which we have had to pay at the timeo the booking and will be payable immediately oncancellation.

We reserve the right to change any o the details,and correct any errors in this brochure or invoices atany time. I changes are made beore you havemade your booking we will advise you beore weconrm your arrangements. We reserve the right in

any circumstances to cancel your travel arrangements(or example i a minimum number o participantsor a particular travel arrangement is not reached,we may have to cancel it) and to change airline,aircrat types, vessels and itineraries without liabilityor any subsequent loss. Even ater we haveconrmed your booking we may have to makealterations but we will not cancel your travelarrangements less than 60 days beore yourdeparture except or reasons o orce majeure orailure by you to pay the nal balance in ull.

Most alterations will be minor and while we will doour best to notiy you or your travel agent o anychanges as soon as reasonably possible i there istime beore your departure, we will have no otherliability to you.

Occasionally we may have to make a signicantchange to your conrmed arrangements.

8. COMPLAINT PROCEdURE

I you have a problem during your holiday concerningany service we have conrmed you must inorm thelocal supplier, e.g. your hotelier, or our localrepresentative or agent immediately to enable them totry to resolve the matter. You are also obliged to act ina way so as to minimise any loss. I the issue is notresolved locally it is essential you notiy our head ocein writing, quoting the booking reerence number, atthe earliest opportunity and no later than 28 days ateryour return, to enable any complaint to beinvestigated. It is strongly recommended that youcommunicate any complaint to the supplier o the

Any accident resultingin personal injury, loss o, or damage to luggage mustbe reported to a ships ocer or airline ocialimmediately and written conrmation obtained.We are unable to accept liability or the contents oliterature, DVDs, videos or websites produced by oursuppliers/hoteliers. In the unlikely event that anycomplaint cannot be settled between us you may iyou wish be reerred to Arbitration. This specialscheme, by arrangement with ABTA is administered byCEDR Solve. It applies i your claim is or not morethan 5,000 per person or 25,000 per booking anddoes not involve physical injury or illness. The schemeprovides or a simple and inexpensive method oarbitration conducted privately based on written

documentation and evidence with limited customerliability on costs. Full details are available on request orrom ABTA Ltd, 30 Park Street, London SE1 9EQ,www.abta.com.

9. OUR LIABILITY TO YOU

We accept liability or any damage caused to you orany person in your party by the ailure to perorm, orthe improper perormance o, the voyage or airpackage holiday arrangements when your bookingis conrmed (subject to any changes subsequentlyagreed between us) (but excluding any additionalarrangements or extras whether or not purchased atthe same time as dened in paragraph 4B) unless:

(a) the ailures which occur in the perormance o thecontract are attributable to you or some otherperson in your party;

(b) such ailures in perormance are attributable to athird party unconnected with the provision o theservices contracted or and are unoreseeable andunavoidable or;

(c) such ailures are due to:

(i) unusual or unoreseeable circumstances beyondour control, the consequences o which could nothave been avoided even i all due care had beenexercised; or

(ii) an event which we, or the supplier o the servicescould not oresee or orestall even with all due care.

Our liability, shall in any event be limited to:

(i) the maximum o twice the cost o your travelarrangements, or

(ii) the minimum amount payable in accordance withand/or in an identical manner to:

(a) the contractual terms o the companies thatprovide the transportation and accommodation oryour travel arrangements, which are expresslyincorporated into the contract and also orm theterms and conditions o separate contracts betweenyou and the carrier.

(b) any relevant international conventions, includingthe Warsaw Convention 1929, whether as amended bythe Hague Protocol 1955 or the Montreal Protocol1999, or otherwise, or the Montreal Convention 1999.

Carriage o passengers and their luggage by sea isgoverned by the Athens Convention 1974, and inrespect o carriage by rail by the Berne Conventionand in respect o provision o accommodation by theParis Convention. Any action arising out o carriage byair or sea must be commenced within the two yeartime limit prescribed by the Warsaw and MontrealConventions or the Athens Convention as applicable.Legal proceedings or all claims or which time bars arenot stated in international conventions or are stated inthe Norwegian Maritime Code must be made withinone year rom the date on which disembarkation did,or should have, taken place. The transport opassengers, baggage and vehicles is subject to the

provisions o the Act. no. 39 o 24 June 1994Norwegian Maritime Code, as amended, (NorwegianMaritime Code) and package tours are subject to theprovisions o the Act no. 57 o 25 August 1995Relating to Package Tours (The Package Tours Act).

We are to be regarded as having all benet o anylimitation o compensation contained in these, or anyother conventions, including claims or death, injury,delay to passengers and loss, damage and delay toluggage. You may ask or copies o the transportcompanies contractual terms or the internationalconventions rom our oces at Bedord House,69-79 Fulham High Street, London SW6 3JW.

Under EU law (Regulation 261/2004) you have rightsin some circumstances to reunds and/orcompensation rom your airline in cases o deniedboarding, cancellation or delay to fights, or whichyou must pursue the airline. Reimbursement in such

cases will not automatically entitle you to a reund oany part o your holiday cost rom us. Also, where adelay may result in entitlement to cancel a fight thisdoes not automatically entitle you to cancel orreceive a reund or any other arrangements, eventhough they may have been made in conjunctionwith your fight. I your airline does not comply withthe Regulation you should complain to the CAAConsumer Protection Group on 020 7453 6700,www.caa.co.uk.

10. INdEMNITY

When you book arrangements with us you acceptresponsibility or the proper conduct o yoursel andyour party. I your actions or omissions causedamage to any property in the provision o thecontracted arrangements, or cause delay ordiversion to any fight or other means otransportation, you agree to ully indemniy usagainst any claim (including proessional ees andlegal costs) made against us by or on behal o theowner o such property or the operator o the fightor other means o transportation. The Captain o anaircrat or Master o a ship has authority over theaircrat/ship and passengers at all times when they

are boarding or on board. There will be no liabilityon our part, or that o any supplier, or any reund,compensation, or costs thus incurred. Additionally,we will have the right to recover ull costs resultingrom the incident rom the passenger.

At any port or place we may reuse to embark or maydisembark any passenger who, in the opinion o theships authorized personnel, might be excluded romlanding at urther destinations by local authorities orwho may be suering rom any contagious orinectious disease, or whose presence may bedetrimental to the wellbeing o passengers or crew.In cases o quarantine o the ship, or individualpassengers (passengers may be required to remain intheir cabin or as instructed by authorised personnel onboard i they or any other occupant o theaccommodation presents any symptoms or may beconsidered to put other passengers at risk) we will notbe liable or expenses thus caused and in such casesas above there will be no entitlement to any reund orcompensation and we will have no liability or costsincurred as a result.

Each passenger warrants that they are t to travel.Hurtigruten reserves the right to require any

passenger to produce evidence o the same andcannot accept liability or any situation arising out o aailure to disclose any pre-existing condition ordisability. Passengers with physical or mentaldisabilities or other conditions which may requirespecial assistance, e.g. use o a wheelchair or scooter,or service animal, must advise us in writing beore abooking is made. Passengers who use wheelchairs orwho may require special assistance must beaccompanied by someone who is able to assist themon shore and at sea.

Your specic passport and visa requirements andother immigration requirements are your responsibility

and you should conrm these with the relevantEmbassies and/or Consulates. We do not acceptresponsibility i you cannot travel because you havenot complied with the latest requirements. I youhave made independent travel arrangements youaccept responsibility or joining the ship in goodtime, regardless o any change to the sailing time ordate, or to the itinerary. We are not able to reundmonies paid to us, or any third party acting on ouror your behal, or make compensation or otherpayments where, or whatever reason, you ail to

join the ship. Passengers going ashore areresponsible or re-boarding the ship prior todeparture rom port.

11. INSURANCE

It is a condition o the contract with us that everymember o the booking has travel insurance in orceor the entire duration o the holiday, covering at leastthe cancellation o the booking and providingmedical cover or illness or injury and repatriationwhile overseas. Please provide us with the name oyour insurer, together with their 24-hour emergencynumber when you book or as soon as possible.

12. BROCHURE VALIdITY

This brochure was published in March 2013 and thedetails and prices contained in it are valid romOctober 2013 to March 2014 but may besuperseded by subsequent brochures.

13. dATA PROTECTION

In order to process your booking and ensure yourtravel arrangements run smoothly and meet yourrequirements we, Hurtigruten Ltd, need to use theinormation you provide such as name, address, anyspecial needs/dietary requirements etc. We take ullresponsibility or ensuring that proper securitymeasures are in place to protect your inormation.We must pass the inormation on to the relevantsuppliers o your travel arrangements such asairlines, ships, hotels, transport companies etc.The inormation may also be provided to security or

credit checking companies, public authorities suchas customs/immigration i required by them, or asrequired by law.

Additionally, where your holiday is outside theEuropean Economic Area (EEA), controls on dataprotection in your destination may not be as strongas the legal requirements in this country. We will notpass any inormation on to any person notresponsible or part o your travel arrangements.This applies to any sensitive inormation that you giveto us such as details o any disabilities, or dietary/religious requirements. (I we cannot pass thisinormation to the relevant suppliers, whether in theEEA or not, we cannot provide your booking.In making this booking, you consent to thisinormation being passed on to the relevant persons.)Please note that where inormation is also held byyour travel agent, this is subject to your agents owndata protection policy.
