Employer’s decision to limit employees’ hours, if to avoid ACA

obligations, could violate ERISA In Marin v. Dave & Buster’s, Inc., 15 Civ. 3608, USDC, S.D. New York, a

former employee filed suit alleging that her employer’s reduction of her hours,

which resulted in loss of eligibility for benefits under its health insurance plan,

violated ERISA’s anti-discrimination provision. In denying a motion to

dismiss filed by the employer, the court noted that ERISA prohibits employers

from discriminating against an employee “for the purpose of interfering with

the attainment” of a right to which the employee “may become entitled” under

a benefit plan. The court further held that the issue was the employer’s intent;

the employee has to establish that the employer “specifically intended to

interfere with benefits.” The Court found the plaintiff asserted sufficient facts

to show that intent, if proved at trial.

FLSA Overtime Changes

The much-awaited final ruling was recently released by the U.S. Department of Labor

(DOL) with changes to the overtime rule in the Fair Labor Standards Act (FLSA). Key

changes to overtime rules will take effect December 1, 2016.
