During the “great recession” we experienced a massive rollout of skilled trades-people from the residential construction industry. If you are a builder or remodeler this is no news to
you. In 2010 the HBA convened a group of our past presidents to discuss issues. One agenda item was our thoughts on where the state of our workforce would be after the recession was over. The consensus in the room reflected people’s personal experiences during the 1981-1982 recession; the worst housing recession in everyone’s memory. That recession lasted two years. This recession lasted five to six years. As a result a considerable percentage of our trades-people left the industry. They went off to employment or training in other industries, went back to school, left the workforce entirely, or retired.
Nationally, the residential construction sector has added 106,000 jobs according to NAHB. That is a substantial number but only slightly eats away at the 1,466,000 jobs lost since 2006 in our industry. Locally, the Southwest Ohio Regional Workforce Development Board estimates that to serve all construction jobs (industrial, commercial and residential) in Greater Cincinnati there needs to be 200 new trained construction trades-people added to the payrolls monthly. Your HBA studied the situation specifically in Northern Kentucky and we estimate that we need to add over 2,000 skilled trades-people between the beginning of this year and the year 2020. Currently, we are equipped to train roughly half of those future trades-people.
Your HBA is working to provide the other roughly 1,000 future trades people you need and fulfill the needs of other areas. Since 2009 we have more than doubled the enrollment in the Enzweiler Apprentice Training Program. In fact we have reached capacity at the Building Center and are looking for other options to enroll more individuals in the program because it is needed. We have expanded the program beyond the historical Carpentry, HVAC, and Electric courses; adding plumbing, maintenance and remodeling, welding and this year masonry. During the last school year we enrolled 200 students in the program and had a waiting list of over 40 individuals who we felt weren’t the best applicants for our workforce. The program boasts a 97% job placement rate and a 76% retention rate for two years following the students’ graduation. This is significant and a track record other programs can’t come close to.
Earlier this year the HBA entered into an educational services agreement with the HBA of Lexington for carpentry and HVAC apprenticeship courses in their jurisdiction. Those courses, owned by the HBA of Lexington are beginning this fall. Your HBA is currently in talks with several other HBA’s across the country to help them do the same in the areas of need in their respective jurisdictions. This problem is not a Northern Kentucky problem. It is nationwide.
As we talk with members locally we hear stories of homes sitting without work being done. This means money as the loan clock ticks. We also get reports of starts being held up due to short labor supply. From our large production builders we hear stories where they have specific trades that are in short supply. One builder can’t find carpenters, another can’t find foundation companies, another can’t fin HVAC installers and on and on. What does this mean? It means that there are serious shortages of skilled trades-people across the board.
There are serious headwinds to overcome. For years schools have pushed students towards colleges and away from the trades whether the student was a fit for college or otherwise. High Schools and Technical Colleges have cut their trades courses back or done away with them entirely. Studies show that if a student is not introduced to a career sector prior to the age of 15 then the chances for that student to consider, much less select, that career are very low. Without training opportunities at the High School level it paints a very bleak picture for the ability to fill our workforce gap.
The HBA will continue to do everything it can to fill the workforce gap. We are working with High School counselors, advising workforce groups, creating workforce partnerships, and speaking with elected and appointed officials to make changes that are significant. This work is integral to the HBA’s mission. We will do whatever we can to fill the needs. Subcontractors beware. On July 17, 2014, the Ohio Supreme Court clarified the necessary language to create a “pay-if-paid” clause and to shift the risk of owner’s nonpayment to subcontractors. Frequently,
subcontract agreements base contractor’s payment to subcontractors on the contractor’s receipt of payment from the owner. Two common methods for dictating the payment of subcontractors are “pay-when-paid” and “pay-if-paid” clauses.
Pay-when-paid clauses provide that payment to subcontractors should be within a certain amount of time after the owner pays the
contractor. Courts interpret these as a timing mechanism for payment, rather than a defense to nonpayment if the owner has not paid the contractor. In practice, these clauses merely delay payment to subcontractors for a reasonable time.
Pay-if-paid clauses, on the other hand, provide that payment from owner to contractor is a condition precedent to the contractor’s duty to pay subcontractors. A condition precedent is an event that must occur before a duty or right arises. This means that, if a certain event does not occur, a party’s obligation under the contract is not necessary. In other words, the contractor has a duty to pay the subcontractor only when, and if, the owner pays the contractor.
Prior to the recent Ohio Supreme Court decision, Ohio courts had been strongly construing contracts against pay-if-paid clauses. A recent Court of Appeals case in Ohio provided that simply stating that the owner’s payment to contractor is a condition precedent to the contractor’s duty to pay subcontractors is not enough to constitute a pay-if-paid clause. A successful pay-if-paid clause must, in addition, expressly provide that it is the parties’ intent for the subcontractor to bear the risk of the owner’s nonpayment. If the parties do not expressly shift the risk of the owner’s nonpayment to the subcontractors, Ohio courts will construe the clause to be a pay-when-paid clause. The reasoning behind this holding is simple. The general contractor of a project contracts directly with the owner. Thus, a general contractor should stand in better position to know the owner’s financial stability than subcontractors.
The competing rationale, however, is that the parties are free to negotiate the terms of an agreement and shift risk as desired. In Transtar Electric, Inc. v. A.E.M. Electric Services Corporation, the Ohio Supreme Court focused on the latter rationale, and upheld bare condition precedent language as a pay-if-paid clause. The Court reasoned that stating that the contractor’s receipt of payment from the owner is a condition precedent to the subcontractor’s right to payment does clearly express the parties’ intent to shift the risk of the owner’s nonpayment to the subcontractors. No more language is necessary to convey the parties’ intent.
This recent decision makes it all the more important for subcontractors to carefully review contracts before signing. HBA Northern Kentucky Welcomes: Chad Nichols of Simtech Home SolutionsChad Nichols has been an IT professional since 1989 and Electronics Systems Integration professional since 2006. He has primarily concentrated on general business management, systems design, and sales activities for Audio/Video, Security, and Automation technology solutions during that time. He has designed, sold, installed, and managed in many different environments including residential, restaurant, hospitality, medical, and multi-dwelling. He holds Nuvo, Control4, and HAI product line system design and installation certifications. He attended Purdue University and received a Bachelor of Science degree in Computer Information Systems from Purdue University in 1993; attended the University of Phoenix MBA program, and completed other coursework in the Project Management Institute curriculum. He worked at Intel Corporation from 1993 – 2006 as an IT professional managing employee productivity technology solution deployments. Chad currently resides in Burlington, Kentucky with his three sons Caleb, Jacob, and Elijah.

The Associates Committee out did themselves with this event. First of all, it was a beautiful evening. Twelve pit masters grilled up fabulous ribs, chicken, shrimp and pulled pork. The KY Bluebelles
filled the air with bluegrass music which inspired Mike Phirman, Phirman Construction to get up and dance “The Old Man from the Mountain” shuffle and provide a train whistle during the Orange Blossom Special. Members also enjoyed corn hole due to the efforts of Adam Chaney, Terrace Holdings, organizing the tournament.
We certainly found out who in the HBA makes the best barbeque ribs. Roy Piercefield, Jr., Forge Lumber, took 1st Place with his special barbeque ribs. His pulled pork wasn’t in the running, but it was mighty good! There was a tie for 2nd Place. Ryan Stoffel, Fischer Homes and Doug Roberts, Watson Gravel had the judges licking their lips and wanting more. Thank you to our judges, Bubba Bo, 99.3 Eagle Country; Jim Pfeiffer, Famous Dave’s; Dan Scherff, Roeding Insurance; Jim Stegman, Stegman Construction and Charlie Harvey, Beef O’Brady’s.
