LUBRICATING OILS AND GREASES (PROCESSING, SUPPLYAND DISTRIBUTION REGULATION) ORDER, 1987'

In exercise of the powers conferred by Section j of .the E~~entia!Commodities Act, 1955 (10 of 1955), the Central Government hereby mClkes thefollowing Order, namely :-

1. Short title, extent and commencement.-{l) This Order may be calledthe lLubricating Oils and Greases (Processing, Supply and DistributionRegulation) Order, 1987.

(2) It extends to the whole of India.

(3) It shall come into force on the 1st day of April. 1987.

2. Definitions.-m this Order, unless the context otherwise require~.-

(a) "compete7lt allthority" means any person or Cluthority Cluthori~ed bya StClte Government or a Union territory Cldminlstration bynOhfication in the Official Gazette, to exercise the powers ,lnd toperform the functions of the competent authority under thi~ Orderfor such area as may be specified in the notification;

(b) "lllbricafill,'{ oils alld greases" shall have the meaning assigned tothem in item number ll-A of the First Schedule to the CentralExcise and Salt Act, 1944 (1 of 1944) and shall include anyspeciality oil falling under item nLimber 68 of that Schedule;.

(c) "processor" means any person carrying on or proposing to carryon the business of processi:1g,' manufacturing, blending,compounding packaging, or refining or sale of any lubricating oiland grease and includes his re.plesent"tive or ilgent but notinclude the oil companies specified in Schedule I appended tothis Order;

(d) without prejudice to the meaning assigned to "adultaalicJ//" wlderthe Prevention of Food Adulteration Act. 1954 (37 of 1954), anylubricating oil or grease shall be d.~med to be adulteri\ted if thesame does not meet the specifications declared therefor by till'processor.

3. Restriction on processing and storage of lubricating oils and greases.-No person shall c(\fry on the business of a processor except under and inaccordance with the terms and conditions of a valid licence grilnted to himunder this Order.

4. No person shall carryon the business of processing, manufacturinh,blending, compoUl1ding, packaging, refining, re-refining. selling or tran~portin,l-;any lubricating oil or grease which has been adulterated.

5. Application for grant or renewal of a iicence,-{l) Any person de~iringto carryon the business of a processor shall make an application to thl'competent authority in Form 1 appended to this Order for th~ grant or renewalof a licence, together with a fee of rupees twenty five.

(2) On receipt of an application under sub-clause (1) the competentauthority after making such enquiry as it considers necessary, shall by order inwriting, either grant or renew the licence in Form 2 or refuse to grant or renewthe same.

(3) Where the competent authority refuses to grant or renew a licence itshall record the reasons for so doing and a copy of the reasons so recorded ~hallbe fumished to the applicant.

(4) In granting or refusing to grant or renew a licence the competentauthority shall have regard to matters such as the following, namely ;__

(a) the existing or proposed facilities for manufacturing and tf:stinl;

lubricant and grease;

(b) the availability of base stocks, raw materials and additives for

manufacturing lubricant and grease; and

(c) the types and specifications of lubricant and grease which thl'

processor is manufacturing or proposing to manufacture.

(5) All existing processors shall obtain the licence under this Order withinsix months at the commencement thereof.

(6) An application for the renewal of licence shall be made three monthsbefore the dcHe of expiry of the existing licence.

(7) Every licence granted under this Order shall remain valid, unlessrenewed for a further period of five years, till the end of five years from thedate of its issue or till it is cancelled Ul1der Clause 6, whic.hever is earlier.

6. Cancellation of licence.-The competent authority milY, withoutprejudice to any other action that may be taken against a processor under theEssential Commodities Act, 1955 (10 of 1955), by order in writing cancel alicence for breach of any of the lerms and conditions of the licence and a copyof the order shall be furnished to the processor:

Provided thilt no licence shall be cancelled under this clause unless theprocessor has been given reasonable opportunity of being heard in the matter.

7. AppeaL-any person ilggrieved by iln order made by the competentauthority under Clause 5 or under Clause (, may, within thirty dilY~ of the

receipt or a copy of the Order by him, prefer an appeal to the State Governmentand the State Government may after giving the applicant an opportunity ofbeing heard confirm, reverse or modify such order.

8. Power of entry, search and seizure.--{l) Any police officer not belowthe rank of an lnspector or any other officer of Government of r~ equivillentor higher thereto, authorised in this behalf by the Central Government or a StateGovernment milY, with a view to securing compliance with this Order or tasatisfying himself that this Order or any order made thereunder has beencomplied with,

(a) enter and search any place, permises, vessel or vehicle which theofficer has reason to believe, has been, or is ilbout to be, used forthe contravention of this Order.

(b) seize-

(i) stock of lubricating oils, greases "nd processing equipments.

(ii) any package, covering or receptilcle in which lubric(\ting oibaI1d greases are found, and

(iii) any animal, vehicle, vessel or other cOlweYilnce used incarrying lubricating oils and greilses, '.vhich the officer hasreason to believe has been, or is being or is about to be.used for the contravention of this Order.

(c) send samples of any lubricating oil or grease seized under sub-paragraph (i) of paragraph (b) to any of the laboriltoriesmentioned in Schedule II appended to this Order, far analysiswith a view to knowing the nature and extent of adulteration.

(2) The provision of Section 100 of the Code of Criminal Procedure, 1973 (2

of 1974) relating to search and seizure shall, as far as may, apply to searchesand seizures under this Order.

9. Power of Central Government to issue directions.- The CentralGovernment may, from time to time, by general or special order, issue to anyprocessor such directions as it consider necessary regarding the processing,storage, transport and disposal of lubricant and grease and upon the issue ofsuch directions, such processor shall be bound to comply therewith.

Tcnns and Conditions of the Licence

1. The licence is issued subject to the provisions of the Lubricant Oils andGreases (Processing, Supply and Distribution Regulation) Order, 1987.

2. The holder of the Licence shall maintain correctly and completely suchrecords as are necessary for verifying the particulars given in t~eapplicationform of the. applicant and this licence granted to him.

3. The holder of the licence shall permit an officer authorised by thecompetent authority under the provisions of the Lubricating Oils and Greases(Processing, Supply and Distribution Regulation) Order, 1987 to inspect theplaces where processing of lubricating oils or greases is being undertaken, shC\llfurnish samples thereof shall permit on demand by such officer such records ordocuments in his possession or under his control and shall allow to enter orsearch any premises and seize any article to which this order applies.

(a) in Clause 2, .

(i) for sub-clauses (b) and (c), the following stIb-dauses shall

be substituted, namely ;__ ,

"(b) 'lubricating oil or gre£lse' means any of the products

classifiable under sub-heading Nos. 2710.32, 2710.60,2710.70, 2710.80, 2710.93, 2710.94, 2710.95, 2710.99 orheading No. 3403.00 of the Schedule to the CentralExciS€ Tariff Act, 1985 (5 of 1986);

(c) 'processor' means any person carrjing on orP'~OP9si;1g.

"to carry on the business' of manufacturing; 'bltiiiding,packaging, re-refining sale or resale of any lubricatingoil Or grease and includes a representative or agent ofsuch processor but does not include the oil companiesspecified in Schedule I appended to this Order;"

(ii) in sub-clause (d), for the words 'declared therefor by the

processor', the words 'declared by or applicable to theprocessor"

shall be substituted;

(b) for Clause 4, the following shall be substituted, namely :_

"4. Prohibition of business of lubn'Ci1iillgoil or grense.-No personshall carryon the business of mar\ufacturing, blending,packaging, re-refining, selling or transporting for sale anylubricating oil or grease which has been adulterated.";

(c) in Clause 5,-

(i) for sub-clauses (i), the followingsub-clauses shall besubstituted, namely ;__

"Any person desiring to carry on the business of a processor,other than a seller or a re-seller, shall make anapplication in Form 1 and every seller or -re-sellershall make an application in Form I-A specified inSchedule I appended to this Order to the competentauthority, together with a fee of n:pees hventy five.";

(ii) in sub-claU$€ (2), after the word and figure "Fonn 2",the words, figure and letter "or, as the case may beForm 2-A specified in Schedule I appended to thisOrder" shall be illserted;

(2) Every processor who is carrying, on or proposing to carryon the business of re-refining of lubricating oil or grease,-

(a) If such-refining is being undertaken other than undera licence issued under Section 15 of the Bureau ofIndian Standards Act, 1986 (63 of 1986), shall confonnto the Standard Mark specified Ul1der the said Act;

(b) Ii such-refining is being undertaken other than undera licence referred to in sub-clause (a), shall make adeclaration as to the specification of such lubricatingoil or grease and shall coruonn to such specifications :

Provident that the requirements of sub-clause (b) shall notbe applicable to the re-refiners of re-refined base oil ifsuch re-refiners sell such base oil only to major usersor to one of the oil companies specified in Schedule 1.

ExplaMat iort.-For the purpose of this sub-clause, 'major user'means any institution which acquires lubricating oil orgrease directly from one of the oil companies and gets thewaste oils re-refined by one of the re-refiners registeredunder this- Order for its own use";

(e) in Clause 6,-

(i) for the marginal heading the following shall be substituted,namely :-

"Suspension or cancellaticn of licence.";
