TIMES OF ARRIVAL THE DAY PRIOR TO SALE: 2.00 pm The Market opens to receive Cattle 6.30 pm All Cattle travelling to Market on the day prior to Sale must arrive by this time. 8.00 pm All Persons and Livestock Vehicles must vacate and leave the licensed premises (the market)

by this time. THE DAY OF SALE: 6.00 am The Market will be open 11.00 am The Sale will commence 5.30 pm It is hoped all Cattle will be removed from the Market premises by this time. Anyone unable

to comply with this requirement should make contact with a member of Wright Marshall Staff who will advise as to alternative arrangements.

REGULATIONS & CONDITIONS OF ENTRY 1. The Sale is held subject to the Regulations as printed in this notice and also to the LAA Conditions of Sale

and the Auctioneers General Conditions of Sale. 2. All entries must be made on the official entry forms and must be completed throughout. Entries must be

accompanied by the entry fee and the relevant Longhorn Cattle Society Registration Certificates. Entries without the relevant fees and certificates will not be accepted. The Society reserves the right to refuse or restrict entries if it is felt necessary, at the closing date for entries.

3. Order of Sale - Cattle will be sold in age order. Females, then Males, then Unregistered Cattle and Stores 4. Cows no longer suckling their Calves must have been weaned at least 2 weeks prior to Sale. 5. Vendors shall have the right to place a reserve price on any or all of their cattle. This must be notified to

the Auctioneers in writing, preferably before the commencement of the Sale and will be treated as a reserve and not a guide.

6. All transactions either by Auction or Private Treaty following the Sale must be passed through the

7. All registered cattle will be sold in guineas with a commission rate of 5%. 8. The Society reserves the right to restrict entries, if it is felt necessary at the closing date for entries. 9. PRE-MOVEMENT TESTING all cattle over 42 days of age must have passed a TB Test within the previous

60 days of the movement 10. It is recommended that all cattle forward for sale are either in a CHeCS recognized Health Scheme or are

individually tested for Leptospirosis, BVD, Johnes and IBR. 11. Each animal forward at the Sale must be exposed for sale by auction before any private sale shall be

permitted or recognized by the Society or the Auctioneers. 12. The Vendor must present for Sale by Auction any animal catalogued for Sale. Where animals catalogued

cannot be brought forthe Sale. Should a substitution be made then a Veterinary Certificate should be submitted for the withdrawn animal and a £20+VAT (£24) fee will be payable for the entry of the substitute animal.

13. Any vendor not bringing cattle for Sale on the day should provide a veterinary certificate for the absent animal and or will be subject to a fine of £20+VAT (£24) when entering a subsequent Sale. The Society shall reserve the right to refuse entries at subsequent Longhorn Sales.

14. A transfer fee of £15+VAT (£18.00) shall be paid by both the vendor and the purchaser. Pedigree certificates will only be transferred on payment of the transfer fee.

VENDORS: Please Ensure:

* Your vehicle is cleaned and disinfected before loading stock. * The Wright Manley Entry Card is completed and travels with the animals. * That all Passports and CTS Documents TRAVEL WITH the animals. * That all Persons travelling with the stock are wearing suitable clothing, i.e. Wellington boots, waterproof

leggings and/or a boiler suit/smock or waterproof top. All clothing to be clean. PURCHASERS & SPECTATORS: * The car park for all non-livestock carrying vehicles will be in the area around the Calf Shed and the only

access for the market will be via the entrance nearest The Wild Boar. * All persons including ladies and children to wear suitable clothing. All clothing to be clean. Anyone handling

stock should wash their hands after handling stock * Disinfection points will be provided around the market which must be used regularly, particularly when

leaving cattle penning areas. * You need only C & D your stock trailer or lorry in the market if you are taking stock out again. If you do not

clean out you will have to complete a C & D exit form indicating when and where you will C & D before carrying livestock again. All rules will have to be rigidly enforced or a licence will be at risk of cancellation.

Failure to comply with the above will result in stock being refused entry to the Market. NOTE: Please note that the entrance for all stock will be at the entrance nearest The Wild Boar. No entry for any

vehicles or people will be permitted at the Main Entrance by the railway bridge.

ANIMAL TRANSPORT REGULATIONS From 5th January 2007 New Regulations came into force affecting anyone who transports live animals. Anyone moving animals more than 65 kilometres (40 miles) will require a LICENCE. For the majority of farmers who are likely to fall in this category, they will ne

suspended and a copy of this will be required to be carried whenever stock are moved. The distance of 65km is defined as the travelling distance, not as the crow flies. Application forms are available at the Beeston Office or from the Welfare in Transport Team, State Veterinary Service, Block C, Government Buildings, Whittington Road, Worcester WR5 2SU Tel. 08456 038395 Email [email protected] If this applies to you, application must be made as soon as possible and you should keep a copy of the application form to carry with you if you did not receive your licence before 5th January.

DOUBLE TAGGING The regulations with regard to Cattle identification clearly state that all Cattle entering the market born after the 1st January 1998 MUST HAVE 2 EAR TAGS. Cattle WITHOUT two tags born after that date CANNOT BE SOLD and will be licenced back home by Trading Standards, and will trigger the 6 day rule.

SALE OF GOODS BY AUCTION – GENERAL CONDITIONS1. Lots1.1 The Buyer is deemed to have inspected any lot he buys and accordingly the lots are not sold by sample.1.2.1 The Buyer admits that he has not been included to bid by any description representation measurement or statement made by or on

behalf of the Seller and agrees that (apart from the agreed price and any matter confirmed in writing by the Auctioneers) theseConditions constitute the whole of the contract.

1.2.2 The Auctioneers act only as agents for the Sellers and will not be liable to the Buyer in any circumstances and have no authority tomake any such descriptions representations measurements or statements.

1.3 No warranty is given or implied as to fitness for purpose or the quality of lots sold.2. Sales2.1 The highest bidder for any lot shall be the Buyer and the contract shall be concluded on the fall of the hammer.2.2 The Buyer may not retract his bid in any circumstances.2.3 On the fall of the hammer the Buyer will immediately give to the Auctioneers his full name and address and if required will pay the

full purchase price.3. Payment3.1 In any event all lots purchased must be paid for in full on the day of sale. No lot must be removed from the sale premises until it

has been paid for in full.3.2 Cheques will be accepted in payment only with references satisfactory to the Auctioneers.3.3 From conclusion of the contract any lot will be at the Buyer’s risk in all respects.3.4 This market is not required to comply with the requirements of the members accounts regulations of the Royal Institution of

Chartered Surveyors. No monies paid to this market are covered by any scheme for the protection of clients money operated by theRoyal Institute of Chartered Surveyors. This notice is published in accordance with the requirement of the Royal Institute of CharteredSurveyors from whom a more detailed explanation can be obtained by writing to the Standards and Practice Department, The RoyalInstitute of Chartered Surveyors, 12 Great George Street, Parliament Square, London, SW1P 3AD.

3.5 The Buyer shall not withhold payment for any Lot by reason of any right of set off or counter-claim which the Buyer may have orallege to have or for any reason whatever against the Seller or the Auctioneers.

4. Disputes4.1 In the event of dispute as to bidding the Auctioneers may either put up and re-offer for sale the lot or lots in question or may decide

the dispute.4.2 Any other dispute arising in any way out of any lot or its sale shall be decided by the Auctioneers.4.3 The Auctioneers’ decision in any such case shall be final and binding in all respects.5. Title to and Removal of Lots5.1 All lots purchased shall be removed on the date of sale at the Buyer’s expense.5.2 The Buyer will be responsible for any damage caused in the course of such removal to other lots or to any part of the premises on

any part of which the auction is held regardless whether such damage is caused by the Buyer, his employees or agents or otherwiseand whether such damage is a result of negligence or otherwise. Notwithstanding Condition 3.3 and the removal by the Buyer ofany Lot, title to such Lot shall not pass to the Buyer until: -

5.2.1 The Buyer shall have paid the Purchase price in full and5.2.2 No other sums whatever shall be due from the Buyer to the seller or the Auctioneer.5.3 In respect of any such damage if so required by the Auctioneers the Buyer will pay the cost of repairing all such damage (as

estimated by the Auctioneers whose estimate shall be final and binding) before removal of any lots. Until such payment is madethe Buyer grants the Seller and/or the Auctioneers a lien over any lots bought by him.

6. Conduct of the Auction6.1 The Seller may offer any lots subject to a reserve price.6.2 The Seller or the Auctioneers may: -6.2.1 Bid up to such reserve price.6.2.2 Withdraw from sale any lot without disclosing a reserve.6.2.3 Rescind any sale within 3 hours of the final lot being sold if the lot has been sold under any reserve.

In the event of such rescission the purchase price or any part already paid by the Buyer shall be repaid but the parties and theAuctioneers shall be under no further liability to each other.

6.3 The Auctioneers may refuse the bid of any person without giving a reason and may regulate bidding as they see fit.6.4 No bidder may advance less at a bid than the sum named from time to time by the Auctioneers.7. Neither the Seller nor the Auctioneers shall be liable in any way for any loss or damage on any part of the premises on any part of

which the auction is held.8. In the event of breach by the Buyer of any of these conditions the Auctioneers may rescind any contract with the Buyer and put up

and re-sell any lots the subject matter of such contract and the Buyer will immediately pay to the Auctioneers as a liquidateddemand any deficit arising on the second sale.
