APPENDIX DLETTERS OF AGREEMENT

WITHOUT PItEJiJDICE TO OR WAIVER OF THE RIGHTS OFTHE BOARD OF SCHOOL DIRECTORS UNDER P.E.R.A.

November 22, 1983

Neshaminy Federation of TeachersAttn: Mr. John Rock, President

Dear Mr. Rock:

Please be advised that this letter of intent and the attached languageregazding "Teaching Load" and "Student~I'eacher Ratios" have been approvedby the Board of School Directors, contingent as above set forth.

With regard to the attached language entitled "Teaching Load" and"Student~I'eacher Ratios", it is the express intention of the parties hereto thatthis letter of intent, although not part of any Collective Bargaining Agreementand not to be refereed to 'n any such Agreement and not constituting a waiverof the Board's rights under P.E.R.A., shall be enforceable as provided herein.Furthermore, any disputes concerning the attached language regarding saidtwo items shall not constitute "grievances" as defined in any current or futureCollective Bargaining Agreement between the pazties nor shall same besubject to the grievance procedure as provided therein. The Boazd willinclude this letter and the attached language regarding said two items withinthe resolution adopting the final Collective Bazgaining Agreement andlikewise include same as the last pages of any copies of said Agreement whichit publishes.

If any dispute concerning compliance should arise during the three-yearterm of the Collective Bazgaining Agreement dated November 22, 1983 orwithin the additional three yeaz period of non-negotiation or renegotiation asprovided in the attached language concerning "StudentlTeacher Ratios" and"Teacher Load" the Federation may appeal same in writing to theSuperintendent or his designee who shall be required to schedule a hearingdate within fifteen (15) working days of receipt of said appeal and thereafterto respond in writing within ten (10) working days after hearing the matter.Any such appeal filed by the Federation must be initiated within a sixty (60)working day period after the alleged event giving rise thereto or within sixty(60) working days after the Federation knew of the event giving rise to theappeal, whichever is later. If same shall not resolve the issue, the Federation

shall be entitled to present the issue for resolution by filing within fifteen (15)working days after receipt of the Superintendent's response a written demandfor voluntary labor disposition with the American Arbitration Association inwhich case the issue shall then be resolved in accordance with the rules ofsaid Association.

All of the above time limits shall be of the essence.

All fees, expenses and costs of the American Arbitration Association andthe arbitrator shall be paid equally by the Federation and the School Board.

STUDENT/TEACHER RATIOS ~

The Board recognizes that the studendteacher ratio is an important aspect ofan effective educational program.

1. In staffing kindergarten, if any such class shall exceed 26 students byOctober 1, 2002, a new class shall be created. Effective July 1, 2003,that number shall be reduced to 25 students. Effective July 1, 2005, thatnumber shall be reduced to 24 students. Effective July 1, 2006, thatnumber shall be reduced to 23 students. Effective July 1, 2007, that

- number shall be reduced to 22 students.

2. In staffing Pre-first grade, if any such class shall exceed 19 students byOctober 1, 2002, a new class shall be created. Effective July 1, 2004,that number shall be reduced to 18 students. Effective July 1, 2006, thatnumber shall be reduced to 17 students.

3. In staffing grade 1, if any such class shall exceed 26 students by October1, 2002, a new class shall be created. Effective July 1, 2004, thatnumber shall be reduced to 25 students. Effective July 1, 2(}06, thatnumber shall be reduced to 24 students.

4. In sting grade 2, if any such class shall exceed 27 students by October1, 2002, a new class shall be created. Effective July 1, 2004, thatnumber shall be reduced to 26 students. Effective July 1, 2006, thatnumber shall be reduced to 25 students.

5. In staffing grade 3, if any such class shall exceed 28 students by October1, 2002, a new class shall be created. Effective July 1, 2004, thatnumber shall be reduced to 27 students. Effective July 1, 2006, thatnumber shall be reduced to 26 students.

6. In sting grades 4 and 5, if any such class shall exceed 29 students byOctober 1, 2002, a new class shall be created.

7. In staffing grades 6, 7, and 8, the Boazd will provide that number ofclassroom teachers on a district wide basis produced by dividing thenumber of such students by 18. All certified staff shall be considered '~classroom teachers for this purpose except persons assigned as thedesignated reading specialist, librarians, nurses, special education '!teachers and guidance counselors. In the event that grade 6 students are ~returned to the elementary level, the class size maximum for grade 6shall be the same as grades 4 and 5.

18. In staffing grade 9, the Board will provide' that number of classroom

teachers on a district wide basis produced by dividing the number ofstudents therein by 20. All certified staff shall be considered classroomteachers for this purpose except persons assigned as the designated

reading specialist, librarians, nurses, special education teachers andguidance counselors.

9. In staffing grades 10, 11, and 12, the Board will provide that number ofclassroom teachers on a district wide basis produced by dividing thenumber of students therein by 20. All certified staff shaIl be consideredclassroom teachers for this purpose except librarians, nurses, guidancecounselors, and special education teachers.

10. In staffing special education classes, the Board shall comply with thefollowing caseload and class size limits. For the purpose of clarification,caseloads are the first number in each category. The class sizemaximums are in parentheses. The cumulative total of students, to beseen in a teaching day by a high school or middle/elementary schoolteacher, is defined in the asterisks' section. Under no circumstancesshall the caseloads, the maximum class size numbers, or the maximumnumber of students to be instructed per teacher per day, be exceeded.

*At the elementary and middle school levels, the maximum class sizeshall be 12 students. The total number of students that may beinstructed in a day is an 8 student average per period, for a total of 40students in a full teaching day. In other words, if a middle schoolspecial education teacher teaches five periods and sees the same studentthree of those five periods, that individual student counts as 3 studentstowards the 40-student maximum for that day.

**At the high school level, the maximum class size shall be 14 students.The total number of students that may be instructed in a day is a 10student average per period, for a total of 50 students in a full teachingday. In other words, if a high school special education teacher teachesfive periods and sees the same student four of those five periods, thatindividual student counts as 4 students towards the 50-studentmaximum for that day.

11. Representatives of the Federation will be provided the opportunity toreview all class schedules, including all district special educationschedules, with the building Administrators of the high school, themiddle schools and the elementary schools, prior to the opening ofschool each year. The purpose of this review will be to assure the

proper application of the agreed class size numbers language and theequitable allocation of student numbers among the scheduled classes.

Anything in this Agreement or in any law or regulation now orhereinafter adopted to the contrary notwithstanding, this paragraph shall notbe subject to negotiation or renegotiation by either party in any mannerwhatsoever until after July 1, 2008.

TEACHING LOAD

Except as provided herein, secondary teachers of Social Studies,

Mathematics, English, Science, Foreign Language, Business, Health and

Physical ~ Education, Technology Education, Family Living, Music and Art

shall not be assigned more than 25 instructional periods per week. Secondary

teachers of Science Lab courses shall not be assigned more than 28 `'

instructional periods per week. High School newspaper and yearbook

advisors shall not be assigned more than 28 instructional periods per week.

The reduction of teaching loads in the above mentioned areas resulting

from this Agreement shall not adversely affect the class sizes of the subject ~'

areas regardless of the student/teacher ratio provisions of the Agreement. The

District's established practice of limiting class size at the secondary level in

regular education classes to no more char thirty-five (35) students shall be

continued.

In the event that scheduling by the district of the above disciplines

indicates a need for additional instructional periods because of course

enrollments, volunteers from the staff to teach said additional instructional

periods will be solicited. Such volunteers, upon acceptance, will be offered

adjustments in their respective non-teaching duties.

Anything in this Agreement or in any law or regulation now or hereinafter

adopted to the contrary not withstanding, this paragraph shall not be subject to

negotiation or renegotiation by any party in any manner whatsoever until after

July 1, 2008.

committed to utilizing the established regular elementary class size numbers as a guideline for tlu class

Dear Mr. Callahan:

"ibis letter of understanding shall set forth the Dis~ict's practices with regard to the preparationtime of bargaining unit members within the Dis~ict elementary schools. Elementary preparation periodsare defined in Section 10-32 of the Collective Bargaining Agreement between the Neshaminy Federationof'feachers and the Neshaminy School District. It has always been understood that the preparation time isunencumbered unless there are emergency situations It is also my understanding that the elementarypreparation time has been defined as the thirty minutes following the lunch period. In addition, the periodoC time that students are in special subject (~r~ music, physical education, library), except (or teachers newto the district for not more than one marking period, is unencumbered.

It is to be noted drat the unencumbered preparation time has been used by the cert~Ced staff inprofessional self-directed activities. llu purpose oC this letter is to recognize Section 10-32, whichaddresses the preparrtion period. It is also niy understanding that activities such as grade level meetings,parent conferences, observation evaluation conferences, class meerings, and other such acti~•ities have beenheld during the above mentioned preparation rimes and it is ehe practice of the school district that teachersmay continue with those activities on a voluntary basis. These examples are characteristic of activities thatoccur during the preparation time for secondary teachers. Alain, this letter of understanding clarifies thedistrict prrctice with regard to Section 10-32.

Re: Medical Opt-out Agreement

Upon providing documentary evidence of the possession of health insurance that issubstantially equivalent to the provided herein, an Employee may elect to waive theDistrict's traditional group hospitalization, medicaUsurgical, and major medicalplans under the following conditions:

1. The waiver shall be in writing and shall be effective as of the first day of the neatmonth following the District's receipt of the notice; and

2. Upon receiving that notice, the waiver shall remain in e[i'ect, unless theEmployee chooses to revoke the waiver the next opt-uut period (July 1"anniversary date) or bas a lifestyle change and chooses to revoke the waiver.Lifestyle changes shall be defined as: marriage, divorce, birth or adoption of achild, death of a spouse or qualifying dependent, starting or ending of a spouse'semployment, or loss of the substitute health insurance; and

3. For each full month that the waiver is in effect, the Employee shall monthlyreceive 37% of the District's savings attributable to that election, i.e. the grosscost of providing the health insurance as provided in Section 8-1 of the CollectiveBarQainin~ Agreement. The money shall be paid to the Employee in thepaycheck next following the completion of the month for which the revocationwas is effect and shall not be considered compensation for pension deductionpurposes; and

4. Such waiver shall leave unaffected the insurance to which the Employeecontinues to be entitled under all Sections of Article VIII of the CollectiveBarQaininQ Agreement; and

5. No other employee group and/or individual shall exceed the percentage and/ordollar amounts as established by this Agreement.

Effective June 30, 2008, the Medical Opt-out Program Agreement shall be removedfrom the Collective Bargaining Agreement.

Re: In-Service Days

The purpose of this letter is to memorialize the existing practice with regard to the utilization of

the current in-service days provided by the 1997-2002 collective bargaining agreement as well as to

describe the utilization of the additional in-service day provided by the terms o£ the new 2002-2008

Collective Bargaining Agreement. We agree that this practice shall continue for the duration of the 2002-

2008 Collective Bazgaining Agreement.

With regazd to the existing in-service days, we agreed that one of those in-service days shall be

utilized as a "trade-off' day by which the certified staffinember elects to attend a district sponsored

workshop during the summer or elementary classroom teacher elects to conduct pazendteacher conferences

in the evening in exchange for being released on the day before Thanksgiving. One of the remaining days

shall be utilized as a site-based building day in which a committee of the certif ed staff determines the

appropriate use or uses of that day in then particular building.

An additional in-service day is being added as of July 1, 2002. We agree that the new day shall be

utilized by the cezteFied staff in one of two fashions — either as another "trade-off' day in which certified

staff will attend a district sponsored workshop in the summer in exchange for an additional release day to

be determined or as an additional site-based bui]ding day. The election of which option [o utilize is to be

made by the certiFied staff member.
