DEAR MEMBERS :

Happy New Year and welcome to the 75th anniversary year of the FCBA! We had a wonderful 2010, including a great series of lunches with Senators Mark Begich and Mike Johanns, FCC Commissioners Mignon Clyburn and Meredith Attwell Baker, as well with Assistant Secretary Larry Strickling, the inaugural (and standing room only) Distinguished Lecturer luncheon with Dean Erwin Chemerinsky, bountiful CLEs, a “most interesting” Chairman’s Dinner, and the launch of our Pay It Forward initiative. I attended the December 17 graduation ceremony for our Pay It Forward partner Byte Back, and came away further convinced that the tremendous resources of the FCBA can transform the lives of hundreds of Washingtonians trying to enhance their digital literacy and return to the workforce.

I’m proud to say that the pace – and more importantly, the quality – of our programming doesn’t abate in the new year. This month, we have partnered with the Federal Energy Bar Association to host a breakfast with our own Scott Blake Harris, general counsel at the Department of Energy, on January 18 at the Capital Hilton. And speaking of anniversaries, on February 15 at the Capital Hilton, FCC Commissioner Michael Copps will keynote a luncheon to assess the Telecommunications Act of 1996 on its 15th birthday.

In coming months, we’ll feature our spring legislative reception and of course, the 2011 FCBA Annual Seminar on April 29 through May 1 at the Nemacolin Woodlands Resort in Pennsylvania. We already have a strong line up of Commissioners and other speakers on board and a few new programming surprises, so register right away. And look for some special events in the coming months that will highlight the FCBA in its diamond anniversary year.

This month, the Pay It Forward spotlight will shine on Alison Minea, who has demonstrated the Pay It Forward ideals of service, dedication, and generosity of spirit. Alison, who serves as Corporate Counsel at DISH Network, is very active in the FCBA, notably in partnering with Ryan Wallach of Willkie Farr & Gallagher, to develop, plan, and execute the Pay It Forward kick-off event at the Arena Stage this past November. She will also be serving as a tutor for students enrolled in Byte Back’s program this year. In addition, Alison serves on the steering committee for the Crittenton Services High Tea 123rd Anniversary event this April. Crittenton Services of Greater Washington focuses on “pregnancy prevention, healthy relationships, teen parenting and goal setting that helps teen women create successful lives.” For all of these efforts and her continued commitment to the FCBA, Alison has been selected to bask in this month’s Pay It Forward spotlight!

I believe that 2011 will be a year of growth and of excitement for our bar association. And, with the 75th anniversary, we have an opportunity to reflect of how far we have come as a legal community and as an industry. Here’s to another 75 wonderful years! Wednesday, January 12, 6:00 – 8:15 p.m.Major International Privacy Developments: Impacts on Multi-National and Globally-Networked Environments Presented by the International Telecommunications and Privacy and Data Security Committees The FCBA International Telecommuni-cations and Privacy and Data Security Committees will be co-hosting a CLE on Wednesday, January 12, 2011 from 6:00 – 8:15 p.m. at Bingham McCutchen LLP, 2020 K Street, NW. This seminar will address the major international privacy laws and policies that impact all companies with a multi-national structure or business model. These companies must navigate myriad privacy laws ranging from the broad EU privacy laws to the often more patch-worked laws in Asia and the Americas, including the APEC Privacy Framework. This CLE will include two panels: one focused on recent international data privacy policy and enforcement developments (including the revision of the EU Data Protection Directive, the implementation of the APEC Privacy Framework, and the U.S. FTC’s enforcement practices), and the second will examine case studies of specific cross-border privacy problems facing multi-national companies (including issues arising

from transferring data to offices around the world, using third party cloud computing service providers, behavioral advertising, and data transfer issues that result from government subpoenas and cross-border investigations).

The second panel will feature stakeholders from the private sector, including advertisers and content providers, consumer groups, and carriers who will respond to the government panel and raise additional concerns/issues about privacy and best practices.

Topics will include the potential for “baseline” privacy legislation or regulation, the strengths and weaknesses of industry self-regulation, intergovernmental efforts in regulation and enforcement, and potential expansions of Fair Information Practice Principles, with a focus on privacy issues unique to the mobile space such as location-based data collection, and mobile behavioral advertising notice and consent.

Michael J. Copps is the senior member of the Federal Communications Commission. He began his service in 2001 and was sworn in for his second term in 2005.

Mr. Copps served from 1998 until January 2001 as Assistant Secretary of Commerce for Trade Development at the U.S. Department of Commerce. In that role, Mr. Copps worked to improve market access and market share for nearly every sector of American industry, including information technologies and telecommunications. Mr. Copps devoted much of his time to building private sector-public sector partnerships to enhance our nation’s success in the global economy. From 1993 to 1998, Mr. Copps served as Deputy Assistant Secretary for Basic Industries, a component of the Trade Development Unit.

Mr. Copps moved to Washington in 1970 to join the staff of Senator Fritz Hollings (D-SC) and served for over a dozen years as Administrative Assistant and Chief of Staff. From 1985 to 1989, he served as Director of Government Affairs for a Fortune 500 Company. From 1989 to 1993, he was Senior Vice President for Legislative Affairs at a major national trade association.

Mr. Copps, a native of Milwaukee, Wisconsin, received a B.A. from Wofford College and earned a Ph.D. in United States history from the University of North Carolina at Chapel Hill. He taught US history at Loyola University of the South from 1967 to 1970.

He and his wife Beth have five children and six grandchildren.

Privacy and Data Security Committee – New Privacy Mentor/Mentee Program The Privacy & Data Security Committee has developed a Mentor/Mentee program for practitioners of all ages and levels of experience who are involved in the fast growing privacy and/or data security law fields or who are interested in learning about what privacy practitioners do. Participants in the Privacy Mentor/Mentee program will be paired up, invited to networking and ice-breaking events, and provided with guidelines about how to get the most out of the mentoring relationship. Related to Smart Grid Technologies and Communications Requirements of Smart Grid Technologies. In a proceeding initiated and conducted under the auspices of the General Counsel’s office, these reports were the culmination of a comprehensive public process that included both a public notice and comment proceeding and public meetings. They set forth a series of findings and recommendations for both industry and government – some of which are already being implemented.

Harris was nominated as General Counsel of the Department of Energy by President Barack Obama in March, and was confirmed by the United States Senate in May 2009. He also serves as Co-Chair of the Broadband Subcommittee of the Administration’s National Science and Technology Council.

Mr. Harris has practiced law in Washington, DC for 34 years both in

the private sector and in government. He has had extensive litigation, telecommunications and technology law, trade law, administrative law, and national security law experience. Prior to joining the Department, Harris was the Managing Partner of Harris, Wiltshire & Grannis LLP, a nationally recognized law firm founded in 1998. He has also been a partner in the law firms of Williams & Connolly LLP and Gibson, Dunn & Crutcher LLP, where he headed the firm’s communications practice. Harris also served in government from 1993 to 1996, first as Chief Counsel for Export Administration in the United States Department of Commerce, and then as the first Chief of the International Bureau at the Federal Communications Commission. Early in his career he served as a law clerk to the Honorable Gerhard A. Gesell on the United States District Court for the District of Columbia.

Harris has also been active in the legal and policy communities, including as a longtime, active member of the FCBA. He has been a member of the Advisory

Board of Virginia Tech’s Center for Wireless Communications, Chairman of the FCC’s Advisory Committee for the 1997 World Radio Conference, Co-Chair of the Council on Foreign Relations Study Group on Information Technology and Foreign Policy, a member of the Executive Committee of the United States ITU Association, a Trustee of the FCBA Foundation, Co-Chair of the FCBA’s International, Online, Legislative Practice, and Annual Seminar Committees, and an Adjunct Professor at Georgetown Law Center.

Harris graduated magna cum laude from both Harvard Law School and Brown University, where he was a member of Phi Beta Kappa. FCBA Foundation Now Accepting Applications for Funding of Unpaid Legal InternshipsFor the 18th consecutive year, the Federal Communications Bar Association (FCBA) Foundation will award stipends to law students from its Chairman Robert E. Lee Scholarship and Internship Fund. In 2011, the Foundation will award several stipends to law students employed as unpaid summer interns in positions with the FCC and other government agencies or entities with a connection to the communications industry. In addition, the Foundation will select one outstanding intern among those chosen to receive an additional stipend for the summer—the “Max Paglin Award.” Mr. Paglin was the former General Counsel and Executive Director of the FCC, and the founder of the Golden Jubilee Commission on Telecommunications, which compiled a definitive legislative history of the Communications Act.

Applicants will be selected on the basis of: (1) a demonstrated interest in the communications field, (2) having secured or having pending, an unpaid summer position (internship) for at least eight weeks in communications with a government agency or entities with a connection to the communications industry, (3) dependence on financial assistance in order to accept the unpaid internship in a government agency or entity involved in communications; and, (4) community activities. To the extent a recipient receives unanticipated funding for the unpaid internship, the FCBA Foundation’s general policy is to reduce its scholarship awards by any amount that a recipient’s total funding (including all sources) for the internship would otherwise exceed $7,000.

McKenna’s Wagon Seeking Volunteers for January 23McKenna’s Wagon is a mobile soup and sandwich wagon that goes “on location” to deliver food to the needy. For those who have volunteered, it has been a wonderful experience and a great way to help the needy in the D.C. community. This is an especially good experience for the teens and pre-teens among us who do not have a full appreciation of the many privileges they enjoy. Community service credits are also available. The Wagon is a white van that is loaded up with sandwiches, snacks and soup. We meet at Martha’s Table at 4:45 pm in comfortable clothes and shoes. Martha’s Table is located in a yellow building at 2114 Fourteenth Street, NW, in the District, near the intersection of 14th and U Streets. On-street parking is available. Upon arrival we get assignments (some of us will distribute snacks and sandwiches, others will serve soup), and put on aprons before we depart in the van to 5th and New York Ave., NW (near the new Convention Center). We are driven by one of our experienced volunteers and the trip to distribution location takes about 10-15 minutes. We serve about 30-75 people per visit including a few mothers who come for food for their families. The area is well patrolled by police. The food distribution

Foundation Newsis conducted in an efficient, calm and orderly fashion and many of the people we serve are quite appreciative of our efforts. Once we serve all of the food, we do a clean up of the immediate area. Total time for the distribution takes about one hour and we usually return to Martha’s Table by or before 6:30 p.m. We would love to have you join us on one of our upcoming food runs which are always on the 4th Sunday of the month. Martha’s Table Seeking Volunteers for January 30Many of us are stretched for time these days, but why not consider spending a few hours on a Sunday to help the FCBA Foundation’s partner charities? For several years now, the FCBA has been providing volunteers to Martha’s Table and McKenna’s Wagon. These organizations rely on the good work of our members each month, so grab a friend, colleague or family member and join your fellow FCBA volunteers!

Martha’s Table feeds hundreds of hungry, homeless adults and children on the streets of Washington daily, through its mobile soup kitchen. Children and friends are also welcome. We will begin at 10:00 am and work until 1:00 p.m. Martha’s Table is located in a yellow building at 2114 Fourteenth Street, NW, in the District, near the intersection of 14th and U Streets. This year’s Symposium opened with a keynote from The Honorable Pamela Jones Harbour, Commissioner of the Federal Trade Commission. Commissioner Harbour provided her perspective on privacy and data security. Three substantive sessions followed. The first covered the government’s role in privacy and data security, including the effectiveness of regulatory enforcement mechanisms and self-regulatory regimes. The second focused on requisite contract clauses, due diligence requirements, and insurance coverage to help reduce liability for relationships with third party service providers, behavioral advertising and social networking websites/services, and e-commerce services. The third session provided an overview of domestic state and federal laws, regulations, and guidelines that govern traditional telemarketing and commercial messages and promotional efforts delivered via wireless devices, including nuances regarding text messages, bounceback messages, and wireless emails.

Nominations for 2011 FCBA ElectionPursuant to Article V, Section 20 of the Association’s Bylaws, the FCBA Nominations Committee is beginning the process of preparing the ballot for the 2011 annual election. Positions to be filled are: President-Elect; Secretary; Assistant Secretary; Assistant Treasurer; Chapter Representative to the Executive Committee; three (3) members of the Executive Committee; three (3) members of the

Nominations Committee; and four (4) FCBA Foundation Trustees.

The first step of this process is for members to notify the Nominations Committee of their interest in being nominated, or to recommend other members for consideration for nomination. Nominations should be sent to FCBA Past President and Chair of the Nominations Committee, Robert L. Pettit, via email to rpettit@

wileyrein.com. Please give the name of the member to be considered for nomination and the office they are being recommended for by January 17, 2011.

The Nominations Committee will present a slate of nominations to the membership via email and the in newsletter. At that point, members will have the option of making additional nominations as outlined in the Bylaws.
