FLSA Changes
• Effective 12/1/16• Updates the salary and compensation levels for executive,
administrative, and professional workers to be exempt.• Sets the weekly salary minimum to $913/week
($47,476/annually) for a full-year worker. Note: Many school district employees do not actually work a full year as defined in the rule.
• Establishes a mechanism for automatically updating the salary and compensation levels every three years.
FLSA ChangesImpacted Positions
• Does NOT include:– Superintendent;– Academic Counselors;– Assistant Principals;– Principals;– Curriculum Specialists;– Instructional Coaches; and– Other professional employees whose primary duty is
“performing academic administrative functions directly related to academic instruction or training in an educational establishment.” Academic administrative functions include operations directly in the field of education and do not include jobs relating to areas outside the educational field.
FLSA Changes Part Time Employees
• Example: district employs a part-time Speech-Language Pathologist for 2 days per week, the employee’s weekly pay would be calculated as follows:

• Review district calendars– calendar starts or ends partway through a week– partial workweek is included somewhere within the
school year (e.g., Thanksgiving week),
• employees may not meet the salary threshold for those particular weeks = NOT exempt for that week = subject to OT and timekeeping requirements for the week

• HQ requirements for teachers will remain in place through the end of the 2015-2016 school year.
• Beginning with the 2016-2017 school year, schools will no longer be required to comply with the highly qualified teacher requirements.– Note that all state certification requirements adopted in State Board for
Educator Certification rule remain in place.
• Provisions under the ESSA will take effect when a new state plan is approved by USDE (prior to the 2017-2018 school year). – Many provisions that are currently outlined in the 2015 Texas State Plan to
Ensure Equitable Access to Excellent Educators will cover the requirements outlined in ESSA.
– 2016-2017 school year to be spent preparing LEAs for the equity plan reporting and transitioning state data collection processes from highly qualified teacher requirements to state in-field data reporting.
Proposed Certification Changes
• Replace the probationary certificate (for 3 years) with an "intern" certificate (reduced to 2 years).
• To be eligible for the intern certificate, a person will have to pass allexams, including PPR and BTLPT.
• If a person has not passed all certification tests, he/she can be hired on an emergency certificate and then move to the intern certificate for years 2 and 3.
• A transition year in 2016-17 will allow programs to prepare, with the new rules going into effect July 1, 2017.
• The paraprofessional certificate will be valid for two years beginning July 1, 2017. Paraprofessional will have to renew certificates every two years at a reduced rate.

Fingerprinting FAQ
1. The bottom half of the non-certified FAST pass is blank. Should it be? Yes, the bottom half of the new non-certified FAST pass has been left blank intentionally. All information that is necessary to schedule a fingerprinting appointment can be found within the top half of the document. This information includes the service code, the applicant name, and the agency applicant number. 2. A potential employee has received a FAST pass and is trying to schedule a fingerprinting appointment on IdentoGo.com, but he is receiving a message that indicates he is ineligible for enrollment. What does this mean? - In some cases, an individual may need to wait up to 48 hours from the time FAST pass is received to schedule a fingerprinting appointment. In most cases, however, an individual will be able to schedule an appointment within 24 hours from the time FAST pass is received. - Additionally, it is important to enter the full SB number, including “SB-”, when making an appointment on the IdentoGO website. Although "SB-" is already shown on the screen, the system will not process the request unless the full SB number is entered. (i.e. "SB-123456") Please contact MorphoTrust/IdentoGO at 888-467-2080 with questions about Service Codes or the IdentoGo registration website.

What is SubHub?
SubHub is the newest service provided by the Region One ESC Office of Personnel Support Services to help schools recruit and retain a qualified pool of certified substitute teachers to fill existing vacancies within schools. This service is an absence management system and a substitute placement system for district.

Decrease hiring and administrative costs (recruiting, screening, criminal history background checks, training, etc. are incurred by the ESC).

Eliminate payroll costs such as unemployment insurance and workman’s compensation.
Manage teacher absences with “real time” reports available to administrators to note who is absent and if a substitute has been found.
