If you would like a copy of the booklet it can be obtained from www.border.gov.au About this visa The New Zealand Citizen Family Relationship (subclass 461) visa allows a person, or persons who do not hold a New Zealand passport but are members of the family unit of a New Zealand citizen who holds, or will hold upon entry to Australia, a Special Category (subclass 444) visa (SCV) to travel to, enter, reside and work in Australia on a temporary basis. This visa: is valid for 5 years; permits unlimited travel to and from Australia; does not require formal sponsorship or nomination; and does not include any work or study restrictions; but may include either or both conditions 8303 and 8501. Condition 8303 states you must not become involved in activities disruptive to, or violence threatening harm to, the Australian community or a group within the Australian community. Condition 8501 states you must maintain adequate arrangements for health insurance while you are in Australia. About this application This form may be used by both primary and secondary applicants who are members of the family unit of a New Zealand citizen SCV holder who wish to apply for temporary residence in Australia. All members of the family unit of the New Zealand citizen SCV holder intending to travel with or join them in Australia, to reside with them should be included in this application. A secondary applicant for this application is a member of the family unit of the primary applicant and may include a child under 18. It may also include a relative who is over the age of 18 and is dependent on the primary applicant. To meet the requirements of this visa, however, the secondary applicant must also be a member of the family unit of the New Zealand citizen SCV holder. Your application for a New Zealand Citizen Family Relationship (subclass 461) visa is not valid if you currently hold a criminal justice entry visa, a domestic worker visa, or if you are a detainee who has not made an application within the prescribed time limits, or if you hold a visa subject to a condition that prevents the grant of a substantive visa while you remain in Australia. Integrity of application The department is committed to maintaining the integrity of the visa and citizenship programmes. In relation to this application, if you or a member of your family unit: provide, or have provided in a previous application, fraudulent documents or false or misleading information (knowingly or not); and/or fail to satisfy, or have failed to satisfy in a previous application, the Minister of your or their identity; this visa application may be refused and you, and any members of your family unit, may become unable to be granted a visa for specified periods of time, as set out in migration legislation. If documents are found to be fraudulent or information to be incorrect after the grant of a visa, the visa may subsequently be cancelled. About this visaThe New Zealand Citizen Family Relationship (subclass 461)visa allows a person, or persons who do not hold a New Zealandpassport but are members of the family unit of a New Zealandcitizen who holds, or will hold upon entry to Australia, a SpecialCategory (subclass 444) visa (SCV) to travel to, enter, reside andwork in Australia on a temporary basis.

This visa:

Method of payment

In Australia

To make a payment, please pay by credit card, bank cheque ormoney order made payable to the Department of Immigrationand Border Protection. Credit card is the preferred method ofpayment.

Outside Australia

Before making a payment outside Australia, please check with theAustralian Government office where you intend to lodge yourapplication as to what methods of payment and currencies theycan accept and to whom the payment should be made payable.

Health insurance requirementsYou may be required, as a condition of this visa, to maintainadequate private medical and hospital health insurance whilein Australia. This insurance cover does not have to be held withan Australian insurer – arrangements made in your homecountry may be assessed as being acceptable. You need toensure your health insurance cover will provide for medicallynecessary treatment for the entire period of your stay.

The above condition may not apply if you are covered byreciprocal health care arrangements with your home country.You will be advised by a case officer if you are required toarrange private health insurance.

How to apply

Step 1 – Complete this application

Please use a black or blue pen, and write neatly in English usingBLOCK LETTERS.

If you need more space to answer questions or wish to provideadditional relevant information, attach a signed and dated sheetgiving the required details.

Any alterations made before you lodge the form must beinitialled and dated.

You will need to supply 2 recent passport-sized photographs ofeach person included in your application.

What happens after you lodge the visa application?

In Australia

If you are in Australia when you lodge your application, thisform also serves as an application for a bridging visa class A, Cor E, depending on which one you may be eligible to apply for.

If you need to travel outside Australia before your applicationis decided, you should contact the processing office regardinga bridging visa that would enable you to return to Australia.

Your bridging visa will usually have the same work conditionsas your existing visa. In and outside Australia

Once a decision has been made on your application, you willbe notified of that decision in writing.

If your application is refused, you will be given reasons for therefusal as well as information about review rights.

Residential addressYou must provide the address of where you intend to live duringthe period that your application is being considered. Failure togive your residential address will result in this application beinginvalid. A post office box address will not be accepted as yourresidential address.

Let the department know if you change your addressIf you change your residential address for more than 14 dayswhile your application is being processed, you must tell thedepartment your new address and how long you will be there.The department will send communication about yourapplication to the latest address for correspondence you haveprovided.

Communication about your application can be sent to anotherperson that you have authorised, but you will be taken to havereceived the communication that the department sends to thatperson. The department must be informed (in writing) of anyaddress change for either you or your authorised person.

Passport informationMost visa applicants will be required to hold a valid passportbefore they can be granted a visa. It is strongly recommendedthat the passport be valid for at least 6 months.

If you change your passport after you have been granted thevisa you must notify the nearest Australian mission or office ofthe department.

If you do not provide us with the details of any new oradditional passports you use to travel to Australia, youmay experience significant delays at the airport and maybe denied permission to board your plane.

When sponsorship is required for your visa subclass, theoutcome of your application may be made known to theperson/organisation who has submitted a sponsorship formregarding your application.

Immigration assistanceA person gives immigration assistance to you if he or she uses,or claims to use, his or her knowledge or experience inmigration procedure to assist you with your visa application,request for ministerial intervention, cancellation reviewapplication, sponsorship or nomination.

In Australia a person may only lawfully give immigration assistanceif he or she is a registered migration agent or is exempt frombeing registered. Only registered migration agents may receivea fee or reward for providing immigration assistance.

If an unregistered person in Australia, who is not exempt fromregistration, gives you immigration assistance they arecommitting a criminal offence and may be prosecuted.

Migration agents in Australia

Migration agents in Australia must be registered with the Officeof the Migration Agents Registration Authority (Office of theMARA) unless they are exempt from registration.

Migration agents outside Australia

Migration agents who operate outside Australia do not have tobe registered. The department may give some overseas agentsan ID number. This number does not mean that they areregistered.

Note: Some Australian registered migration agents operateoverseas.

Migration agent information

A migration agent is someone who can:

• advise you on the visa that may best suit you;

• tell you the documents you need to submit with yourapplication;

• help you fill in the application and submit it; and

• communicate with the department on your behalf.

If you appoint a migration agent, the department will assumethat your migration agent will be your authorised recipient,unless you indicate otherwise.

Your migration agent will be the person with whom thedepartment will discuss your application and from whom it willseek further information when required.

You are not required to use a migration agent. However, if youuse a migration agent, the department encourages you to usea registered migration agent. Registered agents are bound bythe Migration Agents Code of Conduct, which requires them toact professionally in their clients’ lawful best interests.

Exempt persons

The following people do not have to be a registered migrationagent in order to provide immigration assistance, but they mustnot charge a fee for their service:

• a close family member (spouse, de facto partner, child,parent, brother or sister);

• a member of parliament or their staff;

• an official whose duties include providing immigrationassistance (eg. a Legal Aid provider);

• a member of a diplomatic mission, consular post orinternational organisation.

Appointing a migration agent/exempt person

To appoint a migration agent/exempt person you shouldcomplete Part J – Options for receiving writtencommunications.

Your migration agent/exempt person should complete form 956Advice by a migration agent/exempt person of providingimmigration assistance.

Form 956 is available from the department’s websitewww.border.gov.au/allforms/

Options for receiving written communicationsIf you do not appoint a migration agent/exempt person youmay still authorise another person, in writing, to receive writtencommunications on your behalf. This person is called theauthorised recipient.

Authorised recipient information

All written communication about your application will be sent toyour authorised recipient, unless you indicate that you wish tohave health and/or character information sent directly to you.

The department will communicate with the most recentlyappointed authorised recipient as you may only appoint oneauthorised recipient at any time for a particular application.

You will be taken to have received any documents sent to thatperson as if they had been sent to you.

To appoint an authorised recipient you should complete:

• Part J – Options for receiving written communications; and

• form 956A Appointment or withdrawal of an authorisedrecipient.

Consent to communicate electronicallyThe department may use a range of means to communicatewith you. However, electronic means such as fax or email willonly be used if you indicate your agreement to receivingcommunication in this way.
