Local Law 154 Amends the

Administrative Code

Requirementsfor Tenant

Protection Plans (TPPs)

• The DOB released an updated TPP form requiring building owners to specify the means and methods used to safeguard the safety and health of occupants during construction work. Please use this form to notify the Department of Buildings before starting work which requires a Tenant Protection Plan (TPP).

• In order to comply with Building Code 3303.10.2, building owners must notify the Department of Buildings at least 72 hours before starting any work requiring a TTP such as alterations of buildings in which any dwelling unit will be occupied during construction.

• The local law expands existing requirements by mandating that TPPs specify the means and methods used for maintaining essential services (e.g., heat, hot water, gas, electricity, etc.) throughout the construction period. Providing this specific information in the TPP will require strong communication and coordination between building owners, the construction teams and the consulting company providing the TPP. The TPPs must also clearly state the expected duration of any disruption to these services, as well as include the means and methods used to minimize the disruption.

Local Law 154 Amends the

Administrative Code

Requirementsfor Tenant

Protection Plans (TPPs)

Distribution and Notification:• In addition to providing TPPs to building tenants

upon request, owners must either:• Distribute a notice about the TPP to each occupied

dwelling unit, or• Post a notice in the building lobby and on each floor

within 10 feet of the elevator or the main stairwell if the building has no elevator.

TPP notices must include:• A statement that building occupants may request a

hard copy of the TPP from the owner or access the TPP on the DOB website;

• Name and contact information of the Site Safety Manager, Site Safety Coordinator or Construction Superintendent, as applicable; or, in the absence of these roles, the name and contact information of the building owner or the owner’s designee; and

• A statement that work-related complaints may be made to 311

The Adjoining Construction Notification Bill was Signed into Law!

AN ACT to amend the administrative code of the city of New York, New York State Laws of 2018 Chapter 217, in

relation to requiring notice to adjoining owners of construction or demolition work, became a law August

24, 2018, with the approval of the Governor.

This new law requires the New York City Department of Buildings (NYC DOB) to provide written notification to

adjoining property owners when an application for approval of construction is submitted to NYC DOB.

The law will also require NYC DOB to notify owners of adjoining property thirty days prior to a permit issuance for construction, or demolition work. Only emergency

work is exempt from the notification requirements.

There are also additional insurance requirements related to protection of adjoining properties that

appears to affect any new buildings or demolition or enlargement of existing buildings.

*At this time NYC DOB has not issued any rules or procedures related to enforcement of these new code changes

Local Law 196

• Key Areas of Focus:

• Local Law 196 of 2017, when fully phased-in in 2019, will require:

• Workers at certain jobsites receive a minimum of 40 hours of safety training; and

• Supervisors at certain jobsites receive a minimum of 62 hours of safety training

Who Must be Trained?

Workers at jobsites that require a Site Safety Plan must be trained. This includes sites that are required to designate a Construction Superintendent, Site Safety Coordinator or Site Safety Manager.

Supervisors at these jobsites must also be trained. This includes Site Safety Managers, Site Safety Coordinators, Concrete Safety Managers, Construction Superintendents and competent persons.

Timeline for Workers to be Trained?

Training will be phased-in in 3 parts beginning on March 1, 2018, with full training being required by as late as September 1, 2020.

Deadline No. 1 By March 1, 2018, all workers and supervisors have a minimum of 10 hours of training.

Deadline No. 2 By December 1, 2018 or June 1, 2019, if the Department of Buildings (DOB) determines that there is insufficient capacity to provide training, workers must have at least a Limited Site Safety Training (SST) Card, which includes a minimum30 hours of training + 62 hours for supervisors.

Deadline No. 3 By May 1, 2019 or September 1, 2020, if DOB determines that there is insufficient capacity to provide training, workers must have a Site Safety Training (SST) Card, meaning they have been fully trained.

Is Online Training Accepted?

Online training after October 16, 2017, will not be accepted. No parameters have been set for this.

After October 16, 2017, only in-person training and actively proctored online training will be accepted. Actively proctored online training is:

online training, taken in a classroom with a proctor; or online training that at a minimum requires the individual receiving the

training: to attest that they are the individual that received the training and

that the training was received without assistance; and to have their participation monitored at random times to ensure that

the individual receiving the training is present for the entirety of the training

Avoid Violations & Penalties!

• Permit holders must certify workers have required training.

• Fines are $15,000 per untrained worker. $5,000 each for owner, permit holder and employer.

• Permit holders failing to keep log of trained workers face fines of $2,500.

• Department of Buildings (DOB) planning unannounced sites check where untrained workers have been found and will target other jobs of permit holders in violation.
