Meetings were conducted in late 2001 and early 2002 to develop the grant application process. The commission has met nine times since its inception, the most recent being on Decem- ber 1, 2004 and February 2, 2005. The commission dispersed over $445,000 including grants to the following programs: Nevada Chapter AGC The Nevada Chapter AGC con- ducts construction education programs in elementary and middle schools. The organiza- tion also hosts a Construction Career Day including engi- neering career opportunities, demonstrations with heavy equipment, safety, field trips to jobsites, and hands-on build- ing projects for preschool through 6 th grade students. The chapter’s Introduction to Con- struction Technology classes for 9 th through 12 th grade stu- dents will be expanding in the upcoming school year. The Nevada Chapter AGC hosts competitions at University of Nevada Reno. The UNR/ AGC Cooperative Training program continues to help students with construction in- ternship career opportunities. AGC Las Vegas Chapter The AGC Las Vegas Chapter provides classes at a nominal fee for contractors and those interested in contracting. Classes include construction- related teacher in-service training. Construction career information and tool kits are distributed to Clark County School Districts Career and Technical Education Depart- ments among its other educa- tional programs. NSCB Sponsors Contractor Education Classes

quest for new answers, solutions and standards, we mustall be aware of the process at hand and ready to lend avoice when necessary. The issues discussed and thesubsequent decisions will either directly or indirectly affectyou and your business.

Ideas for new legislation come from government,elected officials, businesses, lobbyists, and citizens.That could be you. Many of our current laws wereinitiated by one voice determined to make adifference. Contact your legislator or industryassociation and let your voice be heard.

The Nevada Legislature has an online service thatenables you to track proposed legislation. You canfind it at www.leg.state.nv.us/73rd/Subscriber. Thereyou can create a list of bills of interest to you andreceive email updates.

Let’s continue to work together toward positiveresults for Nevada’s construction industry andtherefore for all citizens of Nevada.

During Fiscal Year 2003-2004, theNSCB Licensing Department imple-mented a Licensing Assistance Pro-gram, aimed at providing applicantsfor a contractors license assistancein understanding the requirements for

licensure and completing theapplication forms. The programalso includes help for licenseesin preparing change applica-tions for existing licenses. In theBusiness Assistance Program, alicense analyst will review anynew or change application toensure compliance with all ap-propriate statutory guidelinesand regulatory requirements.

Eight informational workshopswere conducted in 2004 - 214applicants attended. Content ofthe workshops include an over-view of NRS Chapter 624, a reviewof Nevada Administrative Code(NAC) to assist in determining ap-propriate license classifications;

information concerning examinationsand requisite experience; establishingfinancial fitness and surety bond re-quirements. In addition, applicants areprovided information to assist them inlocating source documents and

compiling documents for the applica-tion process. A checklist of state andlocal requirements for doing businessin Nevada is also provided.

Workshop attendees have found theinformation very helpful. “I’ve been li-censed since 1990 and it ’s been along time since I’ve been a part of thelicensing process. This class reallyhelped me out,” says Larry Greene ofTerra Vision Construction.

The Community College of SouthernNevada will offer a two-year AssociatesDegree in Occupational Safety &Health starting with the fall semester,and students who complete the pro-gram will be certified in several keyareas as part of the curriculum.

“We’ve been working on this programfor some time,” said Jason Rozar, a losscontrol consultant with Risk Services-Nevada who acted as a consultantfor the college. “The college offeredseveral safety-related classes thatnever attracted a student base be-cause there was no degree or certifi-cation tied to them, so we took thoseas a starting point and built the pro-gram from there.”

Industrial hygiene, fire prevention andbuilding codes were some of theclasses that had long been part of theschool’s curriculum, yet attracted few

students. Those offerings have beengiven new life as part of the degreeprogram, according to Rozar, whosaid that in addition to the existingclasses, the college has developedcourses on safety laws and regulations,introduction to hazardous materialsand transportation of hazardous ma-terials. More importantly, students willearn several important certifications asthey fulfill their educational require-ments.

Students will complete the OSHA 10and 40 hour certifications and 40 hourHazwoper as part of the program. The40 hour Hazwoper certification is partof the class load for the two-year de-gree, which requires students to fulfill30 hours of “core” credits such as his-tory and math. Students who don’twish to complete the 30 hours of corecredits can concentrate on occupa-tional safety and health, and earn a

separate safety certification at the endof their training. The OSHA training andHazwoper are part of the certificateprogram.

“Students who want to specialize in justsafety can get a Certificate of Man-agement – Occupational Safety &Health by completing the safety andhealth part of the curriculum,” Rozarsaid. “Someone in the program, evenjust on the certificate side, would stillhave the OSHA 10, 40 and Hazwopercertifications.”

Rozar said the college expects be-tween 20 to 30 students the first year,with an ongoing student population of60 to 100. He said that with moreemployers emphasizing safety andloss control, the availability of the de-gree and safety certificate program isa boon for Southern Nevada.

Can the Contractors Board findyou? Don’t let lost mail result in dis-cipline against your license. Pleasekeep in mind that state law requiresthat you notify the NSCB in writingof any change to your mailing ad-dress. Your “address of record” isthe mailing address that the NSCB

uses to send important noticesto you like renewal forms, noticesof complaints filed, citations, no-tices of hearings, decisions andorders. If you fail to receive mailfrom us, it may cause the sus-pension or even the revocationof your license without yourknowledge.

The NSCB is required to notify li-censed contractors of all cita-tions, hearings and disciplinary

actions that may be taken againsttheir license. These notices are gener-ally sent via certified mail to the lastknown address of record on file withour office. When the letter is mailed,under Nevada law, the NSCB’s obliga-tion is satisfied and the contractor hasbeen legally served.

Be sure to open mail from the NSCBimmediately and read the noticescarefully. Legal notices are timesensitive and usually require a re-ply within a specified number ofdays – the clock starts running whenthe letter was mailed. Do not allowthe letter to go unnoticed or thetime may run out and you may loseyour right to respond.

In spite of recentrecord rainfall,Southern Nevada isentering its sixthconsecutive year ofdrought, the South-ern Nevada WaterAuthority (SNWA)continues to partnerwith contractors andretailers to promotewater conservationand outdoor living.

The SNWA’s WaterSmart Contractorprogram provideswater-smart trainingto licensed land-scape contractors. The eight-hourcourse is divided into two sections. Thefirst section, SNWA Programs, coverslandscape standards that complywith regional laws, codes and conser-vation programs. The second section,Efficient Irrigation, covers proper irriga-tion techniques and scheduling.

SNWA’s outreach efforts now includepool contractors and related issues.“Pools are a way of life for many resi-dents in the desert, so it’s important wemanage them as efficiently as pos-sible,” said Doug Bennett, Conserva-tion Manager of the Southern NevadaWater Authority. “The pool outreach

Academy for Career Education (ACE)ACE is a Sparks charter school dedi-cated to teaching academics throughthe application of construction skills.The school is a result of collaborationbetween the Washoe County SchoolDistrict and the construction industry.Juniors and seniors at ACE learn exca-vation, drywall installation, tiling, roof-ing, plumbing and landscaping in a

hands-on teaching environment.Students at ACE build a housefrom the ground up every year.

The Nevada Commission on Con-struction Education will meet onMay 3, 2005. Grant applications

National Associationof Minority ContractorsThe National Association of MinorityContractors (NAMC) designed anddeveloped a Capacity Building Pro-gram to help contractors and other in-dividuals with employment opportuni-ties. They have trained students onconstruction sites throughout ClarkCounty. Students are evaluated for com-munication skills, adaptability, flexibility,safety, stress tolerance, active lis-tening, ethical behavior, conscien-tiousness, industry knowledge andcompetitiveness. Quality control andquality assurance mechanisms are builtinto courses.

Consider the most critical and irreplace-able equipment you use in your con-tracting business. If it were in need ofrepair, you would likely maintain it asrequired without delay. Neglecting itwould be bad business and a threat toyour livelihood. The same can be saidof your contractor’s license.

Unfortunately, it is not at all uncommonfor some licensed contractors to jeop-ardize or lose their license because theyfail to properly maintain it. Your licenseis essential to the operation of your con-struction business. Without it, you can-not legally contract in Nevada. In short,you are out of business without yourcontractor’s license.

There are a number of things that youmust do to ensure that your licensedoesn’t end up as another statisticalfootnote in the NSCB fiscal year reportas a license “revoked by default or can-celled.” Here are some of them:

❏ If your mailing address changesor is listed incorrectly with theNSCB, notify us immediately.Call us and follow that up with

a letter identifying your correctmailing address.

❏ Ensure that all mail sent to you bythe NSCB is delivered to and readby someone who is authorized toact upon it. Your staff should bethoroughly familiar with what to dowith Contractors Board correspon-dence and understand the impor-tance of getting it to the properperson in a timely manner. Do notrisk having your license disciplinedbecause one of your employeesdid not tell you about a notice orletter received from the NSCB.

❏ Your license bond must remaincurrent and up to date. If it is can-celled or you change suretycompanies, you must providethe appropriate documentationto the Contractors Board. Failureto do so can lead to the imme-diate suspension of your license.

❏ Renew your contractor ’s licensebefore it becomes delinquent. Ifyour license is not renewed by thelast day of your renewal month,your license is automatically sus-

pended and a penalty isadded to your renewal fee.After six months, you must re-apply for your license.

❏ Keep your corporate status cur-rent, neglecting to do so cancause your license to be sus-pended.

❏ If your Qualified employeeleaves your employ, you mustnotify the Board within 10 daysand replace the QE within 30days or the license is subject tosuspension.

The Nevada State Contractors Boardwants to help keep your license currentand in good standing. Use the NSCBwebsite (www.nscb.state.nv.us) to lookup your license or licenses. Make surethe information listed is accurate. If youfind that it is not current or needs cor-rection, contact us right away at (702)486-1100 (Las Vegas Area) or (775) 688-1141 (Reno Area). Proper preventativemaintenance on your contractor ’s li-cense should be done periodically. Itcan save you a lot of headaches in thelong run.

Proper Care and Maintenance of a Contractor’s LicenseKeep Yours in Good Standing

Are you a residential swimming poolcontractor licensed by the Board afterJuly 1, 2001? If so, you are required tohave a Payment and PerformanceBond on every residential swimmingpool or spa you build.

NRS 624.270(8)(a)(b) states that a con-tractor shall, before commencing workfor the repair, restoration, improvementor construction of a residential pool orspa, obtain a performance bond in anamount equal to but not less than 50%of the amount of the contract, condi-tioned upon the faithful performanceof the contract in accordance with theplans, specifications and conditions setforth in the contract.

The performance bond must be solelyfor the protection of the owner of theproperty. The payment bond must besolely for the protection of persons sup-

plying labor or materials to the contrac-tor or any of his subcontractors in car-rying out the provisions of the contract.

The NSCB website provides a formthat contractors or consumers canuse to report unlicensed activity. Theform can be submitted to the Boardanonymously. Though kept entirelyconfidential, this information allowsthe investigator to conduct the nec-essary follow-up and prosecute theunlicensed contractor.

The Nevada State Contractors Board(NSCB) Proactive Enforcement teamvisited the flood-ravaged areas ofMesquite, Overton, Bunkerville andLogandale. Investigators from theBoard went into the communities tomake contact with homeowners whosuffered storm damage to informthem of their rights in contracting forrepairs and the benefits of hiring onlylicensed contractors.

The Enforcement Team visitedcommunity hubs including local post

offices, l ibraries, senior centershardware stores and courthouses aswell as making individual visits toaffected homes. The feedback frommembers of the community has beenpositive.

Investigative Unit Surveys Flood Damaged Areas

NSCB Issues Alert Following Rough Weather Across NevadaAfter the recent rainstorms andflooding in the Clark County area andexcessive snow in Northern Nevada,the Nevada State Contractors Boardissued an alert to homeowners urgingthem to protect themselves againsthome repair scams by unlicensedcontractors.

Ms. Margi A. Grein, the Executive Officerof the NSCB cautioned homeowners totake a little time to ensure thatcontractors are properly licensed before

giving any money or authorizing the repairof rain or flood damage.

Inferior repairs by unqualified contractorsoften cause more problems than theoriginal damage and leave thehomeowner with no viable recourse againstthe unlicensed contractor.

After a natural disaster, homeowners areoften approached by unlicensedcontractors looking for quick profits.These unlicensed contractors do not

have bonds or liability insurance, andtheir workers are not covered byworkman’s compensation benefits.Many times they will ask for cashpayments up front or before completingthe work. Their written contracts are eithernonexistent or vague.

Mobile scaffolds are seen in nearlyevery business in some application oranother and are so common thatemployees and employers often takethem for granted. However, like anyother piece of equipment, they aredangerous if employees are notproperly trained in their safe use. A fewof the OSHA construction requirementsfor mobile scaffolds include:

• Scaffold casters and wheels must belocked with positive wheel and/or wheeland swivel locks, or equivalent means,to prevent movement of the scaffoldwhile the scaffold is used.

• Scaffolds must be plumb, level, andsquared with all braces in place andbrace connections secured.

• When being manually moved, theforce applied must be as close to thebase as practicable, but no more than5 feet above the supporting surface.

• Scaffolds must be stabilized toprevent tipping during use.

• Employees are not permitted to rideon mobile scaffolds unless the followingconditions exist:

1. The surface on which the scaffoldis being moved is within 3 degreesof level, and free of pits, holes, andobstructions;

2. The height to base width ratioduring movement is two to one orless, unless the scaffold is designedand constructed to meet orexceed nationally recognizedstability test requirements;

3. Outrigger frames, when requiredor when used, are installed on bothsides of the scaffold;

4. No employee is on any part ofthe scaffold extending outwardbeyond the wheels, casters, or othersupports.

• Platforms can not extend outwardbeyond the base supports of ascaffold unless outrigger frames orequivalent devices are used toensure stability.

• Caster stems and wheel stems mustbe pinned or otherwise secured inscaffold legs or adjustment screws toprevent displacement.

• Ladders or makeshift devices cannot be used on scaffolds to increasethe working level height ofemployees.

The unlicensed contractor wantedhalf of the money up front anddelivered a pile of wood to thehome. He took eight hundred dollarsand never returned to do any work.The homeowner asked for hermoney back. The floor installerbalked and remarked that she didn’thave a contract and he didn’t havethe money. She kept thinking that hewould come back, but he never did.

“That’s when I remembered that Ihad this card (Unlicensed ContractorPocket Card) in my billfold,” thehomeowner said. Fortunately, sheremembered that she had been toa presentation by the Nevada StateContractors Board and knew whoshe could call to report theunlicensed activity. “We wouldn’thave known if it weren’t for the Boardpresentation at the center. I think allseniors should know about this.” NSCB

Special Investigations Unit opened acase on her behalf. The individualwas cited for contracting without alicense and wil l be processedthrough justice court.

In addition to unlicensed contracting,senior fraud itself is a crime that theNSCB takes very seriously. Crimescommitted against a person 65 orover can add to the severity ofcriminal penalties (NRS 197.167).

NSCB Cracking Down on Senior Scams

Diana Wallace is aLicense Analyst in the Renooffice of the Nevada StateContractors Board. For thepast 12 years, she has en-joyed being able to helpthose that come to theBoard office for license re-newals, license changes,and new applications.

Diana’s goals include providing exceptional cus-tomer service - making the licensing processeasier. Her background in customer service lendsitself well to handling the over two dozen calls aday that come to her desk. She enjoys workingat the Contractors Board because of the diver-sity of the job and being able to see her effortsresult in a positive outcome for contractors.

Diana is a proud mother of three and grand-mother of one.

During a recent sting operation conducted February 28th throughMarch 2nd in Las Vegas, criminal investigators assigned to theBoard’s Special Investigations Unit issued 14 citations for unlicensedcontracting. The violations included NRS 624.700 (engaging inbusiness without a license), and NRS 624.720 (unlawful advertising).

Investigators focused on unlicensed contractors who advertisedtheir services in the classified section of local newspapers,circulated business cards and fliers. Among those cited werepainters, landscapers (including synthetic lawn installers), as wellas those who work with masonry and tile.

Those cited will appear in justice court for hearing within the next60 days. NRS 624 makes contracting without a license aMisdemeanor for the first offense, a Gross Misdemeanor for thesecond offense, and a Class E Felony for the third offense.

Recently, two women from a Nevadasenior community came into the Boardoffices to make a complaint about anunlicensed contractor who had takenmoney and never did the job. Theunlicensed contractor showed up atone of their homes, convinced her thatshe needed a new floor, and offeredher a “deal that was too good to passup” to have her floors redone. “He juststarted measuring,” the womanreported.

the industry. A business may requesta Business Review or the Board mayorder a review as a result of disci-plinary action. A member of our in-vestigative staff wil l review acompany’s business practices andprovide input for improvement. The most common infractions thatinvestigators have discovered in thereviews are:

NSCB Business Review Program

During 2004, the Board has disbursednearly half a million dollars from theResidential Recovery Fund.

The biggest disbursement since thefund’s inception occurred December6, 2004 when an unprecedented$199,999.56 was distributed to 69homeowners who were harmed byCurtis Construction. The license ofCurtis Construction was revoked by theBoard as a result of fraudulent actionby the company.

The Residential Recovery Fund law wasenacted by the 1999 Nevada Legis-lature and provides limited monetarycompensation to single-familyhomeowners harmed by actions of alicensed contractor. All other meansof recovery of damages must havebeen exhausted. The law limits pay-ment for a single claim to $30,000and claims against a single contrac-tor to $200,000.

The Curtis Construction matter was thefirst case in which claims far exceededthe $200,000 limit. Homeowners wereawarded a portion of their lossesbased on established criteria. TheBoard supported Assemblyman Bar-bara Buckley’s bill to increase the ag-gregate per contractor limit allowedfrom $200,000 to $400,000 and in-

creasing the limit amount of individualclaims to $35,000. Assembly Bill 34unanimously passed both houses andis pending signature from the gover-nor making it effective July 1, 2005.

Contractors who perform residentialwork are assessed a fee for the Resi-dential Recovery Fund based on themonetary license limit. The assessmentis levied at the time of initial licensureand upon renewal of the license.

The current fee schedule is as follows:

Contractors are required by law toprovide information regarding theResidential Recovery Fund upon es-tablishment of a residential contract.(See required disclosures below.)

The NSCB Business Review Program(described on page 14) helpscontractors to examine their businesspractices for regulatory compliance.Las Vegas contractor Byrd Underground’sBusiness Review stood out as having noviolations. Byrd Underground is a LasVegas based wet and dry undergroundutility company that has been licensedsince 1986. “It had all the markings ofa well run, well-organized business,”says NSCB Investigator, Bill Adamson.

Buddy Byrd, native Las Vegan andowner of Byrd Underground, attributesmuch of the success of his business

to his wife Tonya. The company wasrun as a husband and wife team upuntil Tonya’s death in 2003. “Tonya ran

a tight ship,” remembers Buddy. “I ranthe work in the field. I did the sales andgot the work done. Her skills set every-thing up right – taxes, insurance, licens-ing, etc. We made a really goodteam.”

Buddy got his first contractor’s licenseat the age of 23. He has a solid goldkey as a reminder of his progress as abusiness owner. The key, a gift fromTonya, is to a 1976 580C Case back-hoe that he bought from his father whohad been in the business since 1969.Buddy remembers going to worksitestime after time until someone gavehim work. Now Byrd Underground hasover 40 backhoes and rents them outwith operators.

Byrd Underground currently has 45 em-ployees, though its numbers havebeen as high as 60. Buddy sees hisemployees and years of experienceas key to his continued success. “Weprovide quality service and installation.We are service-oriented and ready totake care of it right now.”

Buddy looks forward to building up thecompany over the next ten years. ByrdUnderground experienced consider-able growth in 2004. He believes thatNevada construction will also begood for the economy. He says,“There’s nothing like being in the rightplace (Nevada) at the right time.” TheByrd’s have two sons (ages 18 & 20)who dabble in the business and mayone day decide to take it over.

When asked what advice he wouldgive other contractors who maystruggle with the business end of theiroperation, Buddy says, “Stay on topof your paperwork.”
