Naturalisation applications (Form J1)

Checklist for Applicant:

You must ensure that you understand and satisfy the legal requirements to qualify for naturalisation. These are explained in detail in Section 2 of the ‘Guide for Applicants’. You must also fill out the application form correctly. You should read the accompanying ‘Guide for Applicants’, and follow the instructions carefully. Fees cannot be returned for applications that fail.

Please check that you meet the following requirements, and tick the appropriate boxes:

3 Do you intend to continue to live in the UK/Channel Islands/Isle of Man?

7 Are you of good character?

8 Have you lived in the UK/Channel Islands/Isle of Man for a minimum period of 5 years (or 3 years if applying on basis of marriage to a British citizen) before your application?

9 Were you physically present in the UK/Channel Islands/Isle of Man on the day 5 years (or 3 years if applying on basis of marriage to a British citizen), prior to date of application?

10 Have you been in breach of Immigration law during the residential qualifying period?

11 Have you been absent from the UK/ Channel Islands/Isle of Man for more than 450 days in the last 5 years (or 270 days in last 3 years if applying on basis of marriage to a British citizen)?

12 Have you been absent for more than 90 days in the last 12 months?

13 Do you understand and accept that, under the provision of Protocol No 3 of the Treaty of Accession, a British passport issued to an applicant who makes a naturalisation application in Jersey, will be endorsed “The holder is not entitled to benefit from EU provisions relating to employment or establishment”. If you have 5 years residency in the UK, or a UK born parent/grandparent, your British passport will not contain this endorsement (please see form entitled “Channel Islander Status”)

If you have answered ‘No’ to any of the questions 1-9 then you do not qualify for naturalisation. If you have answered ‘Yes’ to any of the questions 10-12 or answered ‘No’ to question 13 then you should seek further clarification from Jersey Customs and Immigration before you submit your application.

You must fill out the application form correctly. You should read the accompanying ‘Guide for Applicants’, and follow the instructions carefully. Fees cannot be refunded for applications that fail.

Applicants are required to submit an application form which satisfies the following requirements:

If you do not meet the above requirements your application will be delayed, and may be rejected.

Applications may fail due to the applicant not meeting the legal requirements required to apply for naturalization, not filling out the application form correctly, or through a lack of documentation.

If we need more documents we will write and ask you for them. We will give you three weeks to respond. If you do not respond in the time we allow you, then we will decide your application on the information that we already have, but there is a risk that your application will not succeed. It is our policy to return valuable documents in person at Maritime House.

Fees cannot be refunded for applications that fail.

Channel Islander Status

Channel Islander Status means that you do not have the automatic right to live or work in Europe. When the UK joined the European Community in 1973, the Islands chose not to become full members. One of the results of this was that persons who naturalise in Jersey are issued with British passports endorsed with the words “The holder is not entitled to benefit from EU provisions relating to employment or establishment”. Therefore, a person who naturalises in Jersey will not have an automatic right to settle and work in EU countries. Such a person will be treated as someone from outside of the EU and will need to apply for relevant permission to reside or work in that EU country. If, however, you have a parent or grandparent born in the United Kingdom, or you have been ordinarily resident in the UK for 5 years, you will not have the Channel Islander Status endorsement in your British passport and you will have the right to live and work in the European Union as a full British citizen without restriction. How can I apply to live or work in a European country? If you naturalise in Jersey, and do not have a parent or grandparent born in the United Kingdom, or have been ordinarily resident in the UK for 5 years, and you wish to live or work in a European country (excluding the UK), you should first get permission from the relevant embassy in the UK. Alternatively, if you have a link with another European Union country, then you may be able to apply for a passport issued by that country. You could then live and work in Europe on that passport. You will need to contact the embassy of that country for advice.
